A BILL
To amend section 4501.21 and to enact section 1
4503.524 of the Revised Code to create the 2
"Massillon Tiger Football Booster Club" license 3
plate.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4501.21 be amended and section 5
4503.524 of the Revised Code be enacted to read as follows:6

       Sec. 4501.21.  (A) There is hereby created in the state 7
treasury the license plate contribution fund. The fund shall 8
consist of all contributions paid by motor vehicle registrants and 9
collected by the registrar of motor vehicles pursuant to sections 10
4503.491, 4503.493, 4503.494, 4503.496, 4503.498, 4503.499, 11
4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 4503.522, 12
4503.523, 4503.524, 4503.531, 4503.545, 4503.55, 4503.551, 13
4503.552, 4503.553, 4503.561, 4503.562, 4503.591, 4503.67, 14
4503.68, 4503.69, 4503.71, 4503.711, 4503.712, 4503.72, 4503.73, 15
4503.74, 4503.75, 4503.85, 4503.89, and 4503.92 of the Revised 16
Code. 17

       (B) The registrar shall pay the contributions the registrar 18
collects in the fund as follows: 19

        The registrar shall pay the contributions received pursuant 20
to section 4503.491 of the Revised Code to the breast cancer fund 21
of Ohio, which shall use that money only to pay for programs that 22
provide assistance and education to Ohio breast cancer patients 23
and that improve access for such patients to quality health care 24
and clinical trials and shall not use any of the money for 25
abortion information, counseling, services, or other 26
abortion-related activities. 27

        The registrar shall pay the contributions received pursuant 28
to section 4503.493 of the Revised Code to the autism society of 29
Ohio, which shall use the contributions for programs and autism 30
awareness efforts throughout the state. 31

       The registrar shall pay the contributions the registrar 32
receives pursuant to section 4503.494 of the Revised Code to the 33
national multiple sclerosis society for distribution in equal 34
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 35
chapters of the national multiple sclerosis society. These 36
chapters shall use the money they receive under this section to 37
assist in paying the expenses they incur in providing services 38
directly to their clients.39

       The registrar shall pay the contributions the registrar 40
receives pursuant to section 4503.496 of the Revised Code to the 41
Ohio sickle cell and health association, which shall use the 42
contributions to help support educational, clinical, and social 43
support services for adults who have sickle cell disease.44

       The registrar shall pay the contributions the registrar 45
receives pursuant to section 4503.498 of the Revised Code to 46
special olympics Ohio, inc., which shall use the contributions for 47
its programs, charitable efforts, and other activities. 48

       The registrar shall pay the contributions the registrar 49
receives pursuant to section 4503.499 of the Revised Code to the 50
children's glioma cancer foundation, which shall use the 51
contributions for its research and other programs. 52

        The registrar shall pay the contributions the registrar 53
receives pursuant to section 4503.50 of the Revised Code to the 54
future farmers of America foundation, which shall deposit the 55
contributions into its general account to be used for educational 56
and scholarship purposes of the future farmers of America 57
foundation. 58

        The registrar shall pay the contributions the registrar 59
receives pursuant to section 4503.501 of the Revised Code to the 60
4-H youth development program of the Ohio state university 61
extension program, which shall use those contributions to pay the 62
expenses it incurs in conducting its educational activities. 63

        The registrar shall pay the contributions received pursuant 64
to section 4503.502 of the Revised Code to the Ohio cattlemen's 65
foundation, which shall use those contributions for scholarships 66
and other educational activities. 67

       The registrar shall pay the contributions received pursuant 68
to section 4503.505 of the Revised Code to the organization Ohio 69
region phi theta kappa, which shall use those contributions for 70
scholarships for students who are members of that organization. 71

        The registrar shall pay each contribution the registrar 72
receives pursuant to section 4503.51 of the Revised Code to the 73
university or college whose name or marking or design appears on 74
collegiate license plates that are issued to a person under that 75
section. A university or college that receives contributions from 76
the fund shall deposit the contributions into its general 77
scholarship fund. 78

