A BILL
To amend section 1901.08 of the Revised Code to 1
convert the part-time judgeship of the Avon Lake 2
Municipal Court into a full-time judgeship.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 1901.08 of the Revised Code be 4
amended to read as follows:5

       Sec. 1901.08. The number of, and the time for election of, 6
judges of the following municipal courts and the beginning of 7
their terms shall be as follows:8

       In the Akron municipal court, two full-time judges shall be 9
elected in 1951, two full-time judges shall be elected in 1953, 10
one full-time judge shall be elected in 1967, and one full-time 11
judge shall be elected in 1975.12

       In the Alliance municipal court, one full-time judge shall be 13
elected in 1953.14

       In the Ashland municipal court, one full-time judge shall be 15
elected in 1951.16

       In the Ashtabula municipal court, one full-time judge shall 17
be elected in 1953.18

       In the Athens county municipal court, one full-time judge 19
shall be elected in 1967.20

       In the Auglaize county municipal court, one full-time judge 21
shall be elected in 1975.22

       In the Avon Lake municipal court, one part-timefull-time23
judge shall be elected in 19572017. On and after the effective 24
date of this amendment, the part-time judge of the Avon Lake 25
municipal court who was elected in 2011 shall serve as a full-time 26
judge of the court until the end of that judge's term on December 27
31, 2017.28

       In the Barberton municipal court, one full-time judge shall 29
be elected in 1969, and one full-time judge shall be elected in 30
1971.31

       In the Bedford municipal court, one full-time judge shall be 32
elected in 1975, and one full-time judge shall be elected in 1979.33

       In the Bellefontaine municipal court, one full-time judge 34
shall be elected in 1993.35

       In the Bellevue municipal court, one part-time judge shall be 36
elected in 1951.37

       In the Berea municipal court, one full-time judge shall be 38
elected in 2005.39

       In the Bowling Green municipal court, one full-time judge 40
shall be elected in 1983.41

       In the Brown county municipal court, one full-time judge 42
shall be elected in 2005. Beginning February 9, 2003, the 43
part-time judge of the Brown county county court that existed 44
prior to that date whose term commenced on January 2, 2001, shall 45
serve as the full-time judge of the Brown county municipal court 46
until December 31, 2005.47

       In the Bryan municipal court, one full-time judge shall be 48
elected in 1965.49

       In the Cambridge municipal court, one full-time judge shall 50
be elected in 1951.51

       In the Campbell municipal court, one part-time judge shall be 52
elected in 1963.53

       In the Canton municipal court, one full-time judge shall be 54
elected in 1951, one full-time judge shall be elected in 1969, and 55
two full-time judges shall be elected in 1977.56

       In the Carroll county municipal court, one full-time judge 57
shall be elected in 2009. Beginning January 1, 2007, the judge 58
elected in 2006 to the part-time judgeship of the Carroll county 59
county court that existed prior to that date shall serve as the 60
full-time judge of the Carroll county municipal court until 61
December 31, 2009.62

       In the Celina municipal court, one full-time judge shall be 63
elected in 1957.64

       In the Champaign county municipal court, one full-time judge 65
shall be elected in 2001.66

       In the Chardon municipal court, one full-time judge shall be 67
elected in 1963.68

       In the Chillicothe municipal court, one full-time judge shall 69
be elected in 1951, and one full-time judge shall be elected in 70
1977.71

       In the Circleville municipal court, one full-time judge shall 72
be elected in 1953.73

       In the Clark county municipal court, one full-time judge 74
shall be elected in 1989, and two full-time judges shall be 75
elected in 1991. The full-time judges of the Springfield municipal 76
court who were elected in 1983 and 1985 shall serve as the judges 77
of the Clark county municipal court from January 1, 1988, until 78
the end of their respective terms.79

       In the Clermont county municipal court, two full-time judges 80
shall be elected in 1991, and one full-time judge shall be elected 81
in 1999.82

       In the Cleveland municipal court, six full-time judges shall 83
be elected in 1975, three full-time judges shall be elected in 84
1953, and four full-time judges shall be elected in 1955.85

       In the Cleveland Heights municipal court, one full-time judge 86
shall be elected in 1957.87

       In the Clinton county municipal court, one full-time judge 88
shall be elected in 1997. The full-time judge of the Wilmington 89
municipal court who was elected in 1991 shall serve as the judge 90
of the Clinton county municipal court from July 1, 1992, until the 91
end of that judge's term on December 31, 1997.92

