A BILL
To amend sections 4501.06, 4503.04, 4503.042, 1
4503.07, 4506.08, and 4507.23 of the Revised Code 2
to eliminate the late fee of twenty dollars for 3
motor vehicle registrations, commercial driver's 4
licenses, driver's licenses, and motorcycle 5
endorsements established by the biennial 6
transportation appropriations act of the 128th 7
General Assembly for deposit primarily into the 8
State Highway Safety Fund and to establish a 9
refund procedure for persons who paid the late 10
fee.11


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4501.06, 4503.04, 4503.042, 4503.07, 12
4506.08, and 4507.23 of the Revised Code be amended to read as 13
follows:14

       Sec. 4501.06.  The taxes, fees, and fines levied, charged, or 15
referred to in division (O) of section 4503.04, division (E) of 16
section 4503.042, division (B) of section 4503.07, division (C)(1) 17
of section 4503.10, division (D) of section 4503.182, division (A) 18
of section 4503.19, division (D)(2) of section 4507.24, division 19
(A) of section 4508.06, and sections 4503.40, 4503.42, 4505.11, 20
4505.111, 4506.08, 4506.09, 4507.23, 4508.05, 4923.12, and 5502.12 21
of the Revised Code, and the taxes charged in section 4503.65 that 22
are distributed in accordance with division (A)(2) of section 23
4501.044 of the Revised Code unless otherwise designated by law, 24
shall be deposited in the state treasury to the credit of the 25
state highway safety fund, which is hereby created, and shall, 26
after receipt of certifications from the commissioners of the 27
sinking fund certifying, as required by sections 5528.15 and 28
5528.35 of the Revised Code, that there are sufficient moneys to 29
the credit of the highway improvement bond retirement fund created 30
by section 5528.12 of the Revised Code to meet in full all 31
payments of interest, principal, and charges for the retirement of 32
bonds and other obligations issued pursuant to Section 2g of 33
Article VIII, Ohio Constitution, and sections 5528.10 and 5528.11 34
of the Revised Code due and payable during the current calendar 35
year, and that there are sufficient moneys to the credit of the 36
highway obligations bond retirement fund created by section 37
5528.32 of the Revised Code to meet in full all payments of 38
interest, principal, and charges for the retirement of highway 39
obligations issued pursuant to Section 2i of Article VIII, Ohio 40
Constitution, and sections 5528.30 and 5528.31 of the Revised Code 41
due and payable during the current calendar year, be used for the 42
purpose of enforcing and paying the expenses of administering the 43
law relative to the registration and operation of motor vehicles 44
on the public roads or highways. Amounts credited to the fund may 45
also be used to pay the expenses of administering and enforcing 46
the laws under which such fees were collected. All investment 47
earnings of the state highway safety fund shall be credited to the 48
fund.49

       Sec. 4503.04.  Except as provided in sections 4503.042 and 50
4503.65 of the Revised Code for the registration of commercial 51
cars, trailers, semitrailers, and certain buses, the rates of the 52
taxes imposed by section 4503.02 of the Revised Code shall be as 53
follows:54

       (A) For motor vehicles having three wheels or less, the 55
license tax is:56

       (1) For each motorized bicycle, ten dollars;57

       (2) For each motorcycle, fourteen dollars.58

       (B) For each passenger car, twenty dollars;59

       (C) For each manufactured home, each mobile home, and each 60
travel trailer, ten dollars;61

       (D) For each noncommercial motor vehicle designed by the 62
manufacturer to carry a load of no more than three-quarters of one 63
ton and for each motor home, thirty-five dollars; for each 64
noncommercial motor vehicle designed by the manufacturer to carry 65
a load of more than three-quarters of one ton, but not more than 66
one ton, seventy dollars;67

       (E) For each noncommercial trailer, the license tax is:68

       (1) Eighty-five cents for each one hundred pounds or part 69
thereof for the first two thousand pounds or part thereof of 70
weight of vehicle fully equipped;71

       (2) One dollar and forty cents for each one hundred pounds or 72
part thereof in excess of two thousand pounds up to and including 73
three thousand pounds.74

       (F) Notwithstanding its weight, twelve dollars for any:75

       (1) Vehicle equipped, owned, and used by a charitable or 76
nonprofit corporation exclusively for the purpose of administering 77
chest x-rays or receiving blood donations;78