        The registrar shall pay the contributions the registrar 79
receives pursuant to section 4503.522 of the Revised Code to the 80
"friends of Perry's victory and international peace memorial, 81
incorporated," a nonprofit corporation organized under the laws of 82
this state, to assist that organization in paying the expenses it 83
incurs in sponsoring or holding charitable, educational, and 84
cultural events at the monument. 85

       The registrar shall pay the contributions the registrar 86
receives pursuant to section 4503.523 of the Revised Code to the 87
fairport lights foundation, which shall use the money to pay for 88
the restoration, maintenance, and preservation of the lighthouses 89
of fairport harbor. 90

       The registrar shall pay the contributions the registrar 91
receives pursuant to section 4503.524 of the Revised Code to the 92
Massillon tiger football booster club, which shall use the 93
contributions only to promote and support the football team of 94
Washington high school of the Massillon city school district.95

       The registrar shall pay the contributions the registrar 96
receives pursuant to section 4503.531 of the Revised Code to the 97
thank you foundation, incorporated, a nonprofit corporation 98
organized under the laws of this state, to assist that 99
organization in paying for the charitable activities and programs 100
it sponsors in support of United States military personnel, 101
veterans, and their families.102

        The registrar shall pay the contributions the registrar 103
receives pursuant to section 4503.55 of the Revised Code to the 104
pro football hall of fame, which shall deposit the contributions 105
into a special bank account that it establishes and which shall be 106
separate and distinct from any other account the pro football hall 107
of fame maintains, to be used exclusively for the purpose of 108
promoting the pro football hall of fame as a travel destination. 109

        The registrar shall pay the contributions that are paid to 110
the registrar pursuant to section 4503.545 of the Revised Code to 111
the national rifle association foundation, which shall use the 112
money to pay the costs of the educational activities and programs 113
the foundation holds or sponsors in this state. 114

        The registrar shall pay to the Ohio pet fund the 115
contributions the registrar receives pursuant to section 4503.551 116
of the Revised Code and any other money from any other source, 117
including donations, gifts, and grants, that is designated by the 118
source to be paid to the Ohio pet fund. The Ohio pet fund shall 119
use the moneys it receives under this section to support programs 120
for the sterilization of dogs and cats and for educational 121
programs concerning the proper veterinary care of those animals, 122
and for expenses of the Ohio pet fund that are reasonably 123
necessary for it to obtain and maintain its tax-exempt status and 124
to perform its duties. 125

        The registrar shall pay the contributions the registrar 126
receives pursuant to section 4503.552 of the Revised Code to the 127
rock and roll hall of fame and museum, incorporated. 128

        The registrar shall pay the contributions the registrar 129
receives pursuant to section 4503.553 of the Revised Code to the 130
Ohio coalition for animals, incorporated, a nonprofit corporation. 131
Except as provided in division (B) of this section, the coalition 132
shall distribute the money to its members, and the members shall 133
use the money only to pay for educational, charitable, and other 134
programs of each coalition member that provide care for unwanted, 135
abused, and neglected horses. The Ohio coalition for animals may 136
use a portion of the money to pay for reasonable marketing costs 137
incurred in the design and promotion of the license plate and for 138
administrative costs incurred in the disbursement and management 139
of funds received under this section. 140

        The registrar shall pay the contributions the registrar 141
receives pursuant to section 4503.561 of the Revised Code to the 142
state of Ohio chapter of ducks unlimited, inc., which shall 143
deposit the contributions into a special bank account that it 144
establishes. The special bank account shall be separate and 145
distinct from any other account the state of Ohio chapter of ducks 146
unlimited, inc., maintains and shall be used exclusively for the 147
purpose of protecting, enhancing, restoring, and managing wetlands 148
and conserving wildlife habitat. The state of Ohio chapter of 149
ducks unlimited, inc., annually shall notify the registrar in 150
writing of the name, address, and account to which such payments 151
are to be made. 152

