A BILL
To amend sections 4501.21 and 4503.499 and to enact 1
sections 4503.576 and 5533.242 of the Revised Code 2
to create the "Ohio State Beekeepers Association" 3
license plate, to alter the law governing the 4
pediatric brain tumor awareness license plate, and 5
to designate a portion of Interstate Route 75 in 6
Hamilton County as the "William L. Mallory, Sr. 7
Memorial Highway."8


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 4501.21 and 4503.499 be amended and 9
sections 4503.576 and 5533.242 of the Revised Code be enacted to 10
read as follows:11

       Sec. 4501.21.  (A) There is hereby created in the state 12
treasury the license plate contribution fund. The fund shall 13
consist of all contributions paid by motor vehicle registrants and 14
collected by the registrar of motor vehicles pursuant to sections 15
4503.491, 4503.492, 4503.493, 4503.494, 4503.496, 4503.498, 16
4503.499, 4503.50, 4503.501, 4503.502, 4503.505, 4503.51, 17
4503.522, 4503.523, 4503.524, 4503.525, 4503.526, 4503.531, 18
4503.545, 4503.55, 4503.551, 4503.552, 4503.553, 4503.561, 19
4503.562, 4503.564, 4503.576, 4503.591, 4503.67, 4503.68, 4503.69, 20
4503.701, 4503.71, 4503.711, 4503.712, 4503.713, 4503.72, 4503.73, 21
4503.732, 4503.74, 4503.75, 4503.751, 4503.85, 4503.89, 4503.90, 22
4503.92, and 4503.94 of the Revised Code. 23

       (B) The registrar shall pay the contributions the registrar 24
collects in the fund as follows: 25

        The registrar shall pay the contributions received pursuant 26
to section 4503.491 of the Revised Code to the breast cancer fund 27
of Ohio, which shall use that money only to pay for programs that 28
provide assistance and education to Ohio breast cancer patients 29
and that improve access for such patients to quality health care 30
and clinical trials and shall not use any of the money for 31
abortion information, counseling, services, or other 32
abortion-related activities. 33

       The registrar shall pay the contributions the registrar 34
receives pursuant to section 4503.492 of the Revised Code to the 35
organization cancer support community central Ohio, which shall 36
deposit the money into the Sheryl L. Kraner Fund of that 37
organization. Cancer support community central Ohio shall expend 38
the money it receives pursuant to this division only in the same 39
manner and for the same purposes as that organization expends 40
other money in that fund.41

        The registrar shall pay the contributions received pursuant 42
to section 4503.493 of the Revised Code to the autism society of 43
Ohio, which shall use the contributions for programs and autism 44
awareness efforts throughout the state. 45

       The registrar shall pay the contributions the registrar 46
receives pursuant to section 4503.494 of the Revised Code to the 47
national multiple sclerosis society for distribution in equal 48
amounts to the northwestern Ohio, Ohio buckeye, and Ohio valley 49
chapters of the national multiple sclerosis society. These 50
chapters shall use the money they receive under this section to 51
assist in paying the expenses they incur in providing services 52
directly to their clients.53

       The registrar shall pay the contributions the registrar 54
receives pursuant to section 4503.496 of the Revised Code to the 55
Ohio sickle cell and health association, which shall use the 56
contributions to help support educational, clinical, and social 57
support services for adults who have sickle cell disease.58

       The registrar shall pay the contributions the registrar 59
receives pursuant to section 4503.498 of the Revised Code to 60
special olympics Ohio, inc., which shall use the contributions for 61
its programs, charitable efforts, and other activities. 62

       The registrar shall pay the contributions the registrar 63
receives pursuant to section 4503.499 of the Revised Code to the 64
children's glioma cancer foundation, which shall use the 65
contributions for its research and other programs. 66

        The registrar shall pay the contributions the registrar 67
receives pursuant to section 4503.50 of the Revised Code to the 68
future farmers of America foundation, which shall deposit the 69
contributions into its general account to be used for educational 70
and scholarship purposes of the future farmers of America 71
foundation. 72

        The registrar shall pay the contributions the registrar 73
receives pursuant to section 4503.501 of the Revised Code to the 74
4-H youth development program of the Ohio state university 75
extension program, which shall use those contributions to pay the 76
expenses it incurs in conducting its educational activities. 77

        The registrar shall pay the contributions received pursuant 78
to section 4503.502 of the Revised Code to the Ohio cattlemen's 79
foundation, which shall use those contributions for scholarships 80
and other educational activities. 81

