4758.42, 4758.43, 4758.44, 4758.45, 4758.51, 4
4758.55, 4758.56, 4758.59, 4758.61, and 4758.70; 5
to enact sections 4758.221, 4758.241, 4758.39, 6
4758.46, 4758.47, 4758.52, 4758.54, and 4758.561; 7
and to repeal sections 3793.07, 4758.04, 4758.53, 8
and 4758.58 of the Revised Code to revise the law 9
governing the professions of chemical dependency 10
counseling and alcohol and other drug prevention.11


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4757.41, 4758.01, 4758.02, 4758.10, 12
4758.20, 4758.21, 4758.22, 4758.23, 4758.24, 4758.26, 4758.27, 13
4758.30, 4758.40, 4758.41, 4758.42, 4758.43, 4758.44, 4758.45, 14
4758.51, 4758.55, 4758.56, 4758.59, 4758.61, and 4758.70 be 15
amended and sections 4758.221, 4758.241, 4758.39, 4758.46, 16
4758.47, 4758.52, 4758.54, and 4758.561 of the Revised Code be 17
enacted to read as follows:18

       Sec. 4757.41.  (A) This chapter shall not apply to the 19
following:20

       (1) A person certified by the state board of education under 21
Chapter 3319. of the Revised Code while performing any services 22
within the person's scope of employment by a board of education or 23
by a private school meeting the standards prescribed by the state 24
board of education under division (D) of section 3301.07 of the 25
Revised Code or in a program operated under Chapter 5126. of the 26
Revised Code for training individuals with mental retardation or 27
other developmental disabilities;28

       (2) Psychologists or school psychologists licensed under 29
Chapter 4732. of the Revised Code;30

       (3) Members of other professions licensed, certified, or 31
registered by this state while performing services within the 32
recognized scope, standards, and ethics of their respective 33
professions;34

       (4) Rabbis, priests, Christian science practitioners, clergy, 35
or members of religious orders and other individuals participating 36
with them in pastoral counseling when the counseling activities 37
are within the scope of the performance of their regular or 38
specialized ministerial duties and are performed under the 39
auspices or sponsorship of an established and legally cognizable 40
church, denomination, or sect or an integrated auxiliary of a 41
church as defined in federal tax regulations, paragraph (g)(5) of 42
26 C.F.R. 1.6033-2 (1995), and when the individual rendering the 43
service remains accountable to the established authority of that 44
church, denomination, sect, or integrated auxiliary;45

       (5) Any person employed in the civil service as defined in 46
section 124.01 of the Revised Code while engaging in social work 47
or professional counseling as a civil service employee;48

       (6) A student in an accredited educational institution while 49
carrying out activities that are part of the student's prescribed 50
course of study if the activities are supervised as required by 51
the educational institution and if the student does not hold 52
herself or himself out as a person licensed or registered under 53
this chapter;54

       (7) Until two years after the date the department of alcohol 55
and drug addiction services ceases to administer its process for 56
the certification or credentialing of chemical dependency 57
counselors and alcohol and other drug prevention specialists under 58
section 3793.07 of the Revised Code, as specified in division (B) 59
of that section, or in the case of an individual who has the 60
expiration date of the individual's certificate or credentials 61
delayed under section 4758.04 of the Revised Code, until the date 62
of the delayed expiration, individuals with certification or 63
credentials accepted by the department under that section who are 64
acting within the scope of their certification or credentials as 65
members of the profession of chemical dependency counseling or as 66
alcohol and other drug prevention specialists;67

       (8) Individuals who hold a license or certificate under 68
Chapter 4758. of the Revised Code who are acting within the scope 69
of their license or certificate as members of the profession of 70
chemical dependency counseling or alcohol and other drug 71
prevention services;72

       (9)(8) Any person employed by the American red cross while 73
engaging in activities relating to services for military families 74
and veterans and disaster relief, as described in the "American 75
National Red Cross Act," 33 Stat. 599 (1905), 36 U.S.C.A. 1, as 76
amended;77

       (10)(9) Members of labor organizations who hold union 78
counselor certificates while performing services in their official 79
capacity as union counselors;80

       (11)(10) Any person employed in a hospital as defined in 81
section 3727.01 of the Revised Code or in a nursing home as 82
defined in section 3721.01 of the Revised Code while providing as 83
a hospital employee or nursing home employee, respectively, social 84
services other than counseling and the use of psychosocial 85
interventions and social psychotherapy.86

       (B) Divisions (A)(5), (9)(8), and (11)(10) of this section do 87
not prevent a person described in those divisions from obtaining a 88
license or certificate of registration under this chapter.89

       Sec. 4758.01. As used in this chapter:90

       (A) "Accredited educational institution" means an educational 91
institution accredited by an accrediting agency accepted by the 92
Ohio board of regents.93

       (B)(1) "Alcohol and other drug clinical counseling 94
principles, methods, or procedures" means an approach to chemical 95
dependency counseling that emphasizes the chemical dependency 96
counselor's role in systematically assisting clients through all 97
of the following:98

       (a) Analyzing background and current information;99

       (b) Exploring possible solutions;100

       (c) Developing and providing a treatment plan;101

       (d) In the case of an independent chemical dependency 102
counselor-clinical supervisor, independent chemical dependency 103
counselor, or chemical dependency counselor III only, diagnosing 104
chemical dependency conditions.105

       (2) "Alcohol and other drug clinical counseling principles, 106
methods, or procedures" includes counseling, assessing, 107
consulting, and referral as they relate to chemical dependency 108
conditions.109

       (C) "Alcohol and other drug prevention services" means a 110
planned process of strategies and activities designed to preclude 111
the onset of the use of alcohol and other drugs, reduce 112
problematic use of alcohol and other drugs, or both.113

       (D) "Chemical dependency conditions" means those conditions 114
relating to the abuse of or dependency on alcohol or other drugs 115
that are classified in accepted nosologies, including the 116
diagnostic and statistical manual of mental disorders and the 117
international classification of diseases, and in editions of those 118
nosologies published after the effective date of this section119
December 23, 2002.120

       (E) "Chemical dependency counseling" means rendering or 121
offering to render to individuals, groups, or the public a 122
counseling service involving the application of alcohol and other 123
drug clinical counseling principles, methods, or procedures to 124
assist individuals who are abusing or dependent on alcohol or 125
other drugs.126

       (F) "ScopeUnless the context provides otherwise, "scope of 127
practice" means the services, methods, and techniques in which and 128
the areas for which a person who holds a license or certificate 129
under this chapter is trained and qualified.130

       (G) "Substance abuse professional" has the same meaning as in 131
49 C.F.R. 40.3.132

       (H) "U.S. department of transportation drug and alcohol 133
testing program" means a transportation workplace drug and alcohol 134
testing program governed by 49 C.F.R. part 40.135

       Sec. 4758.02. (A) Effective two years after the date the 136
department of alcohol and drug addiction services ceases to 137
administer its certification and credentialing process under 138
section 3793.07 of the Revised Code as specified in division (B) 139
of that section and exceptExcept as provided in sectionssection140
4758.03 and 4758.04 of the Revised Code, no person shall do any of 141
the following:142

