A BILL
To amend sections 3335.02, 3335.09, 3337.01, 3339.01, 1
3341.02, 3343.02, 3344.01, 3350.10, 3352.01, 2
3356.01, 3359.01, 3361.01, 3362.01, and 3364.01 of 3
the Revised Code to grant student members of the 4
boards of trustees of state universities and the 5
Northeast Ohio Medical University voting power and 6
the authority to attend executive sessions.7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 3335.02, 3335.09, 3337.01, 3339.01, 8
3341.02, 3343.02, 3344.01, 3350.10, 3352.01, 3356.01, 3359.01, 9
3361.01, 3362.01, and 3364.01 of the Revised Code be amended to 10
read as follows:11

       Sec. 3335.02.  (A) The government of the Ohio state 12
university shall be vested in a board of fourteen trustees in 13
2005, and seventeen trustees beginning in 2006, who shall be 14
appointed by the governor, with the advice and consent of the 15
senate. Two of the seventeen trustees shall be students at the 16
Ohio state university, and their selection and terms shall be in 17
accordance with division (B) of this section. Except as provided 18
in division (C) of this section and except for the terms of 19
student members, terms of office shall be for nine years, 20
commencing on the fourteenth day of May and ending on the 21
thirteenth day of May. Each trustee shall hold office from the 22
date of appointment until the end of the term for which the 23
trustee was appointed. Any trustee appointed to fill a vacancy 24
occurring prior to the expiration of the term for which the 25
trustee's predecessor was appointed shall hold office for the 26
remainder of such term. Any trustee shall continue in office 27
subsequent to the expiration date of the trustee's term until the 28
trustee's successor takes office, or until a period of sixty days 29
has elapsed, whichever occurs first. No person who has served a 30
full nine-year term or more than six years of such a term shall be 31
eligible for reappointment until a period of four years has 32
elapsed since the last day of the term for which the person 33
previously served. The trustees shall not receive compensation for 34
their services, but shall be paid their reasonable necessary 35
expenses while engaged in the discharge of their official duties.36

       (B) The student members of the board of trustees of the Ohio 37
state university shall be students at the Ohio state university, 38
shall have no voting power on the board. Student members, and39
shall not be considered as members of the board in determining 40
whether a quorum is present. Student members shall not be entitled 41
to attend executive sessions of the board. The student members of 42
the board shall be appointed by the governor, with the advice and 43
consent of the senate, from a group of five candidates selected 44
pursuant to a procedure adopted by the university's student 45
governments and approved by the university's board of trustees. 46
The initial term of office of one of the student members shall 47
commence on May 14, 1988, and shall expire on May 13, 1989, and 48
the initial term of office of the other student member shall 49
commence on May 14, 1988, and expire on May 13, 1990. Thereafter, 50
terms of office of student members shall be for two years, each 51
term ending on the same day of the same month of the year as the 52
term it succeeds. In the event a student member cannot fulfill a 53
two-year term, a replacement shall be selected to fill the 54
unexpired term in the same manner used to make the original 55
selection.56

       No student shall be disqualified from membership on the board 57
of trustees because the student receives a scholarship, grant, 58
loan, or any other financial assistance payable out of the state 59
treasury or a university fund, or because the student is employed 60
by the university in a position pursuant to a work-study program 61
or other student employment, including as a graduate teaching 62
assistant, graduate administrative assistant, or graduate research 63
assistant, the compensation for which is payable out of the state 64
treasury or a university fund.65

       Acceptance of such financial assistance or employment by a 66
student trustee shall not be considered a violation of Chapter 67
102. or section 2921.42 or 2921.43 of the Revised Code.68

       (C)(1) The initial terms of office for the three additional 69
trustees appointed in 2005 shall commence on a date in 2005 that 70
is selected by the governor with one term of office expiring on 71
May 13, 2009, one term of office expiring on May 13, 2010, and one 72
term of office expiring on May 13, 2011, as designated by the 73
governor upon appointment. Thereafter terms of office shall be for 74
nine years, as provided in division (A) of this section.75

       (2) The initial terms of office for the three additional 76
trustees appointed in 2006 shall commence on May 14, 2006, with 77
one term of office expiring on May 13, 2012, one term of office 78
expiring on May 13, 2013, and one term of office expiring on May 79
13, 2014, as designated by the governor upon appointment. 80
Thereafter terms of office shall be for nine years, as provided in 81
division (A) of this section.82

       Sec. 3335.09.  The board of trustees of the Ohio state 83
university shall elect, fix the compensation of, and remove, the 84
president and such number of professors, teachers, and other 85
employees as are necessary; but. Except as provided under division 86
(B) of section 3335.02 of the Revised Code, no trustee, or his 87
relationrelative of a trustee by blood or marriage, shall be 88
eligible to a professorship or position in the university, the 89
compensation for which is payable out of the state treasury or a 90
university fund. The board shall fix and regulate the course of 91
instruction and prescribe the extent and character of experiments 92
to be made at the university.93

