A BILL
To amend section 4501.21 and to enact section 1
4503.524 of the Revised Code to create Power 2
Squadron license plates.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.524 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.50, 4503.501, 4503.502, 4503.51, 10
4503.522, 4503.523, 4503.524, 4503.545, 4503.55, 4503.551, 11
4503.552, 4503.553, 4503.561, 4503.562, 4503.591, 4503.67, 12
4503.68, 4503.69, 4503.71, 4503.711, 4503.712, 4503.72, 4503.73, 13
4503.74, 4503.75, 4503.85, and 4503.92 of the Revised Code. 14

       (B) The registrar shall pay the contributions the registrar 15
collects in the fund as follows: 16

        The registrar shall pay the contributions received pursuant 17
to section 4503.491 of the Revised Code to the breast cancer fund 18
of Ohio, which shall use that money only to pay for programs that 19
provide assistance and education to Ohio breast cancer patients 20
and that improve access for such patients to quality health care 21
and clinical trials and shall not use any of the money for 22
abortion information, counseling, services, or other 23
abortion-related activities. 24

        The registrar shall pay the contributions received pursuant 25
to section 4503.493 of the Revised Code to the autism society of 26
Ohio, which shall use the contributions for programs and autism 27
awareness efforts throughout the state. 28

        The registrar shall pay the contributions the registrar 29
receives pursuant to section 4503.50 of the Revised Code to the 30
future farmers of America foundation, which shall deposit the 31
contributions into its general account to be used for educational 32
and scholarship purposes of the future farmers of America 33
foundation. 34

        The registrar shall pay the contributions the registrar 35
receives pursuant to section 4503.501 of the Revised Code to the 36
4-H youth development program of the Ohio state university 37
extension program, which shall use those contributions to pay the 38
expenses it incurs in conducting its educational activities. 39

        The registrar shall pay the contributions received pursuant 40
to section 4503.502 of the Revised Code to the Ohio cattlemen's 41
foundation, which shall use those contributions for scholarships 42
and other educational activities. 43

        The registrar shall pay each contribution the registrar 44
receives pursuant to section 4503.51 of the Revised Code to the 45
university or college whose name or marking or design appears on 46
collegiate license plates that are issued to a person under that 47
section. A university or college that receives contributions from 48
the fund shall deposit the contributions into its general 49
scholarship fund. 50

        The registrar shall pay the contributions the registrar 51
receives pursuant to section 4503.522 of the Revised Code to the 52
"friends of Perry's victory and international peace memorial, 53
incorporated," a nonprofit corporation organized under the laws of 54
this state, to assist that organization in paying the expenses it 55
incurs in sponsoring or holding charitable, educational, and 56
cultural events at the monument. 57

       The registrar shall pay the contributions the registrar 58
receives pursuant to section 4503.523 of the Revised Code to the 59
fairport lights foundation, which shall use the money to pay for 60
the restoration, maintenance, and preservation of the lighthouses 61
of fairport harbor. 62

       The registrar shall pay the contributions the registrar 63
receives pursuant to section 4503.524 of the Revised Code to the 64
United States power squadron districts seven, eleven, twenty-four, 65
and twenty-nine in equal amounts. Each power squadron district 66
shall use the money it receives under this section to pay for the 67
educational boating programs each district holds or sponsors 68
within this state.69

        The registrar shall pay the contributions the registrar 70
receives pursuant to section 4503.55 of the Revised Code to the 71
pro football hall of fame, which shall deposit the contributions 72
into a special bank account that it establishes and which shall be 73
separate and distinct from any other account the pro football hall 74
of fame maintains, to be used exclusively for the purpose of 75
promoting the pro football hall of fame as a travel destination. 76

        The registrar shall pay the contributions that are paid to 77
the registrar pursuant to section 4503.545 of the Revised Code to 78
the national rifle association foundation, which shall use the 79
money to pay the costs of the educational activities and programs 80
the foundation holds or sponsors in this state. 81

        The registrar shall pay to the Ohio pet fund the 82
contributions the registrar receives pursuant to section 83
4503.551 of the Revised Code and any other money from any 84
other source, including donations, gifts, and grants, that is 85
designated by the source to be paid to the Ohio pet fund. The 86
Ohio pet fund shall use the moneys it receives under this 87
section to support programs for the sterilization of dogs and 88
cats and for educational programs concerning the proper 89
veterinary care of those animals, and for expenses of the Ohio 90
pet fund that are reasonably necessary for it to obtain and 91
maintain its tax-exempt status and to perform its duties. 92

