To amend sections 101.27, 141.011, 141.04, 325.03, 1
325.04, 325.06, 325.08, 325.09, 325.10, 325.11, 2
325.14, 325.15, 325.18, 505.24, 507.09, and 3
3501.12 and to enact sections 195.01, 195.02, 4
195.03, 195.04, 195.05, and 195.06 of the Revised 5
Code and to amend Section 307.10 of Am. Sub. H.B. 6
59 of the 130th General Assembly to reinstate the 7
cost of living adjustment for members of the 8
General Assembly and statewide elected executive 9
officers; to increase the compensation of justices 10
and judges of the courts, county elected 11
officials, township trustees and fiscal officers, 12
and board of elections members and to reinstate 13
the annual cost of living adjustment to their 14
compensation; to reduce the number of population 15
classifications used to determine the compensation 16
of county elected officials; to create the Ohio 17
Public Officials Compensation Advisory Commission; 18
to make an appropriation; and to declare an 19
emergency.20


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1.  That sections 101.27, 141.011, 141.04, 325.03, 21
325.04, 325.06, 325.08, 325.09, 325.10, 325.11, 325.14, 325.15, 22
325.18, 505.24, 507.09, and 3501.12 be amended and sections 23
195.01, 195.02, 195.03, 195.04, 195.05, and 195.06 of the Revised 24
Code be enacted to read as follows:25

       Sec. 101.27.  (A)(1) Every member of the senate, except the 26
members elected president, president pro tempore, assistant 27
president pro temporemajority floor leader, majority whip, 28
minority leader, assistant minority leader, minority whip, and 29
assistant minority whip, shall receive as compensation a salary of 30
fifty-onesixty thousand sixfive hundred seventy-four31
eighty-three dollars and seventy cents a year during the senator's 32
term of office. Every member of the house of representatives, 33
except the members elected speaker, speaker pro tempore, majority 34
floor leader, assistant majority floor leader, majority whip, 35
assistant majority whip, minority leader, assistant minority 36
leader, minority whip, and assistant minority whip, shall receive 37
as compensation a salary of fifty-onesixty thousand sixfive38
hundred seventy-foureighty-three dollars and seventy cents a 39
year during the representative's term of office. Such salaries 40
shall be paid in equal monthly installments during such term. All 41
monthly payments shall be made on or before the fifth day of each 42
month. Upon the death of any member of the general assembly during 43
the member's term of office, any unpaid salary due such member for 44
the remainder of the member's term shall be paid to the member's 45
surviving spouse, children, mother, or father, in the order in 46
which the relationship is set forth in this section in monthly 47
installments.48

       (2) Each member shall receive a travel reimbursement per mile 49
each way, at the same mileage rate allowed for the reimbursement 50
of travel expenses of state agents as provided by rule of the 51
director of budget and management pursuant to division (B) of 52
section 126.31 of the Revised Code, for mileage not more than once 53
a week during the session for travel incurred by a member from and 54
to the member's place of residence, by the most direct highway 55
route of public travel to and from the seat of government, to be 56
paid quarterly on the last day of March, June, September, and 57
December of each year.58

       (3) The member of the senate elected president and the member 59
of the house of representatives elected speaker shall each receive 60
as compensation a salary of eightyninety-four thousand fivefour61
hundred forty-ninethirty-seven dollars and thirty-six cents a 62
year during the president's or speaker's term of office.63

