A BILL
To amend section 5910.01 of the Revised Code to 1
qualify for the War Orphans Scholarship children 2
of military veterans who served in Grenada during 3
the intervention.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5910.01 of the Revised Code be 5
amended to read as follows:6

       Sec. 5910.01.  As used in this chapter and section 5919.34 of 7
the Revised Code:8

       (A) "Child" includes natural and adopted children and 9
stepchildren who have not been legally adopted by the veteran 10
parent provided that the relationship between the stepchild and 11
the veteran parent meets the following criteria:12

       (1) The veteran parent is married to the child's natural or 13
adoptive parent at the time application for a scholarship granted 14
under this chapter is made; or if the veteran parent is deceased, 15
the child's natural or adoptive parent was married to the veteran 16
parent at the time of the veteran parent's death;17

       (2) The child resided with the veteran parent for a period of 18
not less than ten consecutive years immediately prior to making 19
application for the scholarship; or if the veteran parent is 20
deceased, the child resided with the veteran parent for a period 21
of not less than ten consecutive years immediately prior to the 22
veteran parent's death;23

       (3) The child received financial support from the veteran 24
parent for a period of not less than ten consecutive years 25
immediately prior to making application for the scholarship; or if 26
the veteran parent is deceased, the child received financial 27
support from the veteran parent for a period of not less than ten 28
consecutive years immediately prior to the veteran parent's death.29

       (B) "Veteran" includes eitherany of the following:30

       (1) Any person who was a member of the armed services of the 31
United States for a period of ninety days or more, or who was 32
discharged from the armed services due to a disability incurred 33
while a member with less than ninety days' service, or who died 34
while a member of the armed services; provided that such service, 35
disability, or death occurred during one of the following periods: 36
April 6, 1917, to November 11, 1918; December 7, 1941, to December 37
31, 1946; June 25, 1950, to January 31, 1955; January 1, 1960, to 38
May 7, 1975; August 2, 1990, to the end of operations conducted as 39
a result of the invasion of Kuwait by Iraq, including support for 40
operation desert shield and operation desert storm, as declared by 41
the president of the United States or the congress; October 7, 42
2001, to the end of operation enduring freedom as declared by the 43
president of the United States or the congress; March 20, 2003, to 44
the end of operation Iraqi freedom as declared by the president of 45
the United States or the congress; or any other period of conflict 46
established by the United States department of veterans affairs 47
for pension purposes;48

       (2) Any person who was a member of the armed services of the 49
United States and served for any period between October 25, 1983, 50
and December 12, 1983, in Grenada during the intervention;51

       (3) Any person who served as a member of the United States 52
merchant marine and to whom either of the following applies:53

       (a) The person has an honorable report of separation from the 54
active duty military service, form DD214 or DD215.55

       (b) The person served in the United States merchant marine 56
between December 7, 1941, and December 31, 1946, and died on 57
active duty while serving in a war zone during that period of 58
service.59

       (C) "Armed services of the United States" or "United States 60
armed forces" includes the army, air force, navy, marine corps, 61
coast guard, and such other military service branch as may be 62
designated by congress as a part of the armed forces of the United 63
States.64

       (D) "Board" means the Ohio war orphans scholarship board 65
created by section 5910.02 of the Revised Code.66

       (E) "Disabled" means having a sixty per cent or greater 67
service-connected disability or receiving benefits for permanent 68
and total nonservice-connected disability, as determined by the 69
United States department of veterans affairs.70

       (F) "United States merchant marine" includes the United 71
States army transport service and the United States naval 72
transport service.73

       Section 2. That existing section 5910.01 of the Revised Code 74
is hereby repealed.75