       (2) Van used principally for the transportation of 79
handicapped persons that has been modified by being equipped with 80
adaptive equipment to facilitate the movement of such persons into 81
and out of the van;82

       (3) Bus used principally for the transportation of 83
handicapped persons or persons sixty-five years of age or older;.84

       (G) Notwithstanding its weight, twenty dollars for any bus 85
used principally for the transportation of persons in a 86
ridesharing arrangement.87

       (H) For each transit bus having motor power the license tax 88
is twelve dollars.89

       "Transit bus" means either a motor vehicle having a seating 90
capacity of more than seven persons which is operated and used by 91
any person in the rendition of a public mass transportation 92
service primarily in a municipal corporation or municipal 93
corporations and provided at least seventy-five per cent of the 94
annual mileage of such service and use is within such municipal 95
corporation or municipal corporations or a motor vehicle having a 96
seating capacity of more than seven persons which is operated 97
solely for the transportation of persons associated with a 98
charitable or nonprofit corporation, but does not mean any motor 99
vehicle having a seating capacity of more than seven persons when 100
such vehicle is used in a ridesharing capacity or any bus 101
described by division (F)(3) of this section.102

       The application for registration of such transit bus shall be 103
accompanied by an affidavit prescribed by the registrar of motor 104
vehicles and signed by the person or an agent of the firm or 105
corporation operating such bus stating that the bus has a seating 106
capacity of more than seven persons, and that it is either to be 107
operated and used in the rendition of a public mass transportation 108
service and that at least seventy-five per cent of the annual 109
mileage of such operation and use shall be within one or more 110
municipal corporations or that it is to be operated solely for the 111
transportation of persons associated with a charitable or 112
nonprofit corporation.113

       The form of the license plate, and the manner of its 114
attachment to the vehicle, shall be prescribed by the registrar of 115
motor vehicles.116

       (I) The minimum tax for any vehicle having motor power other 117
than a farm truck, a motorized bicycle, or motorcycle is ten 118
dollars and eighty cents, and for each noncommercial trailer, five 119
dollars.120

       (J)(1) Except as otherwise provided in division (J) of this 121
section, for each farm truck, except a noncommercial motor 122
vehicle, that is owned, controlled, or operated by one or more 123
farmers exclusively in farm use as defined in this section, and 124
not for commercial purposes, and provided that at least 125
seventy-five per cent of such farm use is by or for the one or 126
more owners, controllers, or operators of the farm in the 127
operation of which a farm truck is used, the license tax is five 128
dollars plus:129

       (a) Fifty cents per one hundred pounds or part thereof for 130
the first three thousand pounds;131

       (b) Seventy cents per one hundred pounds or part thereof in 132
excess of three thousand pounds up to and including four thousand 133
pounds;134

       (c) Ninety cents per one hundred pounds or part thereof in 135
excess of four thousand pounds up to and including six thousand 136
pounds;137

       (d) Two dollars for each one hundred pounds or part thereof 138
in excess of six thousand pounds up to and including ten thousand 139
pounds;140

       (e) Two dollars and twenty-five cents for each one hundred 141
pounds or part thereof in excess of ten thousand pounds;142

       (f) The minimum license tax for any farm truck shall be 143
twelve dollars.144

       (2) The owner of a farm truck may register the truck for a 145
period of one-half year by paying one-half the registration tax 146
imposed on the truck under this chapter and one-half the amount of 147
any tax imposed on the truck under Chapter 4504. of the Revised 148
Code.149

       (3) A farm bus may be registered for a period of ninety days 150
from the date of issue of the license plates for the bus, for a 151
fee of ten dollars, provided such license plates shall not be 152
issued for more than any two ninety-day periods in any calendar 153
year. Such use does not include the operation of trucks by 154
commercial processors of agricultural products.155

       (4) License plates for farm trucks and for farm buses shall 156
have some distinguishing marks, letters, colors, or other 157
characteristics to be determined by the director of public safety.158

       (5) Every person registering a farm truck or bus under this 159
section shall furnish an affidavit certifying that the truck or 160
bus licensed to that person is to be so used as to meet the 161
requirements necessary for the farm truck or farm bus 162
classification.163