       The registrar shall pay the contributions received pursuant 82
to section 4503.505 of the Revised Code to the organization Ohio 83
region phi theta kappa, which shall use those contributions for 84
scholarships for students who are members of that organization. 85

        The registrar shall pay each contribution the registrar 86
receives pursuant to section 4503.51 of the Revised Code to the 87
university or college whose name or marking or design appears on 88
collegiate license plates that are issued to a person under that 89
section. A university or college that receives contributions from 90
the fund shall deposit the contributions into its general 91
scholarship fund. 92

        The registrar shall pay the contributions the registrar 93
receives pursuant to section 4503.522 of the Revised Code to the 94
"friends of Perry's victory and international peace memorial, 95
incorporated," a nonprofit corporation organized under the laws of 96
this state, to assist that organization in paying the expenses it 97
incurs in sponsoring or holding charitable, educational, and 98
cultural events at the monument. 99

       The registrar shall pay the contributions the registrar 100
receives pursuant to section 4503.523 of the Revised Code to the 101
fairport lights foundation, which shall use the money to pay for 102
the restoration, maintenance, and preservation of the lighthouses 103
of fairport harbor. 104

       The registrar shall pay the contributions the registrar 105
receives pursuant to section 4503.524 of the Revised Code to the 106
Massillon tiger football booster club, which shall use the 107
contributions only to promote and support the football team of 108
Washington high school of the Massillon city school district.109

       The registrar shall pay the contributions the registrar 110
receives pursuant to section 4503.525 of the Revised Code to the 111
United States power squadron districts seven, eleven, twenty-four, 112
and twenty-nine in equal amounts. Each power squadron district 113
shall use the money it receives under this section to pay for the 114
educational boating programs each district holds or sponsors 115
within this state.116

       The registrar shall pay the contributions the registrar 117
receives pursuant to section 4503.526 of the Revised Code to the 118
Ohio district Kiwanis foundation of the Ohio district of Kiwanis 119
international, which shall use the money it receives under this 120
section to pay the costs of its educational and humanitarian 121
activities.122

       The registrar shall pay the contributions the registrar 123
receives pursuant to section 4503.531 of the Revised Code to the 124
thank you foundation, incorporated, a nonprofit corporation 125
organized under the laws of this state, to assist that 126
organization in paying for the charitable activities and programs 127
it sponsors in support of United States military personnel, 128
veterans, and their families.129

        The registrar shall pay the contributions the registrar 130
receives pursuant to section 4503.55 of the Revised Code to the 131
pro football hall of fame, which shall deposit the contributions 132
into a special bank account that it establishes and which shall be 133
separate and distinct from any other account the pro football hall 134
of fame maintains, to be used exclusively for the purpose of 135
promoting the pro football hall of fame as a travel destination. 136

        The registrar shall pay the contributions that are paid to 137
the registrar pursuant to section 4503.545 of the Revised Code to 138
the national rifle association foundation, which shall use the 139
money to pay the costs of the educational activities and programs 140
the foundation holds or sponsors in this state. 141

        The registrar shall pay to the Ohio pet fund the 142
contributions the registrar receives pursuant to section 4503.551 143
of the Revised Code and any other money from any other source, 144
including donations, gifts, and grants, that is designated by the 145
source to be paid to the Ohio pet fund. The Ohio pet fund shall 146
use the moneys it receives under this section to support programs 147
for the sterilization of dogs and cats and for educational 148
programs concerning the proper veterinary care of those animals, 149
and for expenses of the Ohio pet fund that are reasonably 150
necessary for it to obtain and maintain its tax-exempt status and 151
to perform its duties. 152

        The registrar shall pay the contributions the registrar 153
receives pursuant to section 4503.552 of the Revised Code to the 154
rock and roll hall of fame and museum, incorporated. 155

        The registrar shall pay the contributions the registrar 156
receives pursuant to section 4503.553 of the Revised Code to the 157
Ohio coalition for animals, incorporated, a nonprofit corporation. 158
Except as provided in division (B) of this section, the coalition 159
shall distribute the money to its members, and the members shall 160
use the money only to pay for educational, charitable, and other 161
programs of each coalition member that provide care for unwanted, 162
abused, and neglected horses. The Ohio coalition for animals may 163
use a portion of the money to pay for reasonable marketing costs 164
incurred in the design and promotion of the license plate and for 165
administrative costs incurred in the disbursement and management 166
of funds received under this section. 167

