A BILL
To enact section 122.177 of the Revised Code to 1
authorize the Development Services Agency to award 2
grants to businesses that employ high school 3
students in career exploration internships and to 4
make an appropriation. 5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 122.177 of the Revised Code be 6
enacted to read as follows:7

       Sec. 122.177.  (A) As used in this section:8

       (1) "Business" means a sole proprietorship, a corporation for 9
profit, or a pass-through entity as defined in section 5733.04 of 10
the Revised Code.11

       (2) "Career exploration internship" means a paid employment 12
relationship between a student intern and a business in which the 13
student intern acquires education, instruction, and experience 14
relevant to the student intern's career aspirations.15

       (3) "Student intern" means an individual who, at the time the 16
business applies for a grant under division (B) of this section, 17
meets both of the following criteria:18

       (a) The individual is entitled to attend school in this 19
state.20

       (b) The individual is either between sixteen and eighteen 21
years of age or is enrolled in grade eleven or twelve.22

       (B) There is hereby created in the development services 23
agency the career exploration internship program to award grants 24
to businesses that employ a student intern in a career exploration 25
internship. To qualify for a grant under the program, the career 26
exploration internship shall be at least twenty weeks in duration 27
and include at least two hundred hours of paid work and 28
instruction in this state. To obtain a grant, the business shall 29
apply to the development services agency before the starting date 30
of the career exploration internship. The application shall 31
include all of the following:32

       (1) A brief description of the career exploration internship;33

       (2) A signed statement by the student intern briefly 34
describing the student intern's career aspirations and how the 35
student intern believes this career exploration internship may 36
help achieve those aspirations;37

       (3) A signed statement by a principal or guidance counselor 38
at the student intern's school or, in the case of a home schooled 39
student, an individual responsible for administering instruction 40
to the student intern, acknowledging that the employment 41
opportunity qualifies as a career exploration internship and 42
expressing intent to advise the student intern as provided in 43
division (E) of this section;44

       (4) The name, address, and telephone number of the business; 45

       (5) Any other information required by the development 46
services agency.47

       (C)(1) The development services agency shall review and make 48
a determination with respect to each application submitted under 49
division (B) of this section in the order in which the application 50
is received. The agency shall not approve any application under 51
this section that is received by the agency more than three years 52
after the effective date of H.B. 107 of the 130th general assembly 53
or that was submitted by a business that does not have substantial 54
operations in this state. The agency may not otherwise deny an 55
application unless the application is incomplete, the proposed 56
employment relationship does not qualify as a career exploration 57
internship for which a grant may be awarded under this section, 58
the business is ineligible to receive a grant under division 59
(D)(1) of this section, or the agency determines that approving 60
the application would cause the amount that could be awarded to 61
exceed the amount of money in the career exploration internship 62
fund.63

       (2) The agency shall send written notice of its determination 64
to the applicant within thirty days after receiving the 65
application. If the agency determines that the application shall 66
not be approved, the notice shall include the reasons for such 67
determination.68

       (3) The agency's determination is final and may not be 69
appealed for any reason. A business may submit a new or amended 70
application under division (B) of this section at any time before 71
or after receiving notice under division (C)(2) of this section.72

       (D)(1) In any calendar year, the development services agency 73
shall not award grants under this section to any business that has 74
received grants for three career exploration internships in that 75
calendar year. The agency shall not award a grant to a business 76
unless the agency receives a report from the business within 77
thirty days after the end of the career exploration internship or 78
thirteen months after the approval of the application, whichever 79
comes first, that includes all of the following:80

       (a) The date the student intern began the internship;81

       (b) The date the internship ended or a statement that the 82
student will continue to be employed by the business;83

       (c) The total number of hours during the internship that the 84
student intern was employed by the business;85

       (d) The total wages paid by the business to the student 86
intern during the internship;87

       (e) A signed statement by the student intern briefly 88
describing the duties performed during the internship and the 89
skills and experiences gained throughout the internship;90