       Any farmer may use a truck owned by the farmer for commercial 164
purposes by paying the difference between the commercial truck 165
registration fee and the farm truck registration fee for the 166
remaining part of the registration period for which the truck is 167
registered. Such remainder shall be calculated from the beginning 168
of the semiannual period in which application for such commercial 169
license is made.170

       Taxes at the rates provided in this section are in lieu of 171
all taxes on or with respect to the ownership of such motor 172
vehicles, except as provided in section 4503.042 and section 173
4503.06 of the Revised Code.174

       (K) Other than trucks registered under the international 175
registration plan in another jurisdiction and for which this state 176
has received an apportioned registration fee, the license tax for 177
each truck which is owned, controlled, or operated by a 178
nonresident, and licensed in another state, and which is used 179
exclusively for the transportation of nonprocessed agricultural 180
products intrastate, from the place of production to the place of 181
processing, is twenty-four dollars.182

       "Truck," as used in this division, means any pickup truck, 183
straight truck, semitrailer, or trailer other than a travel 184
trailer. Nonprocessed agricultural products, as used in this 185
division, does not include livestock or grain.186

       A license issued under this division shall be issued for a 187
period of one hundred thirty days in the same manner in which all 188
other licenses are issued under this section, provided that no 189
truck shall be so licensed for more than one 190
one-hundred-thirty-day period during any calendar year.191

       The license issued pursuant to this division shall consist of 192
a windshield decal to be designed by the director of public 193
safety.194

       Every person registering a truck under this division shall 195
furnish an affidavit certifying that the truck licensed to the 196
person is to be used exclusively for the purposes specified in 197
this division.198

       (L) Every person registering a motor vehicle as a 199
noncommercial motor vehicle as defined in section 4501.01 of the 200
Revised Code, or registering a trailer as a noncommercial trailer 201
as defined in that section, shall furnish an affidavit certifying 202
that the motor vehicle or trailer so licensed to the person is to 203
be so used as to meet the requirements necessary for the 204
noncommercial vehicle classification.205

       (M) Every person registering a van or bus as provided in 206
divisions (F)(2) and (3) of this section shall furnish a notarized 207
statement certifying that the van or bus licensed to the person is 208
to be used for the purposes specified in those divisions. The form 209
of the license plate issued for such motor vehicles shall be 210
prescribed by the registrar.211

       (N) Every person registering as a passenger car a motor 212
vehicle designed and used for carrying more than nine but not more 213
than fifteen passengers, and every person registering a bus as 214
provided in division (G) of this section, shall furnish an 215
affidavit certifying that the vehicle so licensed to the person is 216
to be used in a ridesharing arrangement and that the person will 217
have in effect whenever the vehicle is used in a ridesharing 218
arrangement a policy of liability insurance with respect to the 219
motor vehicle in amounts and coverages no less than those required 220
by section 4509.79 of the Revised Code. The form of the license 221
plate issued for such a motor vehicle shall be prescribed by the 222
registrar.223

       (O) Commencing on October 1, 2009, if an application for 224
registration renewal is not applied for prior to the expiration 225
date of the registration or within seven days after that date, the 226
registrar or deputy registrar shall collect a fee of twenty 227
dollars for the issuance of the vehicle registration, but may 228
waive the fee for good cause shown if the application is 229
accompanied by supporting evidence as the registrar may require. 230
The fee shall be in addition to all other fees established by this 231
section. A deputy registrar shall retain fifty cents of the fee 232
and shall transmit the remaining amount to the registrar at the 233
time and in the manner provided by section 4503.10 of the Revised 234
Code. The registrar shall deposit all moneys received under this 235
division into the state highway safety fund established in section 236
4501.06 of the Revised Code.237

       (P) As used in this section:238

       (1) "Van" means any motor vehicle having a single rear axle 239
and an enclosed body without a second seat.240

       (2) "Handicapped person" means any person who has lost the 241
use of one or both legs, or one or both arms, or is blind, deaf, 242
or so severely disabled as to be unable to move about without the 243
aid of crutches or a wheelchair.244

       (3) "Farm truck" means a truck used in the transportation 245
from the farm of products of the farm, including livestock and its 246
products, poultry and its products, floricultural and 247
horticultural products, and in the transportation to the farm of 248
supplies for the farm, including tile, fence, and every other 249
thing or commodity used in agricultural, floricultural, 250
horticultural, livestock, and poultry production and livestock, 251
poultry, and other animals and things used for breeding, feeding, 252
or other purposes connected with the operation of the farm.253

