(1) In accordance with Chapter 119. of the Revised Code, | 16 |
establish metrics and educator preparation programs for the | 17 |
preparation of educators and other school personnel and the | 18 |
institutions of higher education that are engaged in their | 19 |
preparation. The metrics and educator preparation programs shall | 20 |
be aligned with the standards and qualifications for educator | 21 |
licenses adopted by the state board of education under section | 22 |
3319.22 of the Revised Code and the requirements of the Ohio | 23 |
teacher residency program established under section 3319.223 of | 24 |
the Revised Code. The metrics and educator preparation programs | 25 |
also shall ensure that educators and other school personnel are | 26 |
adequately prepared to use the value-added progress dimension | 27 |
prescribed by section 3302.021 of the Revised Code or the | 28 |
alternative student academic progress measure if adopted under | 29 |
division (C)(1)(e) of section 3302.03 of the Revised Code. | 30 |
(C) If the metrics established under division (A)(1) of this | 39 |
section require an institution of higher education that prepares | 40 |
teachers to satisfy the standards of an independent accreditation | 41 |
organization, the chancellor shall permit each institution to | 42 |
satisfy the standards of either the national council for | 43 |
accreditation of teacher education or the teacher education | 44 |
accreditation councilany applicable national educator preparation | 45 |
accrediting agency recognized by the United States department of | 46 |
education. | 47 |
Notwithstanding division (D) of section 119.03 and division | 53 |
(A)(1) of section 119.04 of the Revised Code, any metrics, | 54 |
educator preparation programs, rules, and regulations, or any | 55 |
amendment or rescission of such metrics, educator preparation | 56 |
programs, rules, and regulations, adopted under this section that | 57 |
necessitate institutions offering preparation programs for | 58 |
educators and other school personnel approved by the chancellor to | 59 |
revise the curricula of those programs shall not be effective for | 60 |
at least one year after the first day of January next succeeding | 61 |
the publication of the said change. | 62 |
(3) "Participating institution in another state" is any | 160 |
institution of higher education that is located outside of Ohio | 161 |
that meets the eligibility requirements under the terms of a | 162 |
similar reciprocity agreement and is approved by the appropriate | 163 |
agency of that institution's home state to participate in an | 164 |
agreement entered into with the midwestern higher education | 165 |
compact, the New England board of higher education, the southern | 166 |
regional education board, or the western interstate commission for | 167 |
higher education. | 168 |
Sec. 3333.77. When making an award under the Ohio | 187 |
co-op/internship program, the chancellor of the Ohio board of | 188 |
regents, subject to approval by the controlling board, may commit | 189 |
to giving a state institution of higher education's proposal | 190 |
preference for future awards after the current fiscal year or | 191 |
fiscal biennium. A proposal's eligibility for future awards | 192 |
remains conditional on all of the following: | 193 |
Before entering upon the discharge of official duties, the | 232 |
treasurer shall give bond to the state or be insured for the | 233 |
faithful performance of official duties and the proper accounting | 234 |
for all moneys coming into the treasurer's care. The amount of the | 235 |
bond or insurance shall be determined by the board but shall not | 236 |
be for a sum less than the estimated amount that may come into the | 237 |
treasurer's control at any time, less any reasonable deductible. | 238 |
The bond shall be approved by the attorney general. | 239 |
(B) The board of trustees may provide for the investment of | 240 |
district funds. Investments may be made in securities of the | 241 |
United States government or of its agencies or instrumentalities, | 242 |
the treasurer of state's pooled investment program, obligations of | 243 |
this state or any political subdivision of this state, | 244 |
certificates of deposit of any national bank located in this | 245 |
state, written repurchase agreements with any eligible Ohio | 246 |
financial institution that is a member of the federal reserve | 247 |
system or federal home loan bank, money market funds, or bankers | 248 |
