A BILL
To amend section 3719.41 of the Revised Code to add 1
six synthetic derivatives of cathinone that have 2
been found in bath salts to the list of Schedule I 3
controlled substances.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3719.41 of the Revised Code be 5
amended to read as follows:6

       Sec. 3719.41.  Controlled substance schedules I, II, III, IV, 7
and V are hereby established, which schedules include the 8
following, subject to amendment pursuant to section 3719.43 or 9
3719.44 of the Revised Code.10

SCHEDULE I

       (A) Narcotics-opiates12

       Any of the following opiates, including their isomers, 13
esters, ethers, salts, and salts of isomers, esters, and ethers, 14
unless specifically excepted under federal drug abuse control 15
laws, whenever the existence of these isomers, esters, ethers, and 16

existence of these salts, isomers, and salts of isomers is 122
possible within the specific chemical designation. For the 123
purposes of this division only, "isomer" includes the optical 124
isomers, position isomers, and geometric isomers.125

       (1) Alpha-ethyltryptamine (some trade or other names: 126
etryptamine; Monase; alpha-ethyl-1H-indole-3-ethanamine; 127
3-(2-aminobutyl) indole; alpha-ET; and AET);128

       (2) 4-bromo-2,5-dimethoxyamphetamine (some trade or other 129
names: 4-bromo-2,5-dimethoxy-alpha-methyphenethylamine; 130

isomers. (Since nomenclature of these substances is not 189
internationally standardized, compounds of these structures, 190

salts, isomers, and salts of isomers is possible within the 218
specific chemical designation:219

       (1) Mecloqualone;220

       (E) Stimulants222

       Unless specifically excepted or unless listed in another 223
schedule, any material, compound, mixture, or preparation that 224
contains any quantity of the following substances having a 225
stimulant effect on the central nervous system, including their 226
salts, isomers, and salts of isomers:227

       (1) Aminorex (some other names: aminoxaphen; 228
2-amino-5-phenyl-2-oxazoline; or 229
4,5-dihydro-5-phenyl-2-oxazolamine);230

       (2) Cathinone (some trade or other names: 231
2-amino-1-phenyl-1-propanone, alpha-aminopropiophenone, 232

       (A) Narcotics-opium and opium derivatives248

       Unless specifically excepted under federal drug abuse control 249
laws or unless listed in another schedule, any of the following 250
substances whether produced directly or indirectly by extraction 251
from substances of vegetable origin, independently by means of 252
chemical synthesis, or by a combination of extraction and chemical 253
synthesis:254

       (1) Opium and opiate, and any salt, compound, derivative, or 255
preparation of opium or opiate, excluding apomorphine, 256
thebaine-derived butorphanol, dextrorphan, nalbuphine, nalmefene, 257
naloxone, and naltrexone, and their respective salts, but 258
including the following:259

       (a) Raw opium;260

       (b) Opium extracts;261

       (c) Opium fluid extracts;262

       (d) Powdered opium;263

       (F) Immediate precursors374

       Unless specifically excepted under federal drug abuse control 375
laws or unless listed in another schedule, any material, compound, 376
mixture, or preparation that contains any quantity of the 377
following substances:378

       (1) Immediate precursor to amphetamine and methamphetamine:379

       (a) Phenylacetone (some trade or other names: 380
phenyl-2-propanone; P2P; benzyl methyl ketone; methyl benzyl 381
ketone);382

       (2) Immediate precursors to phencyclidine (PCP):383

       (a) 1-phenylcyclohexylamine;384

       (b) 1-piperidinocyclohexanecarbonitrile (PCC).385

SCHEDULE III
386

       (A) Stimulants387

       Unless specifically excepted under federal drug abuse control 388
laws or unless listed in another schedule, any material, compound, 389
mixture, or preparation that contains any quantity of the 390
following substances having a stimulant effect on the central 391
nervous system, including their salts, their optical isomers, 392
position isomers, or geometric isomers, and salts of these 393
isomers, whenever the existence of these salts, isomers, and salts 394
of isomers is possible within the specific chemical designation:395

       (1) All stimulant compounds, mixtures, and preparations 396
included in schedule III pursuant to the federal drug abuse 397
control laws and regulations adopted under those laws;398

       (2) Benzphetamine;399

       (3) Chlorphentermine;400

       (4) Clortermine;401

       (5) Phendimetrazine.402

       (B) Depressants403

       Unless specifically excepted under federal drug abuse control 404
laws or unless listed in another schedule, any material, compound, 405
mixture, or preparation that contains any quantity of the 406
following substances having a depressant effect on the central 407
nervous system:408

       (1) Any compound, mixture, or preparation containing 409
amobarbital, secobarbital, pentobarbital, or any salt of any of 410
these drugs, and one or more other active medicinal ingredients 411
that are not listed in any schedule;412

       (2) Any suppository dosage form containing amobarbital, 413
secobarbital, pentobarbital, or any salt of any of these drugs and 414
approved by the food and drug administration for marketing only as 415
a suppository;416

       (3) Any substance that contains any quantity of a derivative 417
of barbituric acid or any salt of a derivative of barbituric acid;418

       (4) Chlorhexadol;419

       (5) Ketamine, its salts, isomers, and salts of isomers (some 420
other names for ketamine: 421
(+/-)-2-(2-chlorophenyl)-2-(methylamino)-cyclohexanone);422

