To enact section 4141.49 of the Revised Code to | 1 |
prohibit an employer from retaliating against the | 2 |
employer's employees for testifying or otherwise | 3 |
participating in an unemployment compensation | 4 |
proceeding or hearing. | 5 |
Section 1. That section 4141.49 of the Revised Code be | 6 |
enacted to read as follows: | 7 |
Sec. 4141.49. (A) No employer shall discharge without just | 8 |
cause, refuse to hire, or otherwise discriminate against any | 9 |
employee of the employer with respect to hire, tenure, terms, | 10 |
conditions, or privileges of employment, or any matter directly or | 11 |
indirectly related to employment, because that employee testifies | 12 |
or otherwise participates in a proceeding or hearing conducted | 13 |
under this chapter. | 14 |
(B) An employee who believes that the employee has suffered | 15 |
an injury as a result of the employee's employer violation of | 16 |
division (A) of this section may bring a civil action against the | 17 |
employee's employer in the court of common pleas of the county | 18 |
where the alleged violation occurred. If the court determines that | 19 |
an employer has violated that division, the court may order any | 20 |
relief that the court determines is appropriate. | 21 |