acceptances maturing in two hundred seventy days or less which are | 249 |
eligible for purchase by the federal reserve system, as a reserve. | 250 |
Notwithstanding the foregoing or any provision of the Revised Code | 251 |
to the contrary, the board of trustees of a state community | 252 |
college district may provide for the investment of district funds | 253 |
in any manner authorized under section 3345.05 of the Revised | 254 |
Code. | 255 |
The foregoing appropriation item 235444, Post-Secondary Adult | 263 |
Career-Technical Education, shall be used by the Chancellor of the | 264 |
Board of Regents, in consultation with the Superintendent of | 265 |
Public Instruction and the Governor's Office of Workforce | 266 |
Transformation, to support post-secondary adult career-technical | 267 |
education. The Chancellor of the Board of Regents, the | 268 |
Superintendent of Public Instruction, and the Governor's Office of | 269 |
Workforce Transformation, or their designees, shall hold a series | 270 |
of consultations with the Ohio Technical Centers during fiscal | 271 |
year 2014 to develop an appropriate funding formula to distribute | 272 |
these funds based on student outcomes, beginning in fiscal year | 273 |
2015. | 274 |
Not later than June 30, 2014, the Chancellor of the Board of | 275 |
Regents shall establish a One-Year Option credit articulation | 276 |
system in which graduates of Ohio Technical Centers who complete a | 277 |
900-hour program of study and obtain an industry-recognized | 278 |
credential approved by the Chancellor shall receive 30 college | 279 |
technical credit hours toward a technical degree upon enrollment | 280 |
in an institution of higher education. | 281 |
(4) Fifty per cent of the fiscal year 2015 allocation for | 320 |
Ohio Technical Centers shall be distributed based on the | 321 |
proportion of each Center's full-time equivalent students to the | 322 |
total full-time equivalent students who have found employment, | 323 |
entered military service, or enrolled in additional post-secondary | 324 |
education and training in accordance with the placement | 325 |
definitions of the Carl D. Perkins Career and Technical Education | 326 |
Act of 2006 (Perkins). The calculation for eligible full-time | 327 |
equivalent students shall be based on the per cent of Perkins | 328 |
placements for students who have completed at least 50 per cent of | 329 |
a program of study. | 330 |
(B) Of the foregoing appropriation item 235444, | 336 |
Post-Secondary Adult Career-Technical Education, $400,000 in | 337 |
fiscal year 2015 shall be distributed by the Chancellor of the | 338 |
Board of Regents to the Ohio Central School System, $48,000 in | 339 |
fiscal year 2015 shall be utilized for accreditation assistance | 340 |
for Ohio Technical Centers, and $975,000 in fiscal year 2015 shall | 341 |
be distributed by the Chancellor to Ohio Technical Centers that | 342 |
provide business consultation with matching local dollars. Centers | 343 |
meeting this requirement shall receive an amount not to exceed | 344 |
$25,000 per center. | 345 |
The Chancellor of the Board of Regents shall establish | 364 |
procedures to allocate the foregoing appropriation item 235501, | 365 |
State Share of Instruction, based on the formulas detailed in this | 366 |
section that utilize the enrollment, course completion, degree | 367 |
attainment, and student achievement factors reported annually by | 368 |
each state institution of higher education participating in the | 369 |
Higher Education Information (HEI) system. | 370 |
(1) As soon as possible during each fiscal year of the | 373 |
biennium ending June 30, 2015, in accordance with instructions of | 374 |
the Board of Regents, each state institution of higher education | 375 |
shall report its actual data, consistent with the definitions in | 376 |
the Higher Education Information (HEI) system's enrollment files, | 377 |
to the Chancellor of the Board of Regents. | 378 |
(2) In defining the number of full-time equivalent students | 379 |
for state subsidy instructional cost purposes, the Chancellor of | 380 |
the Board of Regents shall exclude all undergraduate students who | 381 |
are not residents of Ohio, except those charged in-state fees in | 382 |
accordance with reciprocity agreements made under section 3333.17 | 383 |
of the Revised Code or employer contracts entered into under | 384 |
section 3333.32 of the Revised Code. | 385 |
For the purpose of implementing the recommendations of the | 444 |
