A BILL
To enact section 5502.71 of the Revised Code to 1
establish a program of state financial assistance 2
to counties, municipal corporations, and townships 3
to help in defraying the costs of the county's 4
sheriff, the county's drug task force, or the 5
municipal corporation's or township's law 6
enforcement agency in combatting the opioid abuse 7
and heroin addiction epidemic and to make an 8
appropriation.9


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 5502.71 of the Revised Code be 10
enacted to read as follows:11

       Sec. 5502.71.  (A) As used in this section:12

       (1)(a) "Opioid abuse and heroin addiction epidemic" means all 13
of the following:14

       (i) A violation of any section in Chapter 2925. of the 15
Revised Code that involves any opioid or heroin;16

       (ii) A violation of any ordinance of a municipal corporation 17
that is substantially equivalent to any section identified in 18
division (A)(1)(a)(i) of this section;19

       (iii) Conduct not described in division (A)(1)(a)(i) or (ii) 20
of this section that relates to any illegal activity that involves 21
any opioid or heroin;22

       (b) In addition to the violations and conduct described in 23
division (A)(1)(a) of this section, "opioid abuse and heroin 24
addiction epidemic" includes any ongoing issue with other drug use 25
and trafficking.26

       (2) "Drug task force" has the same meaning as in section 27
5502.68 of the Revised Code.28

       (B)(1) The board of county commissioners of a county may 29
apply to the department of public safety for a grant of financial 30
assistance to help in defraying the costs of the county's sheriff 31
or of the drug task force, if any, organized in the county in 32
combatting an opioid abuse and heroin addiction epidemic in the 33
county.34

       (2) The legislative authority of a municipal corporation may 35
apply to the department of public safety for a grant of financial 36
assistance to help in defraying the costs of the municipal 37
corporation's law enforcement agency in combatting an opioid abuse 38
and heroin addiction epidemic in the municipal corporation.39

       (3) The board of township trustees of a township may apply to 40
the department of public safety for a grant of financial 41
assistance to help in defraying the costs of the township's law 42
enforcement agency in combatting an opioid abuse and heroin 43
addiction epidemic in the township.44

       (4) Application under division (B)(1), (2), or (3) of this 45
section shall be made in accordance with rules adopted by the 46
department of public safety pursuant to division (E) of this 47
section.48

       (C) The department of public safety shall begin accepting 49
applications for grants of financial assistance to counties, 50
municipal corporations, and townships for the purposes described 51
in divisions (B)(1), (2), and (3) of this section as soon as 52
practicable after it adopts the rules under division (E) of this 53
section. If a county, municipal corporation, or township applies 54
for a grant of financial assistance under division (B)(1), (2), or 55
(3) of this section and the department finds that the application 56
is in accordance with those rules and determines that the 57
applicant is to be provided financial assistance under the process 58
established under those rules, the department, from moneys 59
appropriated to it for purposes of granting financial assistance 60
under this section, may grant the applicant financial assistance. 61
The amount of the financial assistance shall be determined 62
pursuant to the process established under the rules adopted under 63
division (E) of this section.64

       The department shall make and distribute grants of financial 65
assistance under this section as soon as practicable after the 66
effective date of this section. Thereafter, the department shall 67
make and distribute grants of financial assistance under this 68
section on an ongoing basis, throughout the fiscal year, as 69
applications are received.70

       (D) A county, municipal corporation, or township that 71
receives a grant of financial assistance under this section shall 72
use the financial assistance received only for the following 73
purposes:74

       (1) To pay some or all of the cost of the county's, drug task 75
force's, municipal corporation's, or township's hiring of 76
part-time or full-time law enforcement and investigative officers 77
to combat the opioid abuse and heroin addiction problem in the 78
county, municipal corporation, or township;79

       (2) To pay the cost of training for the county's, drug task 80
force's, municipal corporation's, or township's law enforcement 81
and investigative officers who perform duties in combatting the 82
opioid abuse and heroin addiction problem in the county, municipal 83
corporation, or township;84