       Sec. 3337.01.  (A) The body politic and corporate by the name 94
and style of "The President and Trustees of the Ohio University" 95
now in the university instituted and established in Athens by the 96
name and style of "The Ohio University" shall consist of a board 97
of trustees composed of eleven members, who shall be appointed by 98
the governor, with the advice and consent of the senate. At least 99
five of the trustees who are not students shall be graduates of 100
Ohio university. Two of the trustees shall be students at Ohio 101
university, and their selection and terms shall be in accordance 102
with division (B) of this section. A majority of the board 103
constitutes a quorum. Except for the terms of student members, 104
terms of office shall be for nine years, commencing on the 105
fourteenth day of May and ending on the thirteenth day of May, 106
except that upon expiration of the term ending on May 14, 1978, 107
the new term which succeeds it shall commence on May 15, 1978, and 108
end on May 13, 1987. Each member shall hold office from the date 109
of appointment until the end of the term for which the member was 110
appointed. Any member appointed to fill a vacancy occurring prior 111
to the expiration of the term for which the member's predecessor 112
was appointed shall hold office for the remainder of such term. 113
Any member shall continue in office subsequent to the expiration 114
date of the member's term until the member's successor takes 115
office, or until a period of sixty days has elapsed, whichever 116
occurs first. No person who has served a full nine-year term or 117
more than six years of such a term shall be eligible for 118
reappointment until a period of four years has elapsed since the 119
last day of the term for which the person previously served. Such 120
trustees shall receive no compensation for their services, but 121
shall be paid their actual and necessary expenses while engaged in 122
the discharge of their official duties.123

       (B) The student members of the board of trustees of the Ohio 124
university shall be students at the Ohio university, have no125
voting power on the board. Student members, and shall not be 126
considered as members of the board in determining whether a quorum 127
is present. Student members shall not be entitled to attend 128
executive sessions of the board. The student members of the board 129
shall be appointed by the governor, with the advice and consent of 130
the senate, from a group of five candidates selected pursuant to a 131
procedure adopted by the university's student governments and 132
approved by the university's board of trustees. The initial term 133
of office of one of the student members shall commence on May 14, 134
1988, and shall expire on May 13, 1989, and the initial term of 135
office of the other student member shall commence on May 14, 1988,136
and expire on May 13, 1990. Thereafter, terms of office of student 137
members shall be for two years, each term ending on the same day 138
of the same month of the year as the term it succeeds. In the 139
event that a student member cannot fulfill the student member's 140
two-year term, a replacement shall be selected to fill the 141
unexpired term in the same manner used to make the original 142
selection.143

       No student shall be disqualified from membership on the board 144
of trustees because the student receives a scholarship, grant, 145
loan, or any other financial assistance payable out of the state 146

       Sec. 3339.01.  (A) The government of Miami university shall 156
be vested in eleven trustees, who shall be appointed by the 157
governor, with the advice and consent of the senate. Two of the 158
trustees shall be students at Miami university, and their 159
selection and terms shall be in accordance with division (B) of 160
this section. A majority of the board constitutes a quorum. Except 161
for the terms of student members, terms of office shall be for 162
nine years, commencing on the first day of March and ending on the 163
last day of February, except that upon expiration of the trustee 164
term ending on March 1, 1974, the trustee term which succeeds it 165
shall commence on March 2, 1974, and end on February 28, 1983; 166
upon expiration of the trustee term ending on March 1, 1977, the 167
trustee term which succeeds it shall commence on March 2, 1977,168
and end on February 28, 1986; upon expiration of the trustee term 169
ending on March 1, 1978, the trustee term which succeeds it shall 170
commence on March 2, 1978, and end on February 28, 1987; and upon 171
expiration of the trustee term ending on March 1, 1979, the 172
trustee term which succeeds it shall commence on March 2, 1979,173
and end on February 29, 1988. Each trustee shall hold office from 174
the date of appointment until the end of the term for which the 175
trustee was appointed. Any trustee appointed to fill a vacancy 176
occurring prior to the end of the term for which the trustee's 177
predecessor was appointed shall hold office for the remainder of 178
such term. Any trustee shall continue in office subsequent to the 179
expiration date of the trustee's term until a successor takes 180
office, or until a period of sixty days has elapsed, whichever 181
occurs first. No person who has served a full nine-year term or 182
more than six years of such a term shall be eligible for 183
reappointment until a period of four years has elapsed since the 184
last day of the term for which the person previously served. The 185
trustees shall receive no compensation for their services but 186
shall be paid their reasonable necessary expenses while engaged in 187
the discharge of their official duties.188

       (B) The student members of the board of trustees of Miami 189
university shall be students at Miami university, shall have no190
voting power on the board. Student members, and shall not be 191
considered as members of the board in determining whether a quorum 192
is present. Student members shall not be entitled to attend 193
executive sessions of the board. The student members of the board 194
shall be appointed by the governor, with the advice and consent of 195
the senate, from a group of five candidates selected pursuant to a 196
procedure adopted by the university's student governments and 197
approved by the university's board of trustees. The initial term 198
of office of one of the student members shall commence on March 1, 199
1988, and shall expire on February 28, 1989, and the initial term 200
of office of the other student member shall commence on March 1, 201
1988, and expire on February 28, 1990. Thereafter, terms of office 202
of student members shall be for two years, each term ending on the 203
last day of February. In the event that a student member cannot 204
fulfill the student member's two-year term, a replacement shall be 205
selected to fill the unexpired term in the same manner used to 206
make the original selection.207

       No student shall be disqualified from membership on the board 208
of trustees because the student receives a scholarship, grant, 209
loan, or any other financial assistance payable out of the state 210
treasury or a university fund, or because the student is employed 211
by the university in a position pursuant to a work-study program 212
or other student employment, including as a graduate teaching 213
assistant, graduate administrative assistant, or graduate research 214
assistant, the compensation for which is payable out of the state 215
treasury or a university fund.216