2006 State Share of Instruction Consultation and the Higher | 445 |
Education Funding Study Council that priority be given to | 446 |
maintaining state support for science, technology, engineering, | 447 |
mathematics, medicine, and graduate programs, the costs in | 448 |
division (B) of this section shall be weighted by the amounts | 449 |
provided below: | 450 |
(1) Of the foregoing appropriation item 235501, State Share | 478 |
of Instruction, 25 per cent of the fiscal year 2014 appropriation | 479 |
for state-supported community colleges, state community colleges, | 480 |
and technical colleges shall be allocated to colleges in | 481 |
proportion to their share of college student success factors as | 482 |
adopted by the Chancellor of the Board of Regents in formal | 483 |
communication to the Controlling Board on August 30, 2010. | 484 |
(2) Of the foregoing appropriation item 235501, State Share | 485 |
of Instruction, 25 per cent of the fiscal year 2015 appropriation | 486 |
for state-supported community colleges, state community colleges, | 487 |
and technical colleges shall be allocated to colleges in | 488 |
proportion to their share of college student success factors as | 489 |
recommended in formal communication from community college | 490 |
presidents to the Chancellor of the Board of Regents dated | 491 |
December 2013. | 492 |
(c) For fiscal year 2015, students with successful course | 516 |
completions, identified in division (D)(3) of this section, that | 517 |
are or have been Pell eligible at any time while enrolled at a | 518 |
state institution of higher education, are Native American, | 519 |
African American, or Hispanic, or are 25 years of age or older | 520 |
when they first enroll at a state institution of higher education, | 521 |
shall be defined as access students and shall have their eligible | 522 |
course completions weighted by a statewide access weight. The | 523 |
weight given to any student that meets any access factor shall be | 524 |
15 per cent for all course completions. | 525 |
(3)(4) Of the foregoing appropriation item 235501, State | 530 |
Share of Instruction, 25 per cent of the fiscal year 2015 | 531 |
appropriation for state-supported community colleges, state | 532 |
community colleges, and technical colleges shall be reserved for | 533 |
completion milestones as identified in formal communication from | 534 |
community college presidents to the Chancellor of the Board of | 535 |
Regents dated December 2013. | 536 |
The completion milestone funding shall be allocated to | 542 |
colleges in proportion to each institution's share of the sector's | 543 |
total completion milestones, weighted by the instructional cost of | 544 |
the associate degree, certificate, or transfer models. Costs for | 545 |
certificates over 30 hours shall be weighted one-half of the | 546 |
associate degree model costs and transfers with at least 12 credit | 547 |
hours shall be weighted one-fourth of the average cost for all | 548 |
associate degree model costs. | 549 |
(c) Those students with successful completions for associate | 562 |
degrees, certificates over 30 credit hours, or transfer to any | 563 |
four-year institution with at least 12 credit hours, identified in | 564 |
division (D)(3) of this section, that are or have been Pell | 565 |
eligible at any time while enrolled at a state institution of | 566 |
higher education, are Native American, African American, or | 567 |
Hispanic, or are 25 years of age or older when they first enroll | 568 |
at a state institution of higher education, shall be defined as | 569 |
access students and shall have their eligible completions weighted | 570 |
by a statewide access weight. The weight shall be 25 per cent for | 571 |
students with one access factor, 66 per cent for students with two | 572 |
access factors, and 150 per cent for students with three access | 573 |
factors. | 574 |
(5) Of the foregoing appropriation item 235501, State Share | 580 |
of Instruction, up to 11.78 per cent of the appropriation for | 581 |
universities, as established in division (A)(2) of the section of | 582 |
this actAm. Sub. H.B. 59 of the 130th General Assembly entitled | 583 |
"STATE SHARE OF INSTRUCTION FOR FISCAL YEARS 2014 and 2015," in | 584 |
each fiscal year shall be reserved for support of doctoral | 585 |
programs to implement the funding recommendations made by | 586 |
representatives of the universities. The amount so reserved shall | 587 |
be referred to as the doctoral set-aside. | 588 |
