A BILL
To amend sections 4501.06, 4503.04, 4503.042, 1
4503.07, 4506.08, and 4507.23 of the Revised Code 2
to eliminate the late fee of twenty dollars for 3
motor vehicle registrations, commercial driver's 4
licenses, driver's licenses, and motorcycle 5
endorsements established by the biennial 6
transportation appropriations act of the 128th 7
General Assembly for deposit primarily into the 8
State Highway Safety Fund.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4501.06, 4503.04, 4503.042, 4503.07, 10
4506.08, and 4507.23 of the Revised Code be amended to read as 11
follows:12

       Sec. 4501.06.  The taxes, fees, and fines levied, charged, or 13
referred to in division (O) of section 4503.04, division (E) of 14
section 4503.042, division (B) of section 4503.07, division (C)(1) 15
of section 4503.10, division (D) of section 4503.182, division (A) 16
of section 4503.19, division (D)(2) of section 4507.24, division 17
(A) of section 4508.06, and sections 4503.40, 4503.42, 4505.11, 18
4505.111, 4506.08, 4506.09, 4507.23, 4508.05, 4923.12, and 5502.12 19
of the Revised Code, and the taxes charged in section 4503.65 that 20
are distributed in accordance with division (A)(2) of section 21
4501.044 of the Revised Code unless otherwise designated by law, 22
shall be deposited in the state treasury to the credit of the 23
state highway safety fund, which is hereby created, and shall, 24
after receipt of certifications from the commissioners of the 25
sinking fund certifying, as required by sections 5528.15 and 26
5528.35 of the Revised Code, that there are sufficient moneys to 27
the credit of the highway improvement bond retirement fund created 28
by section 5528.12 of the Revised Code to meet in full all 29
payments of interest, principal, and charges for the retirement of 30
bonds and other obligations issued pursuant to Section 2g of 31
Article VIII, Ohio Constitution, and sections 5528.10 and 5528.11 32
of the Revised Code due and payable during the current calendar 33
year, and that there are sufficient moneys to the credit of the 34
highway obligations bond retirement fund created by section 35
5528.32 of the Revised Code to meet in full all payments of 36
interest, principal, and charges for the retirement of highway 37
obligations issued pursuant to Section 2i of Article VIII, Ohio 38
Constitution, and sections 5528.30 and 5528.31 of the Revised Code 39
due and payable during the current calendar year, be used for the 40
purpose of enforcing and paying the expenses of administering the 41
law relative to the registration and operation of motor vehicles 42
on the public roads or highways. Amounts credited to the fund may 43
also be used to pay the expenses of administering and enforcing 44
the laws under which such fees were collected. All investment 45
earnings of the state highway safety fund shall be credited to the 46
fund.47

       Sec. 4503.04.  Except as provided in sections 4503.042 and 48
4503.65 of the Revised Code for the registration of commercial 49
cars, trailers, semitrailers, and certain buses, the rates of the 50
taxes imposed by section 4503.02 of the Revised Code shall be as 51
follows:52

       (A) For motor vehicles having three wheels or less, the 53
license tax is:54

       (1) For each motorized bicycle, ten dollars;55

       (2) For each motorcycle, fourteen dollars.56

       (B) For each passenger car, twenty dollars;57

       (C) For each manufactured home, each mobile home, and each 58
travel trailer, ten dollars;59

       (D) For each noncommercial motor vehicle designed by the 60
manufacturer to carry a load of no more than three-quarters of one 61
ton and for each motor home, thirty-five dollars; for each 62
noncommercial motor vehicle designed by the manufacturer to carry 63
a load of more than three-quarters of one ton, but not more than 64
one ton, seventy dollars;65

       (E) For each noncommercial trailer, the license tax is:66

       (1) Eighty-five cents for each one hundred pounds or part 67
thereof for the first two thousand pounds or part thereof of 68
weight of vehicle fully equipped;69

       (2) One dollar and forty cents for each one hundred pounds or 70
part thereof in excess of two thousand pounds up to and including 71
three thousand pounds.72

       (F) Notwithstanding its weight, twelve dollars for any:73

       (1) Vehicle equipped, owned, and used by a charitable or 74
nonprofit corporation exclusively for the purpose of administering 75
chest x-rays or receiving blood donations;76

