A BILL
To enact sections 5101.39, 5101.40, and 5101.41 of 1
the Revised Code to establish the Ohio Community 2
and Neighborhood Service Commission.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 5101.39, 5101.40, and 5101.41 of 4
the Revised Code be enacted to read as follows:5

       Sec. 5101.39.  The Ohio community and neighborhood service 6
commission shall do the following: 7

       (A) Identify and evaluate problems being experienced by 8
communities and neighborhoods throughout the state, such as 9
poverty, lack of safety and security, poor sanitation, and 10
inadequate clothing, housing, utilities, transportation, 11
education, and health care;12

       (B) Identify existing nonprofit, nongovernmental community 13
and neighborhood service programs that are addressing the 14
identified problems;15

       (C) Develop ideas for and encourage the creation of 16
innovative nonprofit, nongovernmental community and neighborhood 17
service programs to address the identified problems;18

       (D) Identify resources that are available to support 19
nonprofit, nongovernmental community and neighborhood and 20
neighborhood service programs; and21

       (E) Award grants from money available in the Ohio community 22
and neighborhood service commission fund to support nonprofit, 23
nongovernmental community and neighborhood service programs.24

       The commission shall adopt rules under Chapter 119. of the 25
Revised Code that prescribe criteria and procedures for awarding 26
grants.27

       The commission annually shall prepare a report of its 28
findings and recommendations. The commission shall furnish a copy 29
of the report to the president of the senate, the speaker of the 30
house of representatives, and the governor. 31

       Sec. 5101.40.  The Ohio community and neighborhood service 32
commission may accept gifts and may accept or seek and accept 33
grants from any public agency or private source to carry out the 34
commission's duties. There is an Ohio community and neighborhood 35
service fund in the state treasury. The commission shall deposit 36
all monetary gifts and grants into the fund. The commission shall 37
use the gifts and grants solely to make grants and to defray the 38
cost of its operations. Gifts and grants are subject to any 39
restriction that applies to the gift or grant.40

       Sec. 5101.41.  The Ohio community and neighborhood service 41
commission consists of the following eleven members:42

       (A) Five representatives of the general public appointed by 43
the governor;44

       (B) The governor, or the governor's designee;45

       (C) The director of job and family services, or the 46
director's designee;47

       (D) Two members of the senate, one appointed by the president 48
of the senate and the other appointed by the minority leader of 49
the senate; 50

       (E) Two members of the house of representatives, one 51
appointed by the speaker of the house of representatives and the 52
other appointed by the minority leader of the house of 53
representatives.54

       Members appointed to the commission under division (A) of 55
this section shall have extensive experience in issues related to 56
community and neighborhood services. 57

       The appointing authorities shall make initial appointments to 58
the commission within thirty days after the effective date of this 59
section. Of the initial appointments to the commission under 60
division (A) of this section, two of the members shall serve a 61
term that expires on June 30, 2015, and three of the members shall 62
serve a term that expires on June 30, 2016. Thereafter, all 63
members appointed under division (A) of this section shall serve a 64
term of two years that begins on the first day of July and expires 65
on the last day of June.66

       A member of the general assembly appointed to the commission 67
shall serve on the commission until the adjournment sine die of 68
the general assembly during which the member was appointed or 69
until the member ceases to be a member of the general assembly or 70
of the chamber from which the member was appointed.71

       Members of the commission are not entitled to compensation 72
but shall be reimbursed for actual and necessary expenses incurred 73
in the performance of their duties.74

       A vacancy occurring among the members of the commission shall 75
be filled in the same manner as the original appointment.76

       Members of the commission may be reappointed. 77

       The commission annually shall elect a chairperson from among 78
its members.79

       The commission shall convene as summoned by the chairperson. 80
The first meeting of the commission shall occur within sixty days 81
after the effective date of this section. Thereafter, the 82
commission shall meet not less often than once per month.83

       The department of job and family services shall provide staff 84
and other support services as necessary for the commission to 85
carry out its duties.86