       (1) Engage in or represent to the public that the person 143
engages in chemical dependency counseling for a fee, salary, or 144
other consideration unless the person holds a valid independent 145
chemical dependency counselor-clinical supervisor license,146
independent chemical dependency counselor license, chemical 147
dependency counselor III license, chemical dependency counselor II 148
license, chemical dependency counselor I certificate, or chemical 149
dependency counselor assistant certificate issued under this 150
chapter;151

       (2) Use the title "licensed independent chemical dependency 152
counselor-clinical supervisor," "LICDC-CS," "licensed independent 153
chemical dependency counselor," "LICDC," "licensed chemical 154
dependency counselor III," "LCDC III," "licensed chemical 155
dependency counselor II," "LCDC II," "certified chemical 156
dependency counselor I," "CCDC I," "chemical dependency counselor 157
assistant," "CDCA," or any other title or description 158
incorporating the word "chemical dependency counselor" or any 159
other initials used to identify persons acting in those capacities 160
unless currently authorized under this chapter to act in the 161
capacity indicated by the title or initials;162

       (3) Represent to the public that the person is a registered 163
applicant unless the person holds a valid registered applicant 164
certificate issued under this chapter;165

       (4) Use the title "certified prevention specialist II," "CPS 166
II," "certified prevention specialist I," "CPS I," "certified 167
prevention specialist assistant," "CPSA," "registered applicant," 168
"RA," or any other title, description, or initials used to 169
identify persons acting in those capacities unless currently 170
authorized under this chapter to act in the capacity indicated by 171
the title or initials.172

       (B) Effective six years after the effective date of this 173
section, noNo person shall engage in or represent to the public 174
that the person engages in chemical dependency counseling as a 175
chemical dependency counselor I.176

       Sec. 4758.10. (A) There is hereby created the chemical 177
dependency professionals board.178

       (B) The governor shall appoint all of the following voting 179
members of the board with the advice and consent of the senate:180

       (1) Four individuals who hold a valid independent chemical 181
dependency counselor-clinical supervisor license or independent 182
chemical dependency counselor license issued under this chapter, 183
including at least two of whom have received at least a master's 184
degree in a field related to chemical dependency counseling from 185
an accredited educational institution;186

       (2) Two individuals who hold a valid chemical dependency 187
counselor III license issued under this chapter;188

       (3) One individual who holds a valid chemical dependency 189
counselor II license issued under this chapter;190

       (4) Two individuals who hold a valid prevention specialist II 191
certificate or prevention specialist I certificate issued under 192
this chapter;193

       (5) One individual who is authorized under Chapter 4731. of 194
the Revised Code to practice medicine and surgery or osteopathic 195
medicine and surgery and has experience practicing in a field 196
related to chemical dependency counseling;197

       (6) Two individuals who represent the public and have not 198
practiced chemical dependency counseling or alcohol and other drug 199
prevention services and have not been involved in the delivery of 200
chemical dependency counseling services or alcohol and other drug 201
prevention services. At least one of these individuals shall be at 202
least sixty years of age. During their terms, the public members 203
shall not practice chemical dependency counseling or alcohol and 204
other drug prevention services or be involved in the delivery of 205
chemical dependency counseling services or alcohol and other drug 206
prevention services.207

       (C) Not later than ninety days after the effective date of 208
this sectionDecember 23, 2002, the director of alcohol and drug 209
addiction services shall appoint an individual who represents the 210
department of alcohol and drug addiction services to serve as an 211
ex officio member of the chemical dependency professionals board.212

       (D) Not more than one-half of the voting members of the board 213
may be of the same gender or members of the same political party. 214
At least two voting members of the board shall be of African, 215
Native American, Hispanic, or Asian descent.216

       Sec. 4758.20. (A) The chemical dependency professionals board 217
shall adopt rules to establish, specify, or provide for all of the 218
following:219

       (1) Fees for the purposes authorized by section 4758.21 of 220
the Revised Code;221

       (2) If the board, pursuant to section 4758.221 of the Revised 222
Code, elects to administer examinations for individuals seeking to 223
act as substance abuse professionals in a U.S. department of 224
transportation drug and alcohol testing program, the board's 225
administration of the examinations;226

       (3) For the purpose of section 4758.23 of the Revised Code, 227
codes of ethical practice and professional conduct for individuals 228
who hold a license or certificate issued under this chapter;229

       (3)(4) For the purpose of section 4758.24 of the Revised 230
Code, all of the following:231

       (a) Good moral character requirements for an individual who 232
seeks or holds a license or certificate issued under this chapter;233

       (b) The documents that an individual seeking such a license 234
or certificate must submit to the board;235

       (c) Requirements to obtain the license or certificate that 236
are in addition to the requirements established under sections 237
4758.39, 4758.40, 4758.41, 4758.42, 4758.43, 4758.44, and 4758.45, 238
4758.46, and 4758.47 of the Revised Code. The additional 239
requirements may include preceptorships.240

       (d) The period of time that an individual whose registered 241
applicant certificate has expired must wait before applying for a 242
new registered applicant certificate.243

       (4) Procedures for renewal of a chemical dependency counselor 244
I license under section 4758.27 of the Revised Code;245

       (5) For the purpose of section 4758.28 of the Revised Code, 246
requirements for approval of continuing education courses of study 247
for individuals who hold a license or certificate issued under 248
this chapter;249

       (6) For the purpose of section 4758.30 of the Revised Code, 250
the intervention for and treatment of an individual holding a 251
license or certificate issued under this chapter whose abilities 252
to practice are impaired due to abuse of or dependency on alcohol 253
or other drugs or other physical or mental condition;254

       (7) Requirements governing reinstatement of a suspended or 255
revoked license or certificate under division (B) of section 256
4758.30 of the Revised Code, including requirements for 257
determining the amount of time an individual must wait to apply 258
for reinstatement;259

       (8) For the purpose of section 4758.31 of the Revised Code, 260
methods of ensuring that all records the board holds pertaining to 261
an investigation remain confidential during the investigation;262

       (9) Criteria for employees of the board to follow when 263
performing their duties under division (B) of section 4758.35 of 264
the Revised Code;265

       (10) For the purpose of division (A)(1) of section 4758.39 266
and division (A)(1) of section 4758.40 of the Revised Code, course 267
requirements for a degree in a behavioral sciencesscience or 268
nursing that shall, at a minimum, include at least sixty quarter269
forty semester hours, or the equivalent number of semester hours,270
in all of the following courses:271

       (a) Theories of counseling and psychotherapy;272

       (b) Counseling procedures;273

       (c) Group process and techniques;274

       (d) Relationship therapy;275

       (e) Research methods and statistics;276

       (f) Fundamentals of assessment and diagnosis, including 277
measurement and appraisal;278

       (g) Psychopathology;279

       (h) Human development;280

       (i) Cultural competence in counseling;281

       (j) Ethics.282

       (11) For the purpose of division (A)(3) of section 4758.39,283
division (A)(3) of section 4758.40, division (A)(3) of section 284
4758.41, and division (A)(3) of section 4758.42 of the Revised 285
Code, training requirements for chemical dependency that shall, at 286
a minimum, include qualifications for the individuals who provide 287
the training and instruction in all of the following courses:288

