A BILL
To amend sections 4501.21, 5533.972, 5533.977, 1
5533.978, 5533.98, and 5533.983 and to enact 2
section 4503.492 of the Revised Code to create the 3
"Ovarian Cancer Awareness" license plate and to 4
make corrections to specified memorial highway 5
designations.6


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4501.21, 5533.972, 5533.977, 7
5533.978, 5533.98, and 5533.983 be amended and section 4503.492 of 8
the Revised Code be enacted to read as follows:9

       Sec. 4501.21.  (A) There is hereby created in the state 10
treasury the license plate contribution fund. The fund shall 11
consist of all contributions paid by motor vehicle registrants and 12
collected by the registrar of motor vehicles pursuant to sections 13
4503.491, 4503.492, 4503.493, 4503.494, 4503.496, 4503.498, 14
4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 15
4503.522, 4503.523, 4503.524, 4503.526, 4503.531, 4503.545, 16
4503.55, 4503.551, 4503.552, 4503.553, 4503.561, 4503.562, 17
4503.564, 4503.591, 4503.67, 4503.68, 4503.69, 4503.701, 4503.71, 18
4503.711, 4503.712, 4503.713, 4503.72, 4503.73, 4503.732, 4503.74, 19
4503.75, 4503.751, 4503.85, 4503.89, 4503.92, and 4503.94 of the 20
Revised Code. 21

       (B) The registrar shall pay the contributions the registrar 22
collects in the fund as follows: 23

        The registrar shall pay the contributions received pursuant 24
to section 4503.491 of the Revised Code to the breast cancer fund 25
of Ohio, which shall use that money only to pay for programs that 26
provide assistance and education to Ohio breast cancer patients 27
and that improve access for such patients to quality health care 28
and clinical trials and shall not use any of the money for 29
abortion information, counseling, services, or other 30
abortion-related activities. 31

       The registrar shall pay the contributions the registrar 32
receives pursuant to section 4503.492 of the Revised Code to the 33
organization cancer support community central Ohio, which shall 34
deposit the money into the Sheryl L. Kraner Fund of that 35
organization. Cancer support community central Ohio shall expend 36
the money it receives pursuant to this division only in the same 37
manner and for the same purposes as that organization expends 38
other money in that fund.39

        The registrar shall pay the contributions received pursuant 40
to section 4503.493 of the Revised Code to the autism society of 41
Ohio, which shall use the contributions for programs and autism 42
awareness efforts throughout the state. 43

       The registrar shall pay the contributions the registrar 44
receives pursuant to section 4503.494 of the Revised Code to the 45
national multiple sclerosis society for distribution in equal 46
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 47
chapters of the national multiple sclerosis society. These 48
chapters shall use the money they receive under this section to 49
assist in paying the expenses they incur in providing services 50
directly to their clients.51

       The registrar shall pay the contributions the registrar 52
receives pursuant to section 4503.496 of the Revised Code to the 53
Ohio sickle cell and health association, which shall use the 54
contributions to help support educational, clinical, and social 55
support services for adults who have sickle cell disease.56

       The registrar shall pay the contributions the registrar 57
receives pursuant to section 4503.498 of the Revised Code to 58
special olympics Ohio, inc., which shall use the contributions for 59
its programs, charitable efforts, and other activities. 60

       The registrar shall pay the contributions the registrar 61
receives pursuant to section 4503.499 of the Revised Code to the 62
children's glioma cancer foundation, which shall use the 63
contributions for its research and other programs. 64

        The registrar shall pay the contributions the registrar 65
receives pursuant to section 4503.50 of the Revised Code to the 66
future farmers of America foundation, which shall deposit the 67
contributions into its general account to be used for educational 68
and scholarship purposes of the future farmers of America 69
foundation. 70

        The registrar shall pay the contributions the registrar 71
receives pursuant to section 4503.501 of the Revised Code to the 72
4-H youth development program of the Ohio state university 73
extension program, which shall use those contributions to pay the 74
expenses it incurs in conducting its educational activities. 75

        The registrar shall pay the contributions received pursuant 76
to section 4503.502 of the Revised Code to the Ohio cattlemen's 77
foundation, which shall use those contributions for scholarships 78
and other educational activities. 79

