A BILL
To amend sections 4501.21, 5533.972, 5533.977, 1
5533.978, 5533.98, and 5533.983 and to enact 2
section 4503.492 of the Revised Code to create the 3
"Ovarian Cancer Awareness" license plate and to 4
make corrections to specified memorial highway 5
designations.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4501.21, 5533.972, 5533.977, 7
5533.978, 5533.98, and 5533.983 be amended and section 4503.492 of 8
the Revised Code be enacted to read as follows:9

       Sec. 4501.21.  (A) There is hereby created in the state 10
treasury the license plate contribution fund. The fund shall 11
consist of all contributions paid by motor vehicle registrants and 12
collected by the registrar of motor vehicles pursuant to sections 13
4503.491, 4503.492, 4503.493, 4503.494, 4503.496, 4503.498, 14
4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 15
4503.522, 4503.523, 4503.524, 4503.525, 4503.526, 4503.531, 16
4503.545, 4503.55, 4503.551, 4503.552, 4503.553, 4503.561, 17
4503.562, 4503.564, 4503.591, 4503.67, 4503.68, 4503.69, 4503.701, 18
4503.71, 4503.711, 4503.712, 4503.713, 4503.72, 4503.73, 4503.732, 19
4503.74, 4503.75, 4503.751, 4503.85, 4503.89, 4503.90, 4503.92, 20
and 4503.94 of the Revised Code. 21

       (B) The registrar shall pay the contributions the registrar 22
collects in the fund as follows: 23

        The registrar shall pay the contributions received pursuant 24
to section 4503.491 of the Revised Code to the breast cancer fund 25
of Ohio, which shall use that money only to pay for programs that 26
provide assistance and education to Ohio breast cancer patients 27
and that improve access for such patients to quality health care 28
and clinical trials and shall not use any of the money for 29
abortion information, counseling, services, or other 30
abortion-related activities. 31

       The registrar shall pay the contributions the registrar 32
receives pursuant to section 4503.492 of the Revised Code to the 33
organization cancer support community central Ohio, which shall 34
deposit the money into the Sheryl L. Kraner Fund of that 35
organization. Cancer support community central Ohio shall expend 36
the money it receives pursuant to this division only in the same 37
manner and for the same purposes as that organization expends 38
other money in that fund.39

        The registrar shall pay the contributions received pursuant 40
to section 4503.493 of the Revised Code to the autism society of 41
Ohio, which shall use the contributions for programs and autism 42
awareness efforts throughout the state. 43

       The registrar shall pay the contributions the registrar 44
receives pursuant to section 4503.494 of the Revised Code to the 45
national multiple sclerosis society for distribution in equal 46
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 47
chapters of the national multiple sclerosis society. These 48
chapters shall use the money they receive under this section to 49
assist in paying the expenses they incur in providing services 50
directly to their clients.51

       The registrar shall pay the contributions the registrar 52
receives pursuant to section 4503.496 of the Revised Code to the 53
Ohio sickle cell and health association, which shall use the 54
contributions to help support educational, clinical, and social 55
support services for adults who have sickle cell disease.56

       The registrar shall pay the contributions the registrar 57
receives pursuant to section 4503.498 of the Revised Code to 58
special olympics Ohio, inc., which shall use the contributions for 59
its programs, charitable efforts, and other activities. 60

       The registrar shall pay the contributions the registrar 61
receives pursuant to section 4503.499 of the Revised Code to the 62
children's glioma cancer foundation, which shall use the 63
contributions for its research and other programs. 64

        The registrar shall pay the contributions the registrar 65
receives pursuant to section 4503.50 of the Revised Code to the 66
future farmers of America foundation, which shall deposit the 67
contributions into its general account to be used for educational 68
and scholarship purposes of the future farmers of America 69
foundation. 70

        The registrar shall pay the contributions the registrar 71
receives pursuant to section 4503.501 of the Revised Code to the 72
4-H youth development program of the Ohio state university 73
extension program, which shall use those contributions to pay the 74
expenses it incurs in conducting its educational activities. 75

        The registrar shall pay the contributions received pursuant 76
to section 4503.502 of the Revised Code to the Ohio cattlemen's 77
foundation, which shall use those contributions for scholarships 78
and other educational activities. 79

       The registrar shall pay the contributions received pursuant 80
to section 4503.505 of the Revised Code to the organization Ohio 81
region phi theta kappa, which shall use those contributions for 82
scholarships for students who are members of that organization. 83