       (a) Theories of addiction;289

       (b) Counseling procedures and strategies with addicted 290
populations;291

       (c) Group process and techniques working with addicted 292
populations;293

       (d) Assessment and diagnosis of addiction;294

       (e) Relationship counseling with addicted populations;295

       (f) Pharmacology;296

       (g) Prevention strategies;297

       (h) Treatment planning;298

       (i) Legal and ethical issues.299

       (12) For the purpose of division (B)(2)(b) of section 4758.40 300
and division (B)(2) of section 4758.41 of the Revised Code, 301
requirements for the forty clock hours of training on the version 302
of the diagnostic and statistical manual of mental disorders that 303
is current at the time of the training, including the number of 304
the clock hours that must be on substance-related disorders, the 305
number of the clock hours that must be on chemical dependency 306
conditions, and the number of the clock hours that must be on 307
awareness of other mental and emotional disorders;308

       (13) For the purpose of division (A)(1) of section 4758.41 of 309
the Revised Code, course requirements for a bachelor's degree in a310
behavioral sciencesscience or nursing;311

       (14) For the purpose of division (A) of section 4758.43 of 312
the Revised Code, training requirements for chemical dependency 313
counseling that shall, at a minimum, include qualifications for 314
the individuals who provide the training and instruction in one or 315
more of the courses listed in division (A)(11)(10) of this section 316
as selected by the individual seeking the chemical dependency 317
counselor assistant certificate;318

       (15) For the purpose of division (A)(2) of section 4758.44 319
and division (A)(2) of section 4758.45 of the Revised Code, the 320
field of study in which an individual must obtain at least a 321
bachelor's degree;322

       (16) For the purpose of division (A)(3) of section 4758.44, 323
division (A)(3) of section 4758.45, and division (A)(2)(D) of 324
section 4758.534758.46 of the Revised Code, requirements for 325
prevention-related education;326

       (16)(17) For the purpose of division (A)(4) of section 327
4758.44 of the Revised Code, the number of hours of administrative 328
or supervisory education that an individual must have;329

       (18) For the purpose of section 4758.51 of the Revised Code, 330
continuing education requirements for individuals who hold a 331
license or certificate issued under this chapter;332

       (17)(19) For the purpose of section 4758.51 of the Revised 333
Code, the number of hours of continuing education that an 334
individual must complete to have an expired license or certificate 335
restored under section 4758.26 of the Revised Code;336

       (18)(20) For the purpose of divisions (A) and (B) of section 337
4758.534758.52 of the Revised Code, thetraining requirements an 338
individual holding a registered applicant certificate must 339
complete to take an examination administered pursuant to section 340
4758.22 of the Revised Code to obtain a prevention specialist II 341
certificate or prevention specialist I certificate and the 342
documentation the individual must submit to the board showing that 343
the individual has completed the requirementsfor chemical 344
dependency counseling;345

       (19) The method of determining the amount of time an 346
individual must wait to apply to the board for a new registered 347
applicant certificate under division (B) of section 4758.53 of the 348
Revised Code;349

       (20)(21) The duties, which may differ, of anall of the 350
following:351

       (a) An independent chemical dependency counselor352
counselor-clinical supervisor licensed under this chapter who 353
supervises a chemical dependency counselor III under section 354
4758.56 of the Revised Code; independent355

       (b) An independent chemical dependency counselor-clinical 356
supervisor, independent chemical dependency counselor, or chemical 357
dependency counselor III licensed under this chapter who 358
supervises a chemical dependency counselor assistant under section 359
4758.59 of the Revised Code; or360

       (c) A prevention specialist II or prevention specialist I 361
certified under this chapter or independent chemical dependency 362
counselor-clinical supervisor, independent chemical dependency 363
counselor, or chemical dependency counselor III, or chemical 364
dependency counselor II licensed under this chapter who supervises 365
a prevention specialist assistant or registered applicant under 366
section 4758.61 of the Revised Code. The duties may differ.367

       (21)(22) Anything else necessary to administer this chapter.368

       (B) All rules adopted under this section shall be adopted in 369
accordance with Chapter 119. of the Revised Code and any 370
applicable federal laws and regulations. Initial rules shall be 371
adopted not later than nine months after December 23, 2002.372

       (C) When it adopts rules under this section, the board may 373
consider standards established by any national association or 374
other organization representing the interests of those involved in 375
chemical dependency counseling or alcohol and other drug 376
prevention services.377

       Sec. 4758.21. (A) In accordance with rules adopted under 378
section 4758.20 of the Revised Code and subject to division (B) of 379
this section, the chemical dependency professionals board shall 380
establish, and may from time to time adjust, fees to be charged 381
for the following:382

       (1) Admitting an individual to an examination administered 383
pursuant to section 4758.22 of the Revised Code;384

       (2) Issuing an initial independent chemical dependency 385
counselor-clinical supervisor license, independent chemical 386
dependency counselor license, chemical dependency counselor III 387
license, chemical dependency counselor II license, chemical 388
dependency counselor assistant certificate, prevention specialist 389
II certificate, prevention specialist I certificate, prevention 390
specialist assistant certificate, or registered applicant 391
certificate;392

       (3) Renewing an independent chemical dependency 393
counselor-clinical supervisor license, independent chemical 394
dependency counselor license, chemical dependency counselor III 395
license, chemical dependency counselor II license, chemical 396
dependency counselor I certificate, chemical dependency counselor 397
assistant certificate, prevention specialist II certificate, 398
prevention specialist I certificate, or registered applicant399
prevention specialist assistant certificate;400

       (4) Approving continuing education courses under section 401
4758.28 of the Revised Code;402

       (5) Doing anything else the board determines necessary to 403
administer this chapter.404

       (B) The fees established under division (A) of this section 405
are nonrefundable. They shall be in amounts sufficient to cover 406
the necessary expenses of the board in administering this chapter 407
and rules adopted under it. The fees for a license or certificate 408
and the renewal of a license or certificate may differ for the 409
various types of licenses and certificates, but shall not exceed 410
one hundred seventy-five dollars each, unless the board determines 411
that amounts in excess of one hundred seventy-five dollars are 412
needed to cover its necessary expenses in administering this 413
chapter and rules adopted under it and the amounts in excess of 414
one hundred seventy-five dollars are approved by the controlling 415
board.416

       (C) All vouchers of the board shall be approved by the 417
chairperson or executive director of the board, or both, as 418
authorized by the board.419

       Sec. 4758.22. The chemical dependency professionals board 420
shall prepare, cause to be prepared, or procure the use of, and 421
grade, cause to be graded, or procure the grading of, examinations 422
to determine the competence of individuals seeking an independent 423
chemical dependency counselor-clinical supervisor license,424
independent chemical dependency counselor license, chemical 425
dependency counselor III license, chemical dependency counselor II 426
license, prevention specialist II certificate, or prevention 427
specialist I certificate. The board may develop the examinations 428
or use examinations prepared by state or national organizations 429
that represent the interests of those involved in chemical 430
dependency counseling or alcohol and other drug prevention 431
services. The board shall conduct examinations at least twice each 432
year and shall determine the level of competence necessary for a 433
passing score.434