       The registrar shall pay the contributions received pursuant 80
to section 4503.505 of the Revised Code to the organization Ohio 81
region phi theta kappa, which shall use those contributions for 82
scholarships for students who are members of that organization. 83

        The registrar shall pay each contribution the registrar 84
receives pursuant to section 4503.51 of the Revised Code to the 85
university or college whose name or marking or design appears on 86
collegiate license plates that are issued to a person under that 87
section. A university or college that receives contributions from 88
the fund shall deposit the contributions into its general 89
scholarship fund. 90

        The registrar shall pay the contributions the registrar 91
receives pursuant to section 4503.522 of the Revised Code to the 92
"friends of Perry's victory and international peace memorial, 93
incorporated," a nonprofit corporation organized under the laws of 94
this state, to assist that organization in paying the expenses it 95
incurs in sponsoring or holding charitable, educational, and 96
cultural events at the monument. 97

       The registrar shall pay the contributions the registrar 98
receives pursuant to section 4503.523 of the Revised Code to the 99
fairport lights foundation, which shall use the money to pay for 100
the restoration, maintenance, and preservation of the lighthouses 101
of fairport harbor. 102

       The registrar shall pay the contributions the registrar 103
receives pursuant to section 4503.524 of the Revised Code to the 104
Massillon tiger football booster club, which shall use the 105
contributions only to promote and support the football team of 106
Washington high school of the Massillon city school district.107

       The registrar shall pay the contributions the registrar 108
receives pursuant to section 4503.526 of the Revised Code to the 109
Ohio district Kiwanis foundation of the Ohio district of Kiwanis 110
international, which shall use the money it receives under this 111
section to pay the costs of its educational and humanitarian 112
activities.113

       The registrar shall pay the contributions the registrar 114
receives pursuant to section 4503.531 of the Revised Code to the 115
thank you foundation, incorporated, a nonprofit corporation 116
organized under the laws of this state, to assist that 117
organization in paying for the charitable activities and programs 118
it sponsors in support of United States military personnel, 119
veterans, and their families.120

        The registrar shall pay the contributions the registrar 121
receives pursuant to section 4503.55 of the Revised Code to the 122
pro football hall of fame, which shall deposit the contributions 123
into a special bank account that it establishes and which shall be 124
separate and distinct from any other account the pro football hall 125
of fame maintains, to be used exclusively for the purpose of 126
promoting the pro football hall of fame as a travel destination. 127

        The registrar shall pay the contributions that are paid to 128
the registrar pursuant to section 4503.545 of the Revised Code to 129
the national rifle association foundation, which shall use the 130
money to pay the costs of the educational activities and programs 131
the foundation holds or sponsors in this state. 132

        The registrar shall pay to the Ohio pet fund the 133
contributions the registrar receives pursuant to section 4503.551 134
of the Revised Code and any other money from any other source, 135
including donations, gifts, and grants, that is designated by the 136
source to be paid to the Ohio pet fund. The Ohio pet fund shall 137
use the moneys it receives under this section to support programs 138
for the sterilization of dogs and cats and for educational 139
programs concerning the proper veterinary care of those animals, 140
and for expenses of the Ohio pet fund that are reasonably 141
necessary for it to obtain and maintain its tax-exempt status and 142
to perform its duties. 143

        The registrar shall pay the contributions the registrar 144
receives pursuant to section 4503.552 of the Revised Code to the 145
rock and roll hall of fame and museum, incorporated. 146

        The registrar shall pay the contributions the registrar 147
receives pursuant to section 4503.553 of the Revised Code to the 148
Ohio coalition for animals, incorporated, a nonprofit corporation. 149
Except as provided in division (B) of this section, the coalition 150
shall distribute the money to its members, and the members shall 151
use the money only to pay for educational, charitable, and other 152
programs of each coalition member that provide care for unwanted, 153
abused, and neglected horses. The Ohio coalition for animals may 154
use a portion of the money to pay for reasonable marketing costs 155
incurred in the design and promotion of the license plate and for 156
administrative costs incurred in the disbursement and management 157
of funds received under this section. 158

