A BILL
To enact section 1545.073 of the Revised Code to 1
authorize a park district's board of park 2
commissioners to create a building department for 3
building code enforcement purposes.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 1545.073 of the Revised Code be 5
enacted to read as follows:6

       Sec. 1545.073. (A) A board of park commissioners of a park 7
district may create a building department and employ the personnel 8
it determines necessary to administer and enforce this section. 9
The building department may enforce the state nonresidential 10
building code adopted pursuant to Chapter 3781. of the Revised 11
Code regarding any building existing or constructed on the park 12
district's property if the building department is certified 13
pursuant to section 3781.10 of the Revised Code to enforce that 14
code.15

       (B) The board may direct the building department, upon 16
certification, to exercise enforcement authority and to accept and 17
approve plans regarding any building existing or constructed on 18
the park district's property pursuant to sections 3781.10 and 19
3791.04 of the Revised Code for the class of building for which 20
the department and personnel are certified.21

       (C) Where a municipal, township, or county building 22
department is located within the same jurisdiction of a park 23
district building department certified to exercise enforcement 24
authority pursuant to sections 3781.10 and 3791.04 of the Revised 25
Code, the municipal, township, or county building department shall 26
not exercise its enforcement authority regarding any buildings 27
existing or constructed on the park district's property.28