       (2) Van used principally for the transportation of 77
handicapped persons that has been modified by being equipped with 78
adaptive equipment to facilitate the movement of such persons into 79
and out of the van;80

       (3) Bus used principally for the transportation of 81
handicapped persons or persons sixty-five years of age or older;.82

       (G) Notwithstanding its weight, twenty dollars for any bus 83
used principally for the transportation of persons in a 84
ridesharing arrangement.85

       (H) For each transit bus having motor power the license tax 86
is twelve dollars.87

       "Transit bus" means either a motor vehicle having a seating 88
capacity of more than seven persons which is operated and used by 89
any person in the rendition of a public mass transportation 90
service primarily in a municipal corporation or municipal 91
corporations and provided at least seventy-five per cent of the 92
annual mileage of such service and use is within such municipal 93
corporation or municipal corporations or a motor vehicle having a 94
seating capacity of more than seven persons which is operated 95
solely for the transportation of persons associated with a 96
charitable or nonprofit corporation, but does not mean any motor 97
vehicle having a seating capacity of more than seven persons when 98
such vehicle is used in a ridesharing capacity or any bus 99
described by division (F)(3) of this section.100

       The application for registration of such transit bus shall be 101
accompanied by an affidavit prescribed by the registrar of motor 102
vehicles and signed by the person or an agent of the firm or 103
corporation operating such bus stating that the bus has a seating 104
capacity of more than seven persons, and that it is either to be 105
operated and used in the rendition of a public mass transportation 106
service and that at least seventy-five per cent of the annual 107
mileage of such operation and use shall be within one or more 108
municipal corporations or that it is to be operated solely for the 109
transportation of persons associated with a charitable or 110
nonprofit corporation.111

       The form of the license plate, and the manner of its 112
attachment to the vehicle, shall be prescribed by the registrar of 113
motor vehicles.114

       (I) The minimum tax for any vehicle having motor power other 115
than a farm truck, a motorized bicycle, or motorcycle is ten 116
dollars and eighty cents, and for each noncommercial trailer, five 117
dollars.118

       (J)(1) Except as otherwise provided in division (J) of this 119
section, for each farm truck, except a noncommercial motor 120
vehicle, that is owned, controlled, or operated by one or more 121
farmers exclusively in farm use as defined in this section, and 122
not for commercial purposes, and provided that at least 123
seventy-five per cent of such farm use is by or for the one or 124
more owners, controllers, or operators of the farm in the 125
operation of which a farm truck is used, the license tax is five 126
dollars plus:127

       (a) Fifty cents per one hundred pounds or part thereof for 128
the first three thousand pounds;129

       (b) Seventy cents per one hundred pounds or part thereof in 130
excess of three thousand pounds up to and including four thousand 131
pounds;132

       (c) Ninety cents per one hundred pounds or part thereof in 133
excess of four thousand pounds up to and including six thousand 134
pounds;135

       (d) Two dollars for each one hundred pounds or part thereof 136
in excess of six thousand pounds up to and including ten thousand 137
pounds;138

       (e) Two dollars and twenty-five cents for each one hundred 139
pounds or part thereof in excess of ten thousand pounds;140

       (f) The minimum license tax for any farm truck shall be 141
twelve dollars.142

       (2) The owner of a farm truck may register the truck for a 143
period of one-half year by paying one-half the registration tax 144
imposed on the truck under this chapter and one-half the amount of 145
any tax imposed on the truck under Chapter 4504. of the Revised 146
Code.147

       (3) A farm bus may be registered for a period of ninety days 148
from the date of issue of the license plates for the bus, for a 149
fee of ten dollars, provided such license plates shall not be 150
issued for more than any two ninety-day periods in any calendar 151
year. Such use does not include the operation of trucks by 152
commercial processors of agricultural products.153

       (4) License plates for farm trucks and for farm buses shall 154
have some distinguishing marks, letters, colors, or other 155
characteristics to be determined by the director of public safety.156

