| To enact section 149.451 of the Revised Code to | 1 |
| prohibit a law enforcement agency from making | 2 |
| available to the general public on the internet a | 3 |
| motor vehicle accident report that contains a | 4 |
| minor's personal information without redacting or | 5 |
| encrypting the personal information. | 6 |
| Section 1. That section 149.451 of the Revised Code be | 7 |
| enacted to read as follows: | 8 |
| Sec. 149.451. (A) As used in this section: | 9 |
| (1) "Law enforcement agency" means an organization or unit | 10 |
| made up of law enforcement officers as defined in section 2901.01 | 11 |
| of the Revised Code. | 12 |
| (2) "Minor" means a person who is less than eighteen years of | 13 |
| age. | 14 |
| (3) "Personal information" means any of the following | 15 |
| information with regard to a minor: address, electronic mail | 16 |
| address, telephone number, and place of employment. | 17 |
| (B) If a law enforcement agency or a law enforcement officer | 18 |
| or other employee of the agency knows or should know that a motor | 19 |
| vehicle accident report contains personal information with regard | 20 |
| to a minor, the agency or employee shall not make the report | 21 |
| available to the general public on the internet without redacting | 22 |
| or encrypting the personal information. | 23 |
| (C) A law enforcement agency or a law enforcement officer or | 24 |
| other employee of the agency who fails to comply with division (B) | 25 |
| of this section is entitled to immunity from liability on the same | 26 |
| grounds as those defined in division (E)(2) of section 149.45 of | 27 |
| the Revised Code. | 28 |
| (D) This section does not require a law enforcement agency, | 29 |
| or a law enforcement officer or other employee of the agency, to | 30 |
| redact or encrypt personal information from a motor vehicle | 31 |
| accident report that was made available to the general public on | 32 |
| the internet before the effective date of this section. | 33 |
