A BILL
To amend section 3333.07 and to enact section 3333.43 1
of the Revised Code to require the Chancellor of 2
the Ohio Board of Regents to establish standards 3
and protocols for approving career-technical 4
planning districts to award associate degrees.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 3333.07 be amended and section 6
3333.43 of the Revised Code be enacted to read as follows:7

       Sec. 3333.07.  (A) Colleges, universities, and other 8
institutions of higher education which receive state assistance, 9
but are not supported primarily by the state, shall submit to the 10
chancellor of the Ohio board of regents such accounting of the 11
expenditure of state funds at such time and in such form as the 12
chancellor prescribes.13

       (B) No state institution of higher education shall establish 14
a new branch or academic center without the approval of the 15
chancellor.16

       (C) No state institution of higher education shall offer a 17
new degree or establish a new degree program without the approval 18
of the chancellor. NoExcept as provided in section 3333.43 of the 19
Revised Code, no degree approval shall be given for a technical 20
education program unless such program is offered by a state 21
assisted university, a university branch, a technical college, or 22
a community college.23

       (D) Any state college, university, or other state assisted 24
institution of higher education not complying with a 25
recommendation of the chancellor pursuant to division (F) or (G) 26
of section 3333.04 of the Revised Code shall so notify the 27
chancellor in writing within one hundred twenty days after receipt 28
of the recommendation, stating the reasons why it cannot or should 29
not comply.30

       (E) The officers, trustees, and employees of all institutions 31
of higher education which are state supported or state assisted 32
shall cooperate with the chancellor in supplying information 33
regarding their institutions, and advising and assisting the 34
chancellor on matters of higher education in this state in every 35
way possible when so requested by the chancellor.36

       (F) Persons associated with the public school systems in this 37
state, personnel of the state department of education, and members 38
of the state board of education shall provide such data about high 39
school students as are requested by the chancellor to aid in the 40
development of state higher education plans.41

       Sec. 3333.43. (A) As used in this section, "career-technical 42
planning district" means a school district or group of school 43
districts designated by the department of education as being 44
responsible for the planning for and provision of career-technical 45
education services to students within the district or group.46

       (B) The chancellor of the Ohio board of regents shall 47
establish standards and protocols by which the chancellor shall 48
approve career-technical planning districts to award associate 49
degrees to graduating high school students, and to adult learners, 50
who successfully complete courses of study that are substantially 51
similar to associate degree programs of community colleges, state 52
community colleges, and technical colleges. The standards and 53
protocols shall include:54

       (1) Specification of the types of associate degrees that 55
career-technical planning districts may offer;56

       (2) Minimum requirements for courses awarding credit toward 57
an associate degree;58

       (3) Qualifications that a career-technical planning district 59
must meet, including accreditation requirements for each type of 60
associate degree authorized. 61

       (C) A career-technical planning district seeking approval to 62
issue associate degrees shall apply to the chancellor for approval 63
in the manner prescribed by the chancellor. Each district 64
receiving approval shall file an annual report with the chancellor 65
in the form and containing the information prescribed by the 66
chancellor.67

       (D) The chancellor shall adopt a rule in accordance with 68
Chapter 119. of the Revised Code establishing fees to pay the cost 69
of reviewing an application from a career-technical planning 70
district for approval to award associate degrees, which the 71
district shall pay when it applies for approval, and establishing 72
fees that a district shall pay for any further reviews the 73
chancellor determines necessary after examining a district's 74
annual report.75

       (E) The chancellor shall establish criteria, policies, and 76
procedures that enable students to transfer courses completed 77
through an associate degree program offered by a career-technical 78
planning district to a state institution of higher education 79
without unnecessary duplication or institutional barriers.80

       Section 2. That existing section 3333.07 of the Revised Code 81
is hereby repealed.82