       (5) Every person registering a farm truck or bus under this 157
section shall furnish an affidavit certifying that the truck or 158
bus licensed to that person is to be so used as to meet the 159
requirements necessary for the farm truck or farm bus 160
classification.161

       Any farmer may use a truck owned by the farmer for commercial 162
purposes by paying the difference between the commercial truck 163
registration fee and the farm truck registration fee for the 164
remaining part of the registration period for which the truck is 165
registered. Such remainder shall be calculated from the beginning 166
of the semiannual period in which application for such commercial 167
license is made.168

       Taxes at the rates provided in this section are in lieu of 169
all taxes on or with respect to the ownership of such motor 170
vehicles, except as provided in section 4503.042 and section 171
4503.06 of the Revised Code.172

       (K) Other than trucks registered under the international 173
registration plan in another jurisdiction and for which this state 174
has received an apportioned registration fee, the license tax for 175
each truck which is owned, controlled, or operated by a 176
nonresident, and licensed in another state, and which is used 177
exclusively for the transportation of nonprocessed agricultural 178
products intrastate, from the place of production to the place of 179
processing, is twenty-four dollars.180

       "Truck," as used in this division, means any pickup truck, 181
straight truck, semitrailer, or trailer other than a travel 182
trailer. Nonprocessed agricultural products, as used in this 183
division, does not include livestock or grain.184

       A license issued under this division shall be issued for a 185
period of one hundred thirty days in the same manner in which all 186
other licenses are issued under this section, provided that no 187
truck shall be so licensed for more than one 188
one-hundred-thirty-day period during any calendar year.189

       The license issued pursuant to this division shall consist of 190
a windshield decal to be designed by the director of public 191
safety.192

       Every person registering a truck under this division shall 193
furnish an affidavit certifying that the truck licensed to the 194
person is to be used exclusively for the purposes specified in 195
this division.196

       (L) Every person registering a motor vehicle as a 197
noncommercial motor vehicle as defined in section 4501.01 of the 198
Revised Code, or registering a trailer as a noncommercial trailer 199
as defined in that section, shall furnish an affidavit certifying 200
that the motor vehicle or trailer so licensed to the person is to 201
be so used as to meet the requirements necessary for the 202
noncommercial vehicle classification.203

       (M) Every person registering a van or bus as provided in 204
divisions (F)(2) and (3) of this section shall furnish a notarized 205
statement certifying that the van or bus licensed to the person is 206
to be used for the purposes specified in those divisions. The form 207
of the license plate issued for such motor vehicles shall be 208
prescribed by the registrar.209

       (N) Every person registering as a passenger car a motor 210
vehicle designed and used for carrying more than nine but not more 211
than fifteen passengers, and every person registering a bus as 212
provided in division (G) of this section, shall furnish an 213
affidavit certifying that the vehicle so licensed to the person is 214
to be used in a ridesharing arrangement and that the person will 215
have in effect whenever the vehicle is used in a ridesharing 216
arrangement a policy of liability insurance with respect to the 217
motor vehicle in amounts and coverages no less than those required 218
by section 4509.79 of the Revised Code. The form of the license 219
plate issued for such a motor vehicle shall be prescribed by the 220
registrar.221

       (O) Commencing on October 1, 2009, if an application for 222
registration renewal is not applied for prior to the expiration 223
date of the registration or within seven days after that date, the 224
registrar or deputy registrar shall collect a fee of twenty 225
dollars for the issuance of the vehicle registration, but may 226
waive the fee for good cause shown if the application is 227
accompanied by supporting evidence as the registrar may require. 228
The fee shall be in addition to all other fees established by this 229
section. A deputy registrar shall retain fifty cents of the fee 230
and shall transmit the remaining amount to the registrar at the 231
time and in the manner provided by section 4503.10 of the Revised 232
Code. The registrar shall deposit all moneys received under this 233
division into the state highway safety fund established in section 234
4501.06 of the Revised Code.235

       (P) As used in this section:236

       (1) "Van" means any motor vehicle having a single rear axle 237
and an enclosed body without a second seat.238

       (2) "Handicapped person" means any person who has lost the 239
use of one or both legs, or one or both arms, or is blind, deaf, 240
or so severely disabled as to be unable to move about without the 241
aid of crutches or a wheelchair.242

