A BILL
To amend section 4501.21 and to enact section 1
4503.534 of the Revised Code to create the 2
"Disabled American Veteran" license plate.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4501.21 be amended and section 4
4503.534 of the Revised Code be enacted to read as follows:5

       Sec. 4501.21.  (A) There is hereby created in the state 6
treasury the license plate contribution fund. The fund shall 7
consist of all contributions paid by motor vehicle registrants and 8
collected by the registrar of motor vehicles pursuant to sections 9
4503.491, 4503.493, 4503.494, 4503.496, 4503.498, 4503.499, 10
4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 4503.522, 11
4503.523, 4503.531, 4503.545, 4503.55, 4503.551, 4503.552, 12
4503.553, 4503.561, 4503.562, 4503.564, 4503.591, 4503.67, 13
4503.68, 4503.69, 4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 14
4503.72, 4503.73, 4503.74, 4503.75, 4503.751, 4503.85, 4503.89, 15
4503.92, and 4503.94 of the Revised Code. 16

       (B) The registrar shall pay the contributions the registrar 17
collects in the fund as follows: 18

        The registrar shall pay the contributions received pursuant 19
to section 4503.491 of the Revised Code to the breast cancer fund 20
of Ohio, which shall use that money only to pay for programs that 21
provide assistance and education to Ohio breast cancer patients 22
and that improve access for such patients to quality health care 23
and clinical trials and shall not use any of the money for 24
abortion information, counseling, services, or other 25
abortion-related activities. 26

        The registrar shall pay the contributions received pursuant 27
to section 4503.493 of the Revised Code to the autism society of 28
Ohio, which shall use the contributions for programs and autism 29
awareness efforts throughout the state. 30

       The registrar shall pay the contributions the registrar 31
receives pursuant to section 4503.494 of the Revised Code to the 32
national multiple sclerosis society for distribution in equal 33
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 34
chapters of the national multiple sclerosis society. These 35
chapters shall use the money they receive under this section to 36
assist in paying the expenses they incur in providing services 37
directly to their clients.38

       The registrar shall pay the contributions the registrar 39
receives pursuant to section 4503.496 of the Revised Code to the 40
Ohio sickle cell and health association, which shall use the 41
contributions to help support educational, clinical, and social 42
support services for adults who have sickle cell disease.43

       The registrar shall pay the contributions the registrar 44
receives pursuant to section 4503.498 of the Revised Code to 45
special olympics Ohio, inc., which shall use the contributions for 46
its programs, charitable efforts, and other activities. 47

       The registrar shall pay the contributions the registrar 48
receives pursuant to section 4503.499 of the Revised Code to the 49
children's glioma cancer foundation, which shall use the 50
contributions for its research and other programs. 51

        The registrar shall pay the contributions the registrar 52
receives pursuant to section 4503.50 of the Revised Code to the 53
future farmers of America foundation, which shall deposit the 54
contributions into its general account to be used for educational 55
and scholarship purposes of the future farmers of America 56
foundation. 57

        The registrar shall pay the contributions the registrar 58
receives pursuant to section 4503.501 of the Revised Code to the 59
4-H youth development program of the Ohio state university 60
extension program, which shall use those contributions to pay the 61
expenses it incurs in conducting its educational activities. 62

        The registrar shall pay the contributions received pursuant 63
to section 4503.502 of the Revised Code to the Ohio cattlemen's 64
foundation, which shall use those contributions for scholarships 65
and other educational activities. 66

       The registrar shall pay the contributions received pursuant 67
to section 4503.505 of the Revised Code to the organization Ohio 68
region phi theta kappa, which shall use those contributions for 69
scholarships for students who are members of that organization. 70

        The registrar shall pay each contribution the registrar 71
receives pursuant to section 4503.51 of the Revised Code to the 72
university or college whose name or marking or design appears on 73
collegiate license plates that are issued to a person under that 74
section. A university or college that receives contributions from 75
the fund shall deposit the contributions into its general 76
scholarship fund. 77

        The registrar shall pay the contributions the registrar 78
receives pursuant to section 4503.522 of the Revised Code to the 79
"friends of Perry's victory and international peace memorial, 80
incorporated," a nonprofit corporation organized under the laws of 81
this state, to assist that organization in paying the expenses it 82
incurs in sponsoring or holding charitable, educational, and 83
cultural events at the monument. 84

