A BILL
To amend section 3737.99 of the Revised Code to 1
revise the penalties for violations of the Ohio 2
Fire Code concerning nonresidential buildings.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3737.99 of the Revised Code be 4
amended to read as follows:5

       Sec. 3737.99.  (A) Whoever violates section 3737.28 of the 6
Revised Code may be summarily punished, by the officer concerned, 7
by a fine of not more than one hundred dollars or commitment to 8
the county jail until that person is willing to comply with the 9
order of such officer.10

       (B) Except as a violation of section 2923.17 of the Revised 11
Code involves subject matter covered by the state fire code and 12
except as such a violation is covered by division (G) of this 13
section, whoever violates division (A) of section 3737.51 of the 14
Revised Code is guilty of a misdemeanor of the first degree. If 15
the violation involves a nonresidential building as defined in 16
section 3781.06 of the Revised Code, notwithstanding the fine 17
specified in division (A)(2)(b) of section 2929.28 or division 18
(A)(8) of section 2929.31 of the Revised Code for a misdemeanor of 19
the first degree, the offender shall be subject to a fine of not 20
less than five thousand dollars nor more than ten thousand 21
dollars.22

       (C) Whoever violates section 3737.61 of the Revised Code is 23
guilty of a minor misdemeanor.24

       (D) Whoever violates section 3737.62 or 3737.64 of the 25
Revised Code is guilty of a misdemeanor of the fourth degree.26

       (E) Whoever violates section 3737.63 or division (A) or (B) 27
of section 3737.65 of the Revised Code is guilty of a misdemeanor 28
of the third degree.29

       (F) Whoever violates division (C)(3) or (D)(5) of section 30
3737.73 of the Revised Code shall be fined one thousand dollars.31

       (G) Whoever violates section 3737.66 of the Revised Code is 32
guilty of a misdemeanor of the first degree.33

       (H) Whoever knowingly violates division (C) of section 34
3737.882 of the Revised Code is guilty of an unclassified felony 35
and shall be fined not more than twenty-five thousand dollars or 36
imprisoned for not more than fourteen months, or both. Whoever 37
recklessly violates division (C) of section 3737.882 of the 38
Revised Code is guilty of a misdemeanor of the first degree.39

       (I) Whoever knowingly violates division (F)(1), (2), or (3) 40
of section 3737.881 or section 3737.93 of the Revised Code is 41
guilty of a misdemeanor of the fourth degree.42

       (J) Whoever knowingly violates division (B) or (C) of section 43
3737.91 of the Revised Code is guilty of a misdemeanor of the 44
second degree.45

       Section 2. That existing section 3737.99 of the Revised Code 46
is hereby repealed.47