       (3) "Farm truck" means a truck used in the transportation 243
from the farm of products of the farm, including livestock and its 244
products, poultry and its products, floricultural and 245
horticultural products, and in the transportation to the farm of 246
supplies for the farm, including tile, fence, and every other 247
thing or commodity used in agricultural, floricultural, 248
horticultural, livestock, and poultry production and livestock, 249
poultry, and other animals and things used for breeding, feeding, 250
or other purposes connected with the operation of the farm.251

       (4) "Farm bus" means a bus used only for the transportation 252
of agricultural employees and used only in the transportation of 253
such employees as are necessary in the operation of the farm.254

       (5) "Farm supplies" includes fuel used exclusively in the 255
operation of a farm, including one or more homes located on and 256
used in the operation of one or more farms, and furniture and 257
other things used in and around such homes.258

       Sec. 4503.042.  The registrar of motor vehicles shall adopt 259
rules establishing the date, subsequent to this state's entry into 260
membership in the international registration plan, when the rates 261
established by this section become operative.262

       (A) The rates of the taxes imposed by section 4503.02 of the 263
Revised Code are as follows for commercial cars having a gross 264
vehicle weight or combined gross vehicle weight of:265

       (1) Not more than two thousand pounds, forty-five dollars;266

       (2) More than two thousand but not more than six thousand 267
pounds, seventy dollars;268

       (3) More than six thousand but not more than ten thousand 269
pounds, eighty-five dollars;270

       (4) More than ten thousand but not more than fourteen 271
thousand pounds, one hundred five dollars;272

       (5) More than fourteen thousand but not more than eighteen 273
thousand pounds, one hundred twenty-five dollars;274

       (6) More than eighteen thousand but not more than twenty-two 275
thousand pounds, one hundred fifty dollars;276

       (7) More than twenty-two thousand but not more than 277
twenty-six thousand pounds, one hundred seventy-five dollars;278

       (8) More than twenty-six thousand but not more than thirty 279
thousand pounds, three hundred fifty-five dollars;280

       (9) More than thirty thousand but not more than thirty-four 281
thousand pounds, four hundred twenty dollars;282

       (10) More than thirty-four thousand but not more than 283
thirty-eight thousand pounds, four hundred eighty dollars;284

       (11) More than thirty-eight thousand but not more than 285
forty-two thousand pounds, five hundred forty dollars;286

       (12) More than forty-two thousand but not more than forty-six 287
thousand pounds, six hundred dollars;288

       (13) More than forty-six thousand but not more than fifty 289
thousand pounds, six hundred sixty dollars;290

       (14) More than fifty thousand but not more than fifty-four 291
thousand pounds, seven hundred twenty-five dollars;292

       (15) More than fifty-four thousand but not more than 293
fifty-eight thousand pounds, seven hundred eighty-five dollars;294

       (16) More than fifty-eight thousand but not more than 295
sixty-two thousand pounds, eight hundred fifty-five dollars;296

       (17) More than sixty-two thousand but not more than sixty-six 297
thousand pounds, nine hundred twenty-five dollars;298

       (18) More than sixty-six thousand but not more than seventy 299
thousand pounds, nine hundred ninety-five dollars;300

       (19) More than seventy thousand but not more than 301
seventy-four thousand pounds, one thousand eighty dollars;302

       (20) More than seventy-four thousand but not more than 303
seventy-eight thousand pounds, one thousand two hundred dollars;304

       (21) More than seventy-eight thousand pounds, one thousand 305
three hundred forty dollars.306

       (B) The rates of the taxes imposed by section 4503.02 of the 307
Revised Code are as follows for buses having a gross vehicle 308
weight or combined gross vehicle weight of:309

       (1) Not more than two thousand pounds, ten dollars;310

       (2) More than two thousand but not more than six thousand 311
pounds, forty dollars;312

       (3) More than six thousand but not more than ten thousand 313
pounds, one hundred dollars;314

       (4) More than ten thousand but not more than fourteen 315
thousand pounds, one hundred eighty dollars;316

       (5) More than fourteen thousand but not more than eighteen 317
thousand pounds, two hundred sixty dollars;318

