A BILL
To enact section 149.60 of the Revised Code to 1
establish the Local Government Information 2
Exchange Grant Program and to make an 3
appropriation.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 149.60 of the Revised Code be enacted 5
to read as follows:6

       Sec. 149.60. (A) As used in this section:7

       (1) "Local government" means a county, township, or municipal 8
corporation or public library.9

       (2) "Metropolitan planning organization" means a metropolitan 10
planning organization designated under section 9(a) of the 11
"Federal-Aid Highway Act of 1962," 76 Stat. 1148, 23 U.S.C. 134, 12
as amended. 13

       (3) "Public record" has the meaning defined in section 149.43 14
of the Revised Code. 15

       (B) There is the local government information exchange grant 16
program in the department of administrative services. The program 17
shall be administered by the director of administrative services. 18
The director shall adopt rules under Chapter 119. of the Revised 19
Code as are necessary to administer the program. The rules shall 20
include all of the following: 21

       (1) Grant eligibility criteria, which shall include a 22
requirement that a grantee be a local government, or a regional 23
planning commission, metropolitan planning organization, or 24
regional council of governments, which may apply on behalf of a 25
local government or group of local governments to assist them in 26
meeting the requirements of this section;27

        (2) Specifications for what data points must be included by 28
local governments in order for the local governments to be 29
eligible for the grant funding;30

       (3) A requirement that electronic data satisfying the grant 31
criteria be posted on the internet, by the local government or by 32
the state, in an open format that is capable of being searched, 33
viewed, and downloaded by the public;34

        (4) Specifications for consistent formatting and technology 35
standards for electronic data satisfying the grant eligibility 36
criteria; and37

        (5) Specifications for accounting standards for data provided 38
by local governments.39

        Required data points may be different for each type of local 40
government. 41

       (C) The director shall disburse a grant of ten thousand 42
dollars to each local government that meets the grant eligibility 43
criteria established by the director, or to a regional planning 44
commission, metropolitan planning organization, or regional 45
council of governments for each local government applied for that 46
meets the grant eligibility criteria established by the director. 47
Grants shall be awarded in the order in which the local 48
governments have met the eligibility criteria. The total amount of 49
grants awarded shall not exceed the amount that can be funded with 50
appropriations made by the general assembly for this purpose.51

       Section 2.  All items in this section are hereby appropriated 52
as designated out of any moneys in the state treasury to the 53
credit of the General Revenue Fund. For all appropriations made in 54
this act, those in the first column are for fiscal year 2015 and 55
the appropriations in the second column are for fiscal year 2016. 56
The appropriations made in this act are in addition to any other 57
appropriations made for the FY 2014-FY 2015 biennium and the FY 58
2016-FY 2017 biennium.59

       LOCAL GOVERNMENT INFORMATION EXCHANGE GRANTS65

       Of the foregoing appropriation item 100501, Local Government 66
Information Exchange Grants, up to $250,000 in fiscal year 2015 67
shall be used by the Director of Administrative Services for 68
administration and maintenance of the Local Government Information 69
Exchange Grant Program and for administration of Local Government 70
Information Exchange Grants. The remainder of the foregoing 71
appropriation item 100501, Local Government Information Exchange 72
Grants, shall be used by the Director of Administrative Services 73
to disburse grant awards to eligible counties, townships, and 74
municipal corporations, and to regional planning commissions, 75
metropolitan planning organizations, and regional councils of 76
governments, under section 149.60 of the Revised Code. 77

       Section 3. Within the limits set forth in this act, the 78
Director of Budget and Management shall establish accounts 79
indicating the source and amount of funds for each appropriation 80
made in this act, and shall determine the form and manner in which 81
appropriation accounts shall be maintained. Expenditures from the 82
FY 2015 appropriations contained in this act shall be accounted 83
for as though made in H.B. 59 of the 130th General Assembly.84

       The FY 2015 appropriations made in this act are subject to 85
all provisions of H.B. 59 of the 130th General Assembly that are 86
generally applicable to such appropriations.87

       Expenditures from the FY 2016 appropriation contained in this 88
act shall be accounted for as though made in the main operating 89
appropriations act of the 131st General Assembly. The FY 2016 90
appropriation made in this act is subject to all provisions of the 91
main operating appropriations act of the 131st General Assembly 92
that are generally applicable to such appropriations.93