       An individual may not sit for an examination administered 435
pursuant to this section unless the individual meets the 436
requirements to obtain the license or certificate the individual 437
seeks, other than the requirement to have passed the examination, 438
and pays the fee established under section 4758.21 of the Revised 439
Code. An individual who is denied admission to the examination may 440
appeal the denial in accordance with Chapter 119. of the Revised 441
Code.442

       Sec. 4758.221.  In accordance with rules adopted under 443
section 4758.20 of the Revised Code, the chemical dependency 444
professionals board may administer examinations for individuals 445
seeking to act as substance abuse professionals in a U.S. 446
department of transportation drug and alcohol testing program. If 447
it elects to administer the examinations, the board shall use 448
examinations that comprehensively cover all the elements of 449
substance abuse professional qualification training listed in 49 450
C.F.R. 40.281(c)(1) and are prepared by a nationally recognized 451
professional or training organization that represents the 452
interests of those involved in chemical dependency counseling 453
services.454

       Sec. 4758.23. (A) In rules adopted under section 4758.20 of 455
the Revised Code, the chemical dependency professionals board 456
shall establish codes of ethical practice and professional conduct 457
for the following:458

       (1) Individuals who hold a valid independent chemical 459
dependency counselor-clinical supervisor license, independent 460
chemical dependency counselor license, chemical dependency 461
counselor III license, chemical dependency counselor II license, 462
chemical dependency counselor I certificate, or chemical 463
dependency counselor assistant certificate issued under this 464
chapter;465

       (2) Individuals who hold a valid prevention specialist II 466
certificate, prevention specialist I certificate, prevention 467
specialist assistant certificate, or registered applicant 468
certificate issued under this chapter.469

       (B) The codes for individuals identified under division 470
(A)(1) of this section shall define unprofessional conduct, which 471
shall include engaging in a dual relationship with a client, 472
former client, consumer, or former consumer; committing an act of 473
sexual abuse, misconduct, or exploitation of a client, former 474
client, consumer, or former consumer; and, except as permitted by 475
law, violating client or consumer confidentiality.476

       (C) The codes for individuals identified under division 477
(A)(1) of this section may be based on any codes of ethical 478
practice and professional conduct developed by national 479
associations or other organizations representing the interests of 480
those involved in chemical dependency counseling. The codes for 481
individuals identified under division (A)(2) of this section may 482
be based on any codes of ethical practice and professional conduct 483
developed by national associations or other organizations 484
representing the interests of those involved in alcohol and other 485
drug prevention services. The board may establish standards in the 486
codes that are more stringent than those established by the 487
national associations or other organizations.488

       Sec. 4758.24. (A) The chemical dependency professionals board 489
shall issue a license or certificate under this chapter to an 490
individual who meets all of the following requirements:491

       (1) Is of good moral character as determined in accordance 492
with rules adopted under section 4758.20 of the Revised Code;493

       (2) SubmitsExcept as provided in section 4758.241 of the 494
Revised Code, submits a properly completed application and all 495
other documentation specified in rules adopted under section 496
4758.20 of the Revised Code;497

       (3) PaysExcept as provided in section 4758.241 of the 498
Revised Code, pays the fee established under section 4758.21 of 499
the Revised Code for the license or certificate that the 500
individual seeks;501

       (4) Meets the requirements to obtain the license or 502
certificate that the individual seeks as specified in section 503
4758.39, 4758.40, 4758.41, 4758.42, 4758.43, 4758.44, or 4758.45, 504
4758.46, or 4758.47 of the Revised Code;505

       (5) Meets any additional requirements specified in rules 506
adopted under section 4758.20 of the Revised Code to obtain the 507
license or certificate that the individual seeks.508

       (B) The board shall not issue an initialdo either of the 509
following:510

       (1) Issue a certificate to practice as a chemical dependency 511
counselor I;512

       (2) Issue a new registered applicant certificate to an 513
individual whose previous registered applicant certificate has 514
been expired for less than the period of time specified in rules 515
adopted under section 4758.20 of the Revised Code.516

       Sec. 4758.241. The chemical dependency professionals board 517
shall issue an independent chemical dependency counselor-clinical 518
supervisor license under section 4758.24 of the Revised Code to 519
each individual who, on the effective date of this section, holds 520
a valid independent chemical dependency counselor license without 521
requiring the individual to comply with divisions (A)(2) and (3) 522
of that section.523

       Sec. 4758.26. (A) Except as provided inSubject to section 524
4758.274758.30 of the Revised Code, a license or certificate 525
issued under this chapter, other than a registered applicant 526
certificate, expires two yearsthe following period of time after 527
it is issued and may be renewed in accordance with the standard 528
renewal procedure established under Chapter 4745. of the Revised 529
Code:530

       (1) In the case of an initial chemical dependency counselor 531
assistant certificate, thirteen months;532

       (2) In the case of any other license or certificate, two 533
years.534

       (B) Subject to section 4758.30 of the Revised Code and except 535
as provided in section 4758.27 of the Revised Code, the chemical 536
dependency professionals board shall renew a license or 537
certificate issued under this chapter, other than a registered 538
applicant certificate,in accordance with the standard renewal 539
procedure established under Chapter 4745. of the Revised Code if 540
the individual seeking the renewal pays the renewal fee 541
established under section 4758.21 of the Revised Code and does the 542
following:543

       (1) In the case of an individual seeking renewal of an 544
initial chemical dependency counselor assistant certificate, 545
satisfies the additional training requirement established under 546
section 4758.52 of the Revised Code;547

       (2) In the case of any other individual, satisfies the 548
continuing education requirements established under section 549
4758.51 of the Revised Code.550

       (C) ExceptSubject to section 4758.30 of the Revised Code and 551
except as provided in section 4758.27 of the Revised Code, a 552
license or certificate issued under this chapter, other than a 553
registered applicant certificate, that has expired may be restored 554
if the individual seeking the restoration, not later than two 555
years after the license or certificate expires, applies for 556
restoration of the license or certificate. The board shall issue a 557
restored license or certificate to the individual if the 558
individual pays the renewal fee established under section 4758.21 559
of the Revised Code and does the following:560

       (1) In the case of an individual whose initial chemical 561
dependency counselor assistant certificate expired, satisfies the 562
additional training requirement established under section 4758.52 563
of the Revised Code;564

       (2) In the case of any other individual, satisfies the 565
continuing education requirements established under section 566
4758.51 of the Revised Code for restoring the license or 567
certificate. The568

       The board shall not require an individual to take an 569
examination as a condition of having an expired license or 570
certificate restored under this section.571

       Sec. 4758.27. Until the date that is six years after the 572
effective date of this section, the chemical dependency 573
professionals board shall renew a certificate that on the 574
effective date of this section is accepted under section 3793.07 575
of the Revised Code as authority to practice as a chemical 576
dependency counselor I if the individual holding the certificate 577
renews the certificate in accordance with rules adopted under 578
section 4758.20 of the Revised Code and pays the renewal fee 579
established under section 4758.21 of the Revised Code. Subsequent 580
renewals shall be done under section 4758.26 of the Revised Code.581

       After the date that is six years after the effective date of 582
this section, theThe chemical dependency professionals board 583
shall not renew under this section, or renew or restore under 584
section 4758.26 of the Revised Code, aeither of the following:585