        The registrar shall pay the contributions the registrar 168
receives pursuant to section 4503.561 of the Revised Code to the 169
state of Ohio chapter of ducks unlimited, inc., which shall 170
deposit the contributions into a special bank account that it 171
establishes. The special bank account shall be separate and 172
distinct from any other account the state of Ohio chapter of ducks 173
unlimited, inc., maintains and shall be used exclusively for the 174
purpose of protecting, enhancing, restoring, and managing wetlands 175
and conserving wildlife habitat. The state of Ohio chapter of 176
ducks unlimited, inc., annually shall notify the registrar in 177
writing of the name, address, and account to which such payments 178
are to be made. 179

        The registrar shall pay the contributions the registrar 180
receives pursuant to section 4503.562 of the Revised Code to the 181
Mahoning river consortium, which shall use the money to pay the 182
expenses it incurs in restoring and maintaining the Mahoning river 183
watershed. 184

       The registrar shall pay the contributions the registrar 185
receives pursuant to section 4503.564 of the Revised Code to 186
Antioch college for the use of the Glen Helen ecology institute to 187
pay expenses related to the Glen Helen nature preserve.188

       The registrar shall pay the contributions the registrar 189
receives pursuant to section 4503.576 of the Revised Code to the 190
Ohio state beekeepers association, which shall use those 191
contributions to promote beekeeping, provide educational 192
information about beekeeping, and to support other state and local 193
beekeeping programs.194

        The registrar shall pay to a sports commission created 195
pursuant to section 4503.591 of the Revised Code each contribution 196
the registrar receives under that section that an applicant pays 197
to obtain license plates that bear the logo of a professional 198
sports team located in the county of that sports commission and 199
that is participating in the license plate program pursuant to 200
division (E) of that section, irrespective of the county of 201
residence of an applicant. 202

        The registrar shall pay to a community charity each 203
contribution the registrar receives under section 4503.591 of the 204
Revised Code that an applicant pays to obtain license plates that 205
bear the logo of a professional sports team that is participating 206
in the license plate program pursuant to division (G) of that 207
section. 208

        The registrar shall pay the contributions the registrar 209
receives pursuant to section 4503.67 of the Revised Code to the 210
Dan Beard council of the boy scouts of America. The council shall 211
distribute all contributions in an equitable manner throughout the 212
state to regional councils of the boy scouts. 213

        The registrar shall pay the contributions the registrar 214
receives pursuant to section 4503.68 of the Revised Code to the 215
great river council of the girl scouts of the United States of 216
America. The council shall distribute all contributions in an 217
equitable manner throughout the state to regional councils of the 218
girl scouts. 219

        The registrar shall pay the contributions the registrar 220
receives pursuant to section 4503.69 of the Revised Code to the 221
Dan Beard council of the boy scouts of America. The council shall 222
distribute all contributions in an equitable manner throughout the 223
state to regional councils of the boy scouts. 224

       The registrar shall pay the contributions the registrar 225
receives pursuant to section 4503.701 of the Revised Code to the 226
Prince Hall grand lodge of free and accepted masons of Ohio, which 227
shall use the contributions for scholarship purposes.228

        The registrar shall pay the contributions the registrar 229
receives pursuant to section 4503.71 of the Revised Code to the 230
fraternal order of police of Ohio, incorporated, which shall 231
deposit the fees into its general account to be used for purposes 232
of the fraternal order of police of Ohio, incorporated. 233

        The registrar shall pay the contributions the registrar 234
receives pursuant to section 4503.711 of the Revised Code to the 235
fraternal order of police of Ohio, incorporated, which shall 236
deposit the contributions into an account that it creates to be 237
used for the purpose of advancing and protecting the law 238
enforcement profession, promoting improved law enforcement 239
methods, and teaching respect for law and order. 240

       The registrar shall pay the contributions received pursuant 241
to section 4503.712 of the Revised Code to Ohio concerns of police 242
survivors, which shall use those contributions to provide whatever 243
assistance may be appropriate to the families of Ohio law 244
enforcement officers who are killed in the line of duty. 245

       The registrar shall pay the contributions received pursuant 246
to section 4503.713 of the Revised Code to the greater Cleveland 247
peace officers memorial society, which shall use those 248
contributions to honor law enforcement officers who have died in 249
the line of duty and support its charitable purposes.250

       The registrar shall pay the contributions the registrar 251
receives pursuant to section 4503.72 of the Revised Code to the 252
organization known on March 31, 2003, as the Ohio CASA/GAL 253
association, a private, nonprofit corporation organized under 254
Chapter 1702. of the Revised Code. The Ohio CASA/GAL association 255
shall use these contributions to pay the expenses it incurs in 256
administering a program to secure the proper representation in the 257
courts of this state of abused, neglected, and dependent children, 258
and for the training and supervision of persons participating in 259
that program. 260