        The registrar shall pay the contributions the registrar 153
receives pursuant to section 4503.562 of the Revised Code to the 154
Mahoning river consortium, which shall use the money to pay the 155
expenses it incurs in restoring and maintaining the Mahoning river 156
watershed. 157

        The registrar shall pay to a sports commission created 158
pursuant to section 4503.591 of the Revised Code each contribution 159
the registrar receives under that section that an applicant pays 160
to obtain license plates that bear the logo of a professional 161
sports team located in the county of that sports commission and 162
that is participating in the license plate program pursuant to 163
division (E) of that section, irrespective of the county of 164
residence of an applicant. 165

        The registrar shall pay to a community charity each 166
contribution the registrar receives under section 4503.591 of the 167
Revised Code that an applicant pays to obtain license plates that 168
bear the logo of a professional sports team that is participating 169
in the license plate program pursuant to division (G) of that 170
section. 171

        The registrar shall pay the contributions the registrar 172
receives pursuant to section 4503.67 of the Revised Code to the 173
Dan Beard council of the boy scouts of America. The council shall 174
distribute all contributions in an equitable manner throughout the 175
state to regional councils of the boy scouts. 176

        The registrar shall pay the contributions the registrar 177
receives pursuant to section 4503.68 of the Revised Code to the 178
great river council of the girl scouts of the United States of 179
America. The council shall distribute all contributions in an 180
equitable manner throughout the state to regional councils of the 181
girl scouts. 182

        The registrar shall pay the contributions the registrar 183
receives pursuant to section 4503.69 of the Revised Code to the 184
Dan Beard council of the boy scouts of America. The council shall 185
distribute all contributions in an equitable manner throughout the 186
state to regional councils of the boy scouts. 187

        The registrar shall pay the contributions the registrar 188
receives pursuant to section 4503.71 of the Revised Code to the 189
fraternal order of police of Ohio, incorporated, which shall 190
deposit the fees into its general account to be used for purposes 191
of the fraternal order of police of Ohio, incorporated. 192

        The registrar shall pay the contributions the registrar 193
receives pursuant to section 4503.711 of the Revised Code to the 194
fraternal order of police of Ohio, incorporated, which shall 195
deposit the contributions into an account that it creates to be 196
used for the purpose of advancing and protecting the law 197
enforcement profession, promoting improved law enforcement 198
methods, and teaching respect for law and order. 199

       The registrar shall pay the contributions received pursuant 200
to section 4503.712 of the Revised Code to Ohio concerns of police 201
survivors, which shall use those contributions to provide whatever 202
assistance may be appropriate to the families of Ohio law 203
enforcement officers who are killed in the line of duty. 204

       The registrar shall pay the contributions the registrar 205
receives pursuant to section 4503.72 of the Revised Code to the 206
organization known on March 31, 2003, as the Ohio CASA/GAL 207
association, a private, nonprofit corporation organized under 208
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 209
shall use these contributions to pay the expenses it incurs in 210
administering a program to secure the proper representation in the 211
courts of this state of abused, neglected, and dependent children, 212
and for the training and supervision of persons participating in 213
that program. 214

        The registrar shall pay the contributions the registrar 215
receives pursuant to section 4503.73 of the Revised Code to Wright 216
B. Flyer, incorporated, which shall deposit the contributions into 217
its general account to be used for purposes of Wright B. Flyer, 218
incorporated. 219

       The registrar shall pay the contributions the registrar 220
receives pursuant to section 4503.74 of the Revised Code to the 221
Columbus zoological park association, which shall disburse the 222
moneys to Ohio's major metropolitan zoos, as defined in section 223
4503.74 of the Revised Code, in accordance with a written 224
agreement entered into by the major metropolitan zoos. 225

       The registrar shall pay the contributions the registrar 226
receives pursuant to section 4503.75 of the Revised Code to the 227
rotary foundation, located on March 31, 2003, in Evanston, 228
Illinois, to be placed in a fund known as the permanent fund and 229
used to endow educational and humanitarian programs of the rotary 230
foundation. 231

