customers regarding smart meters installed on | 3 |
their premises. | 4 |
Section 1. That sections 4933.26 and 4933.27 of the Revised | 5 |
Code be enacted to read as follows: | 6 |
Sec. 4933.26. As used in this section and section 4933.27 of | 7 |
the Revised Code: | 8 |
(A) "Smart meter" means an advanced metering infrastructure | 9 |
device with the capability for two-way communication between the | 10 |
device and a utility. | 11 |
(B) "Utility" means an electric light company, a gas company, | 12 |
a natural gas company, or a water-works company as defined in | 13 |
section 4905.03 of the Revised Code that is a public utility as | 14 |
defined in section 4905.02 of the Revised Code. | 15 |
Sec. 4933.27. (A) A utility may install a smart meter on a | 16 |
customer's premises, provided that the company does the following: | 17 |
(1) Gives written notice to the customer, prior to | 18 |
installation, that includes the following: | 19 |
(a) A statement that the meter will be used for two-way | 20 |
communication between itself and the utility; | 21 |
(b) A description in plain language of the type of data the | 22 |
meter will collect from the customer and send to the utility; | 23 |
(c) The customer's rights under divisions (A)(2) and (3) of | 24 |
this section, and what steps the customer must take to exercise | 25 |
those rights. | 26 |
(2) Allows a residential customer to choose not to have a | 27 |
smart meter installed, without incurring an additional monthly or | 28 |
other charge for this decision; | 29 |
(3) Allows a residential customer to require removal of a | 30 |
previously installed smart meter for any reason at an agreed-upon | 31 |
time, without incurring any charge for such removal. | 32 |
(B) Division (A) of this section does not apply to meters | 33 |
whose communication capabilities will be used only for remote | 34 |
meter reading. | 35 |
