A BILL
To amend sections 1901.01, 1901.02, 1901.03, 1901.07, 1
1901.08, and 1907.11 of the Revised Code to 2
abolish the Trumbull County County Court, to 3
create the Trumbull County Municipal Court, and to 4
provide that the judge of the Trumbull County 5
Municipal Court be nominated by petition.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 1901.01, 1901.02, 1901.03, 1901.07, 7
1901.08, and 1907.11 of the Revised Code be amended to read as 8
follows:9

       Sec. 1901.01.  (A) There is hereby established a municipal 10
court in each of the following municipal corporations:11

       Akron, Alliance, Ashland, Ashtabula, Athens, Avon Lake, 12
Barberton, Bedford, Bellefontaine, Bellevue, Berea, Bowling Green, 13
Bryan, Bucyrus, Cambridge, Campbell, Canton, Carrollton, Celina, 14
Chardon, Chesapeake, Chillicothe, Cincinnati, Circleville, 15
Cleveland, Cleveland Heights, Columbus, Conneaut, Coshocton, 16
Cuyahoga Falls, Dayton, Defiance, Delaware, East Cleveland, East 17
Liverpool, Eaton, Elyria, Euclid, Fairborn, Fairfield, Findlay, 18
Fostoria, Franklin, Fremont, Gallipolis, Garfield Heights, 19
Georgetown, Girard, Greenville, Hamilton, Hillsboro, Huron, 20
Ironton, Jackson, Kenton, Kettering, Lakewood, Lancaster, Lebanon, 21
Lima, Logan, London, Lorain, Lyndhurst, Mansfield, Marietta, 22
Marion, Marysville, Mason, Massillon, Maumee, Medina, Mentor, 23
Miamisburg, Middletown, Millersburg, Mount Gilead, Mount Vernon, 24
Napoleon, Newark, New Philadelphia, Newton Falls, Niles, Norwalk, 25
Oakwood, Oberlin, Oregon, Ottawa, Painesville, Parma, Perrysburg, 26
Port Clinton, Portsmouth, Ravenna, Rocky River, Sandusky, Shaker 27
Heights, Shelby, Sidney, South Euclid, Springfield, Steubenville, 28
Struthers, Sylvania, Tiffin, Toledo, Troy, Upper Sandusky, Urbana, 29
Vandalia, Van Wert, Vermilion, Wadsworth, Wapakoneta, Warren, City 30
of Washington in Fayette county, to be known as Washington Court 31
House, Willoughby, Wilmington, Wooster, Xenia, Youngstown, and 32
Zanesville.33

       (B) There is hereby established a municipal court within 34
Clermont county in Batavia or in any other municipal corporation 35
or unincorporated territory within Clermont county that is 36
selected by the legislative authority of the Clermont county 37
municipal court. The municipal court established by this division 38
is a continuation of the municipal court previously established in 39
Batavia by this section before the enactment of this division.40

       (C) There is hereby established a municipal court within 41
Columbiana county in Lisbon or in any other municipal corporation 42
or unincorporated territory within Columbiana county, except the 43
municipal corporation of East Liverpool or Liverpool or St. Clair 44
township, that is selected by the judges of the municipal court 45
pursuant to division (I) of section 1901.021 of the Revised Code.46

       (D) Effective January 1, 2008, there is hereby established a 47
municipal court within Erie county in Milan or in any other 48
municipal corporation or unincorporated territory within Erie 49
county that is within the territorial jurisdiction of the Erie 50
county municipal court and is selected by the legislative 51
authority of that court.52

       (E) The Cuyahoga Falls municipal court shall remain in 53
existence until December 31, 2008, and shall be replaced by the 54
Stow municipal court on January 1, 2009.55

       (F) Effective January 1, 2009, there is hereby established a 56
municipal court in the municipal corporation of Stow.57

       (G) Effective July 1, 2010, there is hereby established a 58
municipal court within Montgomery county in any municipal 59
corporation or unincorporated territory within Montgomery county, 60
except the municipal corporations of Centerville, Clayton, Dayton, 61
Englewood, Germantown, Kettering, Miamisburg, Moraine, Oakwood, 62
Union, Vandalia, and West Carrollton and Butler, German, Harrison, 63
Miami, and Washington townships, that is selected by the 64
legislative authority of that court.65

       (H) Effective January 1, 2013, there is hereby established a 66
municipal court within Trumbull county in any municipal 67
corporation or unincorporated territory within Trumbull county, 68
except the municipal corporations of Girard, McDonald, Newton 69
Falls, Niles, and Warren and Bloomfield, Braceville, Bristol, 70
Champion, Farmington, Howland, Hubbard, Liberty, Lordstown, 71
Mesopotamia, Newton, Southington, Vienna, Warren, and 72
Weathersfield townships, that is selected by the legislative 73
authority of that court.74

       Sec. 1901.02.  (A) The municipal courts established by 75
section 1901.01 of the Revised Code have jurisdiction within the 76
corporate limits of their respective municipal corporations, or, 77
for the Clermont county municipal court, the Columbiana county 78
municipal court, and, effective January 1, 2008, the Erie county 79
municipal court, within the municipal corporation or 80
unincorporated territory in which they are established, and are 81
courts of record. Each of the courts shall be styled 82
".................................. municipal court," inserting 83
the name of the municipal corporation, except the following 84
courts, which shall be styled as set forth below:85

       (1) The municipal court established in Chesapeake that shall 86
be styled and known as the "Lawrence county municipal court";87

       (2) The municipal court established in Cincinnati that shall 88
be styled and known as the "Hamilton county municipal court";89

       (3) The municipal court established in Ravenna that shall be 90
styled and known as the "Portage county municipal court";91

       (4) The municipal court established in Athens that shall be 92
styled and known as the "Athens county municipal court";93

       (5) The municipal court established in Columbus that shall be 94
styled and known as the "Franklin county municipal court";95

       (6) The municipal court established in London that shall be 96
styled and known as the "Madison county municipal court";97

       (7) The municipal court established in Newark that shall be 98
styled and known as the "Licking county municipal court";99

       (8) The municipal court established in Wooster that shall be 100
styled and known as the "Wayne county municipal court";101

       (9) The municipal court established in Wapakoneta that shall 102
be styled and known as the "Auglaize county municipal court";103

       (10) The municipal court established in Troy that shall be 104
styled and known as the "Miami county municipal court";105

       (11) The municipal court established in Bucyrus that shall be 106
styled and known as the "Crawford county municipal court";107

       (12) The municipal court established in Logan that shall be 108
styled and known as the "Hocking county municipal court";109

       (13) The municipal court established in Urbana that shall be 110
styled and known as the "Champaign county municipal court";111

       (14) The municipal court established in Jackson that shall be 112
styled and known as the "Jackson county municipal court";113

       (15) The municipal court established in Springfield that 114
shall be styled and known as the "Clark county municipal court";115

       (16) The municipal court established in Kenton that shall be 116
styled and known as the "Hardin county municipal court";117

       (17) The municipal court established within Clermont county 118
in Batavia or in any other municipal corporation or unincorporated 119
territory within Clermont county that is selected by the 120
legislative authority of that court that shall be styled and known 121
as the "Clermont county municipal court";122

       (18) The municipal court established in Wilmington that, 123
beginning July 1, 1992, shall be styled and known as the "Clinton 124
county municipal court";125

       (19) The municipal court established in Port Clinton that 126
shall be styled and known as "the Ottawa county municipal court";127

       (20) The municipal court established in Lancaster that, 128
beginning January 2, 2000, shall be styled and known as the 129
"Fairfield county municipal court";130

       (21) The municipal court established within Columbiana county 131
in Lisbon or in any other municipal corporation or unincorporated 132
territory selected pursuant to division (I) of section 1901.021 of 133
the Revised Code, that shall be styled and known as the 134
"Columbiana county municipal court";135

       (22) The municipal court established in Georgetown that, 136
beginning February 9, 2003, shall be styled and known as the 137
"Brown county municipal court";138

       (23) The municipal court established in Mount Gilead that, 139
beginning January 1, 2003, shall be styled and known as the 140
"Morrow county municipal court";141