        The registrar shall pay the contributions the registrar 159
receives pursuant to section 4503.561 of the Revised Code to the 160
state of Ohio chapter of ducks unlimited, inc., which shall 161
deposit the contributions into a special bank account that it 162
establishes. The special bank account shall be separate and 163
distinct from any other account the state of Ohio chapter of ducks 164
unlimited, inc., maintains and shall be used exclusively for the 165
purpose of protecting, enhancing, restoring, and managing wetlands 166
and conserving wildlife habitat. The state of Ohio chapter of 167
ducks unlimited, inc., annually shall notify the registrar in 168
writing of the name, address, and account to which such payments 169
are to be made. 170

        The registrar shall pay the contributions the registrar 171
receives pursuant to section 4503.562 of the Revised Code to the 172
Mahoning river consortium, which shall use the money to pay the 173
expenses it incurs in restoring and maintaining the Mahoning river 174
watershed. 175

       The registrar shall pay the contributions the registrar 176
receives pursuant to section 4503.564 of the Revised Code to 177
Antioch college for the use of the Glen Helen ecology institute to 178
pay expenses related to the Glen Helen nature preserve.179

        The registrar shall pay to a sports commission created 180
pursuant to section 4503.591 of the Revised Code each contribution 181
the registrar receives under that section that an applicant pays 182
to obtain license plates that bear the logo of a professional 183
sports team located in the county of that sports commission and 184
that is participating in the license plate program pursuant to 185
division (E) of that section, irrespective of the county of 186
residence of an applicant. 187

        The registrar shall pay to a community charity each 188
contribution the registrar receives under section 4503.591 of the 189
Revised Code that an applicant pays to obtain license plates that 190
bear the logo of a professional sports team that is participating 191
in the license plate program pursuant to division (G) of that 192
section. 193

        The registrar shall pay the contributions the registrar 194
receives pursuant to section 4503.67 of the Revised Code to the 195
Dan Beard council of the boy scouts of America. The council shall 196
distribute all contributions in an equitable manner throughout the 197
state to regional councils of the boy scouts. 198

        The registrar shall pay the contributions the registrar 199
receives pursuant to section 4503.68 of the Revised Code to the 200
great river council of the girl scouts of the United States of 201
America. The council shall distribute all contributions in an 202
equitable manner throughout the state to regional councils of the 203
girl scouts. 204

        The registrar shall pay the contributions the registrar 205
receives pursuant to section 4503.69 of the Revised Code to the 206
Dan Beard council of the boy scouts of America. The council shall 207
distribute all contributions in an equitable manner throughout the 208
state to regional councils of the boy scouts. 209

       The registrar shall pay the contributions the registrar 210
receives pursuant to section 4503.701 of the Revised Code to the 211
Prince Hall grand lodge of free and accepted masons of Ohio, which 212
shall use the contributions for scholarship purposes.213

        The registrar shall pay the contributions the registrar 214
receives pursuant to section 4503.71 of the Revised Code to the 215
fraternal order of police of Ohio, incorporated, which shall 216
deposit the fees into its general account to be used for purposes 217
of the fraternal order of police of Ohio, incorporated. 218

        The registrar shall pay the contributions the registrar 219
receives pursuant to section 4503.711 of the Revised Code to the 220
fraternal order of police of Ohio, incorporated, which shall 221
deposit the contributions into an account that it creates to be 222
used for the purpose of advancing and protecting the law 223
enforcement profession, promoting improved law enforcement 224
methods, and teaching respect for law and order. 225

       The registrar shall pay the contributions received pursuant 226
to section 4503.712 of the Revised Code to Ohio concerns of police 227
survivors, which shall use those contributions to provide whatever 228
assistance may be appropriate to the families of Ohio law 229
enforcement officers who are killed in the line of duty. 230

       The registrar shall pay the contributions received pursuant 231
to section 4503.713 of the Revised Code to the greater Cleveland 232
peace officers memorial society, which shall use those 233
contributions to honor law enforcement officers who have died in 234
the line of duty and support its charitable purposes.235