       (A) A certificate to practice as a certified chemical 586
dependency counselor I;587

       (B) A registered applicant certificate.588

       Sec. 4758.30. (A) The chemical dependency professionals 589
board, in accordance with Chapter 119. of the Revised Code, may 590
refuse to issue a license or certificate applied for under this 591
chapter; refuse to renew or restore a license or certificate 592
issued under this chapter; suspend, revoke, or otherwise restrict 593
a license or certificate issued under this chapter; or reprimand 594
an individual holding a license or certificate issued under this 595
chapter. These actions may be taken by the board regarding the 596
applicant for a license or certificate or the individual holding a 597
license or certificate for one or more of the following reasons:598

       (1) Violation of any provision of this chapter or rules 599
adopted under it;600

       (2) Knowingly making a false statement on an application for 601
a license or certificate or for renewal, restoration, or 602
reinstatement of a license or certificate;603

       (3) Acceptance of a commission or rebate for referring an 604
individual to a person who holds a license or certificate issued 605
by, or who is registered with, an entity of state government, 606
including persons practicing chemical dependency counseling, 607
alcohol and other drug prevention services, or fields related to 608
chemical dependency counseling or alcohol and other drug 609
prevention services;610

       (4) Conviction in this or any other state of any crime that 611
is a felony in this state;612

       (5) Conviction in this or any other state of a misdemeanor 613
committed in the course of practice as an independent chemical 614
dependency counselor-clinical supervisor, independent chemical 615
dependency counselor, chemical dependency counselor III, chemical 616
dependency counselor II, chemical dependency counselor I, chemical 617
dependency counselor assistant, prevention specialist II, 618
prevention specialist I, prevention specialist assistant, or 619
registered applicant;620

       (6) Inability to practice as an independent chemical 621
dependency counselor-clinical supervisor, independent chemical 622
dependency counselor, chemical dependency counselor III, chemical 623
dependency counselor II, chemical dependency counselor I, chemical 624
dependency counselor assistant, prevention specialist II, 625
prevention specialist I, prevention specialist assistant, or 626
registered applicant due to abuse of or dependency on alcohol or 627
other drugs or other physical or mental condition;628

       (7) Practicing outside the individual's scope of practice;629

       (8) Practicing without complying with the supervision 630
requirements specified under section 4758.56, 4758.59, or 4758.61 631
of the Revised Code;632

       (9) Violation of the code of ethical practice and 633
professional conduct for chemical dependency counseling or alcohol 634
and other drug prevention services adopted by the board pursuant 635
to section 4758.23 of the Revised Code;636

       (10) Revocation of a license or certificate or voluntary 637
surrender of a license or certificate in another state or 638
jurisdiction for an offense that would be a violation of this 639
chapter.640

       (B) An individual whose license or certificate has been 641
suspended or revoked under this section may apply to the board for 642
reinstatement after an amount of time the board shall determine in 643
accordance with rules adopted under section 4758.20 of the Revised 644
Code. The board may accept or refuse an application for 645
reinstatement. The board may require an examination for 646
reinstatement of a license or certificate that has been suspended 647
or revoked.648

       Sec. 4758.39. An individual seeking an independent chemical 649
dependency counselor-clinical supervisor license shall meet the 650
requirements of division (A) or (B) of this section.651

       (A) To meet the requirements of this division, an individual 652
must meet all of the following requirements:653

       (1) Hold from an accredited educational institution at least 654
a master's degree in either a behavioral science or nursing that 655
meets the course requirements specified in rules adopted under 656
section 4758.20 of the Revised Code;657

       (2) Have not less than six thousand hours of compensated work 658
or supervised internship experience (including at least two 659
thousand hours of clinical supervisory experience as part of the 660
compensated work or supervised internship) in any of the 661
following, not less than one thousand two hundred hours of which 662
are in chemical dependency counseling:663

       (a) Chemical dependency services, substance abuse services, 664
or both types of services;665

       (b) The practice of psychology, as defined in section 4732.01 666
of the Revised Code;667

       (c) The practice of professional counseling, the practice of 668
social work, or the practice of marriage and family therapy, all 669
as defined in section 4757.01 of the Revised Code.670

       (3) Have a minimum of one hundred eighty hours of training in 671
chemical dependency that meets the requirements specified in rules 672
adopted under section 4758.20 of the Revised Code;673

       (4) Unless the individual holds a valid license, 674
registration, certificate, or credentials issued under another 675
chapter of the Revised Code that authorizes the individual to 676
engage in a profession whose scope of practice includes the 677
clinical supervision of chemical dependency counseling, chemical 678
dependency counseling, and diagnosing and treating chemical 679
dependency conditions, pass one or more examinations administered 680
pursuant to section 4758.22 of the Revised Code for the purpose of 681
determining competence to practice as an independent chemical 682
dependency counselor-clinical supervisor.683

       (B) To meet the requirement of this division, an individual 684
must hold, on the effective date of this section, a valid 685
independent chemical dependency counselor license.686

       Sec. 4758.40. An individual seeking an independent chemical 687
dependency counselor license shall meet either of the following688
requirements:of division (A) or (B) of this section.689

       (A) MeetTo meet the requirements of this division, an 690
individual must meet all of the following requirements:691

       (1) Hold from an accredited educational institution at least 692
a master's degree in a behavioral sciencesscience or nursing that 693
meets the course requirements specified in rules adopted under 694
section 4758.20 of the Revised Code;695

       (2) Have not less than fourtwo thousand hours of compensated 696
work or supervised internship experience in eitherany of the 697
following, not less than eightfour hundred hours of which are in 698
chemical dependency counseling:699

       (a) Chemical dependency services, substance abuse services, 700
or both types of services;701

       (b) The practice of psychology, as defined in section 4732.01 702
of the Revised Code, or the;703

       (c) The practice of professional counseling or, the practice 704
of social work, bothor the practice of marriage and family 705
therapy, all as defined in section 4757.01 of the Revised Code.706

       (3) Have a minimum of twoone hundred seventyeighty hours of 707
training in chemical dependency that meets the requirements 708
specified in rules adopted under section 4758.20 of the Revised 709
Code;710

       (4) PassUnless the individual holds a valid license, 711
registration, certificate, or credentials issued under another 712
chapter of the Revised Code that authorizes the individual to 713
engage in a profession whose scope of practice includes chemical 714
dependency counseling and diagnosing and treating chemical 715
dependency conditions, pass one or more examinations administered 716
pursuant to section 4758.22 of the Revised Code for the purpose of 717
determining competence to practice as an independent chemical 718
dependency counselor.719

       (B) MeetTo meet the requirements of this division, an 720
individual must meet both of the following requirements:721

       (1) Hold, on December 23, 2002, a certificate or credentials 722
that were accepted under former section 3793.07 of the Revised 723
Code as authority to practice as a certified chemical dependency 724
counselor III or certified chemical dependency counselor III-E;725