       Acceptance of such financial assistance or employment by a 217
student trustee shall not be considered a violation of Chapter 218
102. or section 2921.42 or 2921.43 of the Revised Code.219

       Sec. 3341.02.  (A) The government of Bowling Green state 220
university is vested in a board of eleven trustees, who shall be 221
appointed by the governor, with the advice and consent of the 222
senate. Two of the trustees shall be students at Bowling Green 223
state university, and their selection and terms shall be in 224
accordance with division (B) of this section. A majority of the 225
board constitutes a quorum. Except for the terms of student 226
members, terms of office shall be for nine years, commencing on 227
the seventeenth day of May and ending on the sixteenth day of May. 228
No person who has served a full nine-year term or more than six 229
years of such a term shall be eligible for reappointment until a 230
period of four years has elapsed since the last day of the term 231
for which the person previously served.232

       (B) The student members of the board of trustees of Bowling 233
Green state university shall be students at Bowling Green state 234
university, shall have no voting power on the board. Student 235
members, and shall not be considered as members of the board in 236
determining whether a quorum is present. Student members shall not237
be entitled to attend executive sessions of the board. The student 238
members of the board shall be appointed by the governor, with the 239
advice and consent of the senate, from a group of five candidates 240
selected pursuant to a procedure adopted by the university's 241
student governments and approved by the university's board of 242
trustees. The initial term of office of one of the student members 243
shall commence on March 17, 1988, and shall expire on March 16, 244
1989, and the initial term of office of the other student member 245
shall commence on March 17, 1988, and expire on March 16, 1990. 246
After September 22, 2000, terms of office shall commence on the 247
seventeenth day of May and shall end on the sixteenth day of May. 248
Terms of office of student members shall be for two years, each 249
term ending on the same day of the same month of the year as the 250
term it succeeds. In the event that a student member cannot 251
fulfill the student member's two-year term, a replacement shall be 252
selected in the manner used for the original selection to fill the 253
unexpired term.254

       No student shall be disqualified from membership on the board 255
of trustees because the student receives a scholarship, grant, 256
loan, or any other financial assistance payable out of the state 257
treasury or a university fund, or because the student is employed 258
by the university in a position pursuant to a work-study program 259
or other student employment, including as a graduate teaching 260
assistant, graduate administrative assistant, or graduate research 261
assistant, the compensation for which is payable out of the state 262
treasury or a university fund.263

       Acceptance of such financial assistance or employment by a 264
student trustee shall not be considered a violation of Chapter 265
102. or section 2921.42 or 2921.43 of the Revised Code.266

       (C) The government of Kent state university is vested in a 267
board of eleven trustees, who shall be appointed by the governor, 268
with the advice and consent of the senate. Two of the trustees 269
shall be students at Kent state university, and their selection 270
and terms shall be in accordance with division (D) of this 271
section. A majority of the board constitutes a quorum. Except for 272
the terms of student members, terms of office shall be for nine 273
years, commencing on the seventeenth day of May and ending on the 274
sixteenth day of May. No person who has served a full nine-year 275
term or more than six years of such a term shall be eligible for 276
reappointment until a period of four years has elapsed since the 277
last day of the term for which the person previously served.278

       (D) The student members of the board of trustees of Kent 279
state university shall be students at Kent state university, shall280
have no voting power on the board. Student members, and shall not281
be considered as members of the board in determining whether a 282
quorum is present. Student members shall not be entitled to attend 283
executive sessions of the board. The student members of the board 284
shall be appointed by the governor, with the advice and consent of 285
the senate, from a group of five candidates selected pursuant to a 286
procedure adopted by the university's student governments and 287
approved by the university's board of trustees. The initial term 288
of office of one of the student members shall commence on May 17, 289
1988, and shall expire on May 16, 1989, and the initial term of 290
office of the other student member shall commence on May 17, 1988, 291
and expire on May 16, 1990. Thereafter, terms of office of student 292
members shall be for two years, each term ending on the same day 293
of the same month of the year as the term it succeeds. In the 294
event that a student member cannot fulfill the student member's 295
two-year term, a replacement shall be selected to fill the 296
unexpired term in the same manner used to make the original 297
selection.298

       No student shall be disqualified from membership on the board 299
of trustees because the student receives a scholarship, grant, 300
loan, or any other financial assistance payable out of the state 301
treasury or a university fund, or because the student is employed 302
by the university in a position pursuant to a work-study program 303
or other student employment, including as a graduate teaching 304
assistant, graduate administrative assistant, or graduate research 305
assistant, the compensation for which is payable out of the state 306
treasury or a university fund.307

       Acceptance of such financial assistance or employment by a 308
student trustee shall not be considered a violation of Chapter 309
102. or section 2921.42 or 2921.43 of the Revised Code.310

       (E) The trustees shall receive no compensation for their 311
services but shall be paid their reasonable necessary expenses 312
while engaged in the discharge of their official duties.313

       (F) Each trustee shall hold office from the date of 314
appointment until the end of the term for which the trustee was 315
appointed. Any trustee appointed to fill a vacancy occurring prior 316
to the expiration of the term for which the trustee's predecessor 317
was appointed shall hold office for the remainder of such term. 318
Any trustee shall continue in office subsequent to the expiration 319
date of the trustee's term until a successor takes office, or 320
until a period of sixty days has elapsed, whichever occurs first.321