       The registrar shall pay the contributions the registrar 236
receives pursuant to section 4503.72 of the Revised Code to the 237
organization known on March 31, 2003, as the Ohio CASA/GAL 238
association, a private, nonprofit corporation organized under 239
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 240
shall use these contributions to pay the expenses it incurs in 241
administering a program to secure the proper representation in the 242
courts of this state of abused, neglected, and dependent children, 243
and for the training and supervision of persons participating in 244
that program. 245

        The registrar shall pay the contributions the registrar 246
receives pursuant to section 4503.73 of the Revised Code to Wright 247
B. Flyer, incorporated, which shall deposit the contributions into 248
its general account to be used for purposes of Wright B. Flyer, 249
incorporated. 250

       The registrar shall pay the contributions the registrar 251
receives pursuant to section 4503.732 of the Revised Code to the 252
Siegel & Shuster society, a nonprofit organization dedicated to 253
commemorating and celebrating the creation of Superman in 254
Cleveland, Ohio.255

       The registrar shall pay the contributions the registrar 256
receives pursuant to section 4503.74 of the Revised Code to the 257
Columbus zoological park association, which shall disburse the 258
moneys to Ohio's major metropolitan zoos, as defined in section 259
4503.74 of the Revised Code, in accordance with a written 260
agreement entered into by the major metropolitan zoos. 261

       The registrar shall pay the contributions the registrar 262
receives pursuant to section 4503.75 of the Revised Code to the 263
rotary foundation, located on March 31, 2003, in Evanston, 264
Illinois, to be placed in a fund known as the permanent fund and 265
used to endow educational and humanitarian programs of the rotary 266
foundation. 267

       The registrar shall pay the contributions the registrar 268
receives pursuant to section 4503.751 of the Revised Code to the 269
Ohio association of realtors, which shall deposit the 270
contributions into a property disaster relief fund maintained 271
under the Ohio realtors charitable and education foundation.272

        The registrar shall pay the contributions the registrar 273
receives pursuant to section 4503.85 of the Revised Code to the 274
Ohio sea grant college program to be used for Lake Erie area 275
research projects. 276

       The registrar shall pay the contributions the registrar 277
receives pursuant to section 4503.89 of the Revised Code to the 278
American red cross of greater Columbus on behalf of the Ohio 279
chapters of the American red cross, which shall use the 280
contributions for disaster readiness, preparedness, and response 281
programs on a statewide basis.282

       The registrar shall pay the contributions received pursuant 283
to section 4503.92 of the Revised Code to support our troops, 284
incorporated, a national nonprofit corporation, which shall use 285
those contributions in accordance with its articles of 286
incorporation and for the benefit of servicemembers of the armed 287
forces of the United States and their families when they are in 288
financial need. 289

       The registrar shall pay the contributions the registrar 290
receives pursuant to section 4503.94 of the Revised Code to the 291
Michelle's leading star foundation, which shall use the money 292
solely to fund the rental, lease, or purchase of the simulated 293
driving curriculum of the Michelle's leading star foundation by 294
boards of education of city, exempted village, local, and joint 295
vocational school districts.296

       (C) All investment earnings of the license plate contribution 297
fund shall be credited to the fund. Not later than the first day 298
of May of every year, the registrar shall distribute to each 299
entity described in division (B) of this section the investment 300
income the fund earned the previous calendar year. The amount of 301
such a distribution paid to an entity shall be proportionate to 302
the amount of money the entity received from the fund during the 303
previous calendar year.304

       Sec. 4503.492.  (A) The owner or lessee of any passenger car, 305
noncommercial motor vehicle, recreational vehicle, or other 306
vehicle of a class approved by the registrar of motor vehicles may 307
apply to the registrar for the registration of the vehicle and 308
issuance of ovarian cancer awareness license plates. An 309
application made under this section may be combined with a request 310
for a special reserved license plate under section 4503.40 or 311
4503.42 of the Revised Code. Upon receipt of the completed 312
application and compliance by the applicant with divisions (B) and 313
(C) of this section, the registrar shall issue to the applicant 314
the appropriate vehicle registration and a set of ovarian cancer 315
awareness license plates and a validation sticker, or a validation 316
sticker alone when required by section 4503.191 of the Revised 317
Code.318

