A BILL
To enact section 4933.29 of the Revised Code to 1
restore discounts for customers with all-electric 2
homes, to restore electric, load-management 3
programs, and to declare an emergency.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4933.29 of the Revised Code be 5
enacted to read as follows:6

       Sec. 4933.29. (A) As used in this section:7

        (1) "Dual fuel heating program" means a program under which 8
an electric light company provides an incentive, including a 9
discounted rate, for a customer to use a heating system that 10
operates on both electricity and gas, the electric portion of 11
which may be controlled by the company.12

        (2) "Electric light company" has the same meaning as in 13
section 4905.03 of the Revised Code.14

        (3) "Load management water heating program" means a program 15
under which an electric light company provides an incentive, 16
including a discounted rate, for a customer to use an electric 17
water heater that may be controlled by the company.18

        (B) Every electric light company that discontinued, during 19
the time period beginning one year before the effective date of 20
this section and ending on the effective date of this section, 21
discounts for residential customers with all-electric homes shall 22
restore all such discounts to the discount amounts at the time of 23
the discontinuance.24

       (C) Every electric light company that discontinued, during 25
the time period beginning one year before the effective date of 26
this section and ending on the effective date of this section, any 27
dual fuel heating program or any load management water heating 28
program shall restore in full any such discontinued program.29

       Section 2. This act is hereby declared to be an emergency 30
measure necessary for the immediate preservation of the public 31
peace, health, and safety. The reason for such necessity is that 32
electric-utility customers are experiencing sudden, drastic 33
increases in electricity costs during an economic recession. 34
Therefore, this act shall go into immediate effect.35
