A BILL
To permit a board of elections that conducts a 1
special election on July 13, 2010, for the purpose 2
of nominating candidates for congressional office 3
to conduct that election with a limited number of 4
polling places and to declare an emergency.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. (A) Notwithstanding any provision of the Revised 6
Code to the contrary, a board of elections that conducts a special 7
election on July 13, 2010, for the purpose of nominating 8
candidates for the office of congressional representative may 9
conduct that election using a limited number of polling places. A 10
board of elections that decides to conduct the election using a 11
limited number of polling places shall do all of the following:12

        (1) Notify, by mail, each elector of that county who is 13
eligible to vote in the special election of the special election 14
and of the elector's designated polling place for that special 15
election and include an absent voter's ballot application with 16
that notification;17

        (2) Establish not more than four polling places at which 18
electors in the county may cast a ballot in the special election; 19
and20

        (3) Permit individuals who are eligible to cast a provisional 21
ballot to cast those ballots at the office of the board of 22
elections.23

        (B) This section is hereby repealed, effective August 14, 24
2010.25

       Section 2. This act is hereby declared to be an emergency 26
measure necessary for the immediate preservation of the public 27
peace, health, and safety. The reason for such necessity is that 28
the costs of conducting a special election in each precinct 29
polling place in the third congressional district on July 13, 30
2010, will be prohibitive, considering the budgetary situation of 31
both state and local governments. Therefore, this act shall go 32
into immediate effect.33
