A BILL
To enact section 3301.97 of the Revised Code to 1
prohibit submission of a student's personal 2
identifiable information to the federal government 3
without direct authorization of the local school 4
board.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3301.97 of the Revised Code be 6
enacted to read as follows:7

       Sec. 3301.97.  (A) No public school shall be required by any 8
state law, any rule of the state board of education, or other 9
regulation or guideline of the department of education to submit 10
personally identifiable information of a student to any office, 11
agency, or department of the federal government.12

        (B) To the extent that it complies with the federal "Family 13
Educational Rights and Privacy Act of 1974," 88 Stat. 571, 20 14
U.S.C. 1232g, as amended, no public school, without consent, shall 15
submit personally identifiable information of a student, including 16
any information that may be required to receive a grant pursuant 17
to the federal race to the top program, Division (A), Title XIV, 18
Sections 14005 and 14006 of the "American Recovery and 19
Reinvestment Act of 2009," Pub. L. No. 111-5, 123 Stat. 115, to 20
any office, agency, or department of the federal government unless 21
the school's governing board has adopted a resolution approving 22
submission of the same.23

        (C) For purposes of this section, "personally identifiable 24
information" includes a student's name, the name of the student's 25
parent or other family member, the address of the student or 26
student's family, a personal identifier, such as the student's 27
social security number or student number, a list of personal 28
characteristics that would make the student's identity easily 29
traceable, or other information that would make the student's 30
identity easily traceable. 31