(a) 62.50Sixty-two and one-half per cent of the doctoral | 591 |
set-aside in fiscal year 2014 and 55 per cent of the doctoral | 592 |
set-aside in fiscal year 2015 shall be allocated to universities | 593 |
in proportion to their share of the statewide total of each state | 594 |
institution's three-year average Doctoral I equivalent FTEs as | 595 |
calculated on an institutional basis using historical FTEs for the | 596 |
period fiscal year 1994 through fiscal year 1998 with annualized | 597 |
FTEs for fiscal years 1994 through 1997 and all-term FTEs for | 598 |
fiscal year 1998 as adjusted to reflect the effects of doctoral | 599 |
review and subsequent changes in Doctoral I equivalent | 600 |
enrollments. For the purposes of this calculation, Doctoral I | 601 |
equivalent FTEs shall equal the sum of Doctoral I FTEs plus 1.5 | 602 |
times the sum of Doctoral II FTEs. | 603 |
(b) 25Twenty-five per cent of the doctoral set-aside in | 604 |
fiscal year 2014 and 30 per cent of the doctoral set-aside in | 605 |
fiscal year 2015 shall be allocated to universities in proportion | 606 |
to each campus's share of the total statewide doctoral degrees, | 607 |
weighted by the cost of the doctoral discipline. In calculating | 608 |
each campus's doctoral degrees the Chancellor of the Board of | 609 |
Regents shall use the three-year average doctoral degrees awarded | 610 |
for the three-year period ending in the prior year. | 611 |
(c) 12.5Twelve and one-half per cent of the doctoral | 612 |
set-aside in fiscal year 2014 and 15 per cent of the doctoral | 613 |
set-aside in fiscal year 2015 shall be allocated to universities | 614 |
in proportion to their share of research grant activity, using a | 615 |
data collection method that is reviewed and approved by the | 616 |
presidents of Ohio's doctoral degree granting universities. In the | 617 |
event that the data collection method is not available, funding | 618 |
for this component shall be allocated to universities in | 619 |
proportion to their share of research grant activity published by | 620 |
the National Science Foundation. Grant awards from the Department | 621 |
of Health and Human Services shall be weighted at 50 per cent. | 622 |
(4)(6) Of the foregoing appropriation item 235501, State | 623 |
Share of Instruction, 6.41 per cent of the appropriation for | 624 |
universities, as established in division (A)(2) of the section of | 625 |
this actAm. Sub. H.B. 59 of the 130th General Assembly entitled | 626 |
"STATE SHARE OF INSTRUCTION FOR FISCAL YEARS 2014 AND 2015," in | 627 |
each fiscal year shall be reserved for support of Medical II FTEs. | 628 |
The amount so reserved shall be referred to as the medical II | 629 |
set-aside. | 630 |
(5)(7) Of the foregoing appropriation item 235501, State | 635 |

fiscal year for universities, net any earmarked funding for | 649 |
university regional campuses as detailed in division (B)(1) of the | 650 |
section of
this actAm. Sub. H.B. 59 of the 130th General | 651 |
Assembly entitled "STATE SHARE OF INSTRUCTION FOR FISCAL YEARS | 652 |
2014 AND 2015," shall be reserved for support of associate, | 653 |
baccalaureate, master's, and professional level degree attainment. | 654 |
The degree attainment funding shall be allocated to | 655 |
universities in proportion to each campus's share of the total | 656 |
statewide degrees granted, weighted by the cost of the degree | 657 |
programs. The degree cost calculations shall include the model | 658 |
cost weights for the science, technology, engineering, | 659 |
mathematics, and medicine models as established in division (C) of | 660 |
this section. | 661 |
For degrees including credits earned at multiple | 662 |
institutions, in fiscal year 2015, degree attainment funding shall | 663 |
be allocated to universities and branch campuses in proportion to | 664 |
each campus's share of the cost of earned credits for the degree. | 665 |
Each institution shall receive its prorated share of degree | 666 |
funding for credits earned at that institution. Cost of credits | 667 |
not earned at a university main or regional campus shall be | 668 |
credited to the degree-granting institution for each first degree | 669 |
earned at each level, but shall not be eligible for at-risk | 670 |
weights. | 671 |
(ii) The subsidy eligible degrees conferred to students | 683 |
identified as out-of-state residents during all terms of their | 684 |
studies, as reported through the Higher Education Information | 685 |
(HEI) system student enrollment file, who remain in the state of | 686 |
