A BILL
To enact section 5.2265 of the Revised Code to 1
designate August as "Ohio Military Family Month" 2
and to make operating appropriations for the 3
period beginning July 15, 2009, and ending July 4
21, 2009.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5.2265 of the Revised Code be enacted 6
to read as follows:7

       Sec. 5.2265. The month of August is designated as "Ohio 8
Military Family Month."9

       Section 2. Within the limits set forth in this act, the 10
Director of Budget and Management shall establish accounts 11
indicating the source and amount of funds for each appropriation 12
made in this act, and shall determine the form and manner in which 13
appropriation accounts shall be maintained.14

       Section 3. Except as provided in divisions (C) and (D) of 15
this section, there is hereby appropriated for the period July 16
15, 2009, through July 21, 2009, to each agency, board, 17
commission, department, office, authority, or other organization 18
for which an appropriation was made by the 127th General 19
Assembly, out of money in the state treasury to the credit of 20
the respective funds of the state from which appropriations 21
were made for the 2009 fiscal year, for each specific item for 22
which an appropriation was made by the 127th General Assembly, 23
taking into account Controlling Board actions and executive 24
budget reductions, an amount equal to the following:25

       (A) For General Revenue Fund appropriation items, seventy per 26
cent of one fifty-second of each item's adjusted spending levels 27
for the 2009 fiscal year as adjusted by all budget directives 28
issued by the Office of Budget and Management pursuant to 29
Executive Order 2008-01S. 30

       (B) For federal special revenue, state special revenue, or 31
proprietary appropriation items, one hundred per cent of 32
one-fifty-second of each item's adjusted spending levels for the 33
2009 fiscal year as adjusted by all budget directives issued by 34
the Office of Budget and Management pursuant to Executive Order 35
2008-01S. 36

       (C) It is expressly provided as follows:37

       (1) There is hereby appropriated from the money in the state 38
treasury an amount equal to one hundred per cent of spending 39
levels equal to the second foundation payment made in June of 2009 40
for appropriation item 200550, Foundation Funding. Foundation 41
funding shall be based on the formula used to calculate the 42
second foundation payment made in June of 2009.43

       (2) There is hereby appropriated from the money in the state 44
treasury an amount equal to one-twelfth of spending levels for the 45
2009 fiscal year for appropriation item 235501, State Share of 46
Instruction. State share of instruction subsidy payments shall be 47
based on the formula in existence on June 30, 2009.48

       (3) There is hereby appropriated to those agencies mentioned 49
in Section 4 of this act those moneys received from the federal 50
government pursuant to the American Recovery and Reinvestment Act. 51

       (4) There is hereby appropriated those amounts necessary for 52
expenses incurred in appropriation item 600525 for Medicaid. Rates 53
reimbursed for providers for the period from July 15, 2009, 54
through July 21, 2009, shall be the same as rates on June 30, 55
2009.56

       (5) No money is appropriated for programs or agencies that 57
were terminated by action of law, other than the expiration of an 58
appropriation item, prior to June 30, 2009.59

       (6) No money shall be spent by any state agency for any 60
program that is new or to the extent it has been expanded other 61
than by operation of law.62

       (7) No money is appropriated for any purpose for which 63
appropriations are made elsewhere in this act.64

       (8) No money is appropriated for capital purposes other than 65
by reappropriation of unexpended balances of existing 66
appropriations.67

       (9) No money is appropriated for purposes that have full 68
fiscal year 2010 appropriations by another act of the General 69
Assembly.70

       (D) There is hereby appropriated for the period July 15, 71
2009, through July 21, 2009, to the legislative and judicial 72
branches and their respective agencies seventy per cent of one 73
fifty-second of those agencies' adjusted spending levels for 74
the 2009 fiscal year as adjusted by all budget directives 75
issued by the Office of Budget and Management pursuant to the 76
Executive Order 2008-01S.77

       (E) Where additional amounts are necessary to pay the wages, 78
benefits, and other payroll-related expenses of state employees 79
who are paid directly by warrant of the Director of Budget and 80
Management, including elected state officials, those additional 81
amounts are hereby appropriated.82

       The Director of Budget and Management shall make any 83
determinations necessary to decide which provision applies from 84
this section. All appropriations contained in this act shall be 85
cumulative with any subsequent appropriation act of the 128th 86
General Assembly, and the Director of Budget and Management shall 87
account for expenditures from appropriations contained in this act 88
accordingly.89

       Section 4.  FEDERAL STABILIZATION APPROPRIATIONS90

       There is hereby appropriated in anticipation of receiving 91
federal stabilization funds from the American Recovery and 92
Reinvestment Act, Title XIV for the following items: 93

       (A) Board of Regents appropriation item 235644, State Share 94
of Instruction - Federal Stimulus – Education, $5,959,116; 95

       (B) Department of Education appropriation item 200551 96
Foundation Funding - Federal Stimulus, $7,453,537; and 97

       (C) Department of Rehabilitation and Corrections 98
appropriation item 501620 Institutional Operations-Federal 99
Stimulus, $638,881.100

       Section 5. Any general financial provision of H.B. 16 of the 101
128th General Assembly that applies to appropriations and 102
expenditures under that act applies also to appropriations and 103
expenditures under this act.104

       Section 6. The sections of law contained in this act are 105
exempt from the referendum under Ohio Constitution, Article II, 106
Section 1d and section 1.471 of the Revised Code, and therefore 107
take effect immediately when this act becomes law.108