       (24) The municipal court established in Greenville that, 142
beginning January 1, 2005, shall be styled and known as the "Darke 143
county municipal court";144

       (25) The municipal court established in Millersburg that, 145
beginning January 1, 2007, shall be styled and known as the 146
"Holmes county municipal court";147

       (26) The municipal court established in Carrollton that, 148
beginning January 1, 2007, shall be styled and known as the 149
"Carroll county municipal court";150

       (27) The municipal court established within Erie county in 151
Milan or established in any other municipal corporation or 152
unincorporated territory that is within Erie county, is within the 153
territorial jurisdiction of that court, and is selected by the 154
legislative authority of that court that, beginning January 1, 155
2008, shall be styled and known as the "Erie county municipal 156
court";157

       (28) The municipal court established in Ottawa that, 158
beginning January 1, 2011, shall be styled and known as the 159
"Putnam county municipal court";160

       (29) The municipal court established within Montgomery county 161
in any municipal corporation or unincorporated territory within 162
Montgomery county, except the municipal corporations of 163
Centerville, Clayton, Dayton, Englewood, Germantown, Kettering, 164
Miamisburg, Moraine, Oakwood, Union, Vandalia, and West Carrollton 165
and Butler, German, Harrison, Miami, and Washington townships, 166
that is selected by the legislative authority of that court and 167
that, beginning July 1, 2010, shall be styled and known as the 168
"Montgomery county municipal court";169

       (30) The municipal court established within Trumbull county 170
in any municipal corporation or unincorporated territory within 171
Trumbull county, except the municipal corporations of Girard, 172
McDonald, Newton Falls, Niles, and Warren and Bloomfield, 173
Braceville, Bristol, Champion, Farmington, Howland, Hubbard, 174
Liberty, Lordstown, Mesopotamia, Newton, Southington, Vienna, 175
Warren, and Weathersfield townships that is selected by the 176
legislative authority of that court and that, beginning January 1, 177
2013, shall be styled and known as the "Trumbull county municipal 178
court."179

       (B) In addition to the jurisdiction set forth in division (A) 180
of this section, the municipal courts established by section 181
1901.01 of the Revised Code have jurisdiction as follows:182

       The Akron municipal court has jurisdiction within Bath, 183
Richfield, and Springfield townships, and within the municipal 184
corporations of Fairlawn, Lakemore, and Mogadore, in Summit 185
county.186

       The Alliance municipal court has jurisdiction within 187
Lexington, Marlboro, Paris, and Washington townships in Stark 188
county.189

       The Ashland municipal court has jurisdiction within Ashland 190
county.191

       The Ashtabula municipal court has jurisdiction within 192
Ashtabula, Plymouth, and Saybrook townships in Ashtabula county.193

       The Athens county municipal court has jurisdiction within 194
Athens county.195

       The Auglaize county municipal court has jurisdiction within 196
Auglaize county.197

       The Avon Lake municipal court has jurisdiction within the 198
municipal corporations of Avon and Sheffield in Lorain county.199

       The Barberton municipal court has jurisdiction within 200
Coventry, Franklin, and Green townships, within all of Copley 201
township except within the municipal corporation of Fairlawn, and 202
within the municipal corporations of Clinton and Norton, in Summit 203
county.204

       The Bedford municipal court has jurisdiction within the 205
municipal corporations of Bedford Heights, Oakwood, Glenwillow, 206
Solon, Bentleyville, Chagrin Falls, Moreland Hills, Orange, 207
Warrensville Heights, North Randall, and Woodmere, and within 208
Warrensville and Chagrin Falls townships, in Cuyahoga county.209

       The Bellefontaine municipal court has jurisdiction within 210
Logan county.211

       The Bellevue municipal court has jurisdiction within Lyme and 212
Sherman townships in Huron county and within York township in 213
Sandusky county.214

       The Berea municipal court has jurisdiction within the 215
municipal corporations of Strongsville, Middleburgh Heights, Brook 216
Park, Westview, and Olmsted Falls, and within Olmsted township, in 217
Cuyahoga county.218

       The Bowling Green municipal court has jurisdiction within the 219
municipal corporations of Bairdstown, Bloomdale, Bradner, Custar, 220
Cygnet, Grand Rapids, Haskins, Hoytville, Jerry City, Milton 221
Center, North Baltimore, Pemberville, Portage, Rising Sun, 222
Tontogany, Wayne, West Millgrove, and Weston, and within Bloom, 223
Center, Freedom, Grand Rapids, Henry, Jackson, Liberty, Middleton, 224
Milton, Montgomery, Plain, Portage, Washington, Webster, and 225
Weston townships in Wood county.226

       Beginning February 9, 2003, the Brown county municipal court 227
has jurisdiction within Brown county.228

       The Bryan municipal court has jurisdiction within Williams 229
county.230

       The Cambridge municipal court has jurisdiction within 231
Guernsey county.232

       The Campbell municipal court has jurisdiction within 233
Coitsville township in Mahoning county.234

       The Canton municipal court has jurisdiction within Canton, 235
Lake, Nimishillen, Osnaburg, Pike, Plain, and Sandy townships in 236
Stark county.237

       The Carroll county municipal court has jurisdiction within 238
Carroll county.239

       The Celina municipal court has jurisdiction within Mercer 240
county.241

       The Champaign county municipal court has jurisdiction within 242
Champaign county.243

       The Chardon municipal court has jurisdiction within Geauga 244
county.245

       The Chillicothe municipal court has jurisdiction within Ross 246
county.247

       The Circleville municipal court has jurisdiction within 248
Pickaway county.249

       The Clark county municipal court has jurisdiction within 250
Clark county.251

       The Clermont county municipal court has jurisdiction within 252
Clermont county.253

       The Cleveland municipal court has jurisdiction within the 254
municipal corporation of Bratenahl in Cuyahoga county.255

       Beginning July 1, 1992, the Clinton county municipal court 256
has jurisdiction within Clinton county.257

       The Columbiana county municipal court has jurisdiction within 258
all of Columbiana county except within the municipal corporation 259
of East Liverpool and except within Liverpool and St. Clair 260
townships.261

       The Coshocton municipal court has jurisdiction within 262
Coshocton county.263

       The Crawford county municipal court has jurisdiction within 264
Crawford county.265

        Until December 31, 2008, the Cuyahoga Falls municipal court 266
has jurisdiction within Boston, Hudson, Northfield Center, 267
Sagamore Hills, and Twinsburg townships, and within the municipal 268
corporations of Boston Heights, Hudson, Munroe Falls, Northfield, 269
Peninsula, Reminderville, Silver Lake, Stow, Tallmadge, Twinsburg, 270
and Macedonia, in Summit county.271

       Beginning January 1, 2005, the Darke county municipal court 272
has jurisdiction within Darke county except within the municipal 273
corporation of Bradford.274

       The Defiance municipal court has jurisdiction within Defiance 275
county.276

       The Delaware municipal court has jurisdiction within Delaware 277
county.278

       The East Liverpool municipal court has jurisdiction within 279
Liverpool and St. Clair townships in Columbiana county.280

       The Eaton municipal court has jurisdiction within Preble 281
county.282

       The Elyria municipal court has jurisdiction within the 283
municipal corporations of Grafton, LaGrange, and North Ridgeville, 284
and within Elyria, Carlisle, Eaton, Columbia, Grafton, and 285
LaGrange townships, in Lorain county.286

       Beginning January 1, 2008, the Erie county municipal court 287
has jurisdiction within Erie county except within the townships of 288
Florence, Huron, Perkins, and Vermilion and the municipal 289
corporations of Bay View, Castalia, Huron, Sandusky, and 290
Vermilion.291

       The Fairborn municipal court has jurisdiction within the 292
municipal corporation of Beavercreek and within Bath and 293
Beavercreek townships in Greene county.294

       Beginning January 2, 2000, the Fairfield county municipal 295
court has jurisdiction within Fairfield county.296

       The Findlay municipal court has jurisdiction within all of 297
Hancock county except within Washington township.298