       The registrar shall pay the contributions the registrar 85
receives pursuant to section 4503.523 of the Revised Code to the 86
fairport lights foundation, which shall use the money to pay for 87
the restoration, maintenance, and preservation of the lighthouses 88
of fairport harbor. 89

       The registrar shall pay the contributions the registrar 90
receives pursuant to section 4503.531 of the Revised Code to the 91
thank you foundation, incorporated, a nonprofit corporation 92
organized under the laws of this state, to assist that 93
organization in paying for the charitable activities and programs 94
it sponsors in support of United States military personnel, 95
veterans, and their families.96

       The registrar shall pay the contributions the registrar 97
receives pursuant to section 4503.534 of the Revised Code to the 98
disabled american veterans department of Ohio, to be used for 99
programs that serve disabled american veterans and their families.100

        The registrar shall pay the contributions the registrar 101
receives pursuant to section 4503.55 of the Revised Code to the 102
pro football hall of fame, which shall deposit the contributions 103
into a special bank account that it establishes and which shall be 104
separate and distinct from any other account the pro football hall 105
of fame maintains, to be used exclusively for the purpose of 106
promoting the pro football hall of fame as a travel destination. 107

        The registrar shall pay the contributions that are paid to 108
the registrar pursuant to section 4503.545 of the Revised Code to 109
the national rifle association foundation, which shall use the 110
money to pay the costs of the educational activities and programs 111
the foundation holds or sponsors in this state. 112

        The registrar shall pay to the Ohio pet fund the 113
contributions the registrar receives pursuant to section 4503.551 114
of the Revised Code and any other money from any other source, 115
including donations, gifts, and grants, that is designated by the 116
source to be paid to the Ohio pet fund. The Ohio pet fund shall 117
use the moneys it receives under this section to support programs 118
for the sterilization of dogs and cats and for educational 119
programs concerning the proper veterinary care of those animals, 120
and for expenses of the Ohio pet fund that are reasonably 121
necessary for it to obtain and maintain its tax-exempt status and 122
to perform its duties. 123

        The registrar shall pay the contributions the registrar 124
receives pursuant to section 4503.552 of the Revised Code to the 125
rock and roll hall of fame and museum, incorporated. 126

        The registrar shall pay the contributions the registrar 127
receives pursuant to section 4503.553 of the Revised Code to the 128
Ohio coalition for animals, incorporated, a nonprofit corporation. 129
Except as provided in division (B) of this section, the coalition 130
shall distribute the money to its members, and the members shall 131
use the money only to pay for educational, charitable, and other 132
programs of each coalition member that provide care for unwanted, 133
abused, and neglected horses. The Ohio coalition for animals may 134
use a portion of the money to pay for reasonable marketing costs 135
incurred in the design and promotion of the license plate and for 136
administrative costs incurred in the disbursement and management 137
of funds received under this section. 138

        The registrar shall pay the contributions the registrar 139
receives pursuant to section 4503.561 of the Revised Code to the 140
state of Ohio chapter of ducks unlimited, inc., which shall 141
deposit the contributions into a special bank account that it 142
establishes. The special bank account shall be separate and 143
distinct from any other account the state of Ohio chapter of ducks 144
unlimited, inc., maintains and shall be used exclusively for the 145
purpose of protecting, enhancing, restoring, and managing wetlands 146
and conserving wildlife habitat. The state of Ohio chapter of 147
ducks unlimited, inc., annually shall notify the registrar in 148
writing of the name, address, and account to which such payments 149
are to be made. 150

        The registrar shall pay the contributions the registrar 151
receives pursuant to section 4503.562 of the Revised Code to the 152
Mahoning river consortium, which shall use the money to pay the 153
expenses it incurs in restoring and maintaining the Mahoning river 154
watershed. 155

       The registrar shall pay the contributions the registrar 156
receives pursuant to section 4503.564 of the Revised Code to 157
Antioch college for the use of the Glen Helen ecology institute to 158
pay expenses related to the Glen Helen nature preserve.159