        The registrar shall pay the contributions the registrar 261
receives pursuant to section 4503.73 of the Revised Code to Wright 262
B. Flyer, incorporated, which shall deposit the contributions into 263
its general account to be used for purposes of Wright B. Flyer, 264
incorporated. 265

       The registrar shall pay the contributions the registrar 266
receives pursuant to section 4503.732 of the Revised Code to the 267
Siegel & Shuster society, a nonprofit organization dedicated to 268
commemorating and celebrating the creation of Superman in 269
Cleveland, Ohio.270

       The registrar shall pay the contributions the registrar 271
receives pursuant to section 4503.74 of the Revised Code to the 272
Columbus zoological park association, which shall disburse the 273
moneys to Ohio's major metropolitan zoos, as defined in section 274
4503.74 of the Revised Code, in accordance with a written 275
agreement entered into by the major metropolitan zoos. 276

       The registrar shall pay the contributions the registrar 277
receives pursuant to section 4503.75 of the Revised Code to the 278
rotary foundation, located on March 31, 2003, in Evanston, 279
Illinois, to be placed in a fund known as the permanent fund and 280
used to endow educational and humanitarian programs of the rotary 281
foundation. 282

       The registrar shall pay the contributions the registrar 283
receives pursuant to section 4503.751 of the Revised Code to the 284
Ohio association of realtors, which shall deposit the 285
contributions into a property disaster relief fund maintained 286
under the Ohio realtors charitable and education foundation.287

        The registrar shall pay the contributions the registrar 288
receives pursuant to section 4503.85 of the Revised Code to the 289
Ohio sea grant college program to be used for Lake Erie area 290
research projects. 291

       The registrar shall pay the contributions the registrar 292
receives pursuant to section 4503.89 of the Revised Code to the 293
American red cross of greater Columbus on behalf of the Ohio 294
chapters of the American red cross, which shall use the 295
contributions for disaster readiness, preparedness, and response 296
programs on a statewide basis.297

       The registrar shall pay the contributions the registrar 298
receives pursuant to section 4503.90 of the Revised Code to the 299
nationwide children's hospital foundation.300

       The registrar shall pay the contributions received pursuant 301
to section 4503.92 of the Revised Code to support our troops, 302
incorporated, a national nonprofit corporation, which shall use 303
those contributions in accordance with its articles of 304
incorporation and for the benefit of servicemembers of the armed 305
forces of the United States and their families when they are in 306
financial need. 307

       The registrar shall pay the contributions the registrar 308
receives pursuant to section 4503.94 of the Revised Code to the 309
Michelle's leading star foundation, which shall use the money 310
solely to fund the rental, lease, or purchase of the simulated 311
driving curriculum of the Michelle's leading star foundation by 312
boards of education of city, exempted village, local, and joint 313
vocational school districts.314

       (C) All investment earnings of the license plate contribution 315
fund shall be credited to the fund. Not later than the first day 316
of May of every year, the registrar shall distribute to each 317
entity described in division (B) of this section the investment 318
income the fund earned the previous calendar year. The amount of 319
such a distribution paid to an entity shall be proportionate to 320
the amount of money the entity received from the fund during the 321
previous calendar year.322

       Sec. 4503.499. (A) The owner or lessee of any passenger car, 323
noncommercial motor vehicle, recreational vehicle, or other 324
vehicle of a class approved by the registrar of motor vehicles may 325
apply to the registrar for the registration of the vehicle and 326
issuance of pediatric brain tumor awareness license plates. An 327
application made under this section may be combined with a request 328
for a special reserved license plate under section 4503.40 or 329
4503.42 of the Revised Code. Upon receipt of the completed 330
application and compliance by the applicant with divisions (B) and 331
(C) of this section, the registrar shall issue to the applicant 332
the appropriate vehicle registration and a set of pediatric brain 333
tumor awareness license plates and a validation sticker, or a 334
validation sticker alone when required by section 4503.191 of the 335
Revised Code. 336

       In addition to the letters and numbers ordinarily inscribed 337
on the license plates, pediatric brain tumor awareness license 338
plates shall be inscribed with identifying words or markings that 339
are designed by the children's glioma cancer foundation and are 340
approved by the registrar. Pediatric brain tumor awareness license 341
plates shall display county identification stickers that identify 342
the county of registration by name or number. 343