       The Fostoria municipal court has jurisdiction within Loudon 299
and Jackson townships in Seneca county, within Washington township 300
in Hancock county, and within Perry township, except within the 301
municipal corporation of West Millgrove, in Wood county.302

       The Franklin municipal court has jurisdiction within Franklin 303
township in Warren county.304

       The Franklin county municipal court has jurisdiction within 305
Franklin county.306

       The Fremont municipal court has jurisdiction within Ballville 307
and Sandusky townships in Sandusky county.308

       The Gallipolis municipal court has jurisdiction within Gallia 309
county.310

       The Garfield Heights municipal court has jurisdiction within 311
the municipal corporations of Maple Heights, Walton Hills, Valley 312
View, Cuyahoga Heights, Newburgh Heights, Independence, and 313
Brecksville in Cuyahoga county.314

       The Girard municipal court has jurisdiction within Liberty, 315
Vienna, and Hubbard townships in Trumbull county.316

       The Hamilton municipal court has jurisdiction within Ross and 317
St. Clair townships in Butler county.318

       The Hamilton county municipal court has jurisdiction within 319
Hamilton county.320

       The Hardin county municipal court has jurisdiction within 321
Hardin county.322

       The Hillsboro municipal court has jurisdiction within all of 323
Highland county except within Madison township.324

       The Hocking county municipal court has jurisdiction within 325
Hocking county.326

       The Holmes county municipal court has jurisdiction within 327
Holmes county.328

       The Huron municipal court has jurisdiction within all of 329
Huron township in Erie county except within the municipal 330

       The Ironton municipal court has jurisdiction within Aid, 332
Decatur, Elizabeth, Hamilton, Lawrence, Upper, and Washington 333
townships in Lawrence county.334

       The Jackson county municipal court has jurisdiction within 335
Jackson county.336

       The Kettering municipal court has jurisdiction within the 337
municipal corporations of Centerville and Moraine, and within 338
Washington township, in Montgomery county.339

       Until January 2, 2000, the Lancaster municipal court has 340
jurisdiction within Fairfield county.341

       The Lawrence county municipal court has jurisdiction within 342
the townships of Fayette, Mason, Perry, Rome, Symmes, Union, and 343
Windsor in Lawrence county.344

       The Lebanon municipal court has jurisdiction within 345
Turtlecreek township in Warren county.346

       The Licking county municipal court has jurisdiction within 347
Licking county.348

       The Lima municipal court has jurisdiction within Allen 349
county.350

       The Lorain municipal court has jurisdiction within the 351
municipal corporation of Sheffield Lake, and within Sheffield 352
township, in Lorain county.353

       The Lyndhurst municipal court has jurisdiction within the 354
municipal corporations of Mayfield Heights, Gates Mills, Mayfield, 355
Highland Heights, and Richmond Heights in Cuyahoga county.356

       The Madison county municipal court has jurisdiction within 357
Madison county.358

       The Mansfield municipal court has jurisdiction within 359
Madison, Springfield, Sandusky, Franklin, Weller, Mifflin, Troy, 360
Washington, Monroe, Perry, Jefferson, and Worthington townships, 361
and within sections 35-36-31 and 32 of Butler township, in 362
Richland county.363

       The Marietta municipal court has jurisdiction within 364
Washington county.365

       The Marion municipal court has jurisdiction within Marion 366
county.367

       The Marysville municipal court has jurisdiction within Union 368
county.369

       The Mason municipal court has jurisdiction within Deerfield 370
township in Warren county.371

       The Massillon municipal court has jurisdiction within 372
Bethlehem, Perry, Sugar Creek, Tuscarawas, Lawrence, and Jackson 373
townships in Stark county.374

       The Maumee municipal court has jurisdiction within the 375
municipal corporations of Waterville and Whitehouse, within 376
Waterville and Providence townships, and within those portions of 377
Springfield, Monclova, and Swanton townships lying south of the 378
northerly boundary line of the Ohio turnpike, in Lucas county.379

       The Medina municipal court has jurisdiction within the 380
municipal corporations of Briarwood Beach, Brunswick, 381
Chippewa-on-the-Lake, and Spencer and within the townships of 382
Brunswick Hills, Chatham, Granger, Hinckley, Lafayette, 383
Litchfield, Liverpool, Medina, Montville, Spencer, and York 384
townships, in Medina county.385

       The Mentor municipal court has jurisdiction within the 386
municipal corporation of Mentor-on-the-Lake in Lake county.387

       The Miami county municipal court has jurisdiction within 388
Miami county and within the part of the municipal corporation of 389
Bradford that is located in Darke county.390

       The Miamisburg municipal court has jurisdiction within the 391
municipal corporations of Germantown and West Carrollton, and 392
within German and Miami townships in Montgomery county.393

       The Middletown municipal court has jurisdiction within 394
Madison township, and within all of Lemon township, except within 395
the municipal corporation of Monroe, in Butler county.396

       Beginning July 1, 2010, the Montgomery county municipal court 397
has jurisdiction within all of Montgomery county except for the 398
municipal corporations of Centerville, Clayton, Dayton, Englewood, 399
Germantown, Kettering, Miamisburg, Moraine, Oakwood, Union, 400
Vandalia, and West Carrollton and Butler, German, Harrison, Miami, 401
and Washington townships.402

       Beginning January 1, 2003, the Morrow county municipal court 403
has jurisdiction within Morrow county.404

       The Mount Vernon municipal court has jurisdiction within Knox 405
county.406

       The Napoleon municipal court has jurisdiction within Henry 407
county.408

       The New Philadelphia municipal court has jurisdiction within 409
the municipal corporation of Dover, and within Auburn, Bucks, 410
Fairfield, Goshen, Jefferson, Warren, York, Dover, Franklin, 411
Lawrence, Sandy, Sugarcreek, and Wayne townships in Tuscarawas 412
county.413

       The Newton Falls municipal court has jurisdiction within 414
Bristol, Bloomfield, Lordstown, Newton, Braceville, Southington, 415
Farmington, and Mesopotamia townships in Trumbull county.416

       The Niles municipal court has jurisdiction within the 417
municipal corporation of McDonald, and within Weathersfield 418
township in Trumbull county.419

       The Norwalk municipal court has jurisdiction within all of 420
Huron county except within the municipal corporation of Bellevue 421
and except within Lyme and Sherman townships.422

       The Oberlin municipal court has jurisdiction within the 423
municipal corporations of Amherst, Kipton, Rochester, South 424
Amherst, and Wellington, and within Henrietta, Russia, Camden, 425
Pittsfield, Brighton, Wellington, Penfield, Rochester, and 426
Huntington townships, and within all of Amherst township except 427
within the municipal corporation of Lorain, in Lorain county.428

       The Oregon municipal court has jurisdiction within the 429
municipal corporation of Harbor View, and within Jerusalem 430
township, in Lucas county, and north within Maumee Bay and Lake 431
Erie to the boundary line between Ohio and Michigan between the 432
easterly boundary of the court and the easterly boundary of the 433
Toledo municipal court.434

       The Ottawa county municipal court has jurisdiction within 435
Ottawa county.436

       The Painesville municipal court has jurisdiction within 437
Painesville, Perry, Leroy, Concord, and Madison townships in Lake 438
county.439

       The Parma municipal court has jurisdiction within the 440
municipal corporations of Parma Heights, Brooklyn, Linndale, North 441
Royalton, Broadview Heights, Seven Hills, and Brooklyn Heights in 442
Cuyahoga county.443

       The Perrysburg municipal court has jurisdiction within the 444
municipal corporations of Luckey, Millbury, Northwood, Rossford, 445
and Walbridge, and within Perrysburg, Lake, and Troy townships, in 446
Wood county.447

       The Portage county municipal court has jurisdiction within 448
Portage county.449

       The Portsmouth municipal court has jurisdiction within Scioto 450
county.451

       The Putnam county municipal court has jurisdiction within 452
Putnam county.453

       The Rocky River municipal court has jurisdiction within the 454
municipal corporations of Bay Village, Westlake, Fairview Park, 455
and North Olmsted, and within Riveredge township, in Cuyahoga 456
county.457