       (2) Meet one of the following requirements:726

       (a) Hold the degree described in division (A)(1) of this 727
section;728

       (b) Have held a chemical dependency counselor III, II, or I 729
certificate for at least eight consecutive years and have not less 730
than forty clock hours of training on the version of the 731
diagnostic and statistical manual of mental disorders that is 732
current at the time of the training. The training must meet the 733
requirements specified in rules adopted under section 4758.20 of 734
the Revised Code. An individual authorized under Chapter 4731. of 735
the Revised Code to practice medicine and surgery or osteopathic 736
medicine and surgery, a psychologist licensed under Chapter 4732. 737
of the Revised Code, or a professional clinical counselor or 738
independent social worker licensed under Chapter 4757. of the 739
Revised Code may provide any portion of the training. An 740
independent chemical dependency counselor licensed under this 741
chapter who holds the degree described in division (A)(1) of this 742
section may provide the portion of the training on chemical 743
dependency conditions.744

       Sec. 4758.41. An individual seeking a chemical dependency 745
counselor III license shall meet any of the following746
requirements:of division (A), (B), or (C) of this section.747

       (A) MeetTo meet the requirements of this division, an 748
individual must meet all of the following requirements:749

       (1) Hold from an accredited educational institution at least750
a bachelor's degree in a behavioral science or nursing that meets 751
the course requirements specified in rules adopted under section 752
4758.20 of the Revised Code;753

       (2) Have not less than fourtwo thousand hours of compensated 754
work experience in eitherany of the following, not less than 755
eightfour hundred work hours of which are in chemical dependency 756
counseling:757

       (a) Chemical dependency services, substance abuse services, 758
or both types of services;759

       (b) The practice of psychology, as defined in section 4732.01 760
of the Revised Code, or the;761

       (c) The practice of professional counseling or, the practice 762
of social work, bothor the practice of marriage and family 763
therapy, all as defined in section 4757.01 of the Revised Code.764

       (3) Have a minimum of twoone hundred seventyeighty hours of 765
training in chemical dependency that meets the requirements 766
specified in rules adopted under section 4758.20 of the Revised 767
Code;768

       (4) PassUnless the individual holds a valid license, 769
registration, certificate, or credentials issued under another 770
chapter of the Revised Code that authorizes the individual to 771
engage in a profession whose scope of practice includes chemical 772
dependency counseling and diagnosing and treating chemical 773
dependency conditions, pass one or more examinations administered 774
pursuant to section 4758.22 of the Revised Code for the purpose of 775
determining competence to practice as a chemical dependency 776
counselor III.777

       (B) MeetTo meet the requirements of this division, an 778
individual must meet both of the following requirements:779

       (1) Hold, on December 23, 2002, a certificate or credentials 780
that were accepted under former section 3793.07 of the Revised 781
Code as authority to practice as a certified chemical dependency 782
counselor III or certified chemical dependency counselor III-E;783

       (2) Have not less than forty clock hours of training on the 784
version of the diagnostic and statistical manual of mental 785
disorders that is current at the time of the training. The 786
training must meet the requirements specified in rules adopted 787
under section 4758.20 of the Revised Code. An individual 788
authorized under Chapter 4731. of the Revised Code to practice 789
medicine and surgery or osteopathic medicine and surgery, a 790
psychologist licensed under Chapter 4732. of the Revised Code, or 791
a professional clinical counselor or independent social worker 792
licensed under Chapter 4757. of the Revised Code may provide any 793
portion of the training. An independent chemical dependency 794
counselor licensed under this chapter who holds the degree 795
described in division (A)(1) of section 4758.40 of the Revised 796
Code may provide the portion of the training on chemical 797
dependency conditions.798

       (C) MeetTo meet the requirements of this division, an 799
individual must meet all of the following requirements:800

       (1) Hold, on December 23, 2002, a certificate or credentials 801
that were accepted under former section 3793.07 of the Revised 802
Code as authority to practice as a certified chemical dependency 803
counselor II;804

       (2) Meet the requirement of division (B)(2) of this section;805

       (3) Hold a bachelor's degree in a behavioral science.806

       Sec. 4758.42. An individual seeking a chemical dependency 807
counselor II license shall meet either of the following808
requirements:of division (A) or (B) of this section.809

       (A) MeetTo meet the requirements of this division, an 810
individual must meet all of the following requirements:811

       (1) Hold from an accredited educational institution an 812
associate's degree in a behavioral science or nursing or a 813
bachelor's degree in any field;814

       (2)(a) If the individual holds an associate's degree, have815
Have not less than fivetwo thousand hours of compensated or 816
volunteer work, supervised internship, field placement, intern, or 817
practicum experience in eitherany of the following, not less than 818
one thousandfour hundred hours of which are in chemical 819
dependency counseling:820

       (i)(a) Chemical dependency services, substance abuse 821
services, or both types of services;822

       (ii)(b) The practice of psychology, as defined in section 823
4732.01 of the Revised Code, or the;824

       (c) The practice of professional counseling or, the practice 825
of social work, bothor the practice of marriage and family 826
therapy, all as defined in section 4757.01 of the Revised Code.827

       (b) If the individual holds a bachelor's degree, have not 828
less than six thousand hours of compensated or volunteer work, 829
field placement, intern, or practicum experience in either of the 830
following, not less than one thousand two hundred hours of which 831
are in chemical dependency counseling:832

       (i) Chemical dependency services, substance abuse services, 833
or both types of services;834

       (ii) The practice of psychology, as defined in section 835
4732.01 of the Revised Code, or the practice of professional 836
counseling or the practice of social work, both as defined in 837
section 4757.01 of the Revised Code.838

       (3) Have a minimum of twoone hundred seventyeighty hours of 839
training in chemical dependency that meets the requirements 840
specified in rules adopted under section 4758.20 of the Revised 841
Code;842

       (4) Pass one or more examinations administered pursuant to 843
section 4758.22 of the Revised Code for the purpose of determining 844
competence to practice as a chemical dependency counselor II.845

       (B) HoldTo meet the requirement of this division, an 846
individual must hold, on December 23, 2002, a certificate or 847
credentials that were accepted under former section 3793.07 of the 848
Revised Code as authority to practice as a certified chemical 849
dependency counselor II.850

       Sec. 4758.43. An individual seeking a chemical dependency 851
counselor assistant certificate shall meet either of the following 852
requirements:853

       (A) Have at least forty hours of training in chemical 854
dependency counseling that meets the requirements specified in 855
rules adopted under section 4758.20 of the Revised Code.;856

       (B) Hold, on the effective date of this sectionDecember 23, 857
2002, a certificate or credentials that were accepted under former858
section 3793.07 of the Revised Code as authority to practice as a 859
registered candidate.860

       Sec. 4758.44. An individual seeking a prevention specialist 861
II certificate shall meet either of the following requirements:of 862
division (A) or (B) of this section.863

       (A) MeetTo meet the requirements of this division, an 864
individual must meet all of the following requirements:865

       (1) Have at least six thousand hours of compensated work 866
experience in which not less than fifty per cent of the 867
individual's time was devoted to planning, coordinatingin alcohol 868
and other drug prevention services, including at least four 869
thousand hours of administering or delivering alcohol and other 870
drug preventionsupervising the services;871

       (2) Have one of the following:872

       (a) A bachelor's degree in a behavioral science and at least 873
six thousand hours of compensated work experience in alcohol and 874
other drug prevention services;875

       (b) A master's or doctoral degree in a behavioral science and 876
at least four thousand hours of compensated work experience in 877
alcohol and other drug prevention services.Hold from an 878
accredited educational institution at least a bachelor's degree in 879
a field of study specified in rules adopted under section 4758.20 880
of the Revised Code;881