       Sec. 3343.02.  (A) The government of Central state university 322
shall be vested in a board of trustees to be known as "the board 323
of trustees of the Central state university." Such board shall 324
consist of eleven members who shall be appointed by the governor, 325
with the advice and consent of the senate. Two of the trustees 326
shall be students at Central state university, and their selection 327
and terms shall be in accordance with division (B) of this 328
section. A majority of the board constitutes a quorum. Except for 329
the student members, terms of office shall be for nine years, 330
commencing on the first day of July and ending on the thirtieth 331
day of June. Each member shall hold office from the date of 332
appointment until the end of the term for which the member was 333
appointed. Any member appointed to fill a vacancy occurring prior 334
to the expiration of the term for which the member's predecessor 335
was appointed shall hold office for the remainder of such term. 336
Any member shall continue in office subsequent to the expiration 337
date of the member's term until the member's successor takes 338
office, or until a period of sixty days has elapsed, whichever 339
occurs first. No person who has served a full nine-year term or 340
more than six years of such a term shall be eligible for 341
reappointment until a period of four years has elapsed since the 342
last day of the term for which the person previously served.343

       (B) The student members of the board of trustees of Central 344
state university shall be students at Central state university, 345
shall have no voting power on the board. Student members, and346
shall not be considered as members of the board in determining 347
whether a quorum is present. Student members shall not be entitled 348
to attend executive sessions of the board. The student members of 349
the board shall be appointed by the governor, with the advice and 350
consent of the senate, from a group of five candidates selected 351
pursuant to a procedure adopted by the university's student 352
governments and approved by the university's board of trustees. 353
The initial term of office of one of the student members shall 354
commence on July 1, 1988, and shall expire on June 30, 1989, and 355
the initial term of office of the other student member shall 356
commence on July 1, 1988, and expire on June 30, 1990. Thereafter, 357
terms of office of student members shall be for two years, each 358
term ending on the same day of the same month of the year as the 359
term it succeeds. In the event that a student member cannot 360
fulfill a two-year term, a replacement shall be selected to fill 361
the unexpired term in the same manner used to make the original 362
selection.363

       No student shall be disqualified from membership on the board 364
of trustees because the student receives a scholarship, grant, 365
loan, or any other financial assistance payable out of the state 366
treasury or a university fund, or because the student is employed 367
by the university in a position pursuant to a work-study program 368
or other student employment, including as a graduate teaching 369
assistant, graduate administrative assistant, or graduate research 370
assistant, the compensation for which is payable out of the state 371
treasury or a university fund.372

       Acceptance of such financial assistance or employment by a 373
student trustee shall not be considered a violation of Chapter 374

       Sec. 3344.01.  (A) There is hereby created the Cleveland 376
state university. The government of the Cleveland state university 377
is vested in a board of eleven trustees, who shall be appointed by 378
the governor, with the advice and consent of the senate. Two of 379
the trustees shall be students at the Cleveland state university, 380
and their selection and terms shall be in accordance with division 381
(B) of this section. Except for the student members, terms of 382
office shall be for nine years, commencing on the second day of 383
May and ending on the first day of May. Each trustee shall hold 384
office from the date of appointment until the end of the term for 385
which the trustee was appointed. Any trustee appointed to fill a 386
vacancy occurring prior to the expiration of the term for which 387
the trustee's predecessor was appointed shall hold office for the 388
remainder of such term. Any trustee shall continue in office 389
subsequent to the expiration date of the trustee's term until the 390
trustee's successor takes office, or until a period of sixty days 391
has elapsed, whichever occurs first. No person who has served a 392
full nine-year term or more than six years of such a term shall be 393
eligible for reappointment until a period of four years has 394
elapsed since the last day of the term for which the person 395
previously served. The trustees shall receive no compensation for 396
their services but shall be paid their reasonable necessary 397
expenses while engaged in the discharge of their official duties. 398
A majority of the board constitutes a quorum.399

       (B) The student members of the board of trustees of the 400
Cleveland state university shall be students at Cleveland state 401
university, shall have no voting power on the board. Student 402
members, and shall not be considered as members of the board in 403
determining whether a quorum is present. Student members shall not404
be entitled to attend executive sessions of the board. The student 405
members of the board shall be appointed by the governor, with the 406
advice and consent of the senate, from a group of five candidates 407
selected pursuant to a procedure adopted by the university's 408
student governments and approved by the university's board of 409
trustees. The initial term of office of one of the student members 410
shall commence on May 2, 1988, and shall expire on May 1, 1989, 411
and the initial term of office of the other student member shall 412
commence on May 2, 1988, and expire on May 1, 1990. Thereafter, 413
terms of office of student members shall be for two years, each 414
term ending on the same day of the same month of the year as the 415
term it succeeds. In the event that a student member cannot 416
fulfill a two-year term, a replacement shall be selected to fill 417
the unexpired term in the same manner used to make the original 418
selection.419

       No student shall be disqualified from membership on the board 420
of trustees because the student receives a scholarship, grant, 421
loan, or any other financial assistance payable out of the state 422
treasury or a university fund, or because the student is employed 423
by the university in a position pursuant to a work-study program 424
or other student employment, including as a graduate teaching 425
assistant, graduate administrative assistant, or graduate research 426
assistant, the compensation for which is payable out of the state 427
treasury or a university fund.428

       Acceptance of such financial assistance or employment by a 429
student trustee shall not be considered a violation of Chapter 430
102. or section 2921.42 or 2921.43 of the Revised Code.431