        The registrar shall pay the contributions the registrar 93
receives pursuant to section 4503.552 of the Revised Code to the 94
rock and roll hall of fame and museum, incorporated. 95

        The registrar shall pay the contributions the registrar 96
receives pursuant to section 4503.553 of the Revised Code to the 97
Ohio coalition for animals, incorporated, a nonprofit corporation. 98
Except as provided in division (B) of this section, the coalition 99
shall distribute the money to its members, and the members shall 100
use the money only to pay for educational, charitable, and other 101
programs of each coalition member that provide care for unwanted, 102
abused, and neglected horses. The Ohio coalition for animals may 103
use a portion of the money to pay for reasonable marketing costs 104
incurred in the design and promotion of the license plate and 105
for administrative costs incurred in the disbursement and 106
management of funds received under this section. 107

        The registrar shall pay the contributions the registrar 108
receives pursuant to section 4503.561 of the Revised Code to the 109
state of Ohio chapter of ducks unlimited, inc., which shall 110
deposit the contributions into a special bank account that it 111
establishes. The special bank account shall be separate and 112
distinct from any other account the state of Ohio chapter of ducks 113
unlimited, inc., maintains and shall be used exclusively for the 114
purpose of protecting, enhancing, restoring, and managing wetlands 115
and conserving wildlife habitat. The state of Ohio chapter of 116
ducks unlimited, inc., annually shall notify the registrar in 117
writing of the name, address, and account to which such payments 118
are to be made. 119

        The registrar shall pay the contributions the registrar 120
receives pursuant to section 4503.562 of the Revised Code to the 121
Mahoning river consortium, which shall use the money to pay the 122
expenses it incurs in restoring and maintaining the Mahoning 123
river watershed. 124

        The registrar shall pay to a sports commission created 125
pursuant to section 4503.591 of the Revised Code each 126
contribution the registrar receives under that section that an 127
applicant pays to obtain license plates that bear the logo of a 128
professional sports team located in the county of that sports 129
commission and that is participating in the license plate program 130
pursuant to division (E) of that section, irrespective of the 131
county of residence of an applicant. 132

        The registrar shall pay to a community charity each 133
contribution the registrar receives under section 4503.591 of the 134
Revised Code that an applicant pays to obtain license plates that 135
bear the logo of a professional sports team that is participating 136
in the license plate program pursuant to division (G) of that 137
section. 138

        The registrar shall pay the contributions the registrar 139
receives pursuant to section 4503.67 of the Revised Code to the 140
Dan Beard council of the boy scouts of America. The council shall 141
distribute all contributions in an equitable manner throughout 142
the state to regional councils of the boy scouts. 143

        The registrar shall pay the contributions the registrar 144
receives pursuant to section 4503.68 of the Revised Code to the 145
great river council of the girl scouts of the United States of 146
America. The council shall distribute all contributions in an 147
equitable manner throughout the state to regional councils of the 148
girl scouts. 149

        The registrar shall pay the contributions the registrar 150
receives pursuant to section 4503.69 of the Revised Code to the 151
Dan Beard council of the boy scouts of America. The council shall 152
distribute all contributions in an equitable manner throughout 153
the state to regional councils of the boy scouts. 154

        The registrar shall pay the contributions the registrar 155
receives pursuant to section 4503.71 of the Revised Code to the 156
fraternal order of police of Ohio, incorporated, which shall 157
deposit the fees into its general account to be used for purposes 158
of the fraternal order of police of Ohio, incorporated. 159

        The registrar shall pay the contributions the registrar 160
receives pursuant to section 4503.711 of the Revised Code to the 161
fraternal order of police of Ohio, incorporated, which shall 162
deposit the contributions into an account that it creates to be 163
used for the purpose of advancing and protecting the law 164
enforcement profession, promoting improved law enforcement 165
methods, and teaching respect for law and order. 166

       The registrar shall pay the contributions received pursuant 167
to section 4503.712 of the Revised Code to Ohio concerns of 168
police survivors, which shall use those contributions to provide 169
whatever assistance may be appropriate to the families of Ohio 170
law enforcement officers who are killed in the line of duty. 171

       The registrar shall pay the contributions the registrar 172
receives pursuant to section 4503.72 of the Revised Code to the 173
organization known on March 31, 2003, as the Ohio CASA/GAL 174
association, a private, nonprofit corporation organized under 175
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 176
shall use these contributions to pay the expenses it incurs in 177
administering a program to secure the proper representation in the 178
courts of this state of abused, neglected, and dependent children, 179
and for the training and supervision of persons participating in 180
that program. 181