        The registrar shall pay each contribution the registrar 84
receives pursuant to section 4503.51 of the Revised Code to the 85
university or college whose name or marking or design appears on 86
collegiate license plates that are issued to a person under that 87
section. A university or college that receives contributions from 88
the fund shall deposit the contributions into its general 89
scholarship fund. 90

        The registrar shall pay the contributions the registrar 91
receives pursuant to section 4503.522 of the Revised Code to the 92
"friends of Perry's victory and international peace memorial, 93
incorporated," a nonprofit corporation organized under the laws of 94
this state, to assist that organization in paying the expenses it 95
incurs in sponsoring or holding charitable, educational, and 96
cultural events at the monument. 97

       The registrar shall pay the contributions the registrar 98
receives pursuant to section 4503.523 of the Revised Code to the 99
fairport lights foundation, which shall use the money to pay for 100
the restoration, maintenance, and preservation of the lighthouses 101
of fairport harbor. 102

       The registrar shall pay the contributions the registrar 103
receives pursuant to section 4503.524 of the Revised Code to the 104
Massillon tiger football booster club, which shall use the 105
contributions only to promote and support the football team of 106
Washington high school of the Massillon city school district.107

       The registrar shall pay the contributions the registrar 108
receives pursuant to section 4503.525 of the Revised Code to the 109
United States power squadron districts seven, eleven, twenty-four, 110
and twenty-nine in equal amounts. Each power squadron district 111
shall use the money it receives under this section to pay for the 112
educational boating programs each district holds or sponsors 113
within this state.114

       The registrar shall pay the contributions the registrar 115
receives pursuant to section 4503.526 of the Revised Code to the 116
Ohio district Kiwanis foundation of the Ohio district of Kiwanis 117
international, which shall use the money it receives under this 118
section to pay the costs of its educational and humanitarian 119
activities.120

       The registrar shall pay the contributions the registrar 121
receives pursuant to section 4503.531 of the Revised Code to the 122
thank you foundation, incorporated, a nonprofit corporation 123
organized under the laws of this state, to assist that 124
organization in paying for the charitable activities and programs 125
it sponsors in support of United States military personnel, 126
veterans, and their families.127

        The registrar shall pay the contributions the registrar 128
receives pursuant to section 4503.55 of the Revised Code to the 129
pro football hall of fame, which shall deposit the contributions 130
into a special bank account that it establishes and which shall be 131
separate and distinct from any other account the pro football hall 132
of fame maintains, to be used exclusively for the purpose of 133
promoting the pro football hall of fame as a travel destination. 134

        The registrar shall pay the contributions that are paid to 135
the registrar pursuant to section 4503.545 of the Revised Code to 136
the national rifle association foundation, which shall use the 137
money to pay the costs of the educational activities and programs 138
the foundation holds or sponsors in this state. 139

        The registrar shall pay to the Ohio pet fund the 140
contributions the registrar receives pursuant to section 4503.551 141
of the Revised Code and any other money from any other source, 142
including donations, gifts, and grants, that is designated by the 143
source to be paid to the Ohio pet fund. The Ohio pet fund shall 144
use the moneys it receives under this section to support programs 145
for the sterilization of dogs and cats and for educational 146
programs concerning the proper veterinary care of those animals, 147
and for expenses of the Ohio pet fund that are reasonably 148
necessary for it to obtain and maintain its tax-exempt status and 149
to perform its duties. 150

        The registrar shall pay the contributions the registrar 151
receives pursuant to section 4503.552 of the Revised Code to the 152
rock and roll hall of fame and museum, incorporated. 153

        The registrar shall pay the contributions the registrar 154
receives pursuant to section 4503.553 of the Revised Code to the 155
Ohio coalition for animals, incorporated, a nonprofit corporation. 156
Except as provided in division (B) of this section, the coalition 157
shall distribute the money to its members, and the members shall 158
use the money only to pay for educational, charitable, and other 159
programs of each coalition member that provide care for unwanted, 160
abused, and neglected horses. The Ohio coalition for animals may 161
use a portion of the money to pay for reasonable marketing costs 162
incurred in the design and promotion of the license plate and for 163
administrative costs incurred in the disbursement and management 164
of funds received under this section. 165