       Sec. 3350.10. (A) There is hereby created the northeast Ohio 432
medical university. The principal goal of the medical university 433
shall be to collaborate with the university of Akron, Cleveland 434
state university, Kent state university, and Youngstown state 435
university to graduate physicians oriented to the practice of 436
medicine at the community level, especially family physicians. To 437
accomplish this goal, the medical university may incorporate in 438
the clinical experience provided its students the several 439
community hospitals in the cities and areas served by the medical 440
university; utilize practicing physicians as teachers; and to the 441
fullest extent possible utilize the basic science capabilities of 442
the university of Akron, Cleveland state university, Kent state 443
university, and Youngstown state university.444

       (1) Until December 22, 2008, the government of the northeast 445
Ohio medical university is vested in a nine-member board of 446
trustees consisting of the presidents of the university of Akron, 447
Kent state university, and Youngstown state university; one member 448
each of the boards of trustees of the university of Akron, Kent 449
state university, and Youngstown state university, to be appointed 450
by their respective boards of trustees for a term of six years 451
ending on the first day of May or until the trustee's term on the 452
respective university board of trustees expires, whichever occurs 453
first; and one person each to be appointed by the boards of 454
trustees of the university of Akron, Kent state university, and 455
Youngstown state university, for a term of nine years ending on 456
the first day of May; except that the term of those first 457
appointed by the several boards of trustees shall expire on the 458
first day of May next following their appointment. Vacancies shall 459
be filled for the unexpired term in the manner provided for 460
original appointment. The trustees shall receive no compensation 461
for their services but shall be paid their reasonable necessary 462
expenses while engaged in the discharge of their official duties. 463
A majority of the board constitutes a quorum.464

       (2) Beginning December 22, 2008, the government of the 465
northeast Ohio medical university is vested in a board of eleven 466
trustees, who shall be appointed by the governor, with the advice 467
and consent of the senate. Two of the trustees shall be current 468
students of the medical university, and their selection and terms 469
shall be in accordance with division (B) of this section. Except 470
as provided in division (A)(3) of this section and except for the 471
student members, terms of office shall be for nine years. Each 472
trustee shall hold office from the date of appointment until the 473
end of the term for which the trustee was appointed. Any trustee 474
appointed to fill a vacancy occurring prior to the expiration of 475
the term for which the trustee's predecessor was appointed shall 476
hold office for the remainder of such term. Any trustee shall 477
continue in office subsequent to the expiration date of the 478
trustee's term until the trustee's successor takes office, or 479
until a period of sixty days has elapsed, whichever occurs first. 480
No person who has served a full nine-year term or more than six 481
years of such a term shall be eligible for reappointment until a 482
period of four years has elapsed since the last day of the term 483
for which the person previously served. The trustees shall receive 484
no compensation for their services but shall be paid their 485
reasonable necessary expenses while engaged in the discharge of 486
their official duties. A majority of the board constitutes a 487
quorum.488

        (3) Not later than December 22, 2008, the governor, with the 489
advice and consent of the senate, shall appoint the two student 490
trustees and successors for the trustees serving under division 491
(A)(1) of this section. Except for the student trustees, who shall 492
serve terms pursuant to division (B) of this section, the initial 493
terms of office for trustees appointed under division (A)(2) of 494
this section shall be as follows: one term ending September 23, 495
2009; one term ending September 23, 2010; one term ending 496
September 23, 2011; one term ending September 23, 2012; one term 497
ending September 23, 2013; one term ending September 23, 2014; one 498
term ending September 23, 2015; one term ending September 23, 499
2016; one term ending September 23, 2017. Thereafter, terms of 500
office shall be for nine years, as provided in division (A)(2) of 501
this section.502

        (B) The student members of the board of trustees of the 503
northeast Ohio medical university shall be students of the 504
northeast Ohio medical university, shall have no voting power on 505
the board. Student members, and shall not be considered as members 506
of the board in determining whether a quorum is present. Student 507
members shall not be entitled to attend executive sessions of the 508
board. The student members of the board shall be appointed by the 509
governor, with the advice and consent of the senate, from a group 510
of five candidates selected pursuant to a procedure adopted by the 511
university's student governments and approved by the university's 512
board of trustees. The initial term of office of one of the 513
student members shall commence December 22, 2008, and shall expire 514
on June 30, 2009, and the initial term of office of the other 515
student member shall commence December 22, 2008, and shall expire 516
on June 30, 2010. Thereafter, terms of office of student members 517
shall be for two years, each term ending on the same day of the 518
same month of the year as the term it succeeds. In the event that 519
a student member cannot fulfill a two-year term, a replacement 520
shall be selected to fill the unexpired term in the same manner 521
used to make the original selection.522

       No student shall be disqualified from membership on the board 523
of trustees because the student receives a scholarship, grant, 524
loan, or any other financial assistance payable out of the state 525
treasury or a university fund, or because the student is employed 526
by the university in a position pursuant to a work-study program 527
or other student employment, including as a graduate teaching 528
assistant, graduate administrative assistant, or graduate research 529
assistant, the compensation for which is payable out of the state 530
treasury or a university fund.531

       Acceptance of such financial assistance or employment by a 532
student trustee shall not be considered a violation of Chapter 533
102. or section 2921.42 or 2921.43 of the Revised Code.534