       (3) Have at least twoone hundred seventy hours of 882
prevention-related education that meets the requirements specified 883
in rules adopted under section 4758.20 of the Revised Code;884

       (4) Obtain a registered applicant certificate under this 885
chapter and comply with the requirements ofHave at least the 886
number of hours of administrative or supervisory education 887
specified in rules adopted under section 4758.534758.20 of the 888
Revised Code;889

       (5) Pass the examinationone or more examinations890
administered pursuant to section 4758.22 of the Revised Code for 891
the purpose of determining competence to practice as a prevention 892
specialist II.893

       (B) HoldTo meet the requirement of this division, an 894
individual must hold, on the effective date of this section895
December 23, 2002, a certificate or credentials that were accepted 896
under former section 3793.07 of the Revised Code as authority to 897
practice as a certified prevention specialist II.898

       Sec. 4758.45. An individual seeking a prevention specialist I 899
certificate shall meet either of the following requirements:of 900
division (A) or (B) of this section.901

       (A) MeetTo meet the requirements of this division, an 902
individual must meet all of the following requirements:903

       (1) Have at least two thousand hours of compensated or 904
volunteer work, field placement, intern, or practicum experience 905
in which not less than twenty per cent of the individual's time 906
was devoted toalcohol and other drug prevention services, 907
including at least four hundred hours of planning or delivering 908
alcohol and other drug preventionthe services;909

       (2) Have one of the following:910

       (a) At least six thousand hours of compensated or volunteer 911
work, field placement, intern, or practicum experience in alcohol 912
and other drug prevention services;913

       (b) An associate's degree in a behavioral science and at 914
least four thousand hours of compensated or volunteer work, field 915
placement, intern, or practicum experience in alcohol and other 916
drug prevention services;917

       (c) A bachelor's, master's, or doctoral degree in a 918
behavioral science and at least two thousand hours of compensated 919
or volunteer work, field placement, intern, or practicum 920
experience in alcohol and other drug prevention services.Hold 921
from an accredited educational institution at least an associate's 922
degree in a field of study specified in rules adopted under 923
section 4758.20 of the Revised Code;924

       (3) Have at least one hundred eighty hours of 925
prevention-related education that meets the requirements specified 926
in rules adopted under section 4758.20 of the Revised Code;927

       (4) Obtain a registered applicant certificate under this 928
chapter and comply with the requirements of section 4758.53 of the 929
Revised Code;930

       (5) Pass the examinationone or more examinations931
administered pursuant to section 4758.22 of the Revised Code for 932
the purpose of determining competence to practice as a prevention 933
specialist I.934

       (B) HoldTo meet the requirement of this division, an 935
individual must hold, on the effective date of this section936
December 23, 2002, a certificate or credentials that were accepted 937
under former section 3793.07 of the Revised Code as authority to 938
practice as a certified prevention specialist I.939

       Sec. 4758.46. An individual seeking a prevention specialist 940
assistant certificate shall meet all of the following 941
requirements:942

       (A) Be at least eighteen years of age;943

       (B) Have at least a high school diploma or high school 944
equivalence diploma;945

       (C) Have at least one hundred hours of compensated or 946
volunteer work, field placement, intern, or practicum experience 947
in alcohol and other drug prevention services;948

       (D) Have at least forty-five hours of prevention-related 949
education that meets the requirements specified in rules adopted 950
under section 4758.20 of the Revised Code.951

       Sec. 4758.47. An individual seeking a registered applicant 952
certificate shall meet all of the following requirements:953

       (A) Be at least eighteen years of age;954

       (B) Have at least a high school diploma or high school 955
equivalence diploma;956

       (C) Submit to the chemical dependency professionals board a 957
professional development plan that is acceptable to the board.958

       Sec. 4758.51. (A) Except as provided in division (B)(C) of 959
this section and in accordance with rules adopted under section 960
4758.20 of the Revised Code, each individual who holds a license 961
or certificate issued under this chapter, other than an initial 962
chemical dependency counselor assistant certificate, shall 963
complete during the period that the license or certificate is in 964
effect not less than fortythe following number of clock hours of 965
continuing education as a condition of receiving a renewed license 966
or certificate:967

       (1) In the case of an individual holding a prevention 968
specialist assistant certificate, twenty;969

       (2) In the case of any other individual, forty. To have an 970
expired license or certificate restored,971

       (B) Except as provided in division (C) of this section, an 972
individual whose license or certificate issued under this chapter, 973
other than an initial chemical dependency counselor assistant 974
certificate, has expired shall complete the number of hours of 975
continuing education specified in rules adopted under section 976
4758.20 of the Revised Code as a condition of receiving a restored 977
license or certificate.978

       (B)(C) The chemical dependency professionals board may waive 979
the continuing education requirements established under this 980
section for individuals who are unable to fulfill them because of 981
military service, illness, residence outside the United States, or 982
any other reason the board considers acceptable.983

       Sec. 4758.52. (A) Except as provided in division (C) of this 984
section, each individual who holds an initial chemical dependency 985
counselor assistant certificate shall complete, during the first 986
twelve months that the initial certificate is in effect, at least 987
thirty additional hours of training in chemical dependency 988
counseling that meets the requirements specified in rules adopted 989
under section 4758.20 of the Revised Code as a condition of having 990
the initial certificate renewed.991

       (B) Except as provided in division (C) of this section, an 992
individual whose initial chemical dependency counselor assistant 993
certificate has expired shall complete at least thirty additional 994
hours of training in chemical dependency counseling that meets the 995
requirements specified in rules adopted under section 4758.20 of 996
the Revised Code as a condition of receiving a restored chemical 997
dependency counselor assistant certificate.998

       (C) The chemical dependency professionals board may waive the 999
additional training requirement established under this section for 1000
individuals who are unable to fulfill the requirement because of 1001
military service, illness, residence outside the United States, or 1002
any other reason the board considers acceptable.1003

       Sec. 4758.54. In addition to practicing chemical dependency 1004
counseling, an individual holding a valid independent chemical 1005
dependency counselor-clinical supervisor license may do all of the 1006
following:1007

       (A) Diagnose and treat chemical dependency conditions;1008

       (B) Perform treatment planning, assessment, crisis 1009
intervention, individual and group counseling, case management, 1010
and education services as they relate to abuse of and dependency 1011
on alcohol and other drugs;1012

       (C) Provide clinical supervision of chemical dependency 1013
counseling;1014

       (D) Refer individuals with nonchemical dependency conditions 1015
to appropriate sources of help.1016

       Sec. 4758.55.  In addition to practicing chemical dependency 1017
counseling, an individual holding a valid independent chemical 1018
dependency counselor license may do all of the following:1019

       (A) Diagnose and treat chemical dependency conditions;1020

       (B) Perform treatment planning, assessment, crisis 1021
intervention, individual and group counseling, case management, 1022
and education services as they relate to abuse of and dependency 1023
on alcohol and other drugs;1024

       (C) Provide clinical supervision of chemical dependency 1025
counseling under the supervision of any of the following:1026

