A BILL
To amend section 2927.12 of the Revised Code to 1
rename the offense of ethnic intimidation identity 2
intimidation and to prohibit a person from 3
committing identity intimidation because of the 4
victim's ethnicity, sexual orientation, gender, 5
gender identity, or disability.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 2927.12 of the Revised Code be 7
amended to read as follows:8

       Sec. 2927.12.  (A) No person shall violate section 2903.21, 9
2903.22, 2909.06, or 2909.07, or division (A)(3), (4), or (5) of 10
section 2917.21 of the Revised Code by reason of the race, color, 11
religion, or national origin, ethnicity, sexual orientation, 12
gender, identity, or disability of another person or group of 13
persons.14

       (B) Whoever violates this section is guilty of ethnic15
identity intimidation. EthnicIdentity intimidation is an offense 16
of the next higher degree than the offense the commission of which 17
is a necessary element of ethnicidentity intimidation.18

       (C) As used in this section:19

        (1) "Disability" has the same meaning as in section 4112.01 20
of the Revised Code.21

       (2) "Gender identity" means a person's actual or perceived 22
gender-related identity, appearance, mannerisms, or other 23
gender-related characteristics, with or without regard to the 24
person's designated sex at birth.25

        (3) "Sexual orientation" means heterosexuality, 26
homosexuality, or bisexuality, whether actual or perceived.27

       Section 2. That existing section 2927.12 of the Revised Code 28
is hereby repealed.29
