A BILL
To enact sections 113.50 to 113.61 of the Revised 1
Code to require the Treasurer of State to 2
establish the Ohio State Government Expenditure 3
Database.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 113.50, 113.51, 113.52, 113.53, 5
113.54, 113.55, 113.56, 113.57, 113.58, 113.59, 113.60, and 113.61 6
of the Revised Code be enacted to read as follows: 7

       Sec. 113.50.  As used in sections 113.50 to 113.61 of the 8
Revised Code:9

       (A) "Expenditure" means a payment, distribution, loan, 10
advance, reimbursement, deposit, or gift of money from a state 11
entity to any vendor and that is processed through the Ohio 12
administrative knowledge system.13

       (B) "Political subdivision" means a county, city, village, 14
township, park district, school district, or regional transit 15
authority.16

       (C) "School district" means a city, local, exempted village, 17
or joint vocational school district; a science, technology, 18
engineering, and mathematics school established under Chapter 19
3326. of the Revised Code; or an educational service center. 20
"School district" does not mean a community school established 21
under Chapter 3314. of the Revised Code.22

       (D) "State entity" means the general assembly, the supreme 23
court, the court of claims, the office of an elected state 24
officer, or a department, bureau, board, office, commission, 25
agency, institution, or other instrumentality of this state 26
established by the Constitution or laws of this state for the 27
exercise of any function of state government, but excludes a 28
political subdivision, an institution of higher education, the 29
public employees retirement system, the Ohio police and fire 30
pension fund, the state teachers retirement system, the school 31
employees retirement system, the state highway patrol retirement 32
system, or the city of Cincinnati retirement system. "State 33
entity" does not include the nonprofit corporation formed under 34
section 187.01 of the Revised Code.35

       (E) "Vendor" means any person, partnership, corporation, 36
association, organization, state entity, or other party, including 37
any executive officer, legislative officer, judicial officer, 38
member, or employee of a state entity, that does either of the 39
following:40

        (1) Sells, leases, or otherwise provides equipment, 41
materials, goods, supplies, or services to a state entity pursuant 42
to a contract between the vendor and a state entity;43

        (2) Receives reimbursement from a state entity for any 44
expense. 45

       Sec. 113.51.  Not later than six months after the effective 46
date of this section, the treasurer of state shall establish and 47
maintain the Ohio state government expenditure database. The 48
database shall be available on the web site of the treasurer of 49
state and shall include information about expenditures made in 50
fiscal year 2014 and thereafter.51

       The database shall be accessible by members of the public 52
without charge. 53

       State entities shall assist the treasurer of state in the 54
development, establishment, operation, storage, hosting, and 55
support of the database at no cost to the treasurer of state.56

       Sec. 113.52.  For each expenditure, the Ohio state government 57
expenditure database shall include the following information:58

       (A) The amount of the expenditure;59

       (B) The date the expenditure was paid;60

       (C) The vendor to which the expenditure was paid;61

       (D) The state entity that made the expenditure or requested 62
the expenditure be made.63

       Sec. 113.53.  (A) The Ohio state government expenditure 64
database shall include the following features:65

       (1) A searchable database of all expenditures;66

       (2) The ability to filter expenditures by the following 67
categories:68

       (a) Thecategory of expense;69

       (b) The Ohio administrative knowledge system accounting code 70
for a specific good or service.71

       (3) The ability to search and filter by any of the factors 72
listed in section 113.52 of the Revised Code;73

       (4) The ability to aggregate data contained in the database;74

       (5) The ability to determine the total amount of expenditures 75
awarded to a vendor by a state entity;76

       (6) The ability to download information obtained through the 77
database;78

       (7) A searchable database of state and school district 79
employee salary and employment information.80

       (B) The information required under division (A)(1) of this 81
section shall be provided to the treasurer of state through the 82
data provided to the Ohio administrative knowledge system by state 83
entities as required in section 113.58 of the Revised Code.84

       (C) The information required under division (A)(7) of this 85
section shall be provided to the treasurer of state by the 86
department of administrative services or the department of 87
education, as applicable, with data fields provided in a format, 88
manner, and time frame determined by the treasurer of state.89

       Sec. 113.54.  The treasurer of state shall develop and 90
publish on the web site of the treasurer of state graphical 91
representations of data contained in the Ohio state government 92
expenditure database, including charts and graphs, to enhance and 93
organize the data. The topics illustrated by and frequency of 94
developing and publishing these representations shall be 95
determined by the treasurer of state.96

       Sec. 113.55.  Not later than one year after the Ohio state 97
government expenditure database is implemented, the treasurer of 98
state shall provide, on the web site of the treasurer of state, an 99
opportunity for public comment as to the utility of the database.100

       Sec. 113.56.  The Ohio state government expenditure database 101
shall not include any information that is determined to be 102
confidential or is not a public record under the laws of this 103
state.104

       Sec. 113.57.  The treasurer of state shall include in the 105
annual report of the treasurer of state required under section 106
149.01 of the Revised Code data regarding the usage of the Ohio 107
state government expenditure database.108

       Sec. 113.58.  At least monthly and through the Ohio 109
administrative knowledge system, each state entity shall provide 110
information to the treasurer of state for inclusion in the Ohio 111
state government expenditure database regarding each of the 112
entity's expenditures issued to a vendor for the preceding month.113

       State entities shall comply with sections 113.50 to 113.61 of 114
the Revised Code using existing resources. No state entity shall 115
charge the treasurer of state for any costs arising from 116
compliance with those sections.117

       Sec. 113.59.  The treasurer of state and employees of the 118
treasurer of state are not liable for the disclosure of a record 119
contained in the Ohio state government expenditure database that 120
is determined to be confidential or is not a public record under 121
the laws of this state.122

       Sec. 113.60.  Each state entity shall display on its web site 123
a prominent internet link to the Ohio state government expenditure 124
database.125

       Sec. 113.61.  The treasurer of state may adopt reasonable 126
rules under Chapter 111. of the Revised Code that implement, and 127
are consistent with, sections 113.50 to 113.60 of the Revised 128
Code.129