       (f) Any other information required by the agency.91

       (2) If the agency receives the report and determines that it 92
contains all of the information and the statement required by 93
division (D)(1) of this section and that the career exploration 94
internship described in the report complies with all the 95
provisions of this section, the agency shall award a grant to the 96
business. The amount of the grant shall equal the lesser of the 97
following:98

       (a) Fifty per cent of the wages paid by the business to the 99
student intern for the first twelve months following the date the 100
application was approved;101

       (b) Five thousand dollars.102

       (E) The student intern and the principal, guidance counselor, 103
or other qualified individual who signed the statement described 104
in division (B)(3) of this section shall meet at least once in the 105
thirty days following the end of the career exploration internship 106
or in the thirteenth month following the start of the career 107
exploration internship, whichever comes first. The purpose of the 108
meeting is to discuss the student intern's experiences during the 109
career exploration internship, consider the practical applications 110
of these experiences to the student intern's career aspirations, 111
and to establish or confirm goals for the student intern. If 112
practicable, the meeting shall be in person. Otherwise, the 113
meeting may be conducted over the telephone.114

       (F) A business that receives a grant under this section may 115
submit a new application under division (B) of this section for 116
another career exploration internship with the same student 117
intern. Such an application does not have to include the 118
statements otherwise required by divisions (B)(2) and (3) of this 119
section.120

       (G) Annually, before the seventh day of January until the 121
January of the third year that follows the year that includes the 122
effective date of H.B. 107 of the 130th general assembly, the 123
development services agency shall compile a report indicating the 124
number of career exploration internships approved by the agency 125
under this section, the statements issued by the student interns 126
under divisions (B)(2) and (D)(1)(e) of this section, the number 127
of student interns that continued employment with the business 128
after the termination of the career exploration internship, and 129
the total amount of grants awarded under this section. The report 130
shall not disclose any student interns' personally identifiable 131
information. The agency shall provide copies of the report to the 132
governor, the speaker and minority leader of the house of 133
representatives, and the president and minority leader of the 134
senate.135

       (H) The development services agency may adopt rules necessary 136
to administer this section in accordance with Chapter 119. of the 137
Revised Code.138

       (I) The career exploration internship fund is hereby created 139
in the state treasury. The fund shall consist of a portion of the 140
proceeds from the upfront license fees paid for the casino 141
facilities authorized under Section 6(C) of Article XV, Ohio 142
Constitution. Money in the fund shall be used by the development 143
services agency to provide grants under this section.144

       Section 2. All items in this section are hereby appropriated 145
as designated out of any moneys in the state treasury to the 146
credit of the designated fund. For all appropriations made in this 147
act, those in the first column are for fiscal year 2014 and those 148
in the second column are for fiscal year 2015. The appropriations 149
made in this act are in addition to any other appropriations made 150
for the FY 2014-FY 2015 biennium.151

       CAREER EXPLORATION INTERNSHIP157

       The foregoing appropriation item 195616, Career Exploration 158
Internship, shall be used for the Career Exploration Internship 159
Program as described in section 122.177 of the Revised Code.160

       Section 3. TRANSFER TO CAREER EXPLORATION INTERNSHIP FUND161

       On July 1, 2014, or as soon as possible thereafter, the 162
Director of Budget and Management shall transfer $1,000,000 cash 163
from the Economic Development Programs Fund (Fund 5JC0) used by 164
the Board of Regents to the Career Exploration Internship Fund 165
(Fund 5NS0) used by the Development Services Agency. 166

       Section 4. Within the limits set forth in this act, the 167
Director of Budget and Management shall establish accounts 168
indicating the source and amount of funds for each appropriation 169
made in this act, and shall determine the form and manner in which 170
appropriation accounts shall be maintained. 171

        The appropriation contained in this act shall be accounted 172
for as though made in Am. Sub. H.B. 59 of the 130th General 173
Assembly. The appropriation made in this act is subject to all 174
provisions of Am. Sub. H.B. 59 of the 130th General Assembly that 175
are generally applicable to such appropriations.176