       (4) "Farm bus" means a bus used only for the transportation 254
of agricultural employees and used only in the transportation of 255
such employees as are necessary in the operation of the farm.256

       (5) "Farm supplies" includes fuel used exclusively in the 257
operation of a farm, including one or more homes located on and 258
used in the operation of one or more farms, and furniture and 259
other things used in and around such homes.260

       Sec. 4503.042.  The registrar of motor vehicles shall adopt 261
rules establishing the date, subsequent to this state's entry into 262
membership in the international registration plan, when the rates 263
established by this section become operative.264

       (A) The rates of the taxes imposed by section 4503.02 of the 265
Revised Code are as follows for commercial cars having a gross 266
vehicle weight or combined gross vehicle weight of:267

       (1) Not more than two thousand pounds, forty-five dollars;268

       (2) More than two thousand but not more than six thousand 269
pounds, seventy dollars;270

       (3) More than six thousand but not more than ten thousand 271
pounds, eighty-five dollars;272

       (4) More than ten thousand but not more than fourteen 273
thousand pounds, one hundred five dollars;274

       (5) More than fourteen thousand but not more than eighteen 275
thousand pounds, one hundred twenty-five dollars;276

       (6) More than eighteen thousand but not more than twenty-two 277
thousand pounds, one hundred fifty dollars;278

       (7) More than twenty-two thousand but not more than 279
twenty-six thousand pounds, one hundred seventy-five dollars;280

       (8) More than twenty-six thousand but not more than thirty 281
thousand pounds, three hundred fifty-five dollars;282

       (9) More than thirty thousand but not more than thirty-four 283
thousand pounds, four hundred twenty dollars;284

       (10) More than thirty-four thousand but not more than 285
thirty-eight thousand pounds, four hundred eighty dollars;286

       (11) More than thirty-eight thousand but not more than 287
forty-two thousand pounds, five hundred forty dollars;288

       (12) More than forty-two thousand but not more than forty-six 289
thousand pounds, six hundred dollars;290

       (13) More than forty-six thousand but not more than fifty 291
thousand pounds, six hundred sixty dollars;292

       (14) More than fifty thousand but not more than fifty-four 293
thousand pounds, seven hundred twenty-five dollars;294

       (15) More than fifty-four thousand but not more than 295
fifty-eight thousand pounds, seven hundred eighty-five dollars;296

       (16) More than fifty-eight thousand but not more than 297
sixty-two thousand pounds, eight hundred fifty-five dollars;298

       (17) More than sixty-two thousand but not more than sixty-six 299
thousand pounds, nine hundred twenty-five dollars;300

       (18) More than sixty-six thousand but not more than seventy 301
thousand pounds, nine hundred ninety-five dollars;302

       (19) More than seventy thousand but not more than 303
seventy-four thousand pounds, one thousand eighty dollars;304

       (20) More than seventy-four thousand but not more than 305
seventy-eight thousand pounds, one thousand two hundred dollars;306

       (21) More than seventy-eight thousand pounds, one thousand 307
three hundred forty dollars.308

       (B) The rates of the taxes imposed by section 4503.02 of the 309
Revised Code are as follows for buses having a gross vehicle 310
weight or combined gross vehicle weight of:311

       (1) Not more than two thousand pounds, ten dollars;312

       (2) More than two thousand but not more than six thousand 313
pounds, forty dollars;314

       (3) More than six thousand but not more than ten thousand 315
pounds, one hundred dollars;316

       (4) More than ten thousand but not more than fourteen 317
thousand pounds, one hundred eighty dollars;318

       (5) More than fourteen thousand but not more than eighteen 319
thousand pounds, two hundred sixty dollars;320

       (6) More than eighteen thousand but not more than twenty-two 321
thousand pounds, three hundred forty dollars;322

       (7) More than twenty-two thousand but not more than 323
twenty-six thousand pounds, four hundred twenty dollars;324

       (8) More than twenty-six thousand but not more than thirty 325
thousand pounds, five hundred dollars;326

       (9) More than thirty thousand but not more than thirty-four 327
thousand pounds, five hundred eighty dollars;328

