To amend section 2927.12 of the Revised Code to | 1 |
expand the offense of "ethnic intimidation" to | 2 |
also prohibit conduct currently specified in the | 3 |
offense when the conduct is committed by reason of | 4 |
another person's gender identity, sexual | 5 |
orientation, or disability. | 6 |
Section 1. That section 2927.12 of the Revised Code be | 7 |
amended to read as follows: | 8 |
Sec. 2927.12. (A) As used in this section: | 9 |
(1) "Disability" has the same meaning as in section 4112.01 | 10 |
of the Revised Code. | 11 |
(2) "Gender identity" means the gender-related identity, | 12 |
appearance, or mannerisms of an individual, or other | 13 |
gender-related characteristics of an individual, with or without | 14 |
regard to the individual's designated gender at birth. | 15 |
(3) "Sexual orientation" means actual or perceived | 16 |
heterosexuality, homosexuality, or bisexuality. | 17 |
(B) No person shall violate section 2903.21, 2903.22, | 18 |
2909.06, or 2909.07, or division (A)(3), (4), or (5) of section | 19 |
2917.21 of the Revised Code by reason of the race, color, | 20 |
religion, | 21 |
or disability of another person or group of persons. | 22 |

intimidation. Ethnic intimidation is an offense of the next higher | 24 |
degree than the offense the commission of which is a necessary | 25 |
element of ethnic intimidation. | 26 |
Section 2. That existing section 2927.12 of the Revised Code | 27 |
is hereby repealed. | 28 |
