A BILL
To enact sections 9.57 and 3701.69 of the Revised 1
Code to require the distribution of information on 2
Down syndrome under certain conditions and to 3
establish language standards for signs containing 4
the international symbol of access.5


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That sections 9.57 and 3701.69 of the Revised Code 6
be enacted to read as follows:7

       Sec. 9.57.  Whoever erects or replaces a sign containing the 8
international symbol of access shall use forms of the word 9
"accessible" rather than forms of the word "handicapped" or the 10
word "disabled" whenever words are included on the sign.11

       Sec. 3701.69.  (A)(1) The department of health shall create a 12
Down syndrome information sheet that includes all of the 13
following:14

       (a) A description of Down syndrome, including its causes, 15
effects on development, and potential complications;16

       (b) Diagnostic tests;17

       (c) Options for treatment and therapy;18

       (d) Contact information for local, state, and national 19
organizations that provide Down syndrome educational and support 20
services and programs.21

       (2) With respect to the medical information included in the 22
information sheet, the department shall include only information 23
that is current and based on medical evidence.24

       (3) The department shall periodically review and update the 25
information sheet and shall make it available on the department's 26
internet web site. 27

       (B) If a patient under the care of any of the following 28
health care professionals or facilities receives either a test 29
result indicating Down syndrome or a prenatal or postnatal 30
diagnosis of Down syndrome, the health care professional or 31
facility shall provide to the patient or the patient's 32
representative a copy of the information sheet created under 33
division (A) of this section:34

       (1) A physician authorized under Chapter 4731. of the Revised 35
Code to practice medicine and surgery or osteopathic medicine and 36
surgery;37

        (2) A certified nurse-midwife who holds a certificate of 38
authority issued under Chapter 4723. of the Revised Code;39

        (3) A genetic counselor licensed under Chapter 4778. of the 40
Revised Code;41

        (4) A hospital registered under section 3701.07 of the 42
Revised Code;43

        (5) A maternity unit, newborn care nursery, or maternity home 44
licensed under Chapter 3711. of the Revised Code;45

        (6) A freestanding birthing center licensed under section 46
3702.30 of the Revised Code.47