       (6) More than eighteen thousand but not more than twenty-two 319
thousand pounds, three hundred forty dollars;320

       (7) More than twenty-two thousand but not more than 321
twenty-six thousand pounds, four hundred twenty dollars;322

       (8) More than twenty-six thousand but not more than thirty 323
thousand pounds, five hundred dollars;324

       (9) More than thirty thousand but not more than thirty-four 325
thousand pounds, five hundred eighty dollars;326

       (10) More than thirty-four thousand but not more than 327
thirty-eight thousand pounds, six hundred sixty dollars;328

       (11) More than thirty-eight thousand but not more than 329
forty-two thousand pounds, seven hundred forty dollars;330

       (12) More than forty-two thousand but not more than forty-six 331
thousand pounds, eight hundred twenty dollars;332

       (13) More than forty-six thousand but not more than fifty 333
thousand pounds, nine hundred forty dollars;334

       (14) More than fifty thousand but not more than fifty-four 335
thousand pounds, one thousand dollars;336

       (15) More than fifty-four thousand but not more than 337
fifty-eight thousand pounds, one thousand ninety dollars;338

       (16) More than fifty-eight thousand but not more than 339
sixty-two thousand pounds, one thousand one hundred eighty 340
dollars;341

       (17) More than sixty-two thousand but not more than sixty-six 342
thousand pounds, one thousand two hundred seventy dollars;343

       (18) More than sixty-six thousand but not more than seventy 344
thousand pounds, one thousand three hundred sixty dollars;345

       (19) More than seventy thousand but not more than 346
seventy-four thousand pounds, one thousand four hundred fifty 347
dollars;348

       (20) More than seventy-four thousand but not more than 349
seventy-eight thousand pounds, one thousand five hundred forty 350
dollars;351

       (21) More than seventy-eight thousand pounds, one thousand 352
six hundred thirty dollars.353

       (C) In addition to the license taxes imposed at the rates 354
specified in divisions (A) and (B) of this section, an 355
administrative fee of three dollars and fifty cents, plus an 356
appropriate amount to cover the cost of postage, shall be 357
collected by the registrar for each international registration 358
plan license processed by the registrar. 359

       (D) The rate of the tax for each trailer and semitrailer is 360
twenty-five dollars.361

       (E) Commencing on October 1, 2009, if an application for 362
registration renewal is not applied for prior to the expiration 363
date of the registration or within seven days after that date, the 364
registrar or deputy registrar shall collect a fee of twenty 365
dollars for the issuance of the vehicle registration, but may 366
waive the fee for good cause shown if the application is 367
accompanied by supporting evidence as the registrar may require. 368
The fee shall be in addition to all other fees established by this 369
section. A deputy registrar shall retain fifty cents of the fee 370
and shall transmit the remaining amount to the registrar at the 371
time and in the manner provided by section 4503.10 of the Revised 372
Code. The registrar shall deposit all moneys received under this 373
division into the state highway safety fund established in section 374
4501.06 of the Revised Code.375

       (F) The rates established by this section shall not apply to 376
any of the following:377

       (1) Vehicles equipped, owned, and used by a charitable or 378
nonprofit corporation exclusively for the purpose of administering 379
chest x-rays or receiving blood donations;380

       (2) Vans used principally for the transportation of 381
handicapped persons that have been modified by being equipped with 382
adaptive equipment to facilitate the movement of such persons into 383
and out of the vans;384

       (3) Buses used principally for the transportation of 385
handicapped persons or persons sixty-five years of age or older;386

       (4) Buses used principally for the transportation of persons 387
in a ridesharing arrangement;388

       (5) Transit buses having motor power;389

       (6) Noncommercial trailers, mobile homes, or manufactured 390
homes.391

       Sec. 4503.07.  (A) In lieu of the schedule of rates for 392
commercial cars fixed in section 4503.04 of the Revised Code, the 393
fee shall be ten dollars for each church bus used exclusively to 394
transport members of a church congregation to and from church 395
services or church functions or to transport children and their 396
authorized supervisors to and from any camping function sponsored 397
by a nonprofit, tax-exempt, charitable or philanthropic 398
organization. A church within the meaning of this section is an 399
organized religious group, duly constituted with officers and a 400
board of trustees, regularly holding religious services, and 401
presided over or administered to by a properly accredited 402
ecclesiastical officer, whose name and standing is published in 403
the official publication of the officer's religious group.404