       (10) More than thirty-four thousand but not more than 329
thirty-eight thousand pounds, six hundred sixty dollars;330

       (11) More than thirty-eight thousand but not more than 331
forty-two thousand pounds, seven hundred forty dollars;332

       (12) More than forty-two thousand but not more than forty-six 333
thousand pounds, eight hundred twenty dollars;334

       (13) More than forty-six thousand but not more than fifty 335
thousand pounds, nine hundred forty dollars;336

       (14) More than fifty thousand but not more than fifty-four 337
thousand pounds, one thousand dollars;338

       (15) More than fifty-four thousand but not more than 339
fifty-eight thousand pounds, one thousand ninety dollars;340

       (16) More than fifty-eight thousand but not more than 341
sixty-two thousand pounds, one thousand one hundred eighty 342
dollars;343

       (17) More than sixty-two thousand but not more than sixty-six 344
thousand pounds, one thousand two hundred seventy dollars;345

       (18) More than sixty-six thousand but not more than seventy 346
thousand pounds, one thousand three hundred sixty dollars;347

       (19) More than seventy thousand but not more than 348
seventy-four thousand pounds, one thousand four hundred fifty 349
dollars;350

       (20) More than seventy-four thousand but not more than 351
seventy-eight thousand pounds, one thousand five hundred forty 352
dollars;353

       (21) More than seventy-eight thousand pounds, one thousand 354
six hundred thirty dollars.355

       (C) In addition to the license taxes imposed at the rates 356
specified in divisions (A) and (B) of this section, an 357
administrative fee of three dollars and fifty cents, plus an 358
appropriate amount to cover the cost of postage, shall be 359
collected by the registrar for each international registration 360
plan license processed by the registrar. 361

       (D) The rate of the tax for each trailer and semitrailer is 362
twenty-five dollars.363

       (E) Commencing on October 1, 2009, if an application for 364
registration renewal is not applied for prior to the expiration 365
date of the registration or within seven days after that date, the 366
registrar or deputy registrar shall collect a fee of twenty 367
dollars for the issuance of the vehicle registration, but may 368
waive the fee for good cause shown if the application is 369
accompanied by supporting evidence as the registrar may require. 370
The fee shall be in addition to all other fees established by this 371
section. A deputy registrar shall retain fifty cents of the fee 372
and shall transmit the remaining amount to the registrar at the 373
time and in the manner provided by section 4503.10 of the Revised 374
Code. The registrar shall deposit all moneys received under this 375
division into the state highway safety fund established in section 376
4501.06 of the Revised Code.377

       (F) The rates established by this section shall not apply to 378
any of the following:379

       (1) Vehicles equipped, owned, and used by a charitable or 380
nonprofit corporation exclusively for the purpose of administering 381
chest x-rays or receiving blood donations;382

       (2) Vans used principally for the transportation of 383
handicapped persons that have been modified by being equipped with 384
adaptive equipment to facilitate the movement of such persons into 385
and out of the vans;386

       (3) Buses used principally for the transportation of 387
handicapped persons or persons sixty-five years of age or older;388

       (4) Buses used principally for the transportation of persons 389
in a ridesharing arrangement;390

       (5) Transit buses having motor power;391

       (6) Noncommercial trailers, mobile homes, or manufactured 392
homes.393

       Sec. 4503.07.  (A) In lieu of the schedule of rates for 394
commercial cars fixed in section 4503.04 of the Revised Code, the 395
fee shall be ten dollars for each church bus used exclusively to 396
transport members of a church congregation to and from church 397
services or church functions or to transport children and their 398
authorized supervisors to and from any camping function sponsored 399
by a nonprofit, tax-exempt, charitable or philanthropic 400
organization. A church within the meaning of this section is an 401
organized religious group, duly constituted with officers and a 402
board of trustees, regularly holding religious services, and 403
presided over or administered to by a properly accredited 404
ecclesiastical officer, whose name and standing is published in 405
the official publication of the officer's religious group.406