       Sec. 3352.01.  (A) There is hereby created a state university 535
to be known as "Wright state university." The government of Wright 536
state university is vested in a board of eleven trustees, who 537
shall be appointed by the governor, with the advice and consent of 538
the senate. Two of the trustees shall be students at Wright state 539
university, and their selection and terms shall be in accordance 540
with division (B) of this section. Except for the terms of student 541
members, terms of office shall be for nine years, commencing on 542
the first day of July and ending on the thirtieth day of June. 543
Each trustee shall hold office from the date of appointment until 544
the end of the term for which the trustee was appointed. Any 545
trustee appointed to fill a vacancy occurring prior to the 546
expiration of the term for which the trustee's predecessor was 547
appointed shall hold office for the remainder of such term. Any 548
trustee shall continue in office subsequent to the expiration date 549
of the trustee's term until the trustee's successor takes office, 550
or until a period of sixty days has elapsed, whichever occurs 551
first. No person who has served a full nine-year term or more than 552
six years of such a term shall be eligible for reappointment until 553
a period of four years has elapsed since the last day of the term 554
for which the person previously served. The trustees shall receive 555
no compensation for their services but shall be paid their 556
reasonable necessary expenses while engaged in the discharge of 557
their official duties. A majority of the board constitutes a 558
quorum.559

       (B) The student members of the board of trustees of Wright 560
state university shall be students at Wright state university, 561
shall have no voting power on the board. Student members, and562
shall not be considered as members of the board in determining 563
whether a quorum is present. Student members shall not be entitled 564
to attend executive sessions of the board. The student members of 565
the board shall be appointed by the governor, with the advice and 566
consent of the senate, from a group of five candidates selected 567
pursuant to a procedure adopted by the university's student 568
governments and approved by the university's board of trustees. 569
The initial term of office of one of the student members shall 570
commence on July 1, 1988, and shall expire on June 30, 1989, and 571
the initial term of office of the other student member shall 572
commence on July 1, 1988, and shall expire on June 30, 1990. 573
Thereafter, terms of office of student members shall be for two 574
years, each term ending on the same day of the same month of the 575
year as the term it succeeds. In the event that a student member 576
cannot fulfill a two-year term, a replacement shall be selected to 577
fill the unexpired term in the same manner used to make the 578
original selection.579

       No student shall be disqualified from membership on the board 580
of trustees because the student receives a scholarship, grant, 581
loan, or any other financial assistance payable out of the state 582
treasury or a university fund, or because the student is employed 583
by the university in a position pursuant to a work-study program 584
or other student employment, including as a graduate teaching 585

       Acceptance of such financial assistance or employment by a 589
student trustee shall not be considered a violation of Chapter 590

office from the date of appointment until the end of the term for 601
which the trustee was appointed. Any trustee appointed to fill a 602
vacancy occurring prior to the expiration of the term for which 603
the trustee's predecessor was appointed shall hold office for the 604
remainder of such term. Any trustee shall continue in office 605
subsequent to the expiration date of the trustee's term until the 606
trustee's successor takes office, or until a period of sixty days 607
has elapsed, whichever occurs first. No person who has served a 608
full nine-year term or more than six years of such a term shall be 609
eligible to reappointment until a period of four years has elapsed 610
since the last day of the term for which the person previously 611
served. The trustees shall receive no compensation for their 612
services but shall be paid their reasonable necessary expenses 613
while engaged in the discharge of their duties. A majority of the 614
board constitutes a quorum.615

       (B) The student members of the board of trustees of 616
Youngstown state university shall be students at Youngstown state 617
university, shall have no voting power on the board. Student 618
members, and shall not be considered as members of the board in 619
determining whether a quorum is present. Student members shall not620
be entitled to attend executive sessions of the board. The student 621
members of the board shall be appointed by the governor, with the 622
advice and consent of the senate, from a group of five candidates 623
selected pursuant to a procedure adopted by the university's 624
student governments and approved by the university's board of 625
trustees. The initial term of office of one of the student members 626
shall commence on May 2, 1988, and shall expire on May 1, 1989, 627
and the initial term of office of the other student member shall 628
commence on May 2, 1988, and expire on May 1, 1990. Thereafter, 629
terms of office of student members shall be for two years, each 630
term ending on the same day of the same month of the year as the 631
term it succeeds. In the event that a student member cannot 632
fulfill a two-year term, a replacement shall be selected to fill 633
the unexpired term in the same manner used to make the original 634
selection.635

appointment until the end of the term for which the trustee was 658
appointed. Any trustee appointed to fill a vacancy occurring prior 659

date of the trustee's term until the trustee's successor takes 663

       Sec. 3361.01.  (A) There is hereby created a state university 705
to be known as the "university of Cincinnati." The government of 706
the university of Cincinnati is vested in a board of eleven 707
trustees who shall be appointed by the governor, with the advice 708
and consent of the senate. Two of the trustees shall be students 709
at the university of Cincinnati, and their selection and terms 710
shall be in accordance with division (B) of this section. The 711
terms of the first nine members of the board of trustees shall 712
commence upon the effective date of the transfer of assets of the 713
state-affiliated university of Cincinnati to the university of 714
Cincinnati hereby created. One of such trustees shall be appointed 715
for a term ending on the first day of January occurring at least 716
twelve months after such date of transfer, and each of the other 717
trustees shall be appointed for respective terms ending on each 718
succeeding first day of January, so that one term will expire on 719
each first day of January after expiration of the shortest term. 720
Except for the two student trustees, each successor trustee shall 721
be appointed for a term ending on the first day of January, nine 722
years from the expiration date of the term the trustee succeeds, 723
except that any person appointed to fill a vacancy shall be 724
appointed to serve only for the unexpired term.725