        The registrar shall pay the contributions the registrar 166
receives pursuant to section 4503.561 of the Revised Code to the 167
state of Ohio chapter of ducks unlimited, inc., which shall 168
deposit the contributions into a special bank account that it 169
establishes. The special bank account shall be separate and 170
distinct from any other account the state of Ohio chapter of ducks 171
unlimited, inc., maintains and shall be used exclusively for the 172
purpose of protecting, enhancing, restoring, and managing wetlands 173
and conserving wildlife habitat. The state of Ohio chapter of 174
ducks unlimited, inc., annually shall notify the registrar in 175
writing of the name, address, and account to which such payments 176
are to be made. 177

        The registrar shall pay the contributions the registrar 178
receives pursuant to section 4503.562 of the Revised Code to the 179
Mahoning river consortium, which shall use the money to pay the 180
expenses it incurs in restoring and maintaining the Mahoning river 181
watershed. 182

       The registrar shall pay the contributions the registrar 183
receives pursuant to section 4503.564 of the Revised Code to 184
Antioch college for the use of the Glen Helen ecology institute to 185
pay expenses related to the Glen Helen nature preserve.186

        The registrar shall pay to a sports commission created 187
pursuant to section 4503.591 of the Revised Code each contribution 188
the registrar receives under that section that an applicant pays 189
to obtain license plates that bear the logo of a professional 190
sports team located in the county of that sports commission and 191
that is participating in the license plate program pursuant to 192
division (E) of that section, irrespective of the county of 193
residence of an applicant. 194

        The registrar shall pay to a community charity each 195
contribution the registrar receives under section 4503.591 of the 196
Revised Code that an applicant pays to obtain license plates that 197
bear the logo of a professional sports team that is participating 198
in the license plate program pursuant to division (G) of that 199
section. 200

        The registrar shall pay the contributions the registrar 201
receives pursuant to section 4503.67 of the Revised Code to the 202
Dan Beard council of the boy scouts of America. The council shall 203
distribute all contributions in an equitable manner throughout the 204
state to regional councils of the boy scouts. 205

        The registrar shall pay the contributions the registrar 206
receives pursuant to section 4503.68 of the Revised Code to the 207
great river council of the girl scouts of the United States of 208
America. The council shall distribute all contributions in an 209
equitable manner throughout the state to regional councils of the 210
girl scouts. 211

        The registrar shall pay the contributions the registrar 212
receives pursuant to section 4503.69 of the Revised Code to the 213
Dan Beard council of the boy scouts of America. The council shall 214
distribute all contributions in an equitable manner throughout the 215
state to regional councils of the boy scouts. 216

       The registrar shall pay the contributions the registrar 217
receives pursuant to section 4503.701 of the Revised Code to the 218
Prince Hall grand lodge of free and accepted masons of Ohio, which 219
shall use the contributions for scholarship purposes.220

        The registrar shall pay the contributions the registrar 221
receives pursuant to section 4503.71 of the Revised Code to the 222
fraternal order of police of Ohio, incorporated, which shall 223
deposit the fees into its general account to be used for purposes 224
of the fraternal order of police of Ohio, incorporated. 225

        The registrar shall pay the contributions the registrar 226
receives pursuant to section 4503.711 of the Revised Code to the 227
fraternal order of police of Ohio, incorporated, which shall 228
deposit the contributions into an account that it creates to be 229
used for the purpose of advancing and protecting the law 230
enforcement profession, promoting improved law enforcement 231
methods, and teaching respect for law and order. 232

       The registrar shall pay the contributions received pursuant 233
to section 4503.712 of the Revised Code to Ohio concerns of police 234
survivors, which shall use those contributions to provide whatever 235
assistance may be appropriate to the families of Ohio law 236
enforcement officers who are killed in the line of duty. 237

       The registrar shall pay the contributions received pursuant 238
to section 4503.713 of the Revised Code to the greater Cleveland 239
peace officers memorial society, which shall use those 240
contributions to honor law enforcement officers who have died in 241
the line of duty and support its charitable purposes.242

       The registrar shall pay the contributions the registrar 243
receives pursuant to section 4503.72 of the Revised Code to the 244
organization known on March 31, 2003, as the Ohio CASA/GAL 245
association, a private, nonprofit corporation organized under 246
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 247
shall use these contributions to pay the expenses it incurs in 248
administering a program to secure the proper representation in the 249
courts of this state of abused, neglected, and dependent children, 250
and for the training and supervision of persons participating in 251
that program. 252

