To enact section 4513.42 of the Revised Code to | 1 |
regulate the idling of motor vehicles. | 2 |
Section 1. That section 4513.42 of the Revised Code be | 3 |
enacted to read as follows: | 4 |
Sec. 4513.42. (A) No operator of a motor vehicle shall idle | 5 |
the engine of the motor vehicle, except as follows: | 6 |
(1) If the outdoor temperature exceeds twenty degrees | 7 |
fahrenheit, the operator may idle the motor vehicle engine for not | 8 |
more than five consecutive minutes in any one-hour period. | 9 |
(2) If the outdoor temperature is less than or equal to | 10 |
twenty degrees fahrenheit, the operator may idle the motor vehicle | 11 |
engine for not more than ten consecutive minutes in any one-hour | 12 |
period. | 13 |
(B) Division (A) of this section does not apply to a motor | 14 |
vehicle operator in any of the following circumstances: | 15 |
(1) Heavy traffic congestion or some other adverse traffic | 16 |
condition exists that requires the engine to be running; | 17 |
(2) The motor vehicle is being serviced or repaired and in | 18 |
order to effect the service or repair the engine is required to be | 19 |
running. | 20 |
(3) The engine is required to be running for a personal | 21 |
health or safety reason, such as to maintain the ability of the | 22 |
operator to see outside the motor vehicle or to maintain an | 23 |
acceptable interior temperature. | 24 |
(C) Except as otherwise provided in this division, whoever | 25 |
violates division (A) of this section is guilty of a minor | 26 |
misdemeanor. If, within one year of the offense, the offender | 27 |
previously has been convicted of or pleaded guilty to two or more | 28 |
violations of division (A) of this section, whoever violates | 29 |
division (A) of this section is guilty of a misdemeanor of the | 30 |
fourth degree. | 31 |