        (B) The pediatric brain tumor awareness license plates and a 344
validation sticker, or validation sticker alone, shall be issued 345
upon receipt of a contribution as provided in division (C) of this 346
section and upon payment of the regular license tax as prescribed 347
under section 4503.04 of the Revised Code, any applicable motor 348
vehicle license tax levied under Chapter 4504. of the Revised 349
Code, any applicable additional fee prescribed by section 4503.40 350
or 4503.42 of the Revised Code, a fee of ten dollars for the 351
purpose of compensating the bureau of motor vehicles for 352
additional services required in the issuing of pediatric brain 353
tumor awareness license plates, and compliance with all other 354
applicable laws relating to the registration of motor vehicles. 355

        (C) For each application for registration and registration 356
renewal notice the registrar receives under this section, the 357
registrar shall collect a contribution of thirty-five dollars. The 358
registrar shall transmit this contribution to the treasurer of 359
state for deposit in the license plate contribution fund created 360
in section 4501.21 of the Revised Code. 361

       The registrar shall transmit the additional fee of ten 362
dollars paid to compensate the bureau for the additional services 363
required in the issuing of pediatric brain tumor awareness license 364
plates to the treasurer of state for deposit into the state 365
treasury to the credit of the state bureau of motor vehicles fund 366
created by section 4501.25 of the Revised Code.367

       (D) If the issuance of the license plates under this section 368
has been terminated under section 4503.77 of the Revised Code 369
prior to the effective date of this amendment, the bureau shall 370
begin issuing pediatric brain tumor license plates on and after 371
the effective date of this amendment even if the sponsor of the 372
license plate does not comply with the requirements of section 373
4503.78 of the Revised Code. However, after the effective date of 374
this amendment, the license plate may be terminated as provided in 375
section 4503.77 of the Revised Code.376

       Sec. 4503.576. (A) The owner or lessee of any passenger car, 377
noncommercial motor vehicle, recreational vehicle, or other 378
vehicle of a class approved by the registrar of motor vehicles may 379
apply to the registrar for the registration of the vehicle and 380
issuance of Ohio state beekeepers association license plates. An 381
application made under this section may be combined with a request 382
for a special reserved license plate under section 4503.40 or 383
4503.42 of the Revised Code. Upon receipt of the completed 384
application and compliance by the applicant with divisions (B) and 385
(C) of this section, the registrar shall issue to the applicant 386
the appropriate vehicle registration and a set of Ohio state 387
beekeepers association license plates and a validation sticker, or 388
a validation sticker alone when required by section 4503.191 of 389
the Revised Code.390

       In addition to the letters and numbers ordinarily inscribed 391
on the license plates, Ohio state beekeepers association license 392
plates shall be inscribed with identifying words or markings that 393
promote the Ohio state beekeepers association and are approved by 394
the registrar. Ohio state beekeepers association license plates 395
shall display county identification stickers that identify the 396
county of registration by name or number.397

       (B) The Ohio state beekeepers association license plates and 398
a validation sticker, or validation sticker alone, shall be issued 399
upon receipt of a contribution as provided in division (C) of this 400
section and upon payment of the regular license tax as prescribed 401
under section 4503.04 of the Revised Code, any applicable motor 402
vehicle license tax levied under Chapter 4504. of the Revised 403
Code, any applicable additional fee prescribed by section 4503.40 404
or 4503.42 of the Revised Code, a fee of ten dollars for the 405
purpose of compensating the bureau of motor vehicles for 406
additional services required in the issuing of Ohio state 407
beekeepers association license plates, and compliance with all 408
other applicable laws relating to the registration of motor 409
vehicles.410

       (C) For each application for registration and registration 411
renewal notice the registrar receives under this section, the 412
registrar shall collect a contribution of fifteen dollars. The 413
registrar shall transmit this contribution to the treasurer of 414
state for deposit in the license plate contribution fund created 415
in section 4501.21 of the Revised Code.416

       The registrar shall transmit the additional fee of ten 417
dollars paid to compensate the bureau for the additional services 418
required in the issuing of Ohio state beekeepers association 419
license plates to the treasurer of state for deposit into the 420
state treasury to the credit of the state bureau of motor vehicles 421
fund created by section 4501.25 of the Revised Code.422

       Sec. 5533.242. In addition to any other name prescribed in 423
the Revised Code or otherwise, that portion of the highway known 424
as interstate route seventy-five, running in a northerly and 425
southerly direction between the Freeman avenue exit and the Hopple 426
street viaduct exit, in Hamilton county, shall be known as the 427
"William L. Mallory, Sr. Memorial Highway.428

        The director of transportation may erect suitable markers 429
along the highway indicating its name."430

       Section 2. That existing sections 4501.21 and 4503.499 of the 431
Revised Code are hereby repealed.432