       In addition to the letters and numbers ordinarily inscribed 319
on the license plates, ovarian cancer awareness license plates 320
shall be inscribed with identifying words or markings that promote 321
ovarian cancer awareness and are approved by the registrar. 322
Ovarian cancer awareness license plates shall display county 323
identification stickers that identify the county of registration 324
by name or number.325

       (B) Ovarian cancer awareness license plates and a validation 326
sticker, or validation sticker alone, shall be issued upon receipt 327
of a contribution as provided in division (C) of this section and 328
upon payment of the regular license tax as prescribed under 329
section 4503.04, any applicable motor vehicle license tax levied 330
under Chapter 4504. of the Revised Code, any applicable additional 331
fee prescribed by section 4503.40 or 4503.42 of the Revised Code, 332
a bureau of motor vehicles administrative fee of ten dollars, and 333
compliance with all other applicable laws relating to the 334
registration of motor vehicles.335

       (C) For each application for registration and registration 336
renewal notice the registrar receives under this section, the 337
registrar shall collect a contribution of twenty-five dollars. The 338
registrar shall transmit this contribution to the treasurer of 339
state for deposit in the license plate contribution fund created 340
in section 4501.21 of the Revised Code.341

       The registrar shall transmit the administrative fee of ten 342
dollars, the purpose of which is to compensate the bureau for the 343
additional services required in the issuing of ovarian cancer 344
awareness license plates, to the treasurer of state for deposit 345
into the state treasury to the credit of the state bureau of motor 346
vehicles fund created by section 4501.25 of the Revised Code.347

       Sec. 5533.972.  In addition to any other name prescribed in 348
the Revised Code or otherwise, that portion of the highway known 349
as state route number sixty-three, commencing at the intersection 350
of that route and state route number four and proceeding in an 351
easterly direction to the intersection of state route sixty-three 352
and Cincinnati-Dayton road within the municipal corporation of 353
MiddletownMonroe only, shall be known as the "Sgt. James C. 354
Robinson, Jr. Memorial Highway." 355

       The director of transportation may erect suitable markers 356
along the highway indicating its name.357

       Sec. 5533.977.  In addition to any other name prescribed in 358
the Revised Code or otherwise, that portion of the highway known 359
as stateUnited States route number forty-two, commencing at the 360
intersection of that route and Butler Warren road and proceeding 361
in a northeasterly direction to the intersection of that route and 362
West Main Street in the municipal corporation of Mason, shall be 363
known as the "SFC William B. Woods, Jr. Memorial Highway." 364

       The director of transportation may erect suitable markers 365
along the highway indicating its name.366

       Sec. 5533.978.  In addition to any other name prescribed in 367
the Revised Code or otherwise, that portion of the highway known 368
as stateUnited States route number forty-two, commencing at the 369
intersection of that route and Creek road in the municipal 370
corporation of Sharonville and proceeding in a northeasterly 371
direction to the intersection of that route and Cox road in West 372
Chester township in Butler county, shall be known as the "Sgt. 373
John P. Huling Memorial Highway."374

       The director of transportation may erect suitable markers 375
along the highway indicating its name.376

       Sec. 5533.98.  In addition to any other name prescribed in 377
the Revised Code or otherwise, that portion of the highway known 378
as state route one hundred twenty-eight, commencing at the 379
intersection of that route and United States route number 380
twenty-seven and proceeding in a northeasterly direction to the 381
intersection of that route and New London road in the municipal 382
corporation of Hamilton, shall be known as the "Cpl. Nickolas383
Nicholas H. Olivas Memorial Highway."384

       The director of transportation may erect suitable markers 385
along the highway indicating its name.386

       Sec. 5533.983.  In addition to any other name prescribed in 387
the Revised Code or otherwise, that portion of the highway known 388
as state route number four, commencing at the intersection of that 389
route and Grand boulevard and proceeding in a southerly direction 390
to the intersection of that route and Bobmeyer road within the 391
municipal corporation of Hamilton only, shall be known as the "SFC392
1SG Ricky L. McGinnis Memorial Highway."393

       The director of transportation may erect suitable markers 394
along the highway indicating its name.395

       Section 2.  That existing sections 4501.21, 5533.972, 396
5533.977, 5533.978, 5533.98, and 5533.983 of the Revised Code are 397
hereby repealed.398
