A BILL
To enact section 3314.088 of the Revised Code to 1
prohibit community schools from using state funds 2
to hire a lobbyist or for public relations 3
services.4


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3314.088 of the Revised Code be 5
enacted to read as follows:6

       Sec. 3314.088. (A) As used in this section, "lobby" or 7
"lobbying" means to promote, oppose, or otherwise influence the 8
outcome of federal, state, or local decisions, policies, or 9
legislation by direct communication, including presenting 10
testimony at a hearing, with any person who is an elected 11
executive or legislative official, the director of a federal, 12
state, or local executive or administrative department, or any 13
member of the staff of such an official or department.14

       "Lobbying" does not include either of the following:15

       (1) The action of any person having a direct interest in 16
executive agency decisions who, under Section 3 of Article I, Ohio 17
Constitution, assembles together with other persons to consult for 18
their common good or petitions such a person for the redress of 19
grievances;20

       (2) Contacts made for the sole purpose of gathering 21
information contained in a public record.22

       (B) No community school governing authority, sponsor, or 23
operator shall use state moneys paid to the community school under 24
section 3314.08 of the Revised Code to hire an independent agent 25
to lobby on behalf of the school governing authority, or operator, 26
or to perform public relations services for that school.27

       Nothing in this section shall be construed to prohibit a 28
member of a community school governing authority or any employee 29
of the community school or operator from lobbying for that school.30