       (B) Commencing on October 1, 2009, if an application for 407
registration renewal is not applied for prior to the expiration 408
date of the registration or within seven days after that date, the 409
registrar or deputy registrar shall collect a fee of twenty 410
dollars for the issuance of the vehicle registration, but may 411
waive the fee for good cause shown if the application is 412
accompanied by supporting evidence as the registrar may require. 413
The fee shall be in addition to all other fees established by this 414
section. A deputy registrar shall retain fifty cents of the fee 415
and shall transmit the remaining amount to the registrar at the 416
time and in the manner provided by section 4503.10 of the Revised 417
Code. The registrar shall deposit all moneys received under this 418
division into the state highway safety fund established in section 419
4501.06 of the Revised Code.420

       (C) The application for registration of such bus shall be 421
accompanied by the following, as applicable:422

       (1) An affidavit, prescribed by the registrar of motor 423
vehicles and signed by either the senior pastor, minister, priest, 424
or rabbi of the church making application or by the head of the 425
governing body of the church making application, stating that the 426
bus is to be used exclusively to transport members of a church 427
congregation to and from church services or church functions or to 428
transport children and their authorized supervisors to and from 429
any camping function sponsored by a nonprofit, tax-exempt, 430
charitable, or philanthropic organization;431

       (2) A certificate from the state highway patrol stating that 432
the bus involved is safe for operation in accordance with such 433
standards as are prescribed by the state highway patrol if the bus 434
meets either of the following:435

       (a) It originally was designed by the manufacturer to 436
transport sixteen or more passengers, including the driver;437

       (b) It has a gross vehicle weight rating of ten thousand one 438
pounds or more.439

       (D)(C) The form of the license plate and the manner of its 440
attachment to the vehicle shall be prescribed by the registrar.441

       Sec. 4506.08.  (A)(1) Each application for a commercial 442
driver's license temporary instruction permit shall be accompanied 443
by a fee of ten dollars. Each application for a commercial 444
driver's license, restricted commercial driver's license, renewal 445
of such a license, or waiver for farm-related service industries 446
shall be accompanied by a fee of twenty-five dollars, except that 447
an application for a commercial driver's license or restricted 448
commercial driver's license received pursuant to division (A)(3) 449
of section 4506.14 of the Revised Code shall be accompanied by a 450
fee of eighteen dollars and seventy-five cents if the license will 451
expire on the licensee's birthday three years after the date of 452
issuance, a fee of twelve dollars and fifty cents if the license 453
will expire on the licensee's birthday two years after the date of 454
issuance, and a fee of six dollars and twenty-five cents if the 455
license will expire on the licensee's birthday one year after the 456
date of issuance. Each application for a duplicate commercial 457
driver's license shall be accompanied by a fee of ten dollars.458

       (2) In addition, the registrar of motor vehicles or deputy 459
registrar may collect and retain an additional fee of no more than 460
three dollars and fifty cents for each application for a 461
commercial driver's license temporary instruction permit, 462
commercial driver's license, renewal of a commercial driver's 463
license, or duplicate commercial driver's license received by the 464
registrar or deputy.465

       (B) In addition to the fees imposed under division (A) of 466
this section, the registrar of motor vehicles or deputy registrar 467
shall collect a fee of twelve dollars for each application for a 468
commercial driver's license temporary instruction permit, 469
commercial driver's license, or duplicate commercial driver's 470
license and for each application for renewal of a commercial 471
driver's license. The additional fee is for the purpose of 472
defraying the department of public safety's costs associated with 473
the administration and enforcement of the motor vehicle and 474
traffic laws of Ohio. 475

       (C) Commencing on October 1, 2009, if an application for a 476
commercial driver's license made by a person who previously held 477
such a license is not applied for within the period specified in 478
section 4506.14 of the Revised Code or within seven days after the 479
period so specified, the registrar or deputy registrar shall 480
collect a fee of twenty dollars for the issuance of the commercial 481
driver's license, but may waive the fee for good cause shown if 482
the application is accompanied by supporting evidence as the 483
registrar may require. The fee is in addition to all other fees 484
established by this section. A deputy registrar shall retain fifty 485
cents of the fee and shall transmit the remaining amount in 486
accordance with division (D) of this section.487

       (D) Each deputy registrar shall transmit the fees collected 488
under divisions (A)(1),and (B), and (C) of this section in the 489
time and manner prescribed by the registrar. The registrar shall 490
deposit all moneys received under division (D)(C) of this section 491
into the state highway safety fund established in section 4501.06 492
of the Revised Code.493