        The registrar shall pay to a sports commission created 160
pursuant to section 4503.591 of the Revised Code each contribution 161
the registrar receives under that section that an applicant pays 162
to obtain license plates that bear the logo of a professional 163
sports team located in the county of that sports commission and 164
that is participating in the license plate program pursuant to 165
division (E) of that section, irrespective of the county of 166
residence of an applicant. 167

        The registrar shall pay to a community charity each 168
contribution the registrar receives under section 4503.591 of the 169
Revised Code that an applicant pays to obtain license plates that 170
bear the logo of a professional sports team that is participating 171
in the license plate program pursuant to division (G) of that 172
section. 173

        The registrar shall pay the contributions the registrar 174
receives pursuant to section 4503.67 of the Revised Code to the 175
Dan Beard council of the boy scouts of America. The council shall 176
distribute all contributions in an equitable manner throughout the 177
state to regional councils of the boy scouts. 178

        The registrar shall pay the contributions the registrar 179
receives pursuant to section 4503.68 of the Revised Code to the 180
great river council of the girl scouts of the United States of 181
America. The council shall distribute all contributions in an 182
equitable manner throughout the state to regional councils of the 183
girl scouts. 184

        The registrar shall pay the contributions the registrar 185
receives pursuant to section 4503.69 of the Revised Code to the 186
Dan Beard council of the boy scouts of America. The council shall 187
distribute all contributions in an equitable manner throughout the 188
state to regional councils of the boy scouts. 189

       The registrar shall pay the contributions the registrar 190
receives pursuant to section 4503.701 of the Revised Code to the 191
Prince Hall grand lodge of free and accepted masons of Ohio, which 192
shall use the contributions for scholarship purposes.193

        The registrar shall pay the contributions the registrar 194
receives pursuant to section 4503.71 of the Revised Code to the 195
fraternal order of police of Ohio, incorporated, which shall 196
deposit the fees into its general account to be used for purposes 197
of the fraternal order of police of Ohio, incorporated. 198

        The registrar shall pay the contributions the registrar 199
receives pursuant to section 4503.711 of the Revised Code to the 200
fraternal order of police of Ohio, incorporated, which shall 201
deposit the contributions into an account that it creates to be 202
used for the purpose of advancing and protecting the law 203
enforcement profession, promoting improved law enforcement 204
methods, and teaching respect for law and order. 205

       The registrar shall pay the contributions received pursuant 206
to section 4503.712 of the Revised Code to Ohio concerns of police 207
survivors, which shall use those contributions to provide whatever 208
assistance may be appropriate to the families of Ohio law 209
enforcement officers who are killed in the line of duty. 210

       The registrar shall pay the contributions received pursuant 211
to section 4503.713 of the Revised Code to the greater Cleveland 212
peace officers memorial society, which shall use those 213
contributions to honor law enforcement officers who have died in 214
the line of duty and support its charitable purposes.215

       The registrar shall pay the contributions the registrar 216
receives pursuant to section 4503.72 of the Revised Code to the 217
organization known on March 31, 2003, as the Ohio CASA/GAL 218
association, a private, nonprofit corporation organized under 219
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 220
shall use these contributions to pay the expenses it incurs in 221
administering a program to secure the proper representation in the 222
courts of this state of abused, neglected, and dependent children, 223
and for the training and supervision of persons participating in 224
that program. 225

        The registrar shall pay the contributions the registrar 226
receives pursuant to section 4503.73 of the Revised Code to Wright 227
B. Flyer, incorporated, which shall deposit the contributions into 228
its general account to be used for purposes of Wright B. Flyer, 229
incorporated. 230

       The registrar shall pay the contributions the registrar 231
receives pursuant to section 4503.74 of the Revised Code to the 232
Columbus zoological park association, which shall disburse the 233
moneys to Ohio's major metropolitan zoos, as defined in section 234
4503.74 of the Revised Code, in accordance with a written 235
agreement entered into by the major metropolitan zoos. 236

       The registrar shall pay the contributions the registrar 237
receives pursuant to section 4503.75 of the Revised Code to the 238
rotary foundation, located on March 31, 2003, in Evanston, 239
Illinois, to be placed in a fund known as the permanent fund and 240
used to endow educational and humanitarian programs of the rotary 241
foundation. 242