       In the Columbiana county municipal court, two full-time 93
judges shall be elected in 2001.94

       In the Conneaut municipal court, one full-time judge shall be 95
elected in 1953.96

       In the Coshocton municipal court, one full-time judge shall 97
be elected in 1951.98

       In the Crawford county municipal court, one full-time judge 99
shall be elected in 1977.100

       In the Cuyahoga Falls municipal court, one full-time judge 101
shall be elected in 1953, and one full-time judge shall be elected 102
in 1967. Effective December 31, 2008, the Cuyahoga Falls municipal 103
court shall cease to exist; however, the judges of the Cuyahoga 104
Falls municipal court who were elected pursuant to this section in 105
2003 and 2007 for terms beginning on January 1, 2004, and January 106
1, 2008, respectively, shall serve as full-time judges of the Stow 107
municipal court until December 31, 2009, and December 31, 2013, 108
respectively.109

       In the Darke county municipal court, one full-time judge 110
shall be elected in 2005. Beginning January 1, 2005, the part-time 111
judge of the Darke county county court that existed prior to that 112
date whose term began on January 1, 2001, shall serve as the 113
full-time judge of the Darke county municipal court until December 114
31, 2005.115

       In the Dayton municipal court, three full-time judges shall 116
be elected in 1987, their terms to commence on successive days 117
beginning on the first day of January next after their election, 118
and two full-time judges shall be elected in 1955, their terms to 119
commence on successive days beginning on the second day of January 120
next after their election.121

       In the Defiance municipal court, one full-time judge shall be 122
elected in 1957.123

       In the Delaware municipal court, one full-time judge shall be 124
elected in 1953, and one full-time judge shall be elected in 2007.125

       In the East Cleveland municipal court, one full-time judge 126
shall be elected in 1957.127

       In the East Liverpool municipal court, one full-time judge 128
shall be elected in 1953.129

       In the Eaton municipal court, one full-time judge shall be 130
elected in 1973.131

       In the Elyria municipal court, one full-time judge shall be 132
elected in 1955, and one full-time judge shall be elected in 1973.133

       In the Erie county municipal court, one full-time judge shall 134
be elected in 2007.135

       In the Euclid municipal court, one full-time judge shall be 136
elected in 1951.137

       In the Fairborn municipal court, one full-time judge shall be 138
elected in 1977.139

       In the Fairfield county municipal court, one full-time judge 140
shall be elected in 2003, and one full-time judge shall be elected 141
in 2005.142

       In the Fairfield municipal court, one full-time judge shall 143
be elected in 1989.144

       In the Findlay municipal court, one full-time judge shall be 145
elected in 1955, and one full-time judge shall be elected in 1993.146

       In the Franklin municipal court, one part-time judge shall be 147
elected in 1951.148

       In the Franklin county municipal court, two full-time judges 149
shall be elected in 1969, three full-time judges shall be elected 150
in 1971, seven full-time judges shall be elected in 1967, one 151
full-time judge shall be elected in 1975, one full-time judge 152
shall be elected in 1991, and one full-time judge shall be elected 153
in 1997.154

       In the Fremont municipal court, one full-time judge shall be 155
elected in 1975.156

       In the Gallipolis municipal court, one full-time judge shall 157
be elected in 1981.158

       In the Garfield Heights municipal court, one full-time judge 159
shall be elected in 1951, and one full-time judge shall be elected 160
in 1981.161

       In the Girard municipal court, one full-time judge shall be 162
elected in 1963.163

       In the Hamilton municipal court, one full-time judge shall be 164
elected in 1953.165

       In the Hamilton county municipal court, five full-time judges 166
shall be elected in 1967, five full-time judges shall be elected 167
in 1971, two full-time judges shall be elected in 1981, and two 168
full-time judges shall be elected in 1983. All terms of judges of 169
the Hamilton county municipal court shall commence on the first 170
day of January next after their election, except that the terms of 171
the additional judges to be elected in 1981 shall commence on 172
January 2, 1982, and January 3, 1982, and that the terms of the 173
additional judges to be elected in 1983 shall commence on January 174
4, 1984, and January 5, 1984.175

       In the Hardin county municipal court, one part-time judge 176
shall be elected in 1989.177

       In the Hillsboro municipal court, one full-time judge shall 178
be elected in 2011. On and after December 30, 2008, the part-time 179
judge of the Hillsboro municipal court who was elected in 2005 180
shall serve as a full-time judge of the court until the end of 181
that judge's term on December 31, 2011.182

