A BILL
To change the date of the 2012 primary election to 1
May 8, 2012, to specify a process for candidates 2
to qualify for the ballot at that election, and to 3
declare an emergency.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. (A) Notwithstanding any provision of the Revised 5
Code to the contrary, in the year 2012 the primary election shall 6
be conducted on May 8, 2012, for the purpose of nominating 7
candidates for all offices that are scheduled for election in 2012 8
pursuant to section 3501.02 of the Revised Code.9

        (B)(1) Any person who, prior to the effective date of this 10
act, filed a declaration of candidacy and petition, a declaration 11
of intent to be a write-in candidate, or a nominating petition 12
seeking nomination at the March 6, 2012, primary election shall be 13
deemed to have filed those papers for nomination to the same 14
office for the primary election scheduled to be held, pursuant to 15
this act, on May 8, 2012.16

        (2) A person who wishes to seek nomination at the primary 17
election scheduled to be held, under this act, on May 8, 2012, may 18
file the appropriate declaration of candidacy and petition, 19
declaration of intent to be a write-in candidate, or nominating 20
petition for that election not later than ninety days prior to the 21
day of that election, in the manner specified under Title XXXV of 22
the Revised Code.23

        (3) If a person filed a declaration of candidacy and 24
petition, declaration of intent to be a write-in candidate, or a 25
nominating petition to become a candidate at the March 6, 2012, 26
primary election prior to the filing deadline for that election as 27
it existed before the effective date of this act and files again 28
to become a candidate for nomination at the May 8, 2012, primary 29
election for the same office, the person is not disqualified as a 30
candidate under section 3513.052 of the Revised Code and, if the 31
person otherwise qualifies as a candidate, shall be placed on the 32
ballot for nomination for that office at that election.33

       Section 2. This act is hereby declared to be an emergency 34
measure necessary for the immediate preservation of the public 35
peace, health, and safety. The reason for such necessity is to 36
provide additional time prior to the 2012 presidential primary 37
election for the resolution of questions regarding the 38
congressional district boundaries that will be in effect for that 39
election. Therefore, this act shall go into immediate effect.40