Ohio at least one year after graduation, as calculated based on | 687 |
the three-year average in-state residency rate for out-of-state | 688 |
students at each institution, shall be weighted by a factor of 50 | 689 |
per cent. For fiscal year 2014, subsidy eligible degrees conferred | 690 |
to all out-of-state students shall be weighted by a factor of 25 | 691 |
per cent. | 692 |
(b) In fiscal year 2014, for those associate degrees awarded | 693 |
by a state-supported university, the subsidy eligible degrees | 694 |
granted are defined as only those earned by students attending a | 695 |
university that received funding under GRF appropriation item | 696 |
235418, Access Challenge, in fiscal year 2009. In fiscal year | 697 |
2015, subsidy eligible associate degrees are defined as those | 698 |
earned by students attending any state-supported university main | 699 |
or regional campus. | 700 |
(c) In calculating each campus's count of degrees, the | 701 |
Chancellor of the Board of Regents shall use the three-year | 702 |
average associate, baccalaureate, master's, and professional | 703 |
degrees awarded for the three-year period ending in the prior | 704 |
year. In fiscal year 2014, university regional campuses are not | 705 |
eligible for degree completion funding. In fiscal year 2015, all | 706 |
university campuses are eligible for degree completion funding. | 707 |
(d) For fiscal year 2014, eligible associate degrees defined | 708 |
in division (D)(6)(b) of this section and all bachelor's degrees | 709 |
earned by a student that either had an expected family | 710 |
contribution less than 2190, was determined to have been in need | 711 |
of remedial education, is Native American, African American, or | 712 |
Hispanic, or is at least age 26 at the time of graduation, shall | 713 |
be defined as degrees earned by an at-risk student and shall be | 714 |
weighted by the following: | 715 |
(e) For fiscal year 2015, eligible associate degrees defined | 724 |
in division (D)(6)(b)(8) of this section and all bachelor's | 725 |
degrees earned by a student that either had an expected family | 726 |
contribution less than 2190, was determined to be inneedof | 727 |
remedial education,is Native American, African American, or | 728 |
Hispanic, or is at least 26 years ofdefined as at-risk based on | 729 |
academic preparedness, age at the time of graduation, minority | 730 |
status, or financial status, shall be defined as degrees earned by | 731 |
an at-risk student and shall be weighted by the following: | 732 |
(i) For the state-supported community colleges, state | 747 |
community colleges, and technical colleges, in fiscal year 2014 | 748 |
the Chancellor of the Board of Regents shall compute the uniform | 749 |
state share of instructional costs for enrollment by dividing the | 750 |
sector level appropriation total as determined by the Chancellor | 751 |
in division (A)(1) of the section of this actAm. Sub. H.B. 59 of | 752 |
the 130th General Assembly entitled "STATE SHARE OF INSTRUCTION | 753 |
FOR FISCAL YEARS 2014 AND 2015," and adjusted pursuant to | 754 |
divisions (B) and (C) of that section, less the student college | 755 |
success allocation as described in division (D)(1) of this section | 756 |
and less the course completion allocation as detailed in division | 757 |
(D)(2) of this section, by the sum of all eligible campuses' | 758 |
instructional costs as calculated in division (D)(7)(b) of this | 759 |
section. | 760 |
(ii) For the state-supported university regional campuses, in | 761 |
fiscal year 2014 the Chancellor of the Board of Regents shall | 762 |
compute the uniform state share of instructional costs by dividing | 763 |
the sector level appropriation, as determined by the Chancellor in | 764 |
division (A)(2) of the section of this actAm. Sub. H.B. 59 of the | 765 |
130th General Assembly entitled "STATE SHARE OF INSTRUCTION FOR | 766 |
FISCAL YEARS 2014 AND 2015," and adjusted pursuant to division (B) | 767 |
of that section by the sum of all campuses' instructional costs as | 768 |
calculated in division (D)(7)(b) of this section. | 769 |
(iii) For the state-supported university main campuses, in | 770 |
fiscal year 2014 the Chancellor of the Board of Regents shall | 771 |
compute the uniform state share of instructional costs by dividing | 772 |
the sector level appropriation, as determined by the Chancellor in | 773 |
division (A)(3) of the section of this actAm. Sub. H.B. 59 of the | 774 |