       In the Hocking county municipal court, one full-time judge 183
shall be elected in 1977.184

       In the Holmes county municipal court, one full-time judge 185
shall be elected in 2007. Beginning January 1, 2007, the part-time 186
judge of the Holmes county county court that existed prior to that 187
date whose term commenced on January 1, 2007, shall serve as the 188
full-time judge of the Holmes county municipal court until 189
December 31, 2007.190

       In the Huron municipal court, one part-time judge shall be 191
elected in 1967.192

       In the Ironton municipal court, one full-time judge shall be 193
elected in 1951.194

       In the Jackson county municipal court, one full-time judge 195
shall be elected in 2001. On and after March 31, 1997, the 196
part-time judge of the Jackson county municipal court who was 197
elected in 1995 shall serve as a full-time judge of the court 198
until the end of that judge's term on December 31, 2001.199

       In the Kettering municipal court, one full-time judge shall 200
be elected in 1971, and one full-time judge shall be elected in 201
1975.202

       In the Lakewood municipal court, one full-time judge shall be 203
elected in 1955.204

       In the Lancaster municipal court, one full-time judge shall 205
be elected in 1951, and one full-time judge shall be elected in 206
1979. Beginning January 2, 2000, the full-time judges of the 207
Lancaster municipal court who were elected in 1997 and 1999 shall 208
serve as judges of the Fairfield county municipal court until the 209
end of those judges' terms.210

       In the Lawrence county municipal court, one part-time judge 211
shall be elected in 1981.212

       In the Lebanon municipal court, one part-time judge shall be 213
elected in 1955.214

       In the Licking county municipal court, one full-time judge 215
shall be elected in 1951, and one full-time judge shall be elected 216
in 1971.217

       In the Lima municipal court, one full-time judge shall be 218
elected in 1951, and one full-time judge shall be elected in 1967.219

       In the Lorain municipal court, one full-time judge shall be 220
elected in 1953, and one full-time judge shall be elected in 1973.221

       In the Lyndhurst municipal court, one full-time judge shall 222
be elected in 1957.223

       In the Madison county municipal court, one full-time judge 224
shall be elected in 1981.225

       In the Mansfield municipal court, one full-time judge shall 226
be elected in 1951, and one full-time judge shall be elected in 227
1969.228

       In the Marietta municipal court, one full-time judge shall be 229
elected in 1957.230

       In the Marion municipal court, one full-time judge shall be 231
elected in 1951.232

       In the Marysville municipal court, one full-time judge shall 233
be elected in 2011. On and after January 18, 2007, the part-time 234
judge of the Marysville municipal court who was elected in 2005 235
shall serve as a full-time judge of the court until the end of 236
that judge's term on December 31, 2011.237

       In the Mason municipal court, one part-time judge shall be 238
elected in 1965.239

       In the Massillon municipal court, one full-time judge shall 240
be elected in 1953, and one full-time judge shall be elected in 241
1971.242

       In the Maumee municipal court, one full-time judge shall be 243
elected in 1963.244

       In the Medina municipal court, one full-time judge shall be 245
elected in 1957.246

       In the Mentor municipal court, one full-time judge shall be 247
elected in 1971.248

       In the Miami county municipal court, one full-time judge 249
shall be elected in 1975, and one full-time judge shall be elected 250
in 1979.251

       In the Miamisburg municipal court, one full-time judge shall 252
be elected in 1951.253

       In the Middletown municipal court, one full-time judge shall 254
be elected in 1953.255

       In the Montgomery county municipal court:256

       One judge shall be elected in 2011 to a part-time judgeship 257
for a term to begin on January 1, 2012. If any one of the other 258
judgeships of the court becomes vacant and is abolished after July 259
1, 2010, this judgeship shall become a full-time judgeship on that 260
date. If only one other judgeship of the court becomes vacant and 261
is abolished as of December 31, 2021, this judgeship shall be 262
abolished as of that date. Beginning July 1, 2010, the part-time 263
judge of the Montgomery county county court that existed before 264
that date whose term commenced on January 1, 2005, shall serve as 265
a part-time judge of the Montgomery county municipal court until 266
December 31, 2011.267

       One judge shall be elected in 2011 to a full-time judgeship 268
for a term to begin on January 2, 2012, and this judgeship shall 269
be abolished on January 1, 2016. Beginning July 1, 2010, the 270
part-time judge of the Montgomery county county court that existed 271
before that date whose term commenced on January 2, 2005, shall 272
serve as a full-time judge of the Montgomery county municipal 273
court until January 1, 2012.274