       (B) Commencing on October 1, 2009, if an application for 405
registration renewal is not applied for prior to the expiration 406
date of the registration or within seven days after that date, the 407
registrar or deputy registrar shall collect a fee of twenty 408
dollars for the issuance of the vehicle registration, but may 409
waive the fee for good cause shown if the application is 410
accompanied by supporting evidence as the registrar may require. 411
The fee shall be in addition to all other fees established by this 412
section. A deputy registrar shall retain fifty cents of the fee 413
and shall transmit the remaining amount to the registrar at the 414
time and in the manner provided by section 4503.10 of the Revised 415
Code. The registrar shall deposit all moneys received under this 416
division into the state highway safety fund established in section 417
4501.06 of the Revised Code.418

       (C) The application for registration of such bus shall be 419
accompanied by the following, as applicable:420

       (1) An affidavit, prescribed by the registrar of motor 421
vehicles and signed by either the senior pastor, minister, priest, 422
or rabbi of the church making application or by the head of the 423
governing body of the church making application, stating that the 424
bus is to be used exclusively to transport members of a church 425
congregation to and from church services or church functions or to 426
transport children and their authorized supervisors to and from 427
any camping function sponsored by a nonprofit, tax-exempt, 428
charitable, or philanthropic organization;429

       (2) A certificate from the state highway patrol stating that 430
the bus involved is safe for operation in accordance with such 431
standards as are prescribed by the state highway patrol if the bus 432
meets either of the following:433

       (a) It originally was designed by the manufacturer to 434
transport sixteen or more passengers, including the driver;435

       (b) It has a gross vehicle weight rating of ten thousand one 436
pounds or more.437

       (D)(C) The form of the license plate and the manner of its 438
attachment to the vehicle shall be prescribed by the registrar.439

       Sec. 4506.08.  (A)(1) Each application for a commercial 440
driver's license temporary instruction permit shall be accompanied 441
by a fee of ten dollars. Each application for a commercial 442
driver's license, restricted commercial driver's license, renewal 443
of such a license, or waiver for farm-related service industries 444
shall be accompanied by a fee of twenty-five dollars, except that 445
an application for a commercial driver's license or restricted 446
commercial driver's license received pursuant to division (A)(3) 447
of section 4506.14 of the Revised Code shall be accompanied by a 448
fee of eighteen dollars and seventy-five cents if the license will 449
expire on the licensee's birthday three years after the date of 450
issuance, a fee of twelve dollars and fifty cents if the license 451
will expire on the licensee's birthday two years after the date of 452
issuance, and a fee of six dollars and twenty-five cents if the 453
license will expire on the licensee's birthday one year after the 454
date of issuance. Each application for a duplicate commercial 455
driver's license shall be accompanied by a fee of ten dollars.456

       (2) In addition, the registrar of motor vehicles or deputy 457
registrar may collect and retain an additional fee of no more than 458
three dollars and fifty cents for each application for a 459
commercial driver's license temporary instruction permit, 460
commercial driver's license, renewal of a commercial driver's 461
license, or duplicate commercial driver's license received by the 462
registrar or deputy.463

       (B) In addition to the fees imposed under division (A) of 464
this section, the registrar of motor vehicles or deputy registrar 465
shall collect a fee of twelve dollars for each application for a 466
commercial driver's license temporary instruction permit, 467
commercial driver's license, or duplicate commercial driver's 468
license and for each application for renewal of a commercial 469
driver's license. The additional fee is for the purpose of 470
defraying the department of public safety's costs associated with 471
the administration and enforcement of the motor vehicle and 472
traffic laws of Ohio. 473

       (C) Commencing on October 1, 2009, if an application for a 474
commercial driver's license made by a person who previously held 475
such a license is not applied for within the period specified in 476
section 4506.14 of the Revised Code or within seven days after the 477
period so specified, the registrar or deputy registrar shall 478
collect a fee of twenty dollars for the issuance of the commercial 479
driver's license, but may waive the fee for good cause shown if 480
the application is accompanied by supporting evidence as the 481
registrar may require. The fee is in addition to all other fees 482
established by this section. A deputy registrar shall retain fifty 483
cents of the fee and shall transmit the remaining amount in 484
accordance with division (D) of this section.485

