To enact section 2907.13 of the Revised Code to make | 1 |
bestiality a criminal offense. | 2 |
Section 1. That section 2907.13 of the Revised Code be | 3 |
enacted to read as follows: | 4 |
Sec. 2907.13. (A) No person shall knowingly do any of the | 5 |
following: | 6 |
(1) Engage in sexual conduct with an animal or engage in | 7 |
sexual contact with an animal; | 8 |
(2) Cause, aid, or abet another person to engage in sexual | 9 |
conduct with an animal or to engage in sexual contact with an | 10 |
animal; | 11 |
(3) Permit sexual conduct with an animal or sexual contact | 12 |
with an animal to be engaged in on property under the person's | 13 |
control. | 14 |
(B) Whoever violates this section is guilty of engaging in an | 15 |
act of bestiality. Engaging in an act of bestiality is a felony of | 16 |
the fifth degree on the first offense and a felony of the fourth | 17 |
degree on each subsequent offense. | 18 |
(C) If a court has reasonable grounds to believe that a | 19 |
violation of this section has occurred, the court may order the | 20 |
seizure of all animals involved in the alleged violation as a | 21 |
condition of bond of a person charged with the violation. | 22 |
(D) In addition to any penalty imposed under Chapter 2929. of | 23 |
the Revised Code for a violation of this section, the court may | 24 |
order an offender who violates this section to do any of the | 25 |
following: | 26 |
(1) Not harbor animals, own animals, or reside in any | 27 |
household in which animals are present; | 28 |
(2) Participate in appropriate counseling at the offender's | 29 |
expense; | 30 |
(3) Reimburse an animal shelter or humane society for the | 31 |
reasonable costs incurred for the care and maintenance of any | 32 |
animal taken to the animal shelter or humane society as a result | 33 |
of the offender's violation of this section. | 34 |
(E) Nothing in this section prohibits accepted animal | 35 |
husbandry practices or accepted veterinary medical practices by a | 36 |
licensed veterinarian or registered veterinary technician. | 37 |
(F) As used in this section: | 38 |
(1) "Animal" means every creature, either alive or dead, | 39 |
other than a human being. | 40 |
(2) "Sexual contact with an animal" means any of the | 41 |
following actions taken by a person for the purpose of sexual | 42 |
gratification or sexual arousal: | 43 |
(a) Touching or fondling, either directly or through | 44 |
clothing, of the sex organ, genitals, or anus of an animal; | 45 |
(b) Making contact, however slight, between the mouth, sex | 46 |
organ, genitals, or anus of the person and the mouth, sex organ, | 47 |
genitals, or anus of an animal. | 48 |
(3) "Sexual conduct with an animal" means any of the | 49 |
following acts taken by a person for the purpose of sexual | 50 |
gratification or sexual arousal: | 51 |
(a) The penetration, however slight, of any part of the body | 52 |
of the person into the sex organs, genitals, or anus of an animal; | 53 |
(b) The insertion, however slight, of any instrument, | 54 |
apparatus, or other object into the sex organs, genitals, or anus | 55 |
of an animal; | 56 |
(c) Transferring or transmitting semen upon any part of an | 57 |
animal. | 58 |