       The member of the senate elected president pro tempore, the 64
member of the senate elected minority leader, the member of the 65
house of representatives elected speaker pro tempore, and the 66
member of the house of representatives elected minority leader 67
shall each receive as compensation a salary of seventy-three68
eighty-six thousand fourone hundred ninety-threesixty-four69
dollars and seventy-six cents a year during the member's term of 70
office. The member of the house of representatives elected 71
majority floor leader and the member of the senate elected72
assistant president pro temporemajority floor leader shall each 73
receive as compensation a salary of sixty-nineeighty-one thousand 74
twoone hundred twenty-sevensixty-three dollars and twenty-one 75
cents a year during the member's term of office. The member of the 76
senate elected assistant minority leader and the member of the 77
house of representatives elected assistant minority leader shall 78
each receive as compensation a salary of sixty-sevenseventy-eight79
thousand ninety-ninesix hundred sixty-eight dollars and thirty 80
cents a year during the member's term of office. The member of the 81
senate elected majority whip and the member of the house of 82
representatives elected assistant majority floor leader shall each 83
receive a salary of sixty-fourseventy-six thousand nineone84
hundred sixty-sevensixty-eight dollars and sixty-nine cents a 85
year during the member's term of office. The member of the senate 86
elected minority whip, the member of the house of representatives 87
elected majority whip, and the member of the house of 88
representatives elected minority whip shall each receive as 89
compensation a salary of sixtyseventy-one thousand sevenone90
hundred sixseventy-three dollars a year during the member's term 91
of office. The member of the house of representatives elected 92
assistant majority whip shall receive as compensation a salary of 93
fifty-sixsixty-six thousand fourone hundred forty-three94
seventy-four dollars and ninety-seven cents a year during the 95
member's term of office. The member of the house of 96
representatives elected assistant minority whip and the member of 97
the senate elected assistant minority whip shall each receive a 98
salary of fifty-foursixty-three thousand sixtythree hundred 99
eighty-one dollars and nine cents a year during the member's term 100
of office.101

       (4) The chairperson of the finance committee of each house 102
shall receive an additional sum of ten thousand dollars annually. 103
The chairperson of each standing committee of each house other 104
than the finance committee shall receive an additional sum of six 105
thousand five hundred dollars annually. The chairperson of each 106
standing subcommittee of a finance committee shall receive an 107
additional sum of six thousand five hundred dollars annually. The 108
vice-chairperson of the finance committee of each house shall 109
receive an additional sum of five thousand five hundred dollars 110
annually. The ranking minority member of the finance committee of 111
each house shall receive an additional sum of six thousand five 112
hundred dollars annually. The ranking minority member of each 113
standing subcommittee of a finance committee shall receive an 114
additional sum of five thousand dollars annually. The chairperson 115
of each standing subcommittee of each house other than a standing 116
subcommittee of the finance committee shall receive an additional 117
sum of five thousand dollars annually. The vice-chairperson and 118
ranking minority member of each standing committee of each house 119
other than the finance committee shall each receive an additional 120
sum of five thousand dollars annually. Except for the ranking 121
minority member of each standing subcommittee of a finance 122
committee, the ranking minority member of each standing 123
subcommittee of each house shall receive an additional sum of two 124
thousand five hundred dollars annually.125

       No member may receive more than one additional sum for 126
serving as chairperson, vice-chairperson, or ranking minority 127
member of a standing committee or standing subcommittee, 128
regardless of the number of standing committees or standing 129
subcommittees on which the member serves as chairperson, 130
vice-chairperson, or ranking minority member.131

       (5) If a member is absent without leave, or is not excused on 132
the member's return, there shall be deducted from the member's 133
compensation twenty dollars for each day's absence.134

       (B) Each calendar year from 2002 through 20082017 through 135
2023, the salary amounts under divisions (A)(1) and (3) of this 136
section in the immediately preceding calendar year shall be 137
increased by the lesser of the following:138

       (1) Three per cent;139

       (2) The percentage increase, if any, in the consumer price 140
index over the twelve-month period that ends on the thirtieth day 141
of September of the immediately preceding year, rounded to the 142
nearest one-tenth of one per cent.143

       (C) As used in this section:144

       (1) "Consumer price index" means the consumer price index 145
prepared by the United States bureau of labor statistics (U.S. 146
city average for urban wage earners and clerical workers: all 147
items, 1982-1984=100), or, if that index is no longer published, a 148
generally available comparable index.149