130th General Assembly entitled "STATE SHARE OF INSTRUCTION FOR | 775 |
FISCAL YEARS 2014 AND 2015," and adjusted pursuant to division (B) | 776 |
of that section, less the degree attainment funding as calculated | 777 |
in divisions (D)(3) to (6) of this section, less the doctoral | 778 |
set-aside, less the medical I set-aside, and less the medical II | 779 |
set-aside, by the sum of all campuses' instructional costs as | 780 |
calculated in division (D)(7)(b) of this section. | 781 |
(iv) For the state university regional and main campuses, in | 782 |
fiscal year 2015 the Chancellor of the Board of Regents shall | 783 |
compute the uniform state share of instructional costs by dividing | 784 |
the university appropriation, as determined by the Chancellor in | 785 |
division (A)(3) of the section of this actAm. Sub. H.B. 59 of the | 786 |
130th General Assembly entitled "STATE SHARE OF INSTRUCTION FOR | 787 |
FISCAL YEARS 2014 AND 2015," and adjusted pursuant to division (B) | 788 |
of that section, less the degree attainment funding as calculated | 789 |
in divisions (D)(3) to (6) of this section, less the doctoral | 790 |
set-aside, less the medical I set-aside, and less the medical II | 791 |
set-aside, by the sum of all campuses' instructional costs as | 792 |
calculated in division (D)(7)(b) of this section. | 793 |
(8)(10) In addition to the student success allocation, | 799 |
doctoral set-aside, medical I set-aside, medical II set-aside, and | 800 |
the degree attainment allocation determined in divisions (D)(1) to | 801 |
(6) of this section and the formula entitlement determined in | 802 |
division (D)(7) of this section, an allocation based on | 803 |
facility-based plant operations and maintenance (POM) subsidy | 804 |
shall be made. For each eligible university main campus, the | 805 |
amount of the POM allocation in each fiscal year shall be | 806 |
distributed based on what each campus received in the fiscal year | 807 |
2009 POM allocation. | 808 |
In addition to and after the adjustments noted above, in | 814 |
fiscal year 2014, no community college, state community college, | 815 |
or technical college shall receive a state share of instruction | 816 |
allocation that is less than 97 per cent of the prior year's state | 817 |
share of instruction earnings. Funds shall be made available to | 818 |
support this allocation by proportionately reducing formula | 819 |
entitlement earnings from those campuses, within the community, | 820 |
state community, and technical college sector, that are not | 821 |
receiving stability funding. | 822 |
After all other adjustments have been made, state share of | 824 |
instruction earnings shall be reduced for each campus by the | 825 |
amount, if any, by which debt service charged in Am. H.B. 748 of | 826 |
the 121st General Assembly, Am. Sub. H.B. 850 of the 122nd General | 827 |
Assembly, Am. Sub. H.B. 640 of the 123rd General Assembly, H.B. | 828 |
675 of the 124th General Assembly, Am. Sub. H.B. 16 of the 126th | 829 |
General Assembly, Am. Sub. H.B. 699 of the 126th General Assembly, | 830 |
Am. Sub. H.B. 496 of the 127th General Assembly, and Am. Sub. H.B. | 831 |
562 of the 127th General Assembly for that campus exceeds that | 832 |
campus's capital component earnings. The sum of the amounts | 833 |
deducted shall be transferred to appropriation item 235552, | 834 |
Capital Component, in each fiscal year. | 835 |
The state share of instruction payments to the institutions | 857 |
shall be in substantially equal monthly amounts during the fiscal | 858 |
year, unless otherwise determined by the Director of Budget and | 859 |
Management pursuant to section 126.09 of the Revised Code. | 860 |
Payments during the first six months of the fiscal year shall be | 861 |
based upon the state share of instruction appropriation estimates | 862 |
made for the various institutions of higher education according to | 863 |
the Chancellor of the Board of Regents enrollment, completion, and | 864 |
performance estimates. Payments during the last six months of the | 865 |
fiscal year shall be distributed after approval of the Controlling | 866 |
Board upon the request of the Chancellor. | 867 |
Community college presidents, or their designees, in | 872 |
consultation with the Chancellor of the Board of Regents, shall | 873 |
study the most appropriate formula weights for students who come | 874 |
from "at-risk" populations and recommend how they may be used to | 875 |
determine allocations of appropriations to community colleges from | 876 |

