A BILL
To amend section 3311.19 and to enact section 1
3311.191 of the Revised Code to revise the law 2
regarding terms of office of members of certain 3
joint vocational school district boards of 4
education.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That section 3311.19 be amended and section 6
3311.191 of the Revised Code be enacted to read as follows:7

       Sec. 3311.19.  (A) The management and control of a joint 8
vocational school district shall be vested in the joint vocational 9
school district board of education which, beginning on the 10
effective date of this amendmentSeptember 29, 2013, shall be 11
appointed under division (C) of this section.12

       All members of a joint vocational school district board 13
serving unexpired terms on the effective date of this amendment14
September 29, 2013, may continue in office until the expiration of 15
their terms. If a member leaves office for any reason prior to the 16
expiration of that member's term, the vacancy shall be filled only 17
in the manner provided in division (C) of this section.18

       (B) MembersExcept as provided in section 3311.191 of the 19
Revised Code, members of the joint vocational school district 20
board appointed on or after the effective date of this amendment21
September 29, 2013, shall serve for three-year terms of office. No 22
member shall hold office for a period of longer than two 23
consecutive terms. Terms shall be considered consecutive unless 24
separated by three or more years.25

       Members of the board shall be selected based on the diversity 26
of the employers from the geographical region of the state in 27
which the territory of the joint vocational school district is 28
located represented by the members. Not less than three-fifths of 29
the members of the board shall reside in or be employed within the 30
territory of the joint vocational school district board upon which 31
the member serves.32

       (C) The manner of appointment and the total number of members 33
appointed to the joint vocational school district board shall be 34
in accordance with the most recent plan for the joint vocational 35
school district on file with the department of education. An 36
individual shall not be a member of an appointing board, unless 37
the individual meets the criteria in division (C)(2) of this 38
section.39

       (1) Appointments under this section shall be made as the 40
terms of members of each joint vocational school district board 41
who are serving unexpired terms on the effective date of this 42
amendmentSeptember 29, 2013, expire or as those offices are 43
otherwise vacated prior to the expiration date.44

       (2) Members of the joint vocational board shall have 45
experience as chief financial officers, chief executive officers, 46
human resources managers, or other business, industry, or career 47
counseling professionals who are qualified to discuss the labor 48
needs of the region with respect to the regional economy. The 49
appointing board shall appoint individuals who represent employers 50
in the region served by the joint vocational school district who 51
are qualified to consider the state's workforce needs with an 52
understanding of the skills, training, and education needed for 53
current and future employment opportunities in the state. The 54
appointing board may give preference to individuals who have 55
served as members on a joint vocational school business advisory 56
committee who meet the qualifications in division (C)(2) of this 57
section. 58

       (D) The vocational schools in the joint vocational school 59
district shall be available to all youth of school age within the 60
joint vocational school district subject to the rules adopted by 61
the joint vocational school district board of education in regard 62
to the standards requisite to admission. A joint vocational school 63
district board of education shall have the same powers, duties, 64
and authority for the management and operation of such joint 65
vocational school district as is granted by law, except by this 66
chapter and Chapters 124., 3317., 3323., and 3331. of the Revised 67
Code, to a board of education of a city school district, and shall 68
be subject to all the provisions of law that apply to a city 69
school district, except such provisions in this chapter and 70
Chapters 124., 3317., 3323., and 3331. of the Revised Code.71

       (E) The superintendent of schools of a joint vocational 72
school district shall exercise the duties and authority vested by 73
law in a superintendent of schools pertaining to the operation of 74
a school district and the employment and supervision of its 75
personnel. The joint vocational school district board of education 76
shall appoint a treasurer of the joint vocational school district 77
who shall be the fiscal officer for such district and who shall 78
have all the powers, duties, and authority vested by law in a 79
treasurer of a board of education. 80

       (F) Each member of a joint vocational school district board 81
of education may be paid such compensation as the board provides 82
by resolution, but it shall not exceed one hundred twenty-five 83
dollars per member for each meeting attended plus mileage, at the 84
rate per mile provided by resolution of the board, to and from 85
meetings of the board.86

       The board may provide by resolution for the deduction of 87
amounts payable for benefits under section 3313.202 of the Revised 88
Code.89

       Each member of a joint vocational school district board may 90
be paid such compensation as the board provides by resolution for 91
attendance at an approved training program, provided that such 92
compensation shall not exceed sixty dollars per day for attendance 93
at a training program three hours or fewer in length and one 94
hundred twenty-five dollars a day for attendance at a training 95
program longer than three hours in length. However, no board 96
member shall be compensated for the same training program under 97
this section and section 3313.12 of the Revised Code.98

       Sec. 3311.191.  (A) Subject to division (B) of this section, 99
if a joint vocational school district has an even number of member 100
districts each appointing a member to the joint vocational school 101
district board of education and the joint vocational school 102
district's plan on file with the department of education provides 103
for one additional board member to be appointed on a rotating 104
basis by one of the appointing boards, the term of that additional 105
member shall be for one year. The additional member shall 106
otherwise meet the requirements for joint vocational school board 107
members prescribed by section 3311.19 of the Revised Code.108

       (B) If an additional member of a joint vocational school 109
district board appointed on a rotating basis, as described in 110
division (A) of this section, was appointed on or after September 111
29, 2013, but prior to the effective date of this section, that 112
member may continue in office until the expiration of the member's 113
current term of office. If such member vacates that office for any 114
reason prior to the expiration of that member's term, a new 115
additional member shall be appointed according to the rotational 116
basis prescribed by the district's plan, and that member shall 117
serve for the remainder of the vacating member's term. Thereafter, 118
the term of office of the additional member shall be as prescribed 119
by division (A) of this section.120

       Section 2.  That existing section 3311.19 of the Revised Code 121
is hereby repealed.122