       (2) "Finance committee" means the finance committee of the 150
senate and the finance-and appropriations committee of the house 151
of representatives.152

       Sec. 141.011. Beginning in calendar year 2001, theThe153
annual salaries of the elective officers of the state shall be as 154
follows rather than as prescribed by divisions (A) to (F) of 155
section 141.01 of the Revised Code:156

       (A)(1) In calendar year 2001 the annual salary of the 157
governor shall be one hundred twenty-six thousand four hundred 158
ninety-seven dollars.159

       (2) In calendar years 2002 through 2006, the annual salary of 160
the governor shall be one hundred thirty thousand two hundred 161
ninety-two dollars.162

       (3)(2) In calendar year 2007, the annual salary of the 163
governor shall be the annual salary in 2006 increased by each of 164
the following percentages in succession:165

       (a) The lesser of three per cent or the percentage increase, 166
if any, in the consumer price index from October 1, 2001, to 167
September 30, 2002, rounded to the nearest one-tenth of one per 168
cent;169

       (b) The lesser of three per cent or the percentage increase, 170
if any, in the consumer price index from October 1, 2002, to 171
September 30, 2003, rounded to the nearest one-tenth of one per 172
cent;173

       (c) The lesser of three per cent or the percentage increase, 174
if any, in the consumer price index from October 1, 2003, to 175
September 30, 2004, rounded to the nearest one-tenth of one per 176
cent;177

       (d) The lesser of three per cent or the percentage increase, 178
if any, in the consumer price index from October 1, 2004, to 179
September 30, 2005, rounded to the nearest one-tenth of one per 180
cent;181

       (e) The lesser of three per cent or the percentage increase, 182
if any, in the consumer price index from October 1, 2005, to 183
September 30, 2006, rounded to the nearest one-tenth of one per 184
cent.185

       (4) In(3) Each calendar year from 2008 and thereafter186
through 2016, the annual salary of the governor shall be the 187
annual salary in 2007 increased by the lesser of the following:188

       (a) Three per cent;189

       (b) The percentage increase, if any, in the consumer price 190
index from October 1, 2006, to September 30, 2007, rounded to the 191
nearest one-tenth of one per cent.192

       (4) Each calendar year from 2017 through 2023, the annual 193
salary of the governor shall be the annual salary in the 194
immediately preceding calendar year, increased by the lesser of 195
the following:196

       (a) Three per cent;197

       (b) The percentage increase, if any, in the consumer price 198
index over the twelve-month period that ends on the thirtieth day 199
of September of the immediately preceding year, rounded to the 200
nearest one-tenth of one per cent.201

       (B)(1) In calendar year 2001 the annual salary of the 202
lieutenant governor shall be sixty-six thousand three hundred six 203
dollars.204

       (2) In calendar years 2002 through 2006, the annual salary of 205
the lieutenant governor shall be sixty-eight thousand two hundred 206
ninety-five dollars.207

       (3)(2) In calendar year 2007, the annual salary of the 208
lieutenant governor shall be the annual salary in 2006 increased 209
by each of the following percentages in succession:210

       (a) The lesser of three per cent or the percentage increase, 211
if any, in the consumer price index from October 1, 2001, to 212
September 30, 2002, rounded to the nearest one-tenth of one per 213
cent;214

       (b) The lesser of three per cent or the percentage increase, 215
if any, in the consumer price index from October 1, 2002, to 216
September 30, 2003, rounded to the nearest one-tenth of one per 217
cent;218

       (c) The lesser of three per cent or the percentage increase, 219
if any, in the consumer price index from October 1, 2003, to 220
September 30, 2004, rounded to the nearest one-tenth of one per 221
cent;222

       (d) The lesser of three per cent or the percentage increase, 223
if any, in the consumer price index from October 1, 2004, to 224
September 30, 2005, rounded to the nearest one-tenth of one per 225
cent;226

       (e) The lesser of three per cent or the percentage increase, 227
if any, in the consumer price index from October 1, 2005, to 228
September 30, 2006, rounded to the nearest one-tenth of one per 229
cent.230

