A BILL
To enact sections 113.081, 113.082, 113.083, and 1
113.084 of the Revised Code to create the Taxpayer 2
Voluntary Contribution Fund for the purpose of 3
receiving contributions to be used for 4
transportation purposes or other general purposes 5
of the state.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  To enact sections 113.081, 113.082, 113.083, and 7
113.084 of the Revised Code to read as follows:8

       Sec. 113.081.  Any state officer, employee, or agent may 9
accept on behalf of the state any voluntary contributions in the 10
form of gifts, donations, grants, bequests, or other funds made to 11
the state for transportation purposes or for the purpose of 12
assisting in the financing of state government. All contributions 13
made under this section and received by a state officer, employee, 14
or agent shall be deposited in the taxpayer voluntary contribution 15
fund created in section 113.082 of the Revised Code. Contributions 16
made under this section do not include contributions authorized in 17
section 5747.113 of the Revised Code or contributions to the state 18
or to specific state agencies in the form of gifts, devises, or 19
bequests as otherwise provided by law.20

       A state officer, employee, or agent may reject a gift made 21
under this section if the rejection is in the best interest of the 22
state.23

       Sec. 113.082.  There is hereby created in the state treasury 24
the taxpayer voluntary contribution fund. The fund shall consist 25
of voluntary contributions in the form of gifts, donations, 26
grants, bequests, and other funds that are designated for 27
transportation purposes or for the purpose of assisting in the 28
financing of state government. Contributions deposited to the 29
credit of the fund shall be used for transportation purposes and 30
other general purposes of the state. 31

       Sec. 113.083.  (A) The treasurer of state shall make 32
information available to the public about the taxpayer voluntary 33
contribution fund created in section 113.082 of the Revised Code. 34
To meet this requirement, the treasurer, at a minimum, shall 35
include on the official internet web site of the office of the 36
treasurer of state a description of the fund and its purpose and a 37
copy of the contribution form created under division (B) of this 38
section. The treasurer also may use other methods to inform the 39
public about the taxpayer voluntary contribution fund.40

       (B) The treasurer of state shall provide a form that may be 41
used to accompany voluntary contributions described in section 42
113.081 of the Revised Code. The form shall include the following 43
information:44

       (1) A description of the taxpayer voluntary contribution fund 45
and its purpose;46

       (2) Instructions for making a voluntary contribution to the 47
state for deposit in the fund;48

       (3) Any other information as specified by the treasurer by 49
rule.50

       Sec. 113.084.  The tax commissioner shall make information 51
available to the public about the taxpayer voluntary contribution 52
fund created in section 113.082 of the Revised Code. To meet this 53
requirement, the commissioner, at a minimum, shall include on the 54
official internet web site of the department of taxation a 55
description of the fund and its purpose and a copy of the 56
contribution form created under division (B) of section 113.083 of 57
the Revised Code. The commissioner also may use other methods to 58
inform the public about the taxpayer voluntary contribution fund.59