       (6) Lysergic acid;423

       (7) Lysergic acid amide;424

       (8) Methyprylon;425

       (9) Sulfondiethylmethane;426

       (10) Sulfonethylmethane;427

       (11) Sulfonmethane;428

       (12) Tiletamine, zolazepam, or any salt of tiletamine or 429
zolazepam (some trade or other names for a tiletamine-zolazepam 430
combination product: Telazol); (some trade or other names for 431

       (C) Narcotic antidotes436

       (1) Nalorphine.437

       (D) Narcotics-narcotic preparations438

       Unless specifically excepted under federal drug abuse control 439
laws or unless listed in another schedule, any material, compound, 440
mixture, or preparation that contains any of the following 441
narcotic drugs, or their salts calculated as the free anhydrous 442
base or alkaloid, in limited quantities as set forth below:443

       (1) Not more than 1.8 grams of codeine per 100 milliliters or 444
not more than 90 milligrams per dosage unit, with an equal or 445
greater quantity of an isoquinoline alkaloid of opium;446

       (2) Not more than 1.8 grams of codeine per 100 milliliters or 447
not more than 90 milligrams per dosage unit, with one or more 448
active, nonnarcotic ingredients in recognized therapeutic amounts;449

       (3) Not more than 300 milligrams of dihydrocodeinone per 100 450
milliliters or not more than 15 milligrams per dosage unit, with a 451
fourfold or greater quantity of an isoquinoline alkaloid of opium;452

       (4) Not more than 300 milligrams of dihydrocodeinone per 100 453
milliliters or not more than 15 milligrams per dosage unit, with 454
one or more active, nonnarcotic ingredients in recognized 455
therapeutic amounts;456

       (5) Not more than 1.8 grams of dihydrocodeine per 100 457
milliliters or not more than 90 milligrams per dosage unit, with 458
one or more active, nonnarcotic ingredients in recognized 459
therapeutic amounts;460

       (6) Not more than 300 milligrams of ethylmorphine per 100 461
milliliters or not more than 15 milligrams per dosage unit, with 462
one or more active, nonnarcotic ingredients in recognized 463
therapeutic amounts;464

       (7) Not more than 500 milligrams of opium per 100 milliliters 465
or per 100 grams or not more than 25 milligrams per dosage unit, 466
with one or more active, nonnarcotic ingredients in recognized 467
therapeutic amounts;468

       (8) Not more than 50 milligrams of morphine per 100 469
milliliters or per 100 grams, with one or more active, nonnarcotic 470
ingredients in recognized therapeutic amounts.471

       (E) Anabolic steroids472

       Unless specifically excepted under federal drug abuse control 473
laws or unless listed in another schedule, any material, compound, 474
mixture, or preparation that contains any quantity of the 475
following substances, including their salts, esters, isomers, and 476
salts of esters and isomers, whenever the existence of these 477
salts, esters, and isomers is possible within the specific 478
chemical designation:479

       (1) Anabolic steroids. Except as otherwise provided in 480
division (E)(1) of schedule III, "anabolic steroids" means any 481
drug or hormonal substance that is chemically and 482
pharmacologically related to testosterone (other than estrogens, 483
progestins, and corticosteroids) and that promotes muscle growth. 484
"Anabolic steroids" does not include an anabolic steroid that is 485
expressly intended for administration through implants to cattle 486
or other nonhuman species and that has been approved by the United 487
States secretary of health and human services for that 488
administration, unless a person prescribes, dispenses, or 489
distributes this type of anabolic steroid for human use. "Anabolic 490
steroid" includes, but is not limited to, the following:491

       (a) Boldenone;492

       (b) Chlorotestosterone (4-chlortestosterone);493

       (c) Clostebol;494

       (d) Dehydrochlormethyltestosterone;495

(-)-delta-9-(trans)-tetrahydrocannabinol).529

       Narcotic drugs containing non-narcotic active medicinal 643
ingredients. Any compound, mixture, or preparation that contains 644
any of the following narcotic drugs, or their salts calculated as 645
the free anhydrous base or alkaloid, in limited quantities as set 646
forth below, and that includes one or more nonnarcotic active 647
medicinal ingredients in sufficient proportion to confer upon the 648
compound, mixture, or preparation valuable medicinal qualities 649
other than those possessed by narcotic drugs alone:650

       (1) Not more than 200 milligrams of codeine per 100 651
milliliters or per 100 grams;652

       (2) Not more than 100 milligrams of dihydrocodeine per 100 653
milliliters or per 100 grams;654

       (3) Not more than 100 milligrams of ethylmorphine per 100 655
milliliters or per 100 grams;656

       (4) Not more than 2.5 milligrams of diphenoxylate and not 657
less than 25 micrograms of atropine sulfate per dosage unit;658

       (5) Not more than 100 milligrams of opium per 100 milliliters 659
or per 100 grams;660

       (6) Not more than 0.5 milligram of difenoxin and not less 661
than 25 micrograms of atropine sulfate per dosage unit.662

       (C) Stimulants663

       Unless specifically exempted or excluded under federal drug 664
abuse control laws or unless listed in another schedule, any 665
material, compound, mixture, or preparation that contains any 666
quantity of the following substances having a stimulant effect on 667
the central nervous system, including their salts, isomers, and 668
salts of isomers:669

       (1) Ephedrine, except as provided in division (K) of section 670
3719.44 of the Revised Code;671

       (2) Pyrovalerone.672

       Section 2. That existing section 3719.41 of the Revised Code 673
is hereby repealed.674