       (E)(D) Information regarding the driving record of any person 494
holding a commercial driver's license issued by this state shall 495
be furnished by the registrar, upon request and payment of a fee 496
of five dollars, to the employer or prospective employer of such a 497
person and to any insurer.498

       Of each five-dollar fee the registrar collects under this 499
division, the registrar shall pay two dollars into the state 500
treasury to the credit of the state bureau of motor vehicles fund 501
established in section 4501.25 of the Revised Code, sixty cents 502
into the state treasury to the credit of the trauma and emergency 503
medical services fund established in section 4513.263 of the 504
Revised Code, sixty cents into the state treasury to the credit of 505
the homeland security fund established in section 5502.03 of the 506
Revised Code, thirty cents into the state treasury to the credit 507
of the investigations fund established in section 5502.131 of the 508
Revised Code, one dollar and twenty-five cents into the state 509
treasury to the credit of the emergency management agency service 510
and reimbursement fund established in section 5502.39 of the 511
Revised Code, and twenty-five cents into the state treasury to the 512
credit of the justice program services fund established in section 513
5502.67 of the Revised Code.514

       Sec. 4507.23.  (A) Except as provided in division (J)(I) of 515
this section, each application for a temporary instruction permit 516
and examination shall be accompanied by a fee of five dollars.517

       (B) Except as provided in division (J)(I) of this section, 518
each application for a driver's license made by a person who 519
previously held such a license and whose license has expired not 520
more than two years prior to the date of application, and who is 521
required under this chapter to give an actual demonstration of the 522
person's ability to drive, shall be accompanied by a fee of three 523
dollars in addition to any other fees.524

       (C)(1) Except as provided in divisions (E) and (J)(I) of this 525
section, each application for a driver's license, or motorcycle 526
operator's endorsement, or renewal of a driver's license shall be 527
accompanied by a fee of six dollars. 528

       (2) Except as provided in division (J)(I) of this section, 529
each application for a duplicate driver's license shall be 530
accompanied by a fee of seven dollars and fifty cents. The 531
duplicate driver's licenses issued under this section shall be 532
distributed by the deputy registrar in accordance with rules 533
adopted by the registrar of motor vehicles.534

       (D) Except as provided in division (J)(I) of this section, 535
each application for a motorized bicycle license or duplicate 536
thereof shall be accompanied by a fee of two dollars and fifty 537
cents.538

       (E) Except as provided in division (J)(I) of this section, 539
each application for a driver's license or renewal of a driver's 540
license that will be issued to a person who is less than 541
twenty-one years of age shall be accompanied by whichever of the 542
following fees is applicable:543

       (1) If the person is sixteen years of age or older, but less 544
than seventeen years of age, a fee of seven dollars and 545
twenty-five cents;546

       (2) If the person is seventeen years of age or older, but 547
less than eighteen years of age, a fee of six dollars;548

       (3) If the person is eighteen years of age or older, but less 549
than nineteen years of age, a fee of four dollars and seventy-five 550
cents;551

       (4) If the person is nineteen years of age or older, but less 552
than twenty years of age, a fee of three dollars and fifty cents;553

       (5) If the person is twenty years of age or older, but less 554
than twenty-one years of age, a fee of two dollars and twenty-five 555
cents.556

       (F) Neither the registrar nor any deputy registrar shall 557
charge a fee in excess of one dollar and fifty cents for 558
laminating a driver's license, motorized bicycle license, or 559
temporary instruction permit identification cards as required by 560
sections 4507.13 and 4511.521 of the Revised Code. A deputy 561
registrar laminating a driver's license, motorized bicycle 562
license, or temporary instruction permit identification cards 563
shall retain the entire amount of the fee charged for lamination, 564
less the actual cost to the registrar of the laminating materials 565
used for that lamination, as specified in the contract executed by 566
the bureau for the laminating materials and laminating equipment. 567
The deputy registrar shall forward the amount of the cost of the 568
laminating materials to the registrar for deposit as provided in 569
this section.570