these factors may be used to determine allocations of the State | 881 |
Share of Instruction for community colleges in fiscal year 2015. | 882 |
The study shall be completed by December 31, 2013. Notwithstanding | 883 |
any provision of law to the contrary, community college | 884 |
presidents, or their designees, in consultation with the | 885 |
Chancellor of the Board of Regents, shall use the results of the | 886 |
study to recommend changes in the determination of the | 887 |
distribution of the community college allocations beginning in | 888 |
fiscal year 2015 and shall report any such formula change | 889 |
recommendations to the Governor, the General Assembly, and the | 890 |
Office of Budget and Management not later than February 15, 2014. | 891 |
Community college presidents, or their designees, in | 894 |
consultation with the Chancellor of the Board of Regents, shall | 895 |
study the most appropriate formula weights for the "success | 896 |
points" and completion performance measures used in the allocation | 897 |
of appropriations to community colleges from appropriation item | 898 |
235501, State Share of Instruction, in fiscal year 2015. The study | 899 |
shall research the most appropriate success points and completion | 900 |
measures that occur during the academic career of community | 901 |
college students and recommend revisions to the current State | 902 |
Share of Instruction model to fund achievement of the success | 903 |
points beginning in fiscal year 2015. In addition, community | 904 |
college presidents, or their designees, in consultation with the | 905 |
Chancellor of the Board of Regents, shall determine how the | 906 |
community college's fiscal year 2015 share of State Share of | 907 |
Instruction funding shall be distributed among its success points, | 908 |
completion measures and course completion funding, or other | 909 |
performance and access measures. The study shall be completed by | 910 |
December 31, 2013. Notwithstanding any provision of law to the | 911 |
contrary, community college presidents, or their designees, in | 912 |
consultation with the Chancellor of the Board of Regents, shall | 913 |
use the results of the study to recommend changes in the | 914 |
determination of the distribution of the community college | 915 |
allocations beginning in fiscal year 2015 and shall report any | 916 |
such formula change recommendations to the Governor, the General | 917 |
Assembly, and the Office of Budget and Management not later than | 918 |
February 15, 2014. | 919 |
(C) Of the foregoing appropriation item 235501, State Share | 942 |
of Instruction, up to $5,474,083 in fiscal year 2014 shall be used | 943 |
by the Chancellor to provide supplemental subsidy payments to each | 944 |
university main and regional campus receiving a State Share of | 945 |
Instruction allocation, as determined according to the section of | 946 |
this actAm. Sub. H.B. 59 of the 130th General Assembly entitled | 947 |
"STATE SHARE OF INSTRUCTION FORMULAS" and divisions (A) and (B) of | 948 |
this section, in fiscal year 2014 that is less than 96 per cent of | 949 |
that campus's State Share of Instruction allocation in fiscal year | 950 |
2013. Supplemental subsidy payment amounts shall not exceed the | 951 |
amount needed to ensure that no university main or regional campus | 952 |
receives a State Share of Instruction allocation in fiscal year | 953 |
2014 that is less than 96 per cent of that campus's fiscal year | 954 |
2013 allocation. If the Chancellor determines that the amounts | 955 |
earmarked for these supplemental subsidies are inadequate to | 956 |
provide payments to ensure that each eligible campus receives a | 957 |
State Share of Instruction allocation in fiscal year 2014 that is | 958 |
equal to 96 per cent of that campus's fiscal year 2013 allocation, | 959 |
the Chancellor shall proportionally reduce payment amounts. If the | 960 |
Chancellor determines that the amount earmarked for these | 961 |
supplemental subsidies is greater than what is needed to ensure | 962 |
that no main or regional campus receives a State Share of | 963 |
Instruction allocation in fiscal year 2014 that is less than 96 | 964 |
per cent of the fiscal year 2013 allocation, the Chancellor shall | 965 |
proportionally allocate the remainder of the earmark between the | 966 |
amounts earmarked for fiscal year 2014 divisions (A)(1) and (A)(2) | 967 |
of this section. | 968 |
(D) Of the foregoing appropriation item 235501, State Share | 969 |
