To amend sections 101.27 and 141.011 of the Revised | 1 |

administrative department heads by five per cent. | 4 |
Section 1. That sections 101.27 and 141.011 of the Revised | 5 |
Code be amended to read as follows: | 6 |
Sec. 101.27. (A)(1) Every member of the senate, except the | 7 |
members elected president, president pro tempore, assistant | 8 |
president pro tempore, majority whip, minority leader, assistant | 9 |
minority leader, minority whip, and assistant minority whip, shall | 10 |
receive as compensation a salary of fifty-one thousand six hundred | 11 |
seventy-four dollars a year during the senator's term of office. | 12 |
Every member of the house of representatives, except the members | 13 |
elected speaker, speaker pro tempore, majority floor leader, | 14 |
assistant majority floor leader, majority whip, assistant majority | 15 |
whip, minority leader, assistant minority leader, minority whip, | 16 |
and assistant minority whip, shall receive as compensation a | 17 |
salary of fifty-one thousand six hundred seventy-four dollars a | 18 |
year during the representative's term of office. Such salaries | 19 |
shall be paid in equal monthly installments during such term. All | 20 |
monthly payments shall be made on or before the fifth day of each | 21 |
month. Upon the death of any member of the general assembly | 22 |
during the member's term of office, any unpaid salary due such | 23 |
member for the remainder of the member's term shall be paid to the | 24 |
member's surviving spouse, children, mother, or father, in the | 25 |
order in which the relationship is set forth in this section in | 26 |
monthly installments. | 27 |
(2) Each member shall receive a travel reimbursement per mile | 28 |
each way, at the same mileage rate allowed for the reimbursement | 29 |
of travel expenses of state agents as provided by rule of the | 30 |
director of budget and management pursuant to division (B) of | 31 |
section 126.31 of the Revised Code, for mileage not more than once | 32 |
a week during the session for travel incurred by a member from and | 33 |
to the member's place of residence, by the most direct highway | 34 |
route of public travel to and from the seat of government, to be | 35 |
paid quarterly on the last day of March, June, September, and | 36 |
December of each year. | 37 |
(3) The member of the senate elected president and the member | 38 |
of the house of representatives elected speaker shall each receive | 39 |
as compensation a salary of eighty thousand five hundred | 40 |
forty-nine dollars a year during the president's or speaker's term | 41 |
of office. | 42 |
The member of the senate elected president pro tempore, the | 43 |
member of the senate elected minority leader, the member of the | 44 |
house of representatives elected speaker pro tempore, and the | 45 |
member of the house of representatives elected minority leader | 46 |
shall each receive as compensation a salary of seventy-three | 47 |
thousand four hundred ninety-three dollars a year during the | 48 |
member's term of office. The member of the house of | 49 |
representatives elected majority floor leader and the member of | 50 |
the senate elected assistant president pro tempore shall each | 51 |
receive as compensation a salary of sixty-nine thousand two | 52 |
hundred twenty-seven dollars a year during the member's term of | 53 |
office. The member of the senate elected assistant minority leader | 54 |
and the member of the house of representatives elected assistant | 55 |
minority leader shall each receive as compensation a salary of | 56 |
sixty-seven thousand ninety-nine dollars a year during the | 57 |
member's term of office. The member of the senate elected majority | 58 |
whip and the member of the house of representatives elected | 59 |
assistant majority floor leader shall each receive a salary of | 60 |
sixty-four thousand nine hundred sixty-seven dollars a year during | 61 |
the member's term of office. The member of the senate elected | 62 |
minority whip, the member of the house of representatives elected | 63 |
majority whip, and the member of the house of representatives | 64 |
elected minority whip shall each receive as compensation a salary | 65 |
of sixty thousand seven hundred six dollars a year during the | 66 |
member's term of office. The member of the house of | 67 |
representatives elected assistant majority whip shall receive as | 68 |
compensation a salary of fifty-six thousand four hundred | 69 |
forty-three dollars a year during the member's term of office. The | 70 |
member of the house of representatives elected assistant minority | 71 |
whip and the member of the senate elected assistant minority whip | 72 |
shall each receive a salary of fifty-four thousand sixty dollars a | 73 |
year during the member's term of office. | 74 |
(4) The chairperson of the finance committee of each house | 75 |
shall receive an additional sum of ten thousand dollars annually. | 76 |
The chairperson of each standing committee of each house other | 77 |
than the finance committee shall receive an additional sum of six | 78 |
thousand five hundred dollars annually. The chairperson of each | 79 |
standing subcommittee of a finance committee shall receive an | 80 |