        The registrar shall pay the contributions the registrar 253
receives pursuant to section 4503.73 of the Revised Code to Wright 254
B. Flyer, incorporated, which shall deposit the contributions into 255
its general account to be used for purposes of Wright B. Flyer, 256
incorporated. 257

       The registrar shall pay the contributions the registrar 258
receives pursuant to section 4503.732 of the Revised Code to the 259
Siegel & Shuster society, a nonprofit organization dedicated to 260
commemorating and celebrating the creation of Superman in 261
Cleveland, Ohio.262

       The registrar shall pay the contributions the registrar 263
receives pursuant to section 4503.74 of the Revised Code to the 264
Columbus zoological park association, which shall disburse the 265
moneys to Ohio's major metropolitan zoos, as defined in section 266
4503.74 of the Revised Code, in accordance with a written 267
agreement entered into by the major metropolitan zoos. 268

       The registrar shall pay the contributions the registrar 269
receives pursuant to section 4503.75 of the Revised Code to the 270
rotary foundation, located on March 31, 2003, in Evanston, 271
Illinois, to be placed in a fund known as the permanent fund and 272
used to endow educational and humanitarian programs of the rotary 273
foundation. 274

       The registrar shall pay the contributions the registrar 275
receives pursuant to section 4503.751 of the Revised Code to the 276
Ohio association of realtors, which shall deposit the 277
contributions into a property disaster relief fund maintained 278
under the Ohio realtors charitable and education foundation.279

        The registrar shall pay the contributions the registrar 280
receives pursuant to section 4503.85 of the Revised Code to the 281
Ohio sea grant college program to be used for Lake Erie area 282
research projects. 283

       The registrar shall pay the contributions the registrar 284
receives pursuant to section 4503.89 of the Revised Code to the 285
American red cross of greater Columbus on behalf of the Ohio 286
chapters of the American red cross, which shall use the 287
contributions for disaster readiness, preparedness, and response 288
programs on a statewide basis.289

       The registrar shall pay the contributions the registrar 290
receives pursuant to section 4503.90 of the Revised Code to the 291
nationwide children's hospital foundation.292

       The registrar shall pay the contributions received pursuant 293
to section 4503.92 of the Revised Code to support our troops, 294
incorporated, a national nonprofit corporation, which shall use 295
those contributions in accordance with its articles of 296
incorporation and for the benefit of servicemembers of the armed 297
forces of the United States and their families when they are in 298
financial need. 299

       The registrar shall pay the contributions the registrar 300
receives pursuant to section 4503.94 of the Revised Code to the 301
Michelle's leading star foundation, which shall use the money 302
solely to fund the rental, lease, or purchase of the simulated 303
driving curriculum of the Michelle's leading star foundation by 304
boards of education of city, exempted village, local, and joint 305
vocational school districts.306

       (C) All investment earnings of the license plate contribution 307
fund shall be credited to the fund. Not later than the first day 308
of May of every year, the registrar shall distribute to each 309
entity described in division (B) of this section the investment 310
income the fund earned the previous calendar year. The amount of 311
such a distribution paid to an entity shall be proportionate to 312
the amount of money the entity received from the fund during the 313
previous calendar year.314

       Sec. 4503.492.  (A) The owner or lessee of any passenger car, 315
noncommercial motor vehicle, recreational vehicle, or other 316
vehicle of a class approved by the registrar of motor vehicles may 317
apply to the registrar for the registration of the vehicle and 318
issuance of ovarian cancer awareness license plates. An 319
application made under this section may be combined with a request 320
for a special reserved license plate under section 4503.40 or 321
4503.42 of the Revised Code. Upon receipt of the completed 322
application and compliance by the applicant with divisions (B) and 323
(C) of this section, the registrar shall issue to the applicant 324
the appropriate vehicle registration and a set of ovarian cancer 325
awareness license plates and a validation sticker, or a validation 326
sticker alone when required by section 4503.191 of the Revised 327
Code.328

       In addition to the letters and numbers ordinarily inscribed 329
on the license plates, ovarian cancer awareness license plates 330
shall be inscribed with identifying words or markings that promote 331
ovarian cancer awareness and are approved by the registrar. 332
Ovarian cancer awareness license plates shall display county 333
identification stickers that identify the county of registration 334
by name or number.335

