A BILL
To enact section 153.013 of the Revised Code to 1
require a building or structure constructed using 2
state capital budget moneys to adhere to certain 3
energy efficiency and building standards and to 4
encourage the use of Ohio-produced products. 5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 153.013 of the Revised Code be 6
enacted to read as follows: 7

       Sec. 153.013. (A) Any building or structure constructed using 8
any state capital budget moneys, including moneys from the 9
education facilities trust fund, shall meet both of the 10
following:11

       (1) Achieve at least one of the following building standards:12

       (a) Certification at the silver level or higher from the 13
leadership in energy and environmental design (LEED) green 14
building rating system developed by the U.S. green building 15
council;16

       (b) Certification at the two green globes level or higher 17
from the green globes environmental assessment and rating system 18
owned and operated in the United States by the green building 19
initiative;20

       (c) A design standard determined by the director of 21
administrative services to be a nationally recognized green 22
building rating standard equivalent to the standards listed in 23
divisions (A)(1)(a) and (b) of this section.24

       (2) Achieve at least one of the following energy efficiency 25
standards:26

       (a) Exceed by at least thirty per cent the most current 27
energy efficiency standards developed by the American society of 28
heating, refrigeration, and air conditioning engineers (ASHRAE);29

       (b) Achieve a national energy performance rating of not less 30
than seventy-seven using the energy star rating system developed 31
by the United States environmental protection agency as validated 32
by a professional engineer.33

       (B) With respect to the award of any contract for 34
construction of a building or structure using any state capital 35
budget moneys, including moneys from the education facilities 36
trust fund, reasonable efforts shall be made to use Ohio products 37
and materials and to recoup the costs of implementing the 38
requirements of this section over a period of not more than 39
twenty years as measured by reduced energy costs. 40

       (C) The following construction projects are exempt from the 41
requirements of this section:42

       (1) A building or structure that is less than five thousand 43
square feet;44

       (2) A building or structure that does not consume energy for 45
heating, ventilating, or air conditioning;46

       (3) A building or structure that has construction costs less 47
than five hundred thousand dollars.48

       (D) Except as otherwise provided by law, each state agency 49
overseeing the erection or construction of a building or 50
structure using any state capital budget moneys, including moneys 51
from the education facilities trust fund, shall oversee 52
compliance with this section.53

       (E) The director of administrative services may adopt rules 54
establishing the following:55

       (1) Waiver requirements and procedures pertaining to this 56
section;57

       (2) A process and criteria for recognizing green building 58
rating standards equivalent to the standards listed in divisions 59
(A)(1)(a) and (b) of this section, as required by division 60
(A)(1)(c) of this section.61