       One judge shall be elected in 2013 to a full-time judgeship 275
for a term to begin on January 2, 2014. Beginning July 1, 2010, 276
the part-time judge of the Montgomery county county court that 277
existed before that date whose term commenced on January 2, 2007, 278
shall serve as a full-time judge of the Montgomery county 279
municipal court until January 1, 2014.280

       One judge shall be elected in 2013 to a judgeship for a term 281
to begin on January 1, 2014. If no other judgeship of the court 282
becomes vacant and is abolished by January 1, 2014, this judgeship 283
shall be a part-time judgeship. When one or more of the other 284
judgeships of the court becomes vacant and is abolished after July 285
1, 2010, this judgeship shall become a full-time judgeship. 286
Beginning July 1, 2010, the part-time judge of the Montgomery 287
county county court that existed before that date whose term 288
commenced on January 1, 2007, shall serve as this judge of the 289
Montgomery county municipal court until December 31, 2013.290

       If any one of the judgeships of the court becomes vacant 291
before December 31, 2021, that judgeship is abolished on the date 292
that it becomes vacant, and the other judges of the court shall be 293
or serve as full-time judges. The abolishment of judgeships for 294
the Montgomery county municipal court shall cease when the court 295
has two full-time judgeships.296

       In the Morrow county municipal court, one full-time judge 297
shall be elected in 2005. Beginning January 1, 2003, the part-time 298
judge of the Morrow county county court that existed prior to that 299
date shall serve as the full-time judge of the Morrow county 300
municipal court until December 31, 2005.301

       In the Mount Vernon municipal court, one full-time judge 302
shall be elected in 1951.303

       In the Napoleon municipal court, one full-time judge shall be 304
elected in 2005.305

       In the New Philadelphia municipal court, one full-time judge 306
shall be elected in 1975.307

       In the Newton Falls municipal court, one full-time judge 308
shall be elected in 1963.309

       In the Niles municipal court, one full-time judge shall be 310
elected in 1951.311

       In the Norwalk municipal court, one full-time judge shall be 312
elected in 1975.313

       In the Oakwood municipal court, one part-time judge shall be 314
elected in 1953.315

       In the Oberlin municipal court, one full-time judge shall be 316
elected in 1989.317

       In the Oregon municipal court, one full-time judge shall be 318
elected in 1963.319

       In the Ottawa county municipal court, one full-time judge 320
shall be elected in 1995, and the full-time judge of the Port 321
Clinton municipal court who is elected in 1989 shall serve as the 322
judge of the Ottawa county municipal court from February 4, 1994, 323
until the end of that judge's term.324

       In the Painesville municipal court, one full-time judge shall 325
be elected in 1951.326

       In the Parma municipal court, one full-time judge shall be 327
elected in 1951, one full-time judge shall be elected in 1967, and 328
one full-time judge shall be elected in 1971.329

       In the Perrysburg municipal court, one full-time judge shall 330
be elected in 1977.331

       In the Portage county municipal court, two full-time judges 332
shall be elected in 1979, and one full-time judge shall be elected 333
in 1971.334

       In the Port Clinton municipal court, one full-time judge 335
shall be elected in 1953. The full-time judge of the Port Clinton 336
municipal court who is elected in 1989 shall serve as the judge of 337
the Ottawa county municipal court from February 4, 1994, until the 338
end of that judge's term.339

       In the Portsmouth municipal court, one full-time judge shall 340
be elected in 1951, and one full-time judge shall be elected in 341
1985.342

       In the Putnam county municipal court, one full-time judge 343
shall be elected in 2011. Beginning January 1, 2011, the part-time 344
judge of the Putnam county county court that existed prior to that 345
date whose term commenced on January 1, 2007, shall serve as the 346
full-time judge of the Putnam county municipal court until 347
December 31, 2011.348

       In the Rocky River municipal court, one full-time judge shall 349
be elected in 1957, and one full-time judge shall be elected in 350
1971.351

       In the Sandusky municipal court, one full-time judge shall be 352
elected in 1953.353

       In the Sandusky county municipal court, one full-time judge 354
shall be elected in 2013. Beginning on January 1, 2013, the two 355
part-time judges of the Sandusky county county court that existed 356
prior to that date shall serve as part-time judges of the Sandusky 357
county municipal court until December 31, 2013. If either 358
judgeship becomes vacant before January 1, 2014, that judgeship is 359
abolished on the date it becomes vacant, and the person who holds 360
the other judgeship shall serve as the full-time judge of the 361
Sandusky county municipal court until December 31, 2013.362

