A BILL
To enact section 4113.14 of the Revised Code to 1
prohibit certain employers from requiring 2
employees to accept the employees' pay in the form 3
of a paycheck card.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 4113.14 of the Revised Code be 5
enacted to read as follows:6

       Sec. 4113.14. (A) As used in this section:7

       (1) "Employer" means an independently owned and operated 8
for-profit or nonprofit business entity, including affiliates, 9
that employs five hundred or more employees in this state.10

        (2) "Paycheck card" means a reloadable prepaid debit card 11
issued through a national or regional bank that takes the place of 12
a paper paycheck or the direct deposit of a paycheck.13

        (B) An employer, to the extent consistent with federal law 14
and subject to division (C) of this section, may pay an employee 15
of the employer the employee's wages using one or more of the 16
following methods: 17

       (1) In lawful money of the United States; 18

       (2) By check payable at face value upon demand in lawful 19
money of the United States; 20

       (3) By electronic automated funds transfer in lawful money of 21
the United States into an account in the name of the employee at a 22
financial institution designated by the employee, provided that 23
the employee voluntarily gives written or electronic authorization 24
in advance to receive the employee's wages in this manner; 25

       (4) By credit to a paycheck card.26

        (C) No employer shall require an employee of the employer to 27
accept the employee's wages for services performed for the 28
employer through a paycheck card. If an employer wishes to pay the 29
wages of an employee of the employer using a paycheck card, the 30
employer shall do both of the following:31

        (1) Offer to pay the employee using the methods described in 32
divisions (B)(1), (2), and (3) of this section in addition to 33
offering to pay the employee through a paycheck card; 34

       (2) Permit the employee to select the method by which the 35
employer shall pay the employee's wages to the employee.36