        The registrar shall pay the contributions the registrar 182
receives pursuant to section 4503.73 of the Revised Code to 183
Wright B. Flyer, incorporated, which shall deposit the 184
contributions into its general account to be used for purposes of 185
Wright B. Flyer, incorporated. 186

       The registrar shall pay the contributions the registrar 187
receives pursuant to section 4503.74 of the Revised Code to the 188
Columbus zoological park association, which shall disburse the 189
moneys to Ohio's major metropolitan zoos, as defined in section 190
4503.74 of the Revised Code, in accordance with a written 191
agreement entered into by the major metropolitan zoos. 192

       The registrar shall pay the contributions the registrar 193
receives pursuant to section 4503.75 of the Revised Code to the 194
rotary foundation, located on March 31, 2003, in Evanston, 195
Illinois, to be placed in a fund known as the permanent fund and 196
used to endow educational and humanitarian programs of the rotary 197
foundation. 198

        The registrar shall pay the contributions the registrar 199
receives pursuant to section 4503.85 of the Revised Code to the 200
Ohio sea grant college program to be used for Lake Erie area 201
research projects. 202

       The registrar shall pay the contributions received pursuant 203
to section 4503.92 of the Revised Code to support our troops, 204
incorporated, a national nonprofit corporation, which shall use 205
those contributions in accordance with its articles of 206
incorporation and for the benefit of servicemembers of the armed 207
forces of the United States and their families when they are in 208
financial need. 209

       (C) All investment earnings of the license plate contribution 210
fund shall be credited to the fund. Not later than the first day 211
of May of every year, the registrar shall distribute to each 212
entity described in division (B) of this section the investment 213
income the fund earned the previous calendar year. The amount of 214
such a distribution paid to an entity shall be proportionate to 215
the amount of money the entity received from the fund during the 216
previous calendar year. 217

       Sec. 4503.524.  (A) The owner or lessee of any passenger car, 218
noncommercial motor vehicle, recreational vehicle, or other 219
vehicle of a class approved by the registrar of motor vehicles may 220
apply to the registrar for the registration of the vehicle and 221
issuance of power squadron license plates. The application for 222
power squadron license plates may be combined with a request for a 223
special reserved license plate under section 4503.40 or 4503.42 of 224
the Revised Code. Upon receipt of the completed application and 225
compliance with division (B) of this section, the registrar shall 226
issue to the applicant the appropriate vehicle registration and a 227
set of power squadron license plates with a validation sticker or 228
a validation sticker alone when required by section 4503.191 of 229
the Revised Code.230

       In addition to the letters and numbers ordinarily inscribed 231
thereon, power squadron license plates shall be inscribed with 232
words and markings selected and designed by the organization 233
Mansfield power squadron. The registrar shall approve the final 234
design. Power squadron license plates shall bear county 235
identification stickers that identify the county of registration 236
by name or number.237

       (B) Power squadron license plates and validation stickers 238
shall be issued upon payment of the regular license tax as 239
prescribed under section 4503.04 of the Revised Code, any 240
applicable motor vehicle tax levied under Chapter 4504. of the 241
Revised Code, a bureau of motor vehicles administrative fee of ten 242
dollars, the contribution specified under division (C) of this 243
section, and compliance with all other applicable laws relating to 244
the registration of motor vehicles. If the application for power 245
squadron license plates is combined with a request for a special 246
reserved license plate under section 4503.40 or 4503.42 of the 247
Revised Code, the license plates and validation sticker shall be 248
issued upon payment of the fees and taxes contained in this 249
division and the additional fee prescribed by section 4503.40 or 250
4503.42 of the Revised Code.251

       (C) For each application for registration and registration 252
renewal received under this section, the registrar shall collect a 253
contribution of fifteen dollars. The registrar shall transmit this 254
contribution to the treasurer of state for deposit into the 255
license plate contribution fund created in section 4501.21 of the 256
Revised Code.257

       The registrar shall deposit the ten-dollar bureau 258
administrative fee, the purpose of which is to compensate the 259
bureau for the additional services required in issuing power 260
squadron license plates, into the state bureau of motor vehicles 261
fund created in section 4501.25 of the Revised Code.262

       Section 2. That existing section 4501.21 of the Revised Code 263
is hereby repealed.264
