A BILL
To enact section 4731.73 of the Revised Code to 1
require a surgeon performing a mastectomy in a 2
hospital to guide the patient and provide 3
referrals in a manner consistent with the 4
standards of the National Accreditation Program 5
for Breast Centers and to name this act the 6
"Lizzie B. Byrd Act."7


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4731.73 of the Revised Code be 8
enacted to read as follows:9

       Sec. 4731.73. As used in this section, "NAPBC" means the 10
national accreditation program for breast centers of the American 11
college of surgeons.12

        A surgeon who will perform a mastectomy in a hospital, or a 13
person designated by the surgeon, shall guide the patient through 14
provided or referred services in a manner that is consistent with 15
NAPBC standards. If a surgeon who is to perform a mastectomy 16
considers breast reconstruction appropriate for the patient, the 17
surgeon or designated person shall offer the patient a 18
preoperative referral to a reconstructive or plastic surgeon in 19
accordance with NAPBC standards. 20

       Section 2. This act shall be known as the "Lizzie B. Byrd 21
Act."22
