A BILL
To amend section 1907.11 of the Revised Code to 1
eliminate a judgeship in the Belmont County County 2
Court and to declare an emergency.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 1907.11 of the Revised Code be 4
amended to read as follows:5

       Sec. 1907.11.  (A) Each county court district shall have the 6
following county court judges, to be elected as follows:7

       In the Adams county county court, one part-time judge shall 8
be elected in 1982.9

       In the Ashtabula county county court, one part-time judge 10
shall be elected in 1980, and one part-time judge shall be elected 11
in 1982.12

       In the Belmont county county court, one part-time judge shall 13
be elected in 1992, term to commence on January 1, 1993, and two 14
part-time judges shall be elected in 1994, terms to commence on 15
January 1, 1995, and January 2, 1995, respectively.16

       In the Butler county county court, one part-time judge shall 17
be elected in 1992, term to commence on January 1, 1993, and two 18
part-time judges shall be elected in 1994, terms to commence on 19
January 1, 1995, and January 2, 1995, respectively.20

        Until December 31, 2007, in the Erie county county court, one 21
part-time judge shall be elected in 1982. Effective January 1, 22
2008, the Erie county county court shall cease to exist.23

       In the Fulton county county court, one part-time judge shall 24
be elected in 1980, and one part-time judge shall be elected in25
1982.26

       In the Harrison county county court, one part-time judge 27
shall be elected in 1982.28

       In the Highland county county court, one part-time judge 29
shall be elected in 1982.30

       In the Jefferson county county court, one part-time judge 31
shall be elected in 1992, term to commence on January 1, 1993, and 32
two part-time judges shall be elected in 1994, terms to commence 33
on January 1, 1995, and January 2, 1995, respectively.34

       In the Mahoning county county court, one part-time judge 35
shall be elected in 1992, term to commence on January 1, 1993, and 36
three part-time judges shall be elected in 1994, terms to commence 37
on January 1, 1995, January 2, 1995, and January 3, 1995, 38
respectively.39

       In the Meigs county county court, one part-time judge shall 40
be elected in 1982.41

       In the Monroe county county court, one part-time judge shall 42
be elected in 1982.43

       In the Montgomery county county court, three part-time judges 44
shall be elected in 1998, terms to commence on January 1, 1999, 45
January 2, 1999, and January 3, 1999, respectively, and two 46
part-time judges shall be elected in 1994, terms to commence on 47
January 1, 1995, and January 2, 1995, respectively.48

       In the Morgan county county court, one part-time judge shall 49
be elected in 1982.50

       In the Muskingum county county court, one part-time judge 51
shall be elected in 1980, and one part-time judge shall be elected 52
in 1982.53

       In the Noble county county court, one part-time judge shall 54
be elected in 1982.55

       In the Paulding county county court, one part-time judge 56
shall be elected in 1982.57

       In the Perry county county court, one part-time judge shall 58
be elected in 1982.59

       In the Pike county county court, one part-time judge shall be 60
elected in 1982.61

       In the Putnam county county court, one part-time judge shall 62
be elected in 1980, and one part-time judge shall be elected in 63
1982.64

       In the Sandusky county county court, two part-time judges 65
shall be elected in 1994, terms to commence on January 1, 1995, 66
and January 2, 1995, respectively.67

       In the Trumbull county county court, one part-time judge 68
shall be elected in 1992, and one part-time judge shall be elected 69
in 1994.70

       In the Tuscarawas county county court, one part-time judge 71
shall be elected in 1982.72

       In the Vinton county county court, one part-time judge shall 73
be elected in 1982.74

       In the Warren county county court, one part-time judge shall 75
be elected in 1980, and one part-time judge shall be elected in 76
1982.77

       (B)(1) Additional judges shall be elected at the next regular 78
election for a county court judge as provided in section 1907.13 79
of the Revised Code.80

       (2) Vacancies caused by the death or the resignation from, 81
forfeiture of, or removal from office of a judge shall be filled 82
in accordance with section 107.08 of the Revised Code, except as 83
provided in section 1907.15 of the Revised Code.84

       Section 2. That existing section 1907.11 of the Revised Code 85
is hereby repealed.86

       Section 3. This act eliminates the position of the part-time 87
judge of the Belmont County County Court whose term expires on 88
December 31, 2010. There shall be no election for that position in 89
the general election of 2010.90

       Section 4. This act is hereby declared to be an emergency 91
measure necessary for the immediate preservation of the public 92
peace, health, and safety. The reason for such necessity is to 93
prevent any nominating petitions from being filed prior to the 94
general election on November 2, 2010, for the judgeship that is to 95
be eliminated by this act. Therefore, this act shall go into 96
immediate effect.97
