A BILL
To require the Department of Health to establish a 1
pilot program to test the effectiveness of the 2
"OS1" comprehensive cleaning system in public 3
schools.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  (A) The Department of Health shall establish a 5
pilot program to test in selected public schools the effectiveness 6
of the scientifically validated, comprehensive cleaning system 7
known as Operating System 1 (OS1), as developed and marketed by 8
ManageMen, Inc., and to compare the results of using that system 9
with the results of using the cleaning methods otherwise 10
employed by the selected schools. Under the pilot program, the 11
Department of Health, in accordance with division (B) of this 12
section, shall select at least three school districts and a 13
facility within each of those districts to test the use of OS1 14
for one school year. No school district shall be required to 15
participate in the pilot program. However, each selected school 16
district that agrees to participate in the pilot program shall 17
implement OS1 as specified by ManageMen, Inc., at the selected 18
facility for the school year that begins on the first day of 19
July that is at least three months after the effective date of 20
this section. The project as implemented at each facility shall 21
be under the oversight of a committee prescribed by division (D) 22
of this section, which also shall evaluate the results of using 23
OS1 at that facility and report its findings as required by 24
division (E) of this section. 25

       (B) The Department of Health shall invite school districts to 26
participate in the pilot program and shall select at least three 27
districts and one facility within each district to test OS1. Of 28
the districts selected, at least one shall be an urban district, 29
at least one shall be a suburban district, and at least one shall 30
be a rural district. In selecting the districts, the Department 31
shall examine pertinent data and select districts that have a 32
reported underperformance in regard to sanitary conditions, as 33
reported under sanitary and health and safety inspections 34
conducted under sections 3701.93 to 3701.936, 3707.03, and 3707.26 35
of the Revised Code, and in hazard communication compliance and 36
that have a reported high incidence of workers' compensation 37
claims by janitorial staff, as reported in the data of the Bureau 38
of Workers' Compensation. The Bureau shall cooperate with the 39
Department of Health in selecting districts for the pilot program 40
by providing the Department with data necessary to make the 41
appropriate selection. 42

       (C) The pilot program at each selected facility shall use 43
existing employees and staff of the facility and shall include all 44
of the following:45

       (1) A systematic process that cleans the entire environment 46
of the facility in a comprehensive, effective, and consistent 47
manner and that incorporates continuous improvement as a part of 48
the process;49

       (2) A coordinated team of which each member successfully 50
achieves a special cleaning objective in a consistent manner and 51
that incorporates effective communication between team members, 52
supervisors, and administrators of the facility;53

       (3) The training of housekeepers and managers in a 54
coordinated and comprehensive manner for the implementation of a 55
specific and effective cleaning system;56

       (4) An emphasis on safety as an integral part of the 57
training, the cleaning processes, and all other aspects of the 58
cleaning system, including the incorporation and provision of 59
safety documentation that is easy to read and understand and the 60
use of documentation, equipment, and supplies that are color-coded 61
for easy identification and access;62

       (5) A system that provides cleaning technology that has been 63
tested, evaluated, and employed for safety and cleaning 64
effectiveness and that incorporates simplicity as a main component 65
and that requires the cleaning process and housekeeping team to 66
operate from a central location;67

       (6) A process that uses only three daily-use chemicals, a 68
general purpose disinfectant, a neutral floor cleaner, and a 69
detergent, to reduce exposure to unnecessary chemicals and the 70
amount of accidental spills of chemicals;71

       (7) A primary purpose that maintains and sustains an 72
environment that is healthy for occupants through the use of 73
green-certified cleaning products and that promotes, supports, and 74
enhances the purposes of the building and the activities carried 75
out in the building;76

       (8) A building profile that is based on a detailed assessment 77
and evaluation of the cleaning needs of the facility and, based on 78
the assessment and evaluation, assigns the cleaning tasks into 79
tasks that are performed daily, tasks that are performed on a 80
specific day of the week, and tasks that are performed on one day 81
of the week while ensuring that the assignment of tasks is 82
flexible in order to respond to variability of needs and other 83
conditions such as absenteeism, accommodation of housekeeper 84
special needs, and incorporation of additional team members;85

       (9) Quality control measures that begin with compliance 86
auditing and focused training and that periodically use 87
benchmarking and compliance auditing to verify that the management 88
process is properly followed and implemented;89

       (10) Security measures that are built into the system such as 90
doors and entrances marked with colored dots that indicate the 91
associated security level;92

       (11) A recognition that the primary purpose and importance of 93
effective cleaning are the protection of health by breaking the 94
transmission chain of infectious agents, preventing illnesses, and 95
creating a more sanitary environment and that effective cleaning 96
promotes an aesthetically pleasing environment that increases 97
human productivity and maintains the value of property.98

       (D) The implementation of the pilot program at each selected 99
facility shall be under the oversight of a committee consisting of 100
the following:101

       (1) A staff person of the Department of Health, selected by 102
the Director of Health;103

       (2) A staff person of the Division of Safety and Hygiene in 104
the Bureau of Workers' Compensation, selected by the Administrator 105
of Workers' Compensation;106

       (3) A staff person of the board of health with jurisdiction 107
over the school district that controls the facility, selected by 108
the board of health;109

       (4) The superintendent of the school district that controls 110
the facility;111

       (5) The facility manager of the school district that controls 112
the facility;113

       (6) A representative of ManageMen, Inc., selected by the 114
company.115

       The chair of the committee shall be selected by and from 116
among the members of the committee. 117

       (E) Each committee shall assist in and oversee the 118
implementation of OS1 at the facility. The committee also shall 119
determine a baseline for evaluating the implementation of OS1 at 120
the facility and shall conduct an evaluation near the end of the 121
school year for which OS1 is implemented using that baseline. 122

       The committee shall meet quarterly to review the progress of 123
the implementation of and compliance with the OS1 standards. 124

       At the end of that school year, the committee shall submit a 125
written report of its evaluation and findings to the Governor, the 126
General Assembly in accordance with section 101.68 of the Revised 127
Code, and the Director of Health who shall post the report on the 128
Department of Health's web site.129

       (F) In implementing the pilot program, each selected facility 130
shall comply with the requirements of the school health and safety 131
network, codified in sections 3701.93 to 3701.936 of the Revised 132
Code, and the rules adopted by the Director of Health for the 133
network. 134