of Instruction, up to $3,100,000 in fiscal year 2015 shall be used | 970 |
by the Chancellor to provide supplemental subsidy payments to each | 971 |
state-supported community college, state community college, and | 972 |
technical college receiving a State Share of Instruction | 973 |
allocation, as determined according to the section of this act | 974 |
entitled "STATE SHARE OF INSTRUCTION FORMULAS" and division (A) of | 975 |
this section, in fiscal year 2015 that is less than 96 per cent of | 976 |
that campus's State Share of Instruction allocation in fiscal year | 977 |
2014. Supplemental subsidy payment amounts shall not exceed the | 978 |
amount needed to ensure that no state-supported community college, | 979 |
state community college, or technical college receives a State | 980 |
Share of Instruction allocation in fiscal year 2015 that is less | 981 |
than 96 per cent of that campus's fiscal year 2014 allocation. If | 982 |
the Chancellor determines that the amounts earmarked for these | 983 |
supplemental subsidies are inadequate to provide payments to | 984 |
ensure that each eligible campus receives a State Share of | 985 |
Instruction allocation in fiscal year 2015 that is equal to 96 per | 986 |
cent of that campus's fiscal year 2014 allocation, the Chancellor | 987 |
shall proportionally reduce payment amounts. If the Chancellor | 988 |
determines that the amount earmarked for these supplemental | 989 |
subsidies is greater than what is needed to ensure that no | 990 |
state-supported community college, state community college, or | 991 |
technical college receives a State Share of Instruction allocation | 992 |
in fiscal year 2015 that is less than 96 per cent of the fiscal | 993 |
year 2014 allocation, the Chancellor shall proportionally allocate | 994 |
the remainder of the earmark among each state-supported community | 995 |
college, state community college, and technical college. | 996 |
In developing the recommendations required by this section, | 1017 |
the Chancellor shall study current international postsecondary | 1018 |
student recruitment practices and enrollment in the state and the | 1019 |
retention of international postsecondary students in the state | 1020 |
upon graduation. The Chancellor also shall consult with | 1021 |
institutions of higher education, state agencies, community | 1022 |
organizations, and members of the business community. | 1023 |
The Chancellor shall include recommendations regarding future | 1024 |
efforts to promote the state's postsecondary globalization which | 1025 |
consider implications of, and opportunities for, encouraging | 1026 |
international students to remain in the state after graduation. | 1027 |
The Chancellor shall place a particular emphasis on the economic | 1028 |
impact and effects on workforce development and shall identify | 1029 |
provisions of state and federal law that could potentially limit | 1030 |
the implementation of the recommendations. | 1031 |
(B) The Higher Education Student Financial Aid Workgroup | 1058 |
shall review financial assistance provided to Ohio residents that | 1059 |
attend institutions of higher education in the state. The | 1060 |
workgroup shall develop recommendations with regard to the types | 1061 |
of financial assistance available, including assistance for | 1062 |
at-risk populations, and optimal funding levels and submit those | 1063 |
recommendations to the Governor and the General Assembly, in | 1064 |
accordance with section 101.68 of the Revised Code, not later than | 1065 |
December 31, 2014. Upon submission of the report, the workgroup | 1066 |
shall cease to exist. | 1067 |
Section 7. The Chancellor of the Ohio Board of Regents shall | 1068 |
evaluate performance-based funding practices and policies at all | 1069 |
state institutions of higher education, as defined in section | 1070 |
3345.011 of the Revised Code. The Chancellor also shall make | 1071 |
recommendations regarding funding weights and factors, which shall | 1072 |
include, but not be limited to, potential funding weights and | 1073 |
factors for veterans and individuals who are first-generation | 1074 |
college students. The report also shall include each state | 1075 |
institution's graduation rate compared to the institution's | 1076 |
expected graduation rate. The Chancellor shall submit a report of | 1077 |
the Chancellor's findings to the Governor and the General | 1078 |
Assembly, in accordance with section 101.68 of the Revised Code, | 1079 |
not later than December 31, 2014. | 1080 |