       In the Shaker Heights municipal court, one full-time judge 363
shall be elected in 1957.364

       In the Shelby municipal court, one part-time judge shall be 365
elected in 1957.366

       In the Sidney municipal court, one full-time judge shall be 367
elected in 1995.368

       In the South Euclid municipal court, one full-time judge 369
shall be elected in 1999. The part-time judge elected in 1993, 370
whose term commenced on January 1, 1994, shall serve until 371
December 31, 1999, and the office of that judge is abolished on 372
January 1, 2000.373

       In the Springfield municipal court, two full-time judges 374
shall be elected in 1985, and one full-time judge shall be elected 375
in 1983, all of whom shall serve as the judges of the Springfield 376
municipal court through December 31, 1987, and as the judges of 377
the Clark county municipal court from January 1, 1988, until the 378
end of their respective terms.379

       In the Steubenville municipal court, one full-time judge 380
shall be elected in 1953.381

       In the Stow municipal court, one full-time judge shall be 382
elected in 2009, and one full-time judge shall be elected in 2013. 383
Beginning January 1, 2009, the judge of the Cuyahoga Falls 384
municipal court that existed prior to that date whose term 385
commenced on January 1, 2008, shall serve as a full-time judge of 386
the Stow municipal court until December 31, 2013. Beginning 387
January 1, 2009, the judge of the Cuyahoga Falls municipal court 388
that existed prior to that date whose term commenced on January 1, 389
2004, shall serve as a full-time judge of the Stow municipal court 390
until December 31, 2009.391

       In the Struthers municipal court, one part-time judge shall 392
be elected in 1963.393

       In the Sylvania municipal court, one full-time judge shall be 394
elected in 1963.395

       In the Tiffin-Fostoria municipal court, one full-time judge 396
shall be elected in 2013.397

       In the Toledo municipal court, two full-time judges shall be 398
elected in 1971, four full-time judges shall be elected in 1975, 399
and one full-time judge shall be elected in 1973.400

       In the Upper Sandusky municipal court, one full-time judge 401
shall be elected in 2011. The part-time judge elected in 2005, 402
whose term commenced on January 1, 2006, shall serve as a 403
full-time judge on and after January 1, 2008, until the expiration 404
of that judge's term on December 31, 2011, and the office of that 405
judge is abolished on January 1, 2012.406

       In the Vandalia municipal court, one full-time judge shall be 407
elected in 1959.408

       In the Van Wert municipal court, one full-time judge shall be 409
elected in 1957.410

       In the Vermilion municipal court, one part-time judge shall 411
be elected in 1965.412

       In the Wadsworth municipal court, one full-time judge shall 413
be elected in 1981.414

       In the Warren municipal court, one full-time judge shall be 415
elected in 1951, and one full-time judge shall be elected in 1971.416

       In the Washington Court House municipal court, one full-time 417
judge shall be elected in 1999. The part-time judge elected in 418
1993, whose term commenced on January 1, 1994, shall serve until 419
December 31, 1999, and the office of that judge is abolished on 420
January 1, 2000.421

       In the Wayne county municipal court, one full-time judge 422
shall be elected in 1975, and one full-time judge shall be elected 423
in 1979.424

       In the Willoughby municipal court, one full-time judge shall 425
be elected in 1951.426

       In the Wilmington municipal court, one full-time judge shall 427
be elected in 1991, who shall serve as the judge of the Wilmington 428
municipal court through June 30, 1992, and as the judge of the 429
Clinton county municipal court from July 1, 1992, until the end of 430
that judge's term on December 31, 1997.431

       In the Xenia municipal court, one full-time judge shall be 432
elected in 1977.433

       In the Youngstown municipal court, one full-time judge shall 434
be elected in 1951, and one full-time judge shall be elected in 435
2013.436

       In the Zanesville municipal court, one full-time judge shall 437
be elected in 1953.438

       Section 2.  That existing section 1901.08 of the Revised Code 439
is hereby repealed.440

       Section 3.  On and after the effective date of this act, the 441
full-time judge of the Avon Lake Municipal Court, who prior to the 442
effective date of this act was the part-time judge of that court, 443
shall perform the duties of a full-time judge of a municipal 444
court, shall receive the salary specified in law for a full-time 445
judge of a municipal court, and shall be subject to any 446
restriction specified in law for a full-time judge of a municipal 447
court.448