       The Sandusky municipal court has jurisdiction within the 458
municipal corporations of Castalia and Bay View, and within 459
Perkins township, in Erie county.460

       Beginning January 1, 2013, the Trumbull county municipal 461
court has jurisdiction within all of Trumbull county except within 462
the municipal corporations of Girard, McDonald, Newton Falls, 463
Niles, and Warren and Bloomfield, Braceville, Bristol, Champion, 464
Farmington, Howland, Hubbard, Liberty, Lordstown, Mesopotamia, 465
Newton, Southington, Vienna, Warren, and Weathersfield townships.466

       The Shaker Heights municipal court has jurisdiction within 467
the municipal corporations of University Heights, Beachwood, 468
Pepper Pike, and Hunting Valley in Cuyahoga county.469

       The Shelby municipal court has jurisdiction within Sharon, 470
Jackson, Cass, Plymouth, and Blooming Grove townships, and within 471
all of Butler township except sections 35-36-31 and 32, in 472
Richland county.473

       The Sidney municipal court has jurisdiction within Shelby 474
county.475

       Beginning January 1, 2009, the Stow municipal court has 476
jurisdiction within Boston, Hudson, Northfield Center, Sagamore 477
Hills, and Twinsburg townships, and within the municipal 478
corporations of Boston Heights, Cuyahoga Falls, Hudson, Munroe 479
Falls, Northfield, Peninsula, Reminderville, Silver Lake, Stow, 480
Tallmadge, Twinsburg, and Macedonia, in Summit county.481

       The Struthers municipal court has jurisdiction within the 482
municipal corporations of Lowellville, New Middleton, and Poland, 483
and within Poland and Springfield townships in Mahoning county.484

       The Sylvania municipal court has jurisdiction within the 485
municipal corporations of Berkey and Holland, and within Sylvania, 486
Richfield, Spencer, and Harding townships, and within those 487
portions of Swanton, Monclova, and Springfield townships lying 488
north of the northerly boundary line of the Ohio turnpike, in 489
Lucas county.490

       The Tiffin municipal court has jurisdiction within Adams, Big 491
Spring, Bloom, Clinton, Eden, Hopewell, Liberty, Pleasant, Reed, 492
Scipio, Seneca, Thompson, and Venice townships in Seneca county.493

       The Toledo municipal court has jurisdiction within Washington 494
township, and within the municipal corporation of Ottawa Hills, in 495
Lucas county.496

       The Upper Sandusky municipal court has jurisdiction within 497
Wyandot county.498

       The Vandalia municipal court has jurisdiction within the 499
municipal corporations of Clayton, Englewood, and Union, and 500
within Butler, Harrison, and Randolph townships, in Montgomery 501
county.502

       The Van Wert municipal court has jurisdiction within Van Wert 503
county.504

       The Vermilion municipal court has jurisdiction within the 505
townships of Vermilion and Florence in Erie county and within all 506
of Brownhelm township except within the municipal corporation of 507
Lorain, in Lorain county.508

       The Wadsworth municipal court has jurisdiction within the 509
municipal corporations of Gloria Glens Park, Lodi, Seville, and 510
Westfield Center, and within Guilford, Harrisville, Homer, Sharon, 511
Wadsworth, and Westfield townships in Medina county.512

       The Warren municipal court has jurisdiction within Warren and 513
Champion townships, and within all of Howland township except 514
within the municipal corporation of Niles, in Trumbull county.515

       The Washington Court House municipal court has jurisdiction 516
within Fayette county.517

       The Wayne county municipal court has jurisdiction within 518
Wayne county.519

       The Willoughby municipal court has jurisdiction within the 520
municipal corporations of Eastlake, Wickliffe, Willowick, 521
Willoughby Hills, Kirtland, Kirtland Hills, Waite Hill, 522
Timberlake, and Lakeline, and within Kirtland township, in Lake 523
county.524

       Through June 30, 1992, the Wilmington municipal court has 525
jurisdiction within Clinton county.526

       The Xenia municipal court has jurisdiction within 527
Caesarcreek, Cedarville, Jefferson, Miami, New Jasper, Ross, 528
Silvercreek, Spring Valley, Sugarcreek, and Xenia townships in 529
Greene county.530

       (C) As used in this section:531

       (1) "Within a township" includes all land, including, but not 532
limited to, any part of any municipal corporation, that is 533
physically located within the territorial boundaries of that 534
township, whether or not that land or municipal corporation is 535
governmentally a part of the township.536

       (2) "Within a municipal corporation" includes all land within 537
the territorial boundaries of the municipal corporation and any 538
townships that are coextensive with the municipal corporation.539

       Sec. 1901.03.  As used in this chapter:540

       (A) "Territory" means the geographical areas within which 541
municipal courts have jurisdiction as provided in sections 1901.01 542
and 1901.02 of the Revised Code.543

       (B) "Legislative authority" means the legislative authority 544
of the municipal corporation in which a municipal court, other 545
than a county-operated municipal court, is located, and means the 546
respective board of county commissioners of the county in which a 547
county-operated municipal court is located.548

       (C) "Chief executive" means the chief executive of the 549
municipal corporation in which a municipal court, other than a 550
county-operated municipal court, is located, and means the 551
respective chairman of the board of county commissioners of the 552
county in which a county-operated municipal court is located.553

       (D) "City treasury" means the treasury of the municipal 554
corporation in which a municipal court, other than a 555
county-operated municipal court, is located.556

       (E) "City treasurer" means the treasurer of the municipal 557
corporation in which a municipal court, other than a 558
county-operated municipal court, is located.559

       (F) "County-operated municipal court" means the Auglaize 560
county, Brown county, Carroll county, Clermont county, Columbiana 561
county, Crawford county, Darke county, Erie county, Hamilton 562
county, Hocking county, Holmes county, Jackson county, Lawrence 563
county, Madison county, Miami county, Montgomery county, Morrow 564
county, Ottawa county, Portage county, Putnam county, or Wayne 565
county municipal court and, effective January 1, 20082013, also 566
includes the ErieTrumbull county municipal court.567

       (G) "A municipal corporation in which a municipal court is 568
located" includes each municipal corporation named in section 569
1901.01 of the Revised Code, but does not include one in which a 570
judge sits pursuant to any provision of section 1901.021 of the 571
Revised Code except division (M) of that section.572

       Sec. 1901.07.  (A) All municipal court judges shall be 573
elected on the nonpartisan ballot for terms of six years. In a 574
municipal court in which only one judge is to be elected in any 575
one year, that judge's term commences on the first day of January 576
after the election. In a municipal court in which two or more 577
judges are to be elected in any one year, their terms commence on 578
successive days beginning the first day of January, following the 579
election, unless otherwise provided by section 1901.08 of the 580
Revised Code.581

       (B) All candidates for municipal court judge may be nominated 582
either by nominating petition or by primary election, except that 583
if the jurisdiction of a municipal court extends only to the 584
corporate limits of the municipal corporation in which the court 585
is located and that municipal corporation operates under a 586
charter, all candidates shall be nominated in the same manner 587
provided in the charter for the office of municipal court judge 588
or, if no specific provisions are made in the charter for the 589
office of municipal court judge, in the same manner as the charter 590
prescribes for the nomination and election of the legislative 591
authority of the municipal corporation.592

        If the jurisdiction of a municipal court extends beyond the 593
corporate limits of the municipal corporation in which it is 594
located or if the jurisdiction of the court does not extend beyond 595
the corporate limits of the municipal corporation in which it is 596
located and no charter provisions apply, all candidates for party 597
nomination to the office of municipal court judge shall file a 598
declaration of candidacy and petition not later than four p.m. of 599
the ninetieth day before the day of the primary election in the 600
form prescribed by section 3513.07 of the Revised Code. The 601
petition shall conform to the requirements provided for those 602
petitions of candidacy contained in section 3513.05 of the Revised 603
Code, except that the petition shall be signed by at least fifty 604
electors of the territory of the court. If no valid declaration of 605
candidacy is filed for nomination as a candidate of a political 606
party for election to the office of municipal court judge, or if 607
the number of persons filing the declarations of candidacy for 608
nominations as candidates of one political party for election to 609
the office does not exceed the number of candidates that that 610
party is entitled to nominate as its candidates for election to 611
the office, no primary election shall be held for the purpose of 612
nominating candidates of that party for election to the office, 613
and the candidates shall be issued certificates of nomination in 614
the manner set forth in section 3513.02 of the Revised Code.615

