A BILL
To amend section 4503.181 of the Revised Code to 1
revise the purposes for which a historical vehicle 2
may be operated.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 4503.181 of the Revised Code be 4
amended to read as follows:5

       Sec. 4503.181.  (A) As used in this section, "historical 6
motor vehicle" means any motor vehicle that is more than 7
twenty-five years old and that is owned solely as a collector's 8
item and for participation in club activities, exhibitions, tours, 9
parades, and similar uses, but in no event is. A historical motor 10
vehicle shall not be used for general transportation, but may be 11
operated on the public roads and highways to and from a location 12
where maintenance is performed on the vehicle.13

       (B) In lieu of the annual license tax levied in sections 14
4503.02 and 4503.04 of the Revised Code, a license fee of ten 15
dollars is levied on the operation of ana historical motor 16
vehicle.17

       (C) A person who owns ana historical motor vehicle and 18
applies for license plates under this section shall execute an 19
affidavit that the vehicle for which plates are requested is owned 20
and operated solely for the purposes enumerated in division (A) of 21
this section, and also setting forth in the affidavit that the 22
vehicle has been inspected and found safe to operate on the public 23
roads and highways in the state. A person who owns ana historical 24
motor vehicle and desires to display model year license plates on 25
the vehicle as permitted by this section shall execute at the time 26
of registration an affidavit setting forth that the model year 27
license plates the person desires to display on the person's 28
historical motor vehicle are legible and serviceable license 29
plates that originally were issued by this state. No registration 30
issued pursuant to this section need specify the weight of the 31
vehicle.32

       (D) A vehicle registered under this section may display 33
historical vehicle license plates issued by the registrar of motor 34
vehicles or model year license plates procured by the applicant. 35
Historical vehicle license plates shall not bear a date, but shall 36
bear the inscription "Historical Vehicle--Ohio" and the 37
registration number, which shall be shown thereon. Model year 38
license plates shall be legible and serviceable license plates 39
issued by this state and inscribed with the date of the year 40
corresponding to the model year when the vehicle was manufactured. 41
Notwithstanding section 4503.21 of the Revised Code, only one 42
model year license plate is required to be displayed on the rear 43
of the historical motor vehicle at all times. The registration 44
certificate and the historical vehicle license plates issued by 45
the registrar shall be kept in the vehicle at all times the 46
vehicle is operated on the public roads and highways in this 47
state.48

       Notwithstanding section 4503.21 of the Revised Code, the 49
owner of ana historical motor vehicle that was manufactured for 50
military purposes and that is registered under this section may 51
display the assigned registration number of the vehicle by 52
painting the number on the front and rear of the vehicle. The 53
number shall be painted, in accordance with the size and style 54
specifications established for numerals and letters shown on 55
license plates in section 4503.22 of the Revised Code, in a color 56
that contrasts clearly with the color of the vehicle, and shall be 57
legible and visible at all times. Upon application for 58
registration under this section and payment of the license fee 59
prescribed in division (B) of this section, the owner of such ana60
historical motor vehicle shall be issued historical vehicle 61
license plates. The registration certificate and at least one such 62
license plate shall be kept in the vehicle at all times the 63
vehicle is operated on the public roads and highways in this 64
state. If ownership of such a vehicle is transferred, the 65
transferor shall surrender the historical vehicle license plates 66
or transfer them to another historical motor vehicle the 67
transferor owns, and remove or obliterate the registration numbers 68
painted on the vehicle.69

       (E) Historical vehicle and model year license plates are 70
valid without renewal as long as the vehicle for which they were 71
issued or procured is in existence. Historical vehicle plates are 72
issued for the owner's use only for such vehicle unless later 73
transferred to another historical motor vehicle owned by that 74
person. In order to effect such a transfer, the owner of the 75
historical motor vehicle that originally displayed the historical 76
vehicle plates shall comply with division (C) of this section. In 77
the event of a transfer of title, the transferor shall surrender 78
historical vehicle license plates or transfer them to another 79
historical motor vehicle owned by the transferor, but model year 80
license plates may be retained by the transferor. The registrar 81
may revoke license plates issued under this section, for cause 82
shown and after hearing, for failure of the applicant to comply 83
with this section. Upon revocation, historical vehicle license 84
plates shall be surrendered; model year license plates may be 85
retained, but no longer are valid for display on the vehicle.86

       (F) The owner of ana historical motor vehicle bearing 87
historical vehicle license plates may replace them with model year 88
license plates by surrendering the historical vehicle license 89
plates and motor vehicle certificate of registration to the 90
registrar. The owner, at the time of registration, shall execute 91
an affidavit setting forth that the model year plates are legible 92
and serviceable license plates that originally were issued by this 93
state. Such an owner is required to pay the license fee prescribed 94
by division (B) of this section, but the owner is not required to 95
have the historical motor vehicle reinspected under division (C) 96
of this section.97

       A person who owns ana historical motor vehicle bearing model 98
year license plates may replace them with historical vehicle 99
license plates by surrendering the motor vehicle certificate of 100
registration and applying for issuance of historical vehicle 101
license plates. Such a person is required to pay the license fee 102
prescribed by division (B) of this section, but the person is not 103
required to have the historical motor vehicle reinspected under 104
division (C) of this section.105

       Section 2.  That existing section 4503.181 of the Revised 106
Code is hereby repealed.107
