A BILL
To amend section 4513.03 of the Revised Code to 1
require the headlights of a vehicle to be lighted 2
when its windshield wipers are in use.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4513.03 of the Revised Code be 4
amended to read as follows:5

       Sec. 4513.03.  (A) Every vehicle, other than a motorized 6
bicycle, operated upon a street or highway within this state shall 7
display lighted lights and illuminating devices as required by 8
sections 4513.04 to 4513.37 of the Revised Code during all of the 9
following times:10

       (1) The time from sunset to sunrise, and at;11

       (2) At any other time when there are, due to insufficient 12
natural light or unfavorable atmospheric conditions or when there 13
is not sufficient natural light to render discernible, persons, 14
vehicles, and substantial objects on the highway are not 15
discernible at a distance of one thousand feet ahead, shall 16
display lighted lights and illuminating devices as required by 17
sections 4513.04 to 4513.37 of the Revised Code, for different 18
classes of vehicles; except that every;19

       (3) At any time when the windshield wipers of the vehicle are 20
in use because of precipitation on the windshield.21

       Every motorized bicycle shall display at such times lighted22
lights meeting the rules adopted by the director of public safety23
under section 4511.521 of the Revised Code. No motor vehicle,24
during such timesany time specified in this section, shall be 25
operated upon a street or highway within this state using only 26
parking lights as illumination.27

       Whenever in such sections a requirement is declared as to the28
distance from which certain lamps and devices shall render objects29
visible, or within which such lamps or devices shall be visible,30
such distance shall be measured upon a straight level unlighted31
highway under normal atmospheric conditions unless a different32
condition is expressly stated.33

       Whenever in such sections a requirement is declared as to the34
mounted height of lights or devices, it shall mean from the center35
of such light or device to the level ground upon which the vehicle36
stands.37

       (B) Whoever violates this section shall be punished as38
provided in section 4513.99 of the Revised Code.39

       Section 2. That existing section 4513.03 of the Revised Code 40
is hereby repealed.41