       If the jurisdiction of a municipal court extends beyond the 616
corporate limits of the municipal corporation in which it is 617
located or if the jurisdiction of the court does not extend beyond 618
the corporate limits of the municipal corporation in which it is 619
located and no charter provisions apply, nonpartisan candidates 620
for the office of municipal court judge shall file nominating 621
petitions not later than four p.m. of the day before the day of 622
the primary election in the form prescribed by section 3513.261 of 623
the Revised Code. The petition shall conform to the requirements 624
provided for those petitions of candidacy contained in section 625
3513.257 of the Revised Code, except that the petition shall be 626
signed by at least fifty electors of the territory of the court.627

       The nominating petition or declaration of candidacy for a 628
municipal court judge shall contain a designation of the term for 629
which the candidate seeks election. At the following regular 630
municipal election, the candidacies of the judges nominated shall 631
be submitted to the electors of the territory on a nonpartisan, 632
judicial ballot in the same manner as provided for judges of the 633
court of common pleas, except that, in a municipal corporation 634
operating under a charter, all candidates for municipal court 635
judge shall be elected in conformity with the charter if 636
provisions are made in the charter for the election of municipal 637
court judges.638

       (C) Notwithstanding divisions (A) and (B) of this section, in 639
the following municipal courts, the judges shall be nominated and 640
elected as follows:641

       (1) In the Cleveland municipal court, the judges shall be 642
nominated only by petition. The petition shall be signed by at 643
least fifty electors of the territory of the court. It shall be in 644
the statutory form and shall be filed in the manner and within the 645
time prescribed by the charter of the city of Cleveland for filing 646
petitions of candidates for municipal offices. Each elector shall 647
have the right to sign petitions for as many candidates as are to 648
be elected, but no more. The judges shall be elected by the 649
electors of the territory of the court in the manner provided by 650
law for the election of judges of the court of common pleas.651

       (2) In the Toledo municipal court, the judges shall be 652
nominated only by petition. The petition shall be signed by at 653
least fifty electors of the territory of the court. It shall be in 654
the statutory form and shall be filed in the manner and within the 655
time prescribed by the charter of the city of Toledo for filing 656
nominating petitions for city council. Each elector shall have the 657
right to sign petitions for as many candidates as are to be 658
elected, but no more. The judges shall be elected by the electors 659
of the territory of the court in the manner provided by law for 660
the election of judges of the court of common pleas.661

       (3) In the Akron municipal court, the judges shall be 662
nominated only by petition. The petition shall be signed by at 663
least fifty electors of the territory of the court. It shall be in 664
statutory form and shall be filed in the manner and within the 665
time prescribed by the charter of the city of Akron for filing 666
nominating petitions of candidates for municipal offices. Each 667
elector shall have the right to sign petitions for as many 668
candidates as are to be elected, but no more. The judges shall be 669
elected by the electors of the territory of the court in the 670
manner provided by law for the election of judges of the court of 671
common pleas.672

       (4) In the Hamilton county municipal court, the judges shall 673
be nominated only by petition. The petition shall be signed by at 674
least one hundred electors of the judicial district of the county 675
from which the candidate seeks election, which petitions shall be 676
signed and filed not later than four p.m. of the day before the 677
day of the primary election in the form prescribed by section 678
3513.261 of the Revised Code. Unless otherwise provided in this 679
section, the petition shall conform to the requirements provided 680
for nominating petitions in section 3513.257 of the Revised Code. 681
The judges shall be elected by the electors of the relative 682
judicial district of the county at the regular municipal election 683
and in the manner provided by law for the election of judges of 684
the court of common pleas.685

       (5) In the Franklin county municipal court, the judges shall 686
be nominated only by petition. The petition shall be signed by at 687
least fifty electors of the territory of the court. The petition 688
shall be in the statutory form and shall be filed in the manner 689
and within the time prescribed by the charter of the city of 690
Columbus for filing petitions of candidates for municipal offices. 691
The judges shall be elected by the electors of the territory of 692
the court in the manner provided by law for the election of judges 693
of the court of common pleas.694

       (6) In the Auglaize, Brown, Carroll, Clermont, Crawford, 695
Hocking, Jackson, Lawrence, Madison, Miami, Morrow, Putnam, 696
Trumbull, and Wayne county municipal courts, the judges shall be 697
nominated only by petition. The petitions shall be signed by at 698
least fifty electors of the territory of the court and shall 699
conform to the provisions of this section.700

       (D) In the Portage county municipal court, the judges shall 701
be nominated either by nominating petition or by primary election, 702
as provided in division (B) of this section.703

       (E) As used in this section, as to an election for either a 704
full or an unexpired term, "the territory within the jurisdiction 705
of the court" means that territory as it will be on the first day 706
of January after the election.707

       Sec. 1901.08. The number of, and the time for election of, 708
judges of the following municipal courts and the beginning of 709
their terms shall be as follows:710

       In the Akron municipal court, two full-time judges shall be 711
elected in 1951, two full-time judges shall be elected in 1953, 712
one full-time judge shall be elected in 1967, and one full-time 713
judge shall be elected in 1975.714

       In the Alliance municipal court, one full-time judge shall be 715
elected in 1953.716

       In the Ashland municipal court, one full-time judge shall be 717
elected in 1951.718

       In the Ashtabula municipal court, one full-time judge shall 719
be elected in 1953.720

       In the Athens county municipal court, one full-time judge 721
shall be elected in 1967.722

       In the Auglaize county municipal court, one full-time judge 723
shall be elected in 1975.724

       In the Avon Lake municipal court, one part-time judge shall 725
be elected in 1957.726

       In the Barberton municipal court, one full-time judge shall 727
be elected in 1969, and one full-time judge shall be elected in 728
1971.729

       In the Bedford municipal court, one full-time judge shall be 730
elected in 1975, and one full-time judge shall be elected in 1979.731

       In the Bellefontaine municipal court, one full-time judge 732
shall be elected in 1993.733

       In the Bellevue municipal court, one part-time judge shall be 734
elected in 1951.735

       In the Berea municipal court, one full-time judge shall be 736
elected in 2005.737

       In the Bowling Green municipal court, one full-time judge 738
shall be elected in 1983.739

       In the Brown county municipal court, one full-time judge 740
shall be elected in 2005. Beginning February 9, 2003, the 741
part-time judge of the Brown county county court that existed 742
prior to that date whose term commenced on January 2, 2001, shall 743
serve as the full-time judge of the Brown county municipal court 744
until December 31, 2005.745

       In the Bryan municipal court, one full-time judge shall be 746
elected in 1965.747

       In the Cambridge municipal court, one full-time judge shall 748
be elected in 1951.749

       In the Campbell municipal court, one part-time judge shall be 750
elected in 1963.751

       In the Canton municipal court, one full-time judge shall be 752
elected in 1951, one full-time judge shall be elected in 1969, and 753
two full-time judges shall be elected in 1977.754

       In the Carroll county municipal court, one full-time judge 755
shall be elected in 2009. Beginning January 1, 2007, the judge 756
elected in 2006 to the part-time judgeship of the Carroll county 757
county court that existed prior to that date shall serve as the 758
full-time judge of the Carroll county municipal court until 759
December 31, 2009.760

       In the Celina municipal court, one full-time judge shall be 761
elected in 1957.762

       In the Champaign county municipal court, one full-time judge 763
shall be elected in 2001.764

       In the Chardon municipal court, one full-time judge shall be 765
elected in 1963.766

       In the Chillicothe municipal court, one full-time judge shall 767
be elected in 1951, and one full-time judge shall be elected in 768
1977.769

       In the Circleville municipal court, one full-time judge shall 770
be elected in 1953.771