       (4) In(3) Each calendar year from 2008 and thereafter231
through 2016, the annual salary of the lieutenant governor shall 232
be the annual salary in 2007 increased by the lesser of the 233
following:234

       (a) Three per cent;235

       (b) The percentage increase, if any, in the consumer price 236
index from October 1, 2006 to September 30, 2007, rounded to the 237
nearest one-tenth of one per cent.238

       (4) Each calendar year from 2017 through 2023, the annual 239
salary of the lieutenant governor shall be the annual salary in 240
the immediately preceding calendar year, increased by the lesser 241
of the following:242

       (a) Three per cent;243

       (b) The percentage increase, if any, in the consumer price 244
index over the twelve-month period that ends on the thirtieth day 245
of September of the immediately preceding year, rounded to the 246
nearest one-tenth of one per cent.247

       If the governor appoints the lieutenant governor as an 248
administrative department head, the lieutenant governor may accept 249
the salary for that office while serving as its head in lieu of 250
the salary for the office of lieutenant governor.251

       (C)(1) In calendar year 2001 the annual salary of the 252
secretary of state, auditor of state, treasurer of state, and 253
attorney general shall be ninety-three thousand four hundred 254
forty-seven dollars.255

       (2) In calendar year 2002 theThe annual salary of the 256
secretary of state, auditor of state, treasurer of state, and 257
attorney general shall be ninety-sixone hundred nine thousand two258
nine hundred fiftyeighty-five dollars and ninety-two cents.259

       (3) In each(2) Each calendar year from 2003 through 2008260
2017 through 2023, the annual salary of the secretary of state, 261
auditor of state, treasurer of state, and attorney general shall 262
be the annual salary in the immediately preceding calendar year,263
increased by the lesser of the following:264

       (a) Three per cent;265

       (b) The percentage increase, if any, in the consumer price 266
index over the twelve-month period that ends on the thirtieth day 267
of September of the immediately preceding year, rounded to the 268
nearest one-tenth of one per cent.269

       (D) Upon the death of an elected executive officer of the 270
state listed in divisions (A) to (F) of section 141.01 of the 271
Revised Code during that person's term of office, an amount shall 272
be paid in accordance with section 2113.04 of the Revised Code, or 273
to that person's estate. The amount shall equal the amount of the 274
salary that the officer would have received during the remainder 275
of the officer's unexpired term or an amount equal to the salary 276
of that person's office for two years, whichever is less.277

       (E) As used in this section, "consumer price index" has the 278
same meaning as in section 101.27 of the Revised Code.279

       Sec. 141.04.  (A) The annual salaries of the chief justice of 280
the supreme court and of the justices and judges named in this 281
section payable from the state treasury are as follows, rounded to 282
the nearest fifty dollars:283

       (1) For the chief justice of the supreme court, the following 284
amounts effective in the following years:285

       (a) Beginning January 1, 20002014, one hundred twenty-four286
fifty thousand nineeight hundred fifty dollars;287

       (b) Beginning January 1, 2001, one hundred twenty-eight 288
thousand six hundred fifty dollarsof 2015, 2016, 2017, and 2018, 289
the amount of the annual salary in the immediately preceding 290
calendar year, increased by five per cent;291

       (c) After 2001Each calendar year from 2019 through 2023, the 292
amount determined under division (E)(1) of this section.293

       (2) For the justices of the supreme court, the following 294
amounts effective in the following years:295

       (a) Beginning January 1, 20002014, one hundred seventeen296
forty-one thousand twosix hundred fifty dollars;297

       (b) Beginning January 1, 2001, one hundred twenty thousand 298
seven hundred fifty dollarsof 2015, 2016, 2017, and 2018, the 299
amount of the annual salary in the immediately preceding calendar 300
year, increased by five per cent;301

       (c) After 2001Each calendar year from 2019 through 2023, the 302
amount determined under division (E)(1) of this section.303

