A BILL
To enact section 5902.20 of the Revised Code to 1
create the Ohio Veterans Health Care System.2


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 5902.20 of the Revised Code be 3
enacted to read as follows:4

       Sec. 5902.20.  (A) As used in this section:5

       "Uniformed services" means the armed forces of the United 6
States, the army national guard and the air national guard when 7
engaged in active duty for training, inactive duty for training, 8
or full-time national guard duty, the commissioned corps of the 9
public health service, and any other category of persons 10
designated by the president in time of war or national emergency.11

       "Veteran" means a person who served in the uniformed services 12
or a reserve component of the armed forces of the United States, 13
and who was discharged or released therefrom under conditions 14
other than dishonorable.15

       (B) There is the Ohio veterans health care system to provide 16
eligible veterans with comprehensive health care services, 17
including health, medical, hospital, dental, and surgical 18
benefits. The program is to provide veterans who are eligible for 19
health care benefits under the medicaid program, instead with 20
health care insurance through the Ohio veterans health care 21
system. When the Ohio veterans health care system becomes 22
operational, veterans receiving health care benefits under the 23
medicaid program instead shall be transferred to and enrolled in 24
the Ohio veterans health care system.25

       (C) The director of veterans services, in consultation with 26
the superintendent of insurance, the director of administrative 27
services, and the director of job and family services, shall 28
select the structure of the system from one of the following three 29
options:30

       (1) A state subsidized comprehensive health care plan 31
provided by an insurance company authorized to do business in this 32
state.33

       (2) A state subsidized high deductible health care plan 34
provided by an insurance company authorized to do business in this 35
state, to be provided in conjunction with an obligation for the 36
state to make periodic direct deposits into an individual health 37
savings account, established by the veteran, which qualifies under 38
section 223 of the Internal Revenue Code.39

       (3) A voucher program that grants subsidies to eligible 40
veterans for purchasing private health insurance under the Patient 41
Protection and Affordable Care Act, Pub. L. No. 111-148, 124 Stat. 42
119, through its health insurance marketplace exchange to the 43
extent not otherwise subsidized under the Patient Protection and 44
Affordable Care Act.45

       The director of veterans services, in consultation with the 46
director of administrative services and in accordance with the 47
competitive selection procedures of Chapter 125. of the Revised 48
Code, may contract with an insurance company or a health plan in 49
combination with an insurance company, authorized to do business 50
in this state, for the issuance of a policy or contract to cover 51
veterans under the Ohio veterans health care system.52

       (D) The director of veterans services in consultation with 53
the superintendent of insurance, the director of administrative 54
services, and the director of job and family services, shall adopt 55
rules under Chapter 119. of the Revised Code that specify the 56
terms and conditions of the Ohio veterans health care system, 57
including, but not limited to:58

       (1) Eligibility requirements;59

       (2) Enrollment procedures;60

       (3) Covered services;61

       (4) Covered prescriptions;62

       (5) Deductibles, copays, and maximum out-of-pocket expenses;63

       (6) Any other terms and conditions necessary to implement and 64
manage the system.65

       The rule specifying eligibility requirements shall include a 66
requirement that, in order to be eligible to receive benefits 67
through the Ohio veterans health care system, a person must be a 68
veteran, who is eligible to receive health care benefits under the 69
medicaid program, and who is a resident of this state.70