       (D) Each deputy registrar shall transmit the fees collected 486
under divisions (A)(1),and (B), and (C) of this section in the 487
time and manner prescribed by the registrar. The registrar shall 488
deposit all moneys received under division (D)(C) of this section 489
into the state highway safety fund established in section 4501.06 490
of the Revised Code.491

       (E)(D) Information regarding the driving record of any person 492
holding a commercial driver's license issued by this state shall 493
be furnished by the registrar, upon request and payment of a fee 494
of five dollars, to the employer or prospective employer of such a 495
person and to any insurer.496

       Of each five-dollar fee the registrar collects under this 497
division, the registrar shall pay two dollars into the state 498
treasury to the credit of the state bureau of motor vehicles fund 499
established in section 4501.25 of the Revised Code, sixty cents 500
into the state treasury to the credit of the trauma and emergency 501
medical services fund established in section 4513.263 of the 502
Revised Code, sixty cents into the state treasury to the credit of 503
the homeland security fund established in section 5502.03 of the 504
Revised Code, thirty cents into the state treasury to the credit 505
of the investigations fund established in section 5502.131 of the 506
Revised Code, one dollar and twenty-five cents into the state 507
treasury to the credit of the emergency management agency service 508
and reimbursement fund established in section 5502.39 of the 509
Revised Code, and twenty-five cents into the state treasury to the 510
credit of the justice program services fund established in section 511
5502.67 of the Revised Code.512

       Sec. 4507.23.  (A) Except as provided in division (J)(I) of 513
this section, each application for a temporary instruction permit 514
and examination shall be accompanied by a fee of five dollars.515

       (B) Except as provided in division (J)(I) of this section, 516
each application for a driver's license made by a person who 517
previously held such a license and whose license has expired not 518
more than two years prior to the date of application, and who is 519
required under this chapter to give an actual demonstration of the 520
person's ability to drive, shall be accompanied by a fee of three 521
dollars in addition to any other fees.522

       (C)(1) Except as provided in divisions (E) and (J)(I) of this 523
section, each application for a driver's license, or motorcycle 524
operator's endorsement, or renewal of a driver's license shall be 525
accompanied by a fee of six dollars. 526

       (2) Except as provided in division (J)(I) of this section, 527
each application for a duplicate driver's license shall be 528
accompanied by a fee of seven dollars and fifty cents. The 529
duplicate driver's licenses issued under this section shall be 530
distributed by the deputy registrar in accordance with rules 531
adopted by the registrar of motor vehicles.532

       (D) Except as provided in division (J)(I) of this section, 533
each application for a motorized bicycle license or duplicate 534
thereof shall be accompanied by a fee of two dollars and fifty 535
cents.536

       (E) Except as provided in division (J)(I) of this section, 537
each application for a driver's license or renewal of a driver's 538
license that will be issued to a person who is less than 539
twenty-one years of age shall be accompanied by whichever of the 540
following fees is applicable:541

       (1) If the person is sixteen years of age or older, but less 542
than seventeen years of age, a fee of seven dollars and 543
twenty-five cents;544

       (2) If the person is seventeen years of age or older, but 545
less than eighteen years of age, a fee of six dollars;546

       (3) If the person is eighteen years of age or older, but less 547
than nineteen years of age, a fee of four dollars and seventy-five 548
cents;549

       (4) If the person is nineteen years of age or older, but less 550
than twenty years of age, a fee of three dollars and fifty cents;551

       (5) If the person is twenty years of age or older, but less 552
than twenty-one years of age, a fee of two dollars and twenty-five 553
cents.554