       (B) Ovarian cancer awareness license plates and a validation 336
sticker, or validation sticker alone, shall be issued upon receipt 337
of a contribution as provided in division (C) of this section and 338
upon payment of the regular license tax as prescribed under 339
section 4503.04, any applicable motor vehicle license tax levied 340
under Chapter 4504. of the Revised Code, any applicable additional 341
fee prescribed by section 4503.40 or 4503.42 of the Revised Code, 342
a bureau of motor vehicles administrative fee of ten dollars, and 343
compliance with all other applicable laws relating to the 344
registration of motor vehicles.345

       (C) For each application for registration and registration 346
renewal notice the registrar receives under this section, the 347
registrar shall collect a contribution of twenty-five dollars. The 348
registrar shall transmit this contribution to the treasurer of 349
state for deposit in the license plate contribution fund created 350
in section 4501.21 of the Revised Code.351

       The registrar shall transmit the administrative fee of ten 352
dollars, the purpose of which is to compensate the bureau for the 353
additional services required in the issuing of ovarian cancer 354
awareness license plates, to the treasurer of state for deposit 355
into the state treasury to the credit of the state bureau of motor 356
vehicles fund created by section 4501.25 of the Revised Code.357

       Sec. 5533.972.  In addition to any other name prescribed in 358
the Revised Code or otherwise, that portion of the highway known 359
as state route number sixty-three, commencing at the intersection 360
of that route and state route number four and proceeding in an 361
easterly direction to the intersection of state route sixty-three 362
and Cincinnati-Dayton road within the municipal corporation of 363
MiddletownMonroe only, shall be known as the "Sgt. James C. 364
Robinson, Jr. Memorial Highway." 365

       The director of transportation may erect suitable markers 366
along the highway indicating its name.367

       Sec. 5533.977.  In addition to any other name prescribed in 368
the Revised Code or otherwise, that portion of the highway known 369
as stateUnited States route number forty-two, commencing at the 370
intersection of that route and Butler Warren road and proceeding 371
in a northeasterly direction to the intersection of that route and 372
West Main Street in the municipal corporation of Mason, shall be 373
known as the "SFC William B. Woods, Jr. Memorial Highway." 374

       The director of transportation may erect suitable markers 375
along the highway indicating its name.376

       Sec. 5533.978.  In addition to any other name prescribed in 377
the Revised Code or otherwise, that portion of the highway known 378
as stateUnited States route number forty-two, commencing at the 379
intersection of that route and Creek road in the municipal 380
corporation of Sharonville and proceeding in a northeasterly 381
direction to the intersection of that route and Cox road in West 382
Chester township in Butler county, shall be known as the "Sgt. 383
John P. Huling Memorial Highway."384

       The director of transportation may erect suitable markers 385
along the highway indicating its name.386

       Sec. 5533.98.  In addition to any other name prescribed in 387
the Revised Code or otherwise, that portion of the highway known 388
as state route one hundred twenty-eight, commencing at the 389
intersection of that route and United States route number 390
twenty-seven and proceeding in a northeasterly direction to the 391
intersection of that route and New London road in the municipal 392
corporation of Hamilton, shall be known as the "Cpl. Nickolas393
Nicholas H. Olivas Memorial Highway."394

       The director of transportation may erect suitable markers 395
along the highway indicating its name.396

       Sec. 5533.983.  In addition to any other name prescribed in 397
the Revised Code or otherwise, that portion of the highway known 398
as state route number four, commencing at the intersection of that 399
route and Grand boulevard and proceeding in a southerly direction 400
to the intersection of that route and Bobmeyer road within the 401
municipal corporation of Hamilton only, shall be known as the "SFC402
1SG Ricky L. McGinnis Memorial Highway."403

       The director of transportation may erect suitable markers 404
along the highway indicating its name.405

       Section 2.  That existing sections 4501.21, 5533.972, 406
5533.977, 5533.978, 5533.98, and 5533.983 of the Revised Code are 407
hereby repealed.408

       Section 3.  Section 4501.21 of the Revised Code is presented 409
in this act as a composite of the section as amended by both Am. 410
Sub. H.B. 59 and Sub. H.B. 110 of the 130th General Assembly. The 411
General Assembly, applying the principle stated in division (B) of 412
section 1.52 of the Revised Code that amendments are to be 413
harmonized if reasonably capable of simultaneous operation, finds 414
that the composite is the resulting version of the section in 415
effect prior to the effective date of the section as presented in 416
this act.417