additional sum of six thousand five hundred dollars annually. The | 81 |
vice-chairperson of the finance committee of each house shall | 82 |
receive an additional sum of five thousand five hundred dollars | 83 |
annually. The ranking minority member of the finance committee of | 84 |
each house shall receive an additional sum of six thousand five | 85 |
hundred dollars annually. The ranking minority member of each | 86 |
standing subcommittee of a finance committee shall receive an | 87 |
additional sum of five thousand dollars annually. The chairperson | 88 |
of each standing subcommittee of each house other than a standing | 89 |
subcommittee of the finance committee shall receive an additional | 90 |
sum of five thousand dollars annually. The vice-chairperson and | 91 |
ranking minority member of each standing committee of each house | 92 |
other than the finance committee shall each receive an additional | 93 |
sum of five thousand dollars annually. Except for the ranking | 94 |
minority member of each standing subcommittee of a finance | 95 |
committee, the ranking minority member of each standing | 96 |
subcommittee of each house shall receive an additional sum of two | 97 |
thousand five hundred dollars annually. | 98 |
No member may receive more than one additional sum for | 99 |
serving as chairperson, vice-chairperson, or ranking minority | 100 |
member of a standing committee or standing subcommittee, | 101 |
regardless of the number of standing committees or standing | 102 |
subcommittees on which the member serves as chairperson, | 103 |
vice-chairperson, or ranking minority member. | 104 |
(5) If a member is absent without leave, or is not excused on | 105 |
the member's return, there shall be deducted from the member's | 106 |
compensation twenty dollars for each day's absence. | 107 |
(B) Each calendar year from 2002 through 2008, the salary | 108 |
amounts under divisions (A)(1) and (3) of this section shall be | 109 |
increased by the lesser of the following: | 110 |
(1) Three per cent; | 111 |
(2) The percentage increase, if any, in the consumer price | 112 |
index over the twelve-month period that ends on the thirtieth day | 113 |
of September of the immediately preceding year, rounded to the | 114 |
nearest one-tenth of one per cent. | 115 |
(C) The salary amounts specified in divisions (A)(1) and (3) | 116 |
of this section as they have been increased under division (B) of | 117 |
this section and the additional sums specified in division (A)(4) | 118 |
of this section shall be reduced by five per cent. The changes to | 119 |
salary and additional sums made in this division apply only to | 120 |
members whose terms commence on or after January 1, 2011. | 121 |
(D) As used in this section: | 122 |
(1) "Consumer price index" means the consumer price index | 123 |
prepared by the United States bureau of labor statistics (U.S. | 124 |
city average for urban wage earners and clerical workers: all | 125 |
items, 1982-1984=100), or, if that index is no longer published, a | 126 |
generally available comparable index. | 127 |
(2) "Finance committee" means the finance committee of the | 128 |
senate and the finance-appropriations committee of the house of | 129 |
representatives. | 130 |
Sec. 141.011. Beginning in calendar year 2001, the annual | 131 |
salaries of the elective officers of the state shall be as follows | 132 |
rather than as prescribed by divisions (A) to (F) of section | 133 |
141.01 of the Revised Code: | 134 |
(A)(1) In calendar year 2001 the annual salary of the | 135 |
governor shall be one hundred twenty-six thousand four hundred | 136 |
ninety-seven dollars. | 137 |
(2) In calendar years 2002 through 2006 the annual salary of | 138 |
the governor shall be one hundred thirty thousand two hundred | 139 |
ninety-two dollars. | 140 |
(3) In calendar year 2007 the annual salary of the governor | 141 |
shall be the annual salary in 2006 increased by each of the | 142 |
following percentages in succession: | 143 |
(a) The lesser of three per cent or the percentage increase, | 144 |
if any, in the consumer price index from October 1, 2001, to | 145 |
September 30, 2002, rounded to the nearest one-tenth of one per | 146 |
cent; | 147 |
(b) The lesser of three per cent or the percentage increase, | 148 |
if any, in the consumer price index from October 1, 2002, to | 149 |
September 30, 2003, rounded to the nearest one-tenth of one per | 150 |
cent; | 151 |
(c) The lesser of three per cent or the percentage increase, | 152 |
if any, in the consumer price index from October 1, 2003, to | 153 |
September 30, 2004, rounded to the nearest one-tenth of one per | 154 |
cent; | 155 |
(d) The lesser of three per cent or the percentage increase, | 156 |
if any, in the consumer price index from October 1, 2004, to | 157 |
September 30, 2005, rounded to the nearest one-tenth of one per | 158 |
cent; | 159 |
(e) The lesser of three per cent or the percentage increase, | 160 |
if any, in the consumer price index from October 1, 2005, to | 161 |
September 30, 2006, rounded to the nearest one-tenth of one per | 162 |

(4) | 164 |
calendar year 2008 and thereafter, the annual salary of the | 165 |