       Any trustee shall continue in office subsequent to the 726
expiration date of the trustee's term until the trustee's 727
successor takes office, or until a period of sixty days has 728
elapsed, whichever occurs first.729

       No person who has served a full nine-year term or longer or 730
more than six years of such a term shall be eligible to 731
reappointment until a period of four years has elapsed since the 732
last day of the term for which the person previously served.733

       The trustees shall receive no compensation for their services 734
but shall be paid their reasonable necessary expenses while 735
engaged in the discharge of their official duties. A majority of 736

       (B) The student members of the board of trustees of the 738
university of Cincinnati shall be students at the university of 739

members of the board shall be appointed by the governor, with the 744
advice and consent of the senate, from a group of five candidates 745
selected pursuant to a procedure adopted by the university's 746
student governments and approved by the university's board of 747
trustees. The initial term of office of one of the student members 748
shall commence on May 14, 1988, and shall expire on May 13, 1989, 749
and the initial term of office of the other student member shall 750
commence on May 14, 1988, and expire on May 13, 1990. Thereafter, 751
terms of office of student members shall be for two years, each 752
term ending on the same day of the same month of the year as the 753
term it succeeds. In the event that a student cannot fulfill a 754
two-year term, a replacement shall be selected to fill the 755
unexpired term in the same manner used to make the original 756
selection.757

       No student shall be disqualified from membership on the board 758
of trustees because the student receives a scholarship, grant, 759
loan, or any other financial assistance payable out of the state 760
treasury or a university fund, or because the student is employed 761
by the university in a position pursuant to a work-study program 762

consent of the senate. Two of the trustees shall be students at 774
Shawnee state university, and their selection and terms shall be 775
in accordance with division (B) of this section. The remaining 776
trustees shall be appointed as follows: one for a term of one 777
year, one for a term of two years, one for a term of three years, 778
one for a term of four years, one for a term of five years, one 779
for a term of six years, one for a term of seven years, one for a 780
term of eight years, and one for a term of nine years. Thereafter781
Except for the student members, terms of office shall be for nine 782
years. All terms of office shall commence on the first day of July 783
and end on the thirtieth day of June. 784

       Each trustee shall hold office from the date of appointment 785
until the end of the term for which the trustee was appointed. Any 786
trustee appointed to fill a vacancy occurring prior to the 787
expiration of the term for which the trustee's predecessor was 788

       Sec. 3364.01. (A) The university of Toledo, as authorized 833
under former Chapter 3360. of the Revised Code, and the medical 834
university of Ohio at Toledo, as authorized under former sections 835
3350.01 to 3350.05 of the Revised Code, shall be combined as one 836
state university to be known as the "university of Toledo."837

       (B)(1) The government of the combined university of Toledo is 838
vested in a board of trustees which, except as prescribed in 839
division (B)(2) of this section, shall be appointed by the 840
governor with the advice and consent of the senate. The initial 841
board of trustees of the combined university shall be as 842
prescribed in division (B)(2) of this section. After the 843
abolishment of offices as prescribed in division (B)(2)(a) of this 844
section, the board of trustees of the combined university shall 845
consist of nine voting members, who shall serve for terms of nine 846
years, and two nonvoting members, who shall be students of the 847
combined university and who shall serve for terms of two years. 848
Terms of office of trustees shall begin on the second day of July 849
and end on the first day of July.850

       (2) The initial board of trustees of the combined university 851
shall consist of seventeen voting members who are the eight 852
members who made up the board of trustees of the medical 853
university of Ohio at Toledo prior to May 1, 2006, under former 854
section 3350.01 of the Revised Code, and whose terms would expire 855
under that section after May 1, 2006; the eight voting members who 856
made up the board of trustees of the university of Toledo, under 857
former section 3360.01 of the Revised Code, and whose terms would 858
expire under that section after July 1, 2006; and one additional 859
member appointed by the governor with the advice and consent of 860
the senate. The terms of office, abolishment of office, and 861
succession of the voting members of the initial board shall be as 862
prescribed in division (B)(2)(a) of this section. The initial 863
board also shall consist of two nonvoting members who are students 864
of the combined university, as prescribed in division (B)(2)(b) of 865
this section.866

       (a) The term of office of the voting member of the initial 867
board of trustees of the combined university who was not formerly 868
a member of either the board of trustees of the medical university 869
of Ohio at Toledo or the board of trustees of the university of 870
Toledo shall be for nine years, beginning on July 2, 2006, and 871
ending on July 1, 2015.872

       The terms of office of the sixteen other voting members of 873
the initial board of trustees shall expire on July 1 of the year 874
they otherwise would expire under former section 3350.01 or 875
3360.01 of the Revised Code.876

       The office of one voting member whose term expires on July 1, 877
2007, shall be abolished on that date. The governor, with the 878
advice and consent of the senate, shall appoint a successor to the 879
office of the other voting member whose term expires on that date 880
to a nine-year term beginning on July 2, 2007.881

       The office of one voting member whose term expires on July 1, 882
2008, shall be abolished on that date. The governor, with the 883
advice and consent of the senate, shall appoint a successor to the 884
office of the other voting member whose term expires on that date 885
to a nine-year term beginning on July 2, 2008.886

       The office of one voting member whose term expires on July 1, 887
2009, shall be abolished on that date. The governor, with the 888
advice and consent of the senate, shall appoint a successor to the 889
office of the other voting member whose term expires on that date 890
to a nine-year term beginning on July 2, 2009.891