       (G) Except as provided in division (J)(I) of this section and 571
except for the renewal of a driver's license, commencing on 572
October 1, 2003, each transaction described in divisions (A), (B), 573
(C), (D), and (E) of this section shall be accompanied by an 574
additional fee of twelve dollars. A transaction involving the 575
renewal of a driver's license with an expiration date on or after 576
that date shall be accompanied by an additional fee of twelve 577
dollars. The additional fee is for the purpose of defraying the 578
department of public safety's costs associated with the 579
administration and enforcement of the motor vehicle and traffic 580
laws of Ohio.581

       (H) Except as provided in division (J) of this section, 582
commencing on October 1, 2009, if an application for a driver's 583
license or motorcycle operator's endorsement made by a person who 584
previously held such a license is not applied for within the 585
period specified in section 4507.09 of the Revised Code or within 586
seven days after the period so specified, the registrar or deputy 587
registrar shall collect a fee of twenty dollars for the issuance 588
of the driver's license or motorcycle endorsement, but may waive 589
the fee for good cause shown if the application is accompanied by 590
supporting evidence as the registrar may require. The fee shall be 591
in addition to all other fees established by this section. A 592
deputy registrar collecting this twenty dollar fee shall retain 593
fifty cents and send the remaining fee to the registrar as 594
specified in division (I) of this section.595

       (I) At the time and in the manner provided by section 4503.10 596
of the Revised Code, the deputy registrar shall transmit the fees 597
collected under divisions (A), (B), (C), (D), and (E), those 598
portions of the fees specified in and collected under division 599
(F), and the additional fee under divisionsdivision (G) and (H)600
of this section to the registrar. The registrar shall pay two 601
dollars and fifty cents of each fee collected under divisions (A), 602
(B), (C)(1) and (2), (D), and (E)(1) to (4) of this section, and 603
the entire fee collected under division (E)(5) of this section, 604
into the state highway safety fund established in section 4501.06 605
of the Revised Code, and such fees shall be used for the sole 606
purpose of supporting driver licensing activities. The registrar 607
also shall pay five dollars of each fee collected under division 608
(C)(2) of this section and the entire fee collected under 609
divisionsdivision (G) and (H) of this section into the state 610
highway safety fund created in section 4501.06 of the Revised 611
Code. The remaining fees collected by the registrar under this 612
section shall be paid into the state bureau of motor vehicles fund 613
established in section 4501.25 of the Revised Code.614

       (J)(I) A disabled veteran who has a service-connected 615
disability rated at one hundred per cent by the veterans' 616
administration may apply to the registrar or a deputy registrar 617
for the issuance to that veteran, without the payment of any fee 618
prescribed in this section, of any of the following items:619

       (1) A temporary instruction permit and examination;620

       (2) A new, renewal, or duplicate driver's or commercial 621
driver's license;622

       (3) A motorcycle operator's endorsement;623

       (4) A motorized bicycle license or duplicate thereof;624

       (5) The fee established in division (H) of this section;625

       (6) Lamination of a driver's license, motorized bicycle 626
license, or temporary instruction permit identification card as 627
provided in division (F) of this section, if the circumstances 628
specified in division (J)(6) of this section are met.629

       A disabled veteran whose driver's license, motorized bicycle 630
license, or temporary instruction permit identification card is 631
laminated by the registrar or deputy registrar is not required to 632
pay the registrar any lamination fee.633

       An application made under division (J)(I) of this section 634
shall be accompanied by such documentary evidence of disability as 635
the registrar may require by rule.636

       Section 2. That existing sections 4501.06, 4503.04, 4503.042, 637
4503.07, 4506.08, and 4507.23 of the Revised Code are hereby 638
repealed.639

       Section 3.  Not later than thirty days after the effective 640
date of this act, the Registrar of Motor Vehicles shall implement 641
a program to refund the twenty-dollar fee paid under division (O) 642
of section 4503.04, division (E) of section 4503.042, division (B) 643
of section 4503.07, division (C) of section 4506.08, and division 644
(H) of section 4507.23 of the Revised Code on and after October 9, 645
2009, as those divisions of those sections existed prior to the 646
effective date of this act.647

       A refund request shall be made not later than six months 648
after the effective date of this act, in writing, on a form 649
prescribed by the Registrar. Any refund request shall be supported 650
by evidence of the fee payment as the Registrar may require. If 651
the request and any required evidence submitted with the request 652
indicate that a refund is warranted, the Registrar promptly shall 653
approve and pay the refund in the full amount of the fee.654