        The registrar shall pay the contributions the registrar 232
receives pursuant to section 4503.85 of the Revised Code to the 233
Ohio sea grant college program to be used for Lake Erie area 234
research projects. 235

       The registrar shall pay the contributions the registrar 236
receives pursuant to section 4503.89 of the Revised Code to the 237
American red cross of greater Columbus on behalf of the Ohio 238
chapters of the American red cross, which shall use the 239
contributions for disaster readiness, preparedness, and response 240
programs on a statewide basis.241

       The registrar shall pay the contributions received pursuant 242
to section 4503.92 of the Revised Code to support our troops, 243
incorporated, a national nonprofit corporation, which shall use 244
those contributions in accordance with its articles of 245
incorporation and for the benefit of servicemembers of the armed 246
forces of the United States and their families when they are in 247
financial need. 248

       (C) All investment earnings of the license plate contribution 249
fund shall be credited to the fund. Not later than the first day 250
of May of every year, the registrar shall distribute to each 251
entity described in division (B) of this section the investment 252
income the fund earned the previous calendar year. The amount of 253
such a distribution paid to an entity shall be proportionate to 254
the amount of money the entity received from the fund during the 255
previous calendar year. 256

       Sec. 4503.524.  (A) The owner or lessee of any passenger car, 257
noncommercial motor vehicle, recreational vehicle, or other 258
vehicle of a class approved by the registrar of motor vehicles may 259
apply to the registrar for the registration of the vehicle and 260
issuance of "Massillon tiger football booster club" license 261
plates. The application for "Massillon tiger football booster 262
club" license plates may be combined with a request for a special 263
reserved license plate under section 4503.40 or 4503.42 of the 264
Revised Code. Upon receipt of the completed application and 265
compliance with division (B) of this section, the registrar shall 266
issue to the applicant the appropriate vehicle registration and a 267
set of "Massillon tiger football booster club" license plates with 268
a validation sticker or a validation sticker alone when required 269
by section 4503.191 of the Revised Code. In addition to the 270
letters and numbers ordinarily inscribed thereon, "Massillon tiger 271
football booster club" license plates shall be inscribed with 272
words and markings selected and designed by the Massillon tiger 273
football booster club and approved by the registrar. "Massillon 274
tiger football booster club" license plates shall bear county 275
identification stickers that identify the county of registration 276
by name or number.277

       (B) "Massillon tiger football booster club" license plates 278
and validation stickers shall be issued upon payment of the 279
regular license tax as prescribed under section 4503.04 of the 280
Revised Code, any applicable motor vehicle tax levied under 281
Chapter 4504. of the Revised Code, a bureau of motor vehicles 282
administrative fee of ten dollars, the contribution specified in 283
division (C) of this section, and compliance with all other 284
applicable laws relating to the registration of motor vehicles. If 285
the application for "Massillon tiger football booster club" 286
license plates is combined with a request for a special reserved 287
license plate under section 4503.40 or 4503.42 of the Revised 288
Code, the license plates and validation sticker shall be issued 289
upon payment of the contribution, fees, and taxes contained in 290
this division and the additional fee prescribed under section 291
4503.40 or 4503.42 of the Revised Code.292

       (C) For each application for registration and registration 293
renewal submitted under this section, the registrar shall collect 294
a contribution of twenty-five dollars. The registrar shall 295
transmit this contribution to the treasurer of state for deposit 296
into the license plate contribution fund created in section 297
4501.21 of the Revised Code.298

       The registrar shall deposit the ten-dollar bureau 299
administrative fee, the purpose of which is to compensate the 300
bureau for additional services required in issuing "Massillon 301
tiger football booster club" license plates, into the state bureau 302
of motor vehicles fund created in section 4501.25 of the Revised 303
Code.304

       Section 2.  That existing section 4501.21 of the Revised Code 305
is hereby repealed.306