governor shall be the annual salary in 2007 increased by the | 166 |
lesser of the following: | 167 |
(a) Three per cent; | 168 |
(b) The percentage increase, if any, in the consumer price | 169 |
index from October 1, 2006, to September 30, 2007, rounded to the | 170 |
nearest one-tenth of one per cent. | 171 |
(5) With respect to terms commencing on or after January 1, | 172 |
2011, the annual salary of the governor shall be the salary amount | 173 |
specified in division (A)(4) of this section reduced by five per | 174 |
cent. | 175 |
(B)(1) In calendar year 2001 the annual salary of the | 176 |
lieutenant governor shall be sixty-six thousand three hundred six | 177 |
dollars. | 178 |
(2) In calendar years 2002 through 2006 the annual salary of | 179 |
the lieutenant governor shall be sixty-eight thousand two hundred | 180 |
ninety-five dollars. | 181 |
(3) In calendar year 2007 the annual salary of the lieutenant | 182 |
governor shall be the annual salary in 2006 increased by each of | 183 |
the following percentages in succession: | 184 |
(a) The lesser of three per cent or the percentage increase, | 185 |
if any, in the consumer price index from October 1, 2001, to | 186 |
September 30, 2002, rounded to the nearest one-tenth of one per | 187 |
cent; | 188 |
(b) The lesser of three per cent or the percentage increase, | 189 |
if any, in the consumer price index from October 1, 2002, to | 190 |
September 30, 2003, rounded to the nearest one-tenth of one per | 191 |
cent; | 192 |
(c) The lesser of three per cent or the percentage increase, | 193 |
if any, in the consumer price index from October 1, 2003, to | 194 |
September 30, 2004, rounded to the nearest one-tenth of one per | 195 |
cent; | 196 |
(d) The lesser of three per cent or the percentage increase, | 197 |
if any, in the consumer price index from October 1, 2004, to | 198 |
September 30, 2005, rounded to the nearest one-tenth of one per | 199 |
cent; | 200 |
(e) The lesser of three per cent or the percentage increase, | 201 |
if any, in the consumer price index from October 1, 2005, to | 202 |
September 30, 2006, rounded to the nearest one-tenth of one per | 203 |

(4) | 205 |
calendar year 2008 and thereafter, the annual salary of the | 206 |
lieutenant governor shall be the annual salary in 2007 increased | 207 |
by the lesser of the following: | 208 |
(a) Three per cent; | 209 |
(b) The percentage increase, if any, in the consumer price | 210 |
index from October 1, 2006 to September 30, 2007, rounded to the | 211 |
nearest one-tenth of one per cent. | 212 |
(5) With respect to terms commencing on or after January 1, | 213 |
2011, the annual salary of the lieutenant governor shall be the | 214 |
salary amount specified in division (B)(4) of this section reduced | 215 |
by five per cent. | 216 |
(6) If the governor appoints the lieutenant governor as an | 217 |
administrative department head, the lieutenant governor may accept | 218 |
the salary for that office while serving as its head in lieu of | 219 |
the salary for the office of lieutenant governor. | 220 |
(C)(1) In calendar year 2001 the annual salary of the | 221 |
secretary of state, auditor of state, treasurer of state, and | 222 |
attorney general shall be ninety-three thousand four hundred | 223 |
forty-seven dollars. | 224 |
(2) In calendar year 2002 the annual salary of the secretary | 225 |
of state, auditor of state, treasurer of state, and attorney | 226 |
general shall be ninety-six thousand two hundred fifty dollars. | 227 |
(3) In each calendar year from 2003 through 2008, the annual | 228 |
salary of the secretary of state, auditor of state, treasurer of | 229 |
state, and attorney general shall be increased by the lesser of | 230 |
the following: | 231 |
(a) Three per cent; | 232 |
(b) The percentage increase, if any, in the consumer price | 233 |
index over the twelve-month period that ends on the thirtieth day | 234 |
of September of the immediately preceding year, rounded to the | 235 |
nearest one-tenth of one per cent. | 236 |
(D) Upon the death of an elected executive officer of the | 237 |
state listed in divisions (A) to (F) of section 141.01 of the | 238 |
Revised Code during that person's term of office, an amount shall | 239 |
be paid in accordance with section 2113.04 of the Revised Code, or | 240 |
to that person's estate. The amount shall equal the amount of the | 241 |
salary that the officer would have received during the remainder | 242 |
of the officer's unexpired term or an amount equal to the salary | 243 |
of that person's office for two years, whichever is less. | 244 |
(E) As used in this section, "consumer price index" has the | 245 |
same meaning as in section 101.27 of the Revised Code. | 246 |
Section 2. That existing sections 101.27 and 141.011 of the | 247 |
Revised Code are hereby repealed. | 248 |
Section 3. In calendar year 2010, the annual salary of the | 249 |
administrative department heads listed in section 121.03 of the | 250 |
Revised Code, the Adjutant General, the Chancellor of the Ohio | 251 |
Board of Regents, and the Director of the State Lottery Commission | 252 |
shall be the annual salary those persons were receiving as of July | 253 |
1, 2009, reduced by five per cent. | 254 |