       (F) Neither the registrar nor any deputy registrar shall 555
charge a fee in excess of one dollar and fifty cents for 556
laminating a driver's license, motorized bicycle license, or 557
temporary instruction permit identification cards as required by 558
sections 4507.13 and 4511.521 of the Revised Code. A deputy 559
registrar laminating a driver's license, motorized bicycle 560
license, or temporary instruction permit identification cards 561
shall retain the entire amount of the fee charged for lamination, 562
less the actual cost to the registrar of the laminating materials 563
used for that lamination, as specified in the contract executed by 564
the bureau for the laminating materials and laminating equipment. 565
The deputy registrar shall forward the amount of the cost of the 566
laminating materials to the registrar for deposit as provided in 567
this section.568

       (G) Except as provided in division (J)(I) of this section and 569
except for the renewal of a driver's license, commencing on 570
October 1, 2003, each transaction described in divisions (A), (B), 571
(C), (D), and (E) of this section shall be accompanied by an 572
additional fee of twelve dollars. A transaction involving the 573
renewal of a driver's license with an expiration date on or after 574
that date shall be accompanied by an additional fee of twelve 575
dollars. The additional fee is for the purpose of defraying the 576
department of public safety's costs associated with the 577
administration and enforcement of the motor vehicle and traffic 578
laws of Ohio.579

       (H) Except as provided in division (J) of this section, 580
commencing on October 1, 2009, if an application for a driver's 581
license or motorcycle operator's endorsement made by a person who 582
previously held such a license is not applied for within the 583
period specified in section 4507.09 of the Revised Code or within 584
seven days after the period so specified, the registrar or deputy 585
registrar shall collect a fee of twenty dollars for the issuance 586
of the driver's license or motorcycle endorsement, but may waive 587
the fee for good cause shown if the application is accompanied by 588
supporting evidence as the registrar may require. The fee shall be 589
in addition to all other fees established by this section. A 590
deputy registrar collecting this twenty dollar fee shall retain 591
fifty cents and send the remaining fee to the registrar as 592
specified in division (I) of this section.593

       (I) At the time and in the manner provided by section 4503.10 594
of the Revised Code, the deputy registrar shall transmit the fees 595
collected under divisions (A), (B), (C), (D), and (E), those 596
portions of the fees specified in and collected under division 597
(F), and the additional fee under divisionsdivision (G) and (H)598
of this section to the registrar. The registrar shall pay two 599
dollars and fifty cents of each fee collected under divisions (A), 600
(B), (C)(1) and (2), (D), and (E)(1) to (4) of this section, and 601
the entire fee collected under division (E)(5) of this section, 602
into the state highway safety fund established in section 4501.06 603
of the Revised Code, and such fees shall be used for the sole 604
purpose of supporting driver licensing activities. The registrar 605
also shall pay five dollars of each fee collected under division 606
(C)(2) of this section and the entire fee collected under 607
divisionsdivision (G) and (H) of this section into the state 608
highway safety fund created in section 4501.06 of the Revised 609
Code. The remaining fees collected by the registrar under this 610
section shall be paid into the state bureau of motor vehicles fund 611
established in section 4501.25 of the Revised Code.612

       (J)(I) A disabled veteran who has a service-connected 613
disability rated at one hundred per cent by the veterans' 614
administration may apply to the registrar or a deputy registrar 615
for the issuance to that veteran, without the payment of any fee 616
prescribed in this section, of any of the following items:617

       (1) A temporary instruction permit and examination;618

       (2) A new, renewal, or duplicate driver's or commercial 619
driver's license;620

       (3) A motorcycle operator's endorsement;621

       (4) A motorized bicycle license or duplicate thereof;622

       (5) The fee established in division (H) of this section;623

       (6) Lamination of a driver's license, motorized bicycle 624
license, or temporary instruction permit identification card as 625
provided in division (F) of this section, if the circumstances 626
specified in division (J)(6) of this section are met.627

       A disabled veteran whose driver's license, motorized bicycle 628
license, or temporary instruction permit identification card is 629
laminated by the registrar or deputy registrar is not required to 630
pay the registrar any lamination fee.631

       An application made under division (J)(I) of this section 632
shall be accompanied by such documentary evidence of disability as 633
the registrar may require by rule.634

       Section 2. That existing sections 4501.06, 4503.04, 4503.042, 635
4503.07, 4506.08, and 4507.23 of the Revised Code are hereby 636
repealed.637