       (1) An independent chemical dependency counselor-clinical 1027
supervisor licensed under this chapter;1028

       (2) An individual authorized under Chapter 4731. of the 1029
Revised Code to practice medicine and surgery or osteopathic 1030
medicine and surgery;1031

       (3) A psychologist licensed under Chapter 4732. of the 1032
Revised Code;1033

       (4) A registered nurse licensed under Chapter 4723. of the 1034
Revised Code or professional clinical counselor, independent 1035
social worker, or independent marriage and family therapist 1036
licensed under Chapter 4757. of the Revised Code if such 1037
supervision is consistent with the scope of practice of the 1038
registered nurse, professional clinical counselor, independent 1039
social worker, or independent marriage and family therapist.1040

       (D) Refer individuals with nonchemical dependency conditions 1041
to appropriate sources of help.1042

       Sec. 4758.56. (A) In addition to practicing chemical 1043
dependency counseling, an individual holding a valid chemical 1044
dependency counselor III license may do all of the following:1045

       (1) Diagnose chemical dependency conditions under the 1046
supervision of any of the following:1047

       (a) An independent chemical dependency counselor licensed 1048
under this chapter;1049

       (b) An individual authorized under Chapter 4731. of the 1050
Revised Code to practice medicine and surgery or osteopathic 1051
medicine and surgery;1052

       (c) A psychologist licensed under Chapter 4732. of the 1053
Revised Code;1054

       (d) A registered nurse licensed under Chapter 4723. of the 1055
Revised Code or professional clinical counselor or independent 1056
social worker licensed under Chapter 4757. of the Revised Code if 1057
such supervision is consistent with the scope of practice of the 1058
registered nurse, professional clinical counselor, or independent 1059
social worker.professionals listed in section 4758.561 of the 1060
Revised Code;1061

       (2) Treat chemical dependency conditions;1062

       (3) Perform treatment planning, assessment, crisis 1063
intervention, individual and group counseling, case management, 1064
and education services as they relate to abuse of and dependency 1065
on alcohol and other drugs;1066

       (4) Provide clinical supervision of chemical dependency 1067
counseling under the supervision of any of the professionals 1068
listed in section 4758.561 of the Revised Code;1069

       (5) Refer individuals with nonchemical dependency conditions 1070
to appropriate sources of help.1071

       (B) A chemical dependency counselor III may not practice as 1072
an individual practitioner.1073

       Sec. 4758.561. Any of the following professionals may 1074
supervise a chemical dependency counselor III for purposes of 1075
divisions (A)(1) and (4) of section 4758.56 of the Revised Code:1076

       (A) An independent chemical dependency counselor-clinical 1077
supervisor licensed under this chapter;1078

       (B) An individual authorized under Chapter 4731. of the 1079
Revised Code to practice medicine and surgery or osteopathic 1080
medicine and surgery;1081

       (C) A psychologist licensed under Chapter 4732. of the 1082
Revised Code;1083

       (D) A registered nurse licensed under Chapter 4723. of the 1084
Revised Code or professional clinical counselor, independent 1085
social worker, or independent marriage and family therapist 1086
licensed under Chapter 4757. of the Revised Code if such 1087
supervision is consistent with the scope of practice of the 1088
registered nurse, professional clinical counselor, independent 1089
social worker, or independent marriage and family therapist.1090

       Sec. 4758.59. (A) Subject to division (B) of this section, an 1091
individual holding a valid chemical dependency counselor assistant 1092
certificate may do both of the following in addition to practicing 1093
chemical dependency counseling:1094

       (1) Perform treatment planning, assessment, crisis 1095
intervention, individual and group counseling, case management, 1096
and education services as they relate to abuse of or dependency on 1097
alcohol and other drugs;1098

       (2) Refer individuals with nonchemical dependency conditions 1099
to appropriate sources of help.1100

       (B) An individual holding a valid chemical dependency 1101
counselor assistant certificate may practice chemical dependency 1102
counseling and perform the tasks specified in division (A) of this 1103
section only while under the supervision of any of the following:1104

       (1) An independent chemical dependency counselor-clinical 1105
supervisor, independent chemical dependency counselor, or chemical 1106
dependency counselor III licensed under this chapter;1107

       (2) An individual authorized under Chapter 4731. of the 1108
Revised Code to practice medicine and surgery or osteopathic 1109
medicine and surgery;1110

       (3) A psychologist licensed under Chapter 4732. of the 1111
Revised Code;1112

       (4) A registered nurse licensed under Chapter 4723. of the 1113
Revised Code or professional clinical counselor or, independent 1114
social worker, or independent marriage and family therapist1115
licensed under Chapter 4757. of the Revised Code if such 1116
supervision is consistent with the scope of practice of the 1117
registered nurse, professional clinical counselor, or independent 1118
social worker, or independent marriage and family therapist.1119

       (C) A chemical dependency counselor assistant may not 1120
practice as an individual practitioner.1121

       Sec. 4758.61. An individual who holds a valid prevention 1122
specialist assistant certificate or registered applicant 1123
certificate issued under this chapter may engage in the practice 1124
of alcohol and other drug prevention services under the 1125
supervision of any of the following:1126

       (A) A prevention specialist II or prevention specialist I 1127
certified under this chapter;1128

       (B) An independent chemical dependency counselor-clinical 1129
supervisor, an independent chemical dependency counselor, or a 1130
chemical dependency counselor III, or a chemical dependency 1131
counselor II licensed under this chapter;1132

       (C) An individual authorized under Chapter 4731. of the 1133
Revised Code to practice medicine and surgery or osteopathic 1134
medicine and surgery;1135

        (D) A psychologist licensed under Chapter 4732. of the 1136
Revised Code;1137

       (E) A registered nurse licensed under Chapter 4723. of the 1138
Revised Code;1139

        (F) A professional clinical counselor, a professional 1140
counselor, an independent social worker, or a social worker, an 1141
independent marriage and family therapist, or a marriage and 1142
family therapist licensed under Chapter 4757. of the Revised Code;1143

        (G) A school counselor licensed by the department of 1144
education pursuant to section 3319.22 of the Revised Code;1145

        (H) A health education specialist certified by the national 1146
commission for health education credentialing.1147

       Sec. 4758.70. Except to the extent of providing services 1148
authorized by this chapter, this chapter does not authorize any 1149
individual to engage in either of the following:1150

       (A) The practice of psychology as defined in section 4732.01 1151
of the Revised Code.1152

       Except to the extent of providing services authorized by this 1153
chapter, this chapter does not authorize any individual to engage 1154
in the;1155

       (B) The practice of professional counseling or, practice of1156
social work, or practice of marriage and family therapy, as those 1157
terms are defined in section 4757.01 of the Revised Code.1158

       Section 2. That existing sections 4757.41, 4758.01, 4758.02, 1159
4758.10, 4758.20, 4758.21, 4758.22, 4758.23, 4758.24, 4758.26, 1160
4758.27, 4758.30, 4758.40, 4758.41, 4758.42, 4758.43, 4758.44, 1161
4758.45, 4758.51, 4758.55, 4758.56, 4758.59, 4758.61, and 4758.70 1162
and sections 3793.07, 4758.04, 4758.53, and 4758.58 of the Revised 1163
Code are hereby repealed.1164