       The office of one voting member whose term expires on July 1, 892
2010, shall be abolished on that date. The governor, with the 893
advice and consent of the senate, shall appoint a successor to the 894
office of the other voting member whose term expires on that date 895
to a nine-year term beginning on July 2, 2010.896

       The office of one voting member whose term expires on July 1, 897
2011, shall be abolished on that date. The governor, with the 898
advice and consent of the senate, shall appoint a successor to the 899
office of the other voting member whose term expires on that date 900
to a nine-year term beginning on July 2, 2011.901

       The office of one voting member whose term expires on July 1, 902
2012, shall be abolished on that date. The governor, with the 903
advice and consent of the senate, shall appoint a successor to the 904
office of the other voting member whose term expires on that date 905
to a nine-year term beginning on July 2, 2012.906

       The office of one voting member whose term expires on July 1, 907
2013, shall be abolished on that date. The governor, with the 908
advice and consent of the senate, shall appoint a successor to the 909
office of the other voting member whose term expires on that date 910
to a nine-year term beginning on July 2, 2013.911

       The office of one voting member whose term expires on July 1, 912
2014, shall be abolished on that date. The governor, with the 913
advice and consent of the senate, shall appoint a successor to the 914
office of the other voting member whose term expires on that date 915
to a nine-year term beginning on July 2, 2014.916

       The governor, with the advice and consent of the senate, 917
shall appoint a successor to the office of the voting member whose 918
term expires on July 1, 2015, to a nine-year term beginning on 919
July 2, 2015.920

       Thereafter the terms of office of all subsequent voting921
members of the board of trustees, other than the student members,922
shall be for nine years beginning on the second day of July and 923
ending on the first day of July.924

       (b) One of the student members of the initial board of 925
trustees shall be the student member of the former university of 926
Toledo board of trustees, appointed under former section 3360.01 927
of the Revised Code, whose term would expire under that section on 928
July 1, 2007. The term of that student member shall expire on July 929
1, 2007. The other student member shall be a new appointee, 930
representing the portion of the combined university that made up 931
the former medical university of Ohio at Toledo, appointed to a 932
two-year term beginning on July 2, 2006, and ending on July 1, 933
2008. That student trustee shall be appointed by the governor, 934
with the advice and consent of the senate, from a group of three 935
candidates selected pursuant to a procedure adopted by the 936
university's student governments and approved by the university's 937
board of trustees. Thereafter appointment and terms of office of 938
student members of the board of trustees shall be as prescribed by 939
division (B)(3) of this section.940

       (3) The student members of the board of trustees of the 941
combined university shall be appointed by the governor, with the 942
advice and consent of the senate, from a group of six candidates 943
selected pursuant to a procedure adopted by the university's 944
student governments and approved by the university's board of 945
trustees. Terms of office of student members shall be for two 946
years, each term ending on the same day of the same month of the 947
year as the term it succeeds. In the event that a student member 948
cannot fulfill a two-year term, a replacement shall be selected to 949
fill the unexpired term in the same manner used to make the 950
original selection. Beginning on the effective date of this 951
amendment, the student members of the board shall have voting 952
power, shall be considered members of the board in determining 953
whether a quorum is present, and shall be entitled to attend 954
executive sessions of the board.955

       No student shall be disqualified from membership on the board 956
of trustees because the student receives a scholarship, grant, 957
loan, or any other financial assistance payable out of the state 958
treasury or a university fund, or because the student is employed 959
by the university in a position pursuant to a work-study program 960
or other student employment, including as a graduate teaching 961

       (4) Each trustee shall hold office from the date of 968

was appointed shall hold office for the remainder of such term. 972
Any trustee shall continue in office subsequent to the expiration 973
date of the trustee's term until the trustee's successor takes 974
office, or until a period of sixty days has elapsed, whichever 975
occurs first.976

       (5) No person who has served as a voting member of the board 977
of trustees for a full nine-year term or more than six years of 978
such a term and no person who is a voting member of the initial 979
board of trustees as prescribed in division (B)(2)(a) of this 980
section is eligible for reappointment to the board until a period 981
of four years has elapsed since the last day of the term for which 982
the person previously served.983

       No person who served as a voting member of the board of 984
trustees of the former university of Toledo, as authorized under 985
former Chapter 3360. of the Revised Code, for a full nine-year 986
term or more than six years of such a term, and no person who 987
served on the board of trustees of the former medical university 988
of Ohio at Toledo, as authorized under former sections 3350.01 to 989
3350.05 of the Revised Code, for a full nine-year term or more 990
than six years of such a term is eligible for appointment to the 991
board of trustees of the combined university until a period of 992
four years has elapsed since the last day of the term for which 993
the person previously served.994

       (C) The trustees shall receive no compensation for their 995
services but shall be paid their reasonable necessary expenses 996
while engaged in the discharge of their official duties. A 997
majority of the board constitutes a quorum. The student members of 998
the board have no voting power on the board. Student members shall 999
not be considered as members of the board in determining whether a 1000
quorum is present. Student members shall not be entitled to attend 1001
executive sessions of the board.1002

       Section 2.  That existing sections 3335.02, 3335.09, 3337.01, 1003
3339.01, 3341.02, 3343.02, 3344.01, 3350.10, 3352.01, 3356.01, 1004
3359.01, 3361.01, 3362.01, and 3364.01 of the Revised Code are 1005
hereby repealed.1006