       (3) To pay the cost of necessary equipment for the county, 85
drug task force, municipal corporation, or township to be used in 86
combatting the opioid abuse and heroin addiction problem in the 87
county, municipal corporation, or township;88

       (4) To pay any other cost or expense that relates to 89
combatting the opioid abuse and heroin addiction problem in the 90
county, municipal corporation, or township.91

       (E) The department of public safety shall adopt rules to 92
implement the program of granting financial assistance to 93
counties, municipal corporations, and townships for the purposes 94
described in divisions (B)(1), (2), and (3) of this section. The 95
rules shall be provided to each sheriff, each drug task force, 96
each municipal law enforcement agency, and each township law 97
enforcement agency. The rules shall include, but shall not be 98
limited to, provisions that:99

       (1) Prescribe the manner of application for the financial 100
assistance;101

       (2) Establish a process for determining whether an applicant 102
county, municipal corporation, or township will be provided 103
financial assistance, which process shall base the determinations 104
on the need of the applicants and give priority to applicants that 105
identify in their application a significant challenge in the 106
particular county, municipal corporation, or township with respect 107
to an opioid abuse and heroin addiction epidemic;108

       (3) Establish a process for determining the amount of 109
financial assistance to be provided to each applicant county, 110
municipal corporation, or township that will be provided financial 111
assistance as determined under the process described in division 112
(E)(2) of this section.113

       (F) The department of public safety shall conduct a statewide 114
study to determine the counties, drug task forces, municipal 115
corporations, and townships that are in need of, but financially 116
unable to afford, the hiring of additional law enforcement and 117
investigative officers to combat an opioid abuse and heroin 118
addiction epidemic in the county, municipal corporation, or 119
township. The department shall prepare a report that contains its 120
findings from the study. Not later than March 31, 2015, the 121
department shall do all of the following:122

       (1) Publish the report prepared under this division;123

       (2) Make recommendations to the general assembly regarding 124
the use of, and further demand for, additional resources for 125
county sheriffs, drug task forces, municipal law enforcement 126
agencies, and township law enforcement agencies to combat the 127
opioid abuse and heroin addiction epidemic, which recommendations 128
shall include proposed increases or decreases to any line item 129
that could be used to help fund those resources as a part of 130
combatting the epidemic.131

       Section 2. All items in this section are hereby appropriated 132
as designated out of any moneys in the state treasury to the 133
credit of the designated fund. For all appropriations made in this 134
act, those in the first column are for fiscal year 2014 and those 135
in the second column are for fiscal year 2015. The appropriations 136
made in this act are in addition to any other appropriations made 137
for the FY 2014-FY 2015 biennium.138

       LOCAL LAW ENFORCEMENT GRANTS144

       The foregoing appropriation item 768506, Local Law 145
Enforcement Grants, shall be used to award grants for fiscal year 146
2015 under section 5502.71 of the Revised Code, as enacted by this 147
act.148

       BUDGET STABILIZATION FUND TRANSFERS149

       Notwithstanding section 131.43 and division (D) of section 150
127.14 of the Revised Code, the Director of Budget and Management 151
may, with Controlling Board approval, transfer up to $10 million 152
cash from the Budget Stabilization Fund to the General Revenue 153
Fund in fiscal year 2015 to help ensure that the available revenue 154
receipts and balances in the General Revenue Fund are not less 155
than the appropriations for fiscal year 2015. 156

       Section 3. Within the limits set forth in this act, the 157
Director of Budget and Management shall establish accounts 158
indicating the source and amount of funds for each appropriation 159
made in this act, and shall determine the form and manner in which 160
appropriation accounts shall be maintained. Expenditures from 161
appropriations contained in this act shall be accounted for as 162
though made in Am. Sub. H.B. 59 of the 130th General Assembly.163

       The appropriations made in this act are subject to all 164
provisions of Am. Sub. H.B. 59 of the 130th General Assembly that 165
are generally applicable to such appropriations. 166