       The registrar shall pay the contributions the registrar 243
receives pursuant to section 4503.751 of the Revised Code to the 244
Ohio association of realtors, which shall deposit the 245
contributions into a property disaster relief fund maintained 246
under the Ohio realtors charitable and education foundation.247

        The registrar shall pay the contributions the registrar 248
receives pursuant to section 4503.85 of the Revised Code to the 249
Ohio sea grant college program to be used for Lake Erie area 250
research projects. 251

       The registrar shall pay the contributions the registrar 252
receives pursuant to section 4503.89 of the Revised Code to the 253
American red cross of greater Columbus on behalf of the Ohio 254
chapters of the American red cross, which shall use the 255
contributions for disaster readiness, preparedness, and response 256
programs on a statewide basis.257

       The registrar shall pay the contributions received pursuant 258
to section 4503.92 of the Revised Code to support our troops, 259
incorporated, a national nonprofit corporation, which shall use 260
those contributions in accordance with its articles of 261
incorporation and for the benefit of servicemembers of the armed 262
forces of the United States and their families when they are in 263
financial need. 264

       The registrar shall pay the contributions the registrar 265
receives pursuant to section 4503.94 of the Revised Code to the 266
Michelle's leading star foundation, which shall use the money 267
solely to fund the rental, lease, or purchase of the simulated 268
driving curriculum of the Michelle's leading star foundation by 269
boards of education of city, exempted village, local, and joint 270
vocational school districts.271

       (C) All investment earnings of the license plate contribution 272
fund shall be credited to the fund. Not later than the first day 273
of May of every year, the registrar shall distribute to each 274
entity described in division (B) of this section the investment 275
income the fund earned the previous calendar year. The amount of 276
such a distribution paid to an entity shall be proportionate to 277
the amount of money the entity received from the fund during the 278
previous calendar year. 279

       Sec. 4503.534. (A) The owner or lessee of any passenger car, 280
noncommercial motor vehicle, recreational vehicle, or other 281
vehicle of a class approved by the registrar of motor vehicles may 282
apply to the registrar for the registration of the vehicle and 283
issuance of disabled american veteran license plates. An 284
application made under this section may be combined with a request 285
for a special reserved license plate under section 4503.40 or 286
4503.42 of the Revised Code. Upon receipt of the completed 287
application and compliance by the applicant with divisions (B) and 288
(C) of this section, the registrar shall issue to the applicant 289
the appropriate vehicle registration and a set of disabled 290
american veteran license plates and a validation sticker, or a 291
validation sticker alone when required by section 4503.191 of the 292
Revised Code.293

       In addition to the letters and numbers ordinarily inscribed 294
on the license plates, disabled american veteran license plates 295
shall be inscribed with identifying words or markings that are 296
approved by the disabled american veterans department of Ohio and 297
the registrar. Disabled american veteran license plates shall 298
display county identification stickers that identify the county of 299
registration by name or number.300

       (B) The disabled american veteran license plates and a 301
validation sticker, or validation sticker alone, shall be issued 302
upon receipt of a contribution as provided in division (C) of this 303
section and upon payment of the regular license tax as prescribed 304
under section 4503.04 of the Revised Code, any applicable motor 305
vehicle license tax levied under Chapter 4504. of the Revised 306
Code, any applicable additional fee prescribed by section 4503.40 307
or 4503.42 of the Revised Code, a fee of ten dollars for the 308
purpose of compensating the bureau of motor vehicles for 309
additional services required in the issuing of disabled american 310
veteran license plates, and compliance with all other applicable 311
laws relating to the registration of motor vehicles.312

        (C) For each application for registration and registration 313
renewal notice the registrar receives under this section, the 314
registrar shall collect a contribution of twenty-five dollars. The 315
registrar shall transmit this contribution to the treasurer of 316
state for deposit in the license plate contribution fund created 317
in section 4501.21 of the Revised Code.318

       The registrar shall transmit the additional fee of ten 319
dollars paid to compensate the bureau for the additional services 320
required in the issuing of disabled american veteran license 321
plates to the treasurer of state for deposit into the state 322
treasury to the credit of the state bureau of motor vehicles fund 323
created by section 4501.25 of the Revised Code.324

       Section 2. That existing section 4501.21 of the Revised Code 325
is hereby repealed.326