       In the Clark county municipal court, one full-time judge 772
shall be elected in 1989, and two full-time judges shall be 773
elected in 1991. The full-time judges of the Springfield municipal 774
court who were elected in 1983 and 1985 shall serve as the judges 775
of the Clark county municipal court from January 1, 1988, until 776
the end of their respective terms.777

       In the Clermont county municipal court, two full-time judges 778
shall be elected in 1991, and one full-time judge shall be elected 779
in 1999.780

       In the Cleveland municipal court, six full-time judges shall 781
be elected in 1975, three full-time judges shall be elected in 782
1953, and four full-time judges shall be elected in 1955.783

       In the Cleveland Heights municipal court, one full-time judge 784
shall be elected in 1957.785

       In the Clinton county municipal court, one full-time judge 786
shall be elected in 1997. The full-time judge of the Wilmington 787
municipal court who was elected in 1991 shall serve as the judge 788
of the Clinton county municipal court from July 1, 1992, until the 789
end of that judge's term on December 31, 1997.790

       In the Columbiana county municipal court, two full-time 791
judges shall be elected in 2001.792

       In the Conneaut municipal court, one full-time judge shall be 793
elected in 1953.794

       In the Coshocton municipal court, one full-time judge shall 795
be elected in 1951.796

       In the Crawford county municipal court, one full-time judge 797
shall be elected in 1977.798

       In the Cuyahoga Falls municipal court, one full-time judge 799
shall be elected in 1953, and one full-time judge shall be elected 800
in 1967. Effective December 31, 2008, the Cuyahoga Falls municipal 801
court shall cease to exist; however, the judges of the Cuyahoga 802
Falls municipal court who were elected pursuant to this section in 803
2003 and 2007 for terms beginning on January 1, 2004, and January 804
1, 2008, respectively, shall serve as full-time judges of the Stow 805
municipal court until December 31, 2009, and December 31, 2013, 806
respectively.807

       In the Darke county municipal court, one full-time judge 808
shall be elected in 2005. Beginning January 1, 2005, the part-time 809
judge of the Darke county county court that existed prior to that 810
date whose term began on January 1, 2001, shall serve as the 811
full-time judge of the Darke county municipal court until December 812
31, 2005.813

       In the Dayton municipal court, three full-time judges shall 814
be elected in 1987, their terms to commence on successive days 815
beginning on the first day of January next after their election, 816
and two full-time judges shall be elected in 1955, their terms to 817
commence on successive days beginning on the second day of January 818
next after their election.819

       In the Defiance municipal court, one full-time judge shall be 820
elected in 1957.821

       In the Delaware municipal court, one full-time judge shall be 822
elected in 1953, and one full-time judge shall be elected in 2007.823

       In the East Cleveland municipal court, one full-time judge 824
shall be elected in 1957.825

       In the East Liverpool municipal court, one full-time judge 826
shall be elected in 1953.827

       In the Eaton municipal court, one full-time judge shall be 828
elected in 1973.829

       In the Elyria municipal court, one full-time judge shall be 830
elected in 1955, and one full-time judge shall be elected in 1973.831

       In the Erie county municipal court, one full-time judge shall 832
be elected in 2007.833

       In the Euclid municipal court, one full-time judge shall be 834
elected in 1951.835

       In the Fairborn municipal court, one full-time judge shall be 836
elected in 1977.837

       In the Fairfield county municipal court, one full-time judge 838
shall be elected in 2003, and one full-time judge shall be elected 839
in 2005.840

       In the Fairfield municipal court, one full-time judge shall 841
be elected in 1989.842

       In the Findlay municipal court, one full-time judge shall be 843
elected in 1955, and one full-time judge shall be elected in 1993.844

       In the Fostoria municipal court, one full-time judge shall be 845
elected in 1975.846

       In the Franklin municipal court, one part-time judge shall be 847
elected in 1951.848

       In the Franklin county municipal court, two full-time judges 849
shall be elected in 1969, three full-time judges shall be elected 850
in 1971, seven full-time judges shall be elected in 1967, one 851
full-time judge shall be elected in 1975, one full-time judge 852
shall be elected in 1991, and one full-time judge shall be elected 853
in 1997.854

       In the Fremont municipal court, one full-time judge shall be 855
elected in 1975.856

       In the Gallipolis municipal court, one full-time judge shall 857
be elected in 1981.858

       In the Garfield Heights municipal court, one full-time judge 859
shall be elected in 1951, and one full-time judge shall be elected 860
in 1981.861

       In the Girard municipal court, one full-time judge shall be 862
elected in 1963.863

       In the Hamilton municipal court, one full-time judge shall be 864
elected in 1953.865

       In the Hamilton county municipal court, five full-time judges 866
shall be elected in 1967, five full-time judges shall be elected 867
in 1971, two full-time judges shall be elected in 1981, and two 868
full-time judges shall be elected in 1983. All terms of judges of 869
the Hamilton county municipal court shall commence on the first 870
day of January next after their election, except that the terms of 871
the additional judges to be elected in 1981 shall commence on 872
January 2, 1982, and January 3, 1982, and that the terms of the 873
additional judges to be elected in 1983 shall commence on January 874
4, 1984, and January 5, 1984.875

       In the Hardin county municipal court, one part-time judge 876
shall be elected in 1989.877

       In the Hillsboro municipal court, one full-time judge shall 878
be elected in 2011. On and after December 30, 2008, the part-time 879
judge of the Hillsboro municipal court who was elected in 2005 880
shall serve as a full-time judge of the court until the end of 881
that judge's term on December 31, 2011.882

       In the Hocking county municipal court, one full-time judge 883
shall be elected in 1977.884

       In the Holmes county municipal court, one full-time judge 885
shall be elected in 2007. Beginning January 1, 2007, the part-time 886
judge of the Holmes county county court that existed prior to that 887
date whose term commenced on January 1, 2007, shall serve as the 888
full-time judge of the Holmes county municipal court until 889
December 31, 2007.890

       In the Huron municipal court, one part-time judge shall be 891
elected in 1967.892

       In the Ironton municipal court, one full-time judge shall be 893
elected in 1951.894

       In the Jackson county municipal court, one full-time judge 895
shall be elected in 2001. On and after March 31, 1997, the 896
part-time judge of the Jackson county municipal court who was 897
elected in 1995 shall serve as a full-time judge of the court 898
until the end of that judge's term on December 31, 2001.899

       In the Kettering municipal court, one full-time judge shall 900
be elected in 1971, and one full-time judge shall be elected in 901
1975.902

       In the Lakewood municipal court, one full-time judge shall be 903
elected in 1955.904

       In the Lancaster municipal court, one full-time judge shall 905
be elected in 1951, and one full-time judge shall be elected in 906
1979. Beginning January 2, 2000, the full-time judges of the 907
Lancaster municipal court who were elected in 1997 and 1999 shall 908
serve as judges of the Fairfield county municipal court until the 909
end of those judges' terms.910

       In the Lawrence county municipal court, one part-time judge 911
shall be elected in 1981.912

       In the Lebanon municipal court, one part-time judge shall be 913
elected in 1955.914

       In the Licking county municipal court, one full-time judge 915
shall be elected in 1951, and one full-time judge shall be elected 916
in 1971.917

       In the Lima municipal court, one full-time judge shall be 918
elected in 1951, and one full-time judge shall be elected in 1967.919

       In the Lorain municipal court, one full-time judge shall be 920
elected in 1953, and one full-time judge shall be elected in 1973.921

       In the Lyndhurst municipal court, one full-time judge shall 922
be elected in 1957.923

       In the Madison county municipal court, one full-time judge 924
shall be elected in 1981.925

       In the Mansfield municipal court, one full-time judge shall 926
be elected in 1951, and one full-time judge shall be elected in 927
1969.928

       In the Marietta municipal court, one full-time judge shall be 929
elected in 1957.930

       In the Marion municipal court, one full-time judge shall be 931
elected in 1951.932

       In the Marysville municipal court, one full-time judge shall 933
be elected in 2011. On and after January 18, 2007, the part-time 934
judge of the Marysville municipal court who was elected in 2005 935
shall serve as a full-time judge of the court until the end of 936
that judge's term on December 31, 2011.937

