A BILL
To enact section 5501.70 of the Revised Code to 1
require the Director of Transportation to 2
designate portions of state highways, county or 3
township roads, or streets or highways located 4
within municipal corporations as memorial highways 5
in honor of each State Highway Patrol trooper, 6
county sheriff, deputy sheriff, township 7
constable, or police officer of a township police 8
department or district or law enforcement agency 9
of a municipal corporation who is or has been 10
killed in the line of duty.11


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5501.70 of the Revised Code be 12
enacted to read as follows:13

       Sec. 5501.70. (A)(1) The director of transportation, in 14
consultation with the director of public safety and the 15
superintendent of the state highway patrol, shall designate 16
portions of state highways, with each portion not exceeding twenty 17
miles in length, as a separate memorial highway in honor of each 18
state highway patrol trooper who is or has been killed in the line 19
of duty.20

        (2) The director of transportation, in consultation with the 21
appropriate county sheriffs, shall designate portions of state 22
highways, portions of county roads, or a combination of such 23
portions, with each portion or combined portions not exceeding 24
twenty miles in total length, as a memorial highway in honor of 25
each county sheriff or deputy sheriff who is or has been killed in 26
the line of duty.27

        (3) The director of transportation, in consultation with the 28
appropriate township constable or chief of a township police 29
department or district, shall designate portions of state 30
highways, portions of county roads, portions of township roads, or 31
a combination of such portions, with each portion or combined 32
portions not exceeding twenty miles in total length, as a memorial 33
highway in honor of each township constable or police officer of a 34
township police department or district who is or has been killed 35
in the line of duty.36

        (4) The director of transportation, in consultation with the 37
appropriate chiefs of the law enforcement agencies of municipal 38
corporations, shall designate portions of state highways, portions 39
of county roads, portions of township roads, a combination of such 40
portions, or a combination of such portions and a portion of a 41
street or highway located within a municipal corporation, with 42
each portion or combined portions not exceeding twenty miles in 43
total length, as a memorial highway in honor of each police 44
officer of a law enforcement agency of a municipal corporation who 45
is or has been killed in the line of duty.46

        (B) In acting under this section, the director of 47
transportation may designate a portion of a state highway, county 48
or township road, or street or highway located within a municipal 49
corporation that has been given a designation in Chapter 5533. of 50
the Revised Code, and if the director does so that portion shall 51
have both names. If the director designates any such portion under 52
this section and that portion subsequently is given a designation 53
in Chapter 5533. of the Revised Code, that portion shall have both 54
names unless the designation in Chapter 5533. of the Revised Code 55
expressly provides otherwise.56

        (C) Upon a designation made under this section, the director 57
of transportation may erect suitable markers along the state 58
highway, county or township road, or street or highway located 59
within a municipal corporation indicating its name.60