       In the Mason municipal court, one part-time judge shall be 938
elected in 1965.939

       In the Massillon municipal court, one full-time judge shall 940
be elected in 1953, and one full-time judge shall be elected in 941
1971.942

       In the Maumee municipal court, one full-time judge shall be 943
elected in 1963.944

       In the Medina municipal court, one full-time judge shall be 945
elected in 1957.946

       In the Mentor municipal court, one full-time judge shall be 947
elected in 1971.948

       In the Miami county municipal court, one full-time judge 949
shall be elected in 1975, and one full-time judge shall be elected 950
in 1979.951

       In the Miamisburg municipal court, one full-time judge shall 952
be elected in 1951.953

       In the Middletown municipal court, one full-time judge shall 954
be elected in 1953.955

       In the Montgomery county municipal court:956

       One judge shall be elected in 2011 to a part-time judgeship 957
for a term to begin on January 1, 2012. If any one of the other 958
judgeships of the court becomes vacant and is abolished after July 959
1, 2010, this judgeship shall become a full-time judgeship on that 960
date. If only one other judgeship of the court becomes vacant and 961
is abolished as of December 31, 2021, this judgeship shall be 962
abolished as of that date. Beginning July 1, 2010, the part-time 963
judge of the Montgomery county county court that existed before 964
that date whose term commenced on January 1, 2005, shall serve as 965
a part-time judge of the Montgomery county municipal court until 966
December 31, 2011.967

       One judge shall be elected in 2011 to a full-time judgeship 968
for a term to begin on January 2, 2012, and this judgeship shall 969
be abolished on January 1, 2016. Beginning July 1, 2010, the 970
part-time judge of the Montgomery county county court that existed 971
before that date whose term commenced on January 2, 2005, shall 972
serve as a full-time judge of the Montgomery county municipal 973
court until January 1, 2012.974

       One judge shall be elected in 2013 to a full-time judgeship 975
for a term to begin on January 2, 2014. Beginning July 1, 2010, 976
the part-time judge of the Montgomery county county court that 977
existed before that date whose term commenced on January 2, 2007, 978
shall serve as a full-time judge of the Montgomery county 979
municipal court until January 1, 2014.980

       One judge shall be elected in 2013 to a judgeship for a term 981
to begin on January 1, 2014. If no other judgeship of the court 982
becomes vacant and is abolished by January 1, 2014, this judgeship 983
shall be a part-time judgeship. When one or more of the other 984
judgeships of the court becomes vacant and is abolished after July 985
1, 2010, this judgeship shall become a full-time judgeship. 986
Beginning July 1, 2010, the part-time judge of the Montgomery 987
county county court that existed before that date whose term 988
commenced on January 1, 2007, shall serve as this judge of the 989
Montgomery county municipal court until December 31, 2013.990

       If any one of the judgeships of the court becomes vacant 991
before December 31, 2021, that judgeship is abolished on the date 992
that it becomes vacant, and the other judges of the court shall be 993
or serve as full-time judges. The abolishment of judgeships for 994
the Montgomery county municipal court shall cease when the court 995
has two full-time judgeships.996

       In the Morrow county municipal court, one full-time judge 997
shall be elected in 2005. Beginning January 1, 2003, the part-time 998
judge of the Morrow county county court that existed prior to that 999
date shall serve as the full-time judge of the Morrow county 1000
municipal court until December 31, 2005.1001

       In the Mount Vernon municipal court, one full-time judge 1002
shall be elected in 1951.1003

       In the Napoleon municipal court, one full-time judge shall be 1004
elected in 2005.1005

       In the New Philadelphia municipal court, one full-time judge 1006
shall be elected in 1975.1007

       In the Newton Falls municipal court, one full-time judge 1008
shall be elected in 1963.1009

       In the Niles municipal court, one full-time judge shall be 1010
elected in 1951.1011

       In the Norwalk municipal court, one full-time judge shall be 1012
elected in 1975.1013

       In the Oakwood municipal court, one part-time judge shall be 1014
elected in 1953.1015

       In the Oberlin municipal court, one full-time judge shall be 1016
elected in 1989.1017

       In the Oregon municipal court, one full-time judge shall be 1018
elected in 1963.1019

       In the Ottawa county municipal court, one full-time judge 1020
shall be elected in 1995, and the full-time judge of the Port 1021
Clinton municipal court who is elected in 1989 shall serve as the 1022
judge of the Ottawa county municipal court from February 4, 1994, 1023
until the end of that judge's term.1024

       In the Painesville municipal court, one full-time judge shall 1025
be elected in 1951.1026

       In the Parma municipal court, one full-time judge shall be 1027
elected in 1951, one full-time judge shall be elected in 1967, and 1028
one full-time judge shall be elected in 1971.1029

       In the Perrysburg municipal court, one full-time judge shall 1030
be elected in 1977.1031

       In the Portage county municipal court, two full-time judges 1032
shall be elected in 1979, and one full-time judge shall be elected 1033
in 1971.1034

       In the Port Clinton municipal court, one full-time judge 1035
shall be elected in 1953. The full-time judge of the Port Clinton 1036
municipal court who is elected in 1989 shall serve as the judge of 1037
the Ottawa county municipal court from February 4, 1994, until the 1038
end of that judge's term.1039

       In the Portsmouth municipal court, one full-time judge shall 1040
be elected in 1951, and one full-time judge shall be elected in 1041
1985.1042

       In the Putnam county municipal court, one full-time judge 1043
shall be elected in 2011. Beginning January 1, 2011, the part-time 1044
judge of the Putnam county county court that existed prior to that 1045
date whose term commenced on January 1, 2007, shall serve as the 1046
full-time judge of the Putnam county municipal court until 1047
December 31, 2011.1048

       In the Rocky River municipal court, one full-time judge shall 1049
be elected in 1957, and one full-time judge shall be elected in 1050
1971.1051

       In the Sandusky municipal court, one full-time judge shall be 1052
elected in 1953.1053

       In the Trumbull county municipal court, one full-time judge 1054
shall be elected in 2017. Beginning on January 1, 2013, the 1055
part-time judge of the Trumbull county county court that existed 1056
prior to that date who was elected in 2010 shall serve as the 1057
full-time judge of the Trumbull county municipal court until 1058
December 31, 2017.1059

       In the Shaker Heights municipal court, one full-time judge 1060
shall be elected in 1957.1061

       In the Shelby municipal court, one part-time judge shall be 1062
elected in 1957.1063

       In the Sidney municipal court, one full-time judge shall be 1064
elected in 1995.1065

       In the South Euclid municipal court, one full-time judge 1066
shall be elected in 1999. The part-time judge elected in 1993, 1067
whose term commenced on January 1, 1994, shall serve until 1068
December 31, 1999, and the office of that judge is abolished on 1069
January 1, 2000.1070

       In the Springfield municipal court, two full-time judges 1071
shall be elected in 1985, and one full-time judge shall be elected 1072
in 1983, all of whom shall serve as the judges of the Springfield 1073
municipal court through December 31, 1987, and as the judges of 1074
the Clark county municipal court from January 1, 1988, until the 1075
end of their respective terms.1076

       In the Steubenville municipal court, one full-time judge 1077
shall be elected in 1953.1078

       In the Stow municipal court, one full-time judge shall be 1079
elected in 2009, and one full-time judge shall be elected in 2013. 1080
Beginning January 1, 2009, the judge of the Cuyahoga Falls 1081
municipal court that existed prior to that date whose term 1082
commenced on January 1, 2008, shall serve as a full-time judge of 1083
the Stow municipal court until December 31, 2013. Beginning 1084
January 1, 2009, the judge of the Cuyahoga Falls municipal court 1085
that existed prior to that date whose term commenced on January 1, 1086
2004, shall serve as a full-time judge of the Stow municipal court 1087
until December 31, 2009.1088

       In the Struthers municipal court, one part-time judge shall 1089
be elected in 1963.1090

       In the Sylvania municipal court, one full-time judge shall be 1091
elected in 1963.1092

       In the Tiffin municipal court, one full-time judge shall be 1093
elected in 1953.1094

       In the Toledo municipal court, two full-time judges shall be 1095
elected in 1971, four full-time judges shall be elected in 1975, 1096
and one full-time judge shall be elected in 1973.1097

       In the Upper Sandusky municipal court, one full-time judge 1098
shall be elected in 2011. The part-time judge elected in 2005, 1099
whose term commenced on January 1, 2006, shall serve as a 1100
full-time judge on and after January 1, 2008, until the expiration 1101
of that judge's term on December 31, 2011, and the office of that 1102
judge is abolished on January 1, 2012.1103

       In the Vandalia municipal court, one full-time judge shall be 1104
elected in 1959.1105

       In the Van Wert municipal court, one full-time judge shall be 1106
elected in 1957.1107

       In the Vermilion municipal court, one part-time judge shall 1108
be elected in 1965.1109

       In the Wadsworth municipal court, one full-time judge shall 1110
be elected in 1981.1111

       In the Warren municipal court, one full-time judge shall be 1112
elected in 1951, and one full-time judge shall be elected in 1971.1113

       In the Washington Court House municipal court, one full-time 1114
judge shall be elected in 1999. The part-time judge elected in 1115
1993, whose term commenced on January 1, 1994, shall serve until 1116
December 31, 1999, and the office of that judge is abolished on 1117
January 1, 2000.1118

       In the Wayne county municipal court, one full-time judge 1119
shall be elected in 1975, and one full-time judge shall be elected 1120
in 1979.1121

       In the Willoughby municipal court, one full-time judge shall 1122
be elected in 1951.1123

       In the Wilmington municipal court, one full-time judge shall 1124
be elected in 1991, who shall serve as the judge of the Wilmington 1125
municipal court through June 30, 1992, and as the judge of the 1126
Clinton county municipal court from July 1, 1992, until the end of 1127
that judge's term on December 31, 1997.1128

       In the Xenia municipal court, one full-time judge shall be 1129
elected in 1977.1130

       In the Youngstown municipal court, one full-time judge shall 1131
be elected in 1951, and two full-time judges shall be elected in 1132
1953.1133

       In the Zanesville municipal court, one full-time judge shall 1134
be elected in 1953.1135

       Sec. 1907.11.  (A) Each county court district shall have the 1136
following county court judges, to be elected as follows:1137

       In the Adams county county court, one part-time judge shall 1138
be elected in 1982.1139

       In the Ashtabula county county court, one part-time judge 1140
shall be elected in 1980, and one part-time judge shall be elected 1141
in 1982.1142

       In the Belmont county county court, one part-time judge shall 1143
be elected in 1992, term to commence on January 1, 1993, and two 1144
part-time judges shall be elected in 1994, terms to commence on 1145
January 1, 1995, and January 2, 1995, respectively.1146

       In the Butler county county court, one part-time judge shall 1147
be elected in 1992, term to commence on January 1, 1993, and two 1148
part-time judges shall be elected in 1994, terms to commence on 1149
January 1, 1995, and January 2, 1995, respectively.1150

        Until December 31, 2007, in the Erie county county court, one 1151
part-time judge shall be elected in 1982. Effective January 1, 1152
2008, the Erie county county court shall cease to exist.1153

       In the Fulton county county court, one part-time judge shall 1154
be elected in 1980, and one part-time judge shall be elected in 1155
1982.1156

       In the Harrison county county court, one part-time judge 1157
shall be elected in 1982.1158

       In the Highland county county court, one part-time judge 1159
shall be elected in 1982.1160

       In the Jefferson county county court, one part-time judge 1161
shall be elected in 1992, term to commence on January 1, 1993, and 1162
two part-time judges shall be elected in 1994, terms to commence 1163
on January 1, 1995, and January 2, 1995, respectively.1164

       In the Mahoning county county court, one part-time judge 1165
shall be elected in 1992, term to commence on January 1, 1993, and 1166
three part-time judges shall be elected in 1994, terms to commence 1167
on January 1, 1995, January 2, 1995, and January 3, 1995, 1168
respectively.1169

       In the Meigs county county court, one part-time judge shall 1170
be elected in 1982.1171

       In the Monroe county county court, one part-time judge shall 1172
be elected in 1982.1173

       In the Morgan county county court, one part-time judge shall 1174
be elected in 1982.1175

       In the Muskingum county county court, one part-time judge 1176
shall be elected in 1980, and one part-time judge shall be elected 1177
in 1982.1178

       In the Noble county county court, one part-time judge shall 1179
be elected in 1982.1180

       In the Paulding county county court, one part-time judge 1181
shall be elected in 1982.1182

       In the Perry county county court, one part-time judge shall 1183
be elected in 1982.1184

       In the Pike county county court, one part-time judge shall be 1185
elected in 1982.1186

       In the Sandusky county county court, two part-time judges 1187
shall be elected in 1994, terms to commence on January 1, 1995, 1188
and January 2, 1995, respectively. 1189

       InUntil December 31, 2010, in the Trumbull county county 1190
court, one part-time judge shall be elected in 1992, and one 1191
part-time judge shall be elected in 1994. The judges elected in 1192
2006 and 2010 shall serve until December 31, 2012. The Trumbull 1193
county county court shall cease to exist on January 1, 2013.1194

       In the Tuscarawas county county court, one part-time judge 1195
shall be elected in 1982.1196

       In the Vinton county county court, one part-time judge shall 1197
be elected in 1982.1198

       In the Warren county county court, one part-time judge shall 1199
be elected in 1980, and one part-time judge shall be elected in 1200
1982.1201

       (B)(1) Additional judges shall be elected at the next regular 1202
election for a county court judge as provided in section 1907.13 1203
of the Revised Code.1204

       (2) Vacancies caused by the death or the resignation from, 1205
forfeiture of, or removal from office of a judge shall be filled 1206
in accordance with section 107.08 of the Revised Code, except as 1207
provided in section 1907.15 of the Revised Code.1208

       Section 2.  That existing sections 1901.01, 1901.02, 1901.03, 1209
1901.07, 1901.08, and 1907.11 of the Revised Code are hereby 1210
repealed.1211

       Section 3. (A) Effective January 1, 2013, the Trumbull County 1212
County Court is abolished.1213

        (B) All causes, executions, and other proceedings pending in 1214
the Trumbull County County Court at the close of business on 1215
December 31, 2012, shall be transferred to and proceed in the 1216
Trumbull County Municipal Court on January 1, 2013, as if 1217
originally instituted in the Trumbull County Municipal Court. 1218
Parties to those causes, judgments, executions, and proceedings 1219
may make any amendments to their pleadings that are required to 1220
conform them to the rules of the Trumbull County Municipal Court. 1221
The Clerk of the Trumbull County County Court or other custodian 1222
shall transfer to the Trumbull County Municipal Court all 1223
pleadings, orders, entries, dockets, bonds, papers, records, 1224
books, exhibits, files, moneys, property, and persons that belong 1225
to, are in the possession of, or are subject to the jurisdiction 1226
of the Trumbull County County Court, or any officer of that court, 1227
at the close of business on December 31, 2012, and that pertain to 1228
those causes, judgments, executions, and proceedings.1229

        (C) All employees of the Trumbull County County Court shall 1230
be transferred to and shall become employees of the Trumbull 1231
County Municipal Court on January 1, 2013.1232

        (D) Effective January 1, 2013, the part-time judgeship in the 1233
Trumbull County County Court is abolished.1234

       Section 4.  Sections 1901.01, 1901.03, 1901.08, and 1907.11 1235
of the Revised Code are presented in this act as composites of the 1236
sections as amended by both Am. Sub. H.B. 238 and Sub. H.B. 338 of 1237
the 128th General Assembly. The General Assembly, applying the 1238
principle stated in division (B) of section 1.52 of the Revised 1239
Code that amendments are to be harmonized if reasonably capable of 1240
simultaneous operation, finds that the composites are the 1241
resulting versions of the sections in effect prior to the 1242
effective date of the sections as presented in this act.1243