       (3) For the judges of the courts of appeals, the following 304
amounts effective in the following years:305

       (a) Beginning January 1, 20002014, one hundred nine306
thirty-two thousand two hundred fifty dollars;307

       (b) Beginning January 1, 2001, one hundred twelve thousand 308
five hundred fifty dollarsof 2015, 2016, 2017, and 2018, the 309
amount of the annual salary in the immediately preceding calendar 310
year, increased by five per cent;311

       (c) After 2001Each calendar year from 2019 through 2023, the 312
amount determined under division (E)(1) of this section.313

       (4) For the judges of the courts of common pleas, the 314
following amounts effective in the following years:315

       (a) Beginning January 1, 20002014, one hundred twenty-one316
thousand fivethree hundred fifty dollars, reduced by an amount 317
equal to the annual compensation paid to that judge from the 318
county treasury pursuant to section 141.05 of the Revised Code;319

       (b) Beginning January 1, 2001, one hundred three thousand 320
five hundred dollarsof 2015, 2016, 2017, and 2018, the amount of 321
the annual salary in the immediately preceding calendar year, 322
increased by five per cent, reduced by an amount equal to the 323
annual compensation paid to that judge from the county treasury 324
pursuant to section 141.05 of the Revised Code;325

       (c) After 2001Each calendar year from 2019 through 2023, the 326
aggregate annual salary amount determined under division (E)(2) of 327
this section, reduced by an amount equal to the annual 328
compensation paid to that judge from the county treasury pursuant 329
to section 141.05 of the Revised Code.330

       (5) For the full-time judges of a municipal court or the 331
part-time judges of a municipal court of a territory having a 332
population of more than fifty thousand, the following amounts 333
effective in the following years, which amounts shall be in 334
addition to all amounts received pursuant to divisions (B)(1)(a) 335
and (2) of section 1901.11 of the Revised Code from municipal 336
corporations and counties:337

       (a) Beginning January 1, 20002014, thirty-twoone hundred 338
fourteen thousand sixone hundred fifty dollars, reduced by an 339
amount equal to the annual compensation paid to that judge 340
pursuant to division (B)(1)(a) of section 1901.11 of the Revised 341
Code from municipal corporations and counties;342

       (b) Beginning January 1, 2001, thirty-five thousand five 343
hundred dollars;of 2015, 2016, 2017, and 2018, the aggregate 344
amount of the annual salary paid in the immediately preceding 345
calendar year pursuant to division (A)(5) of this section and 346
division (B)(1)(a) of section 1901.11 of the Revised Code, 347
increased by five per cent.348

       (c) After 2001Each calendar year from 2019 through 2023, the 349
amount determined under division (E)(3) of this section, reduced 350
by an amount equal to the annual compensation paid to that judge 351
pursuant to division (B)(1)(a) of section 1901.11 of the Revised 352
Code.353

       (6) For judges of a municipal court designated as part-time 354
judges by section 1901.08 of the Revised Code, other than 355
part-time judges to whom division (A)(5) of this section applies, 356
and for judges of a county court, the following amounts effective 357
in the following years, which amounts shall be in addition to any 358
amounts received pursuant to division (A) of section 1901.11 of 359
the Revised Code from municipal corporations and counties or 360
pursuant to division (A) of section 1907.16 of the Revised Code 361
from counties:362

       (a) Beginning January 1, 20002014, eighteensixty-five363
thousand eightsix hundred fifty dollars, reduced by an amount 364
equal to the annual compensation paid to that judge pursuant to 365
division (A) of section 1901.11 of the Revised Code from municipal 366
corporations and counties or pursuant to division (A) of section 367
1907.16 of the Revised Code from counties;368

       (b) Beginning January 1, 2001, twenty thousand four hundred 369
fifty dollars;of 2015, 2016, 2017, and 2018, the aggregate amount 370
of the annual salary paid in the immediately preceding calendar 371
year pursuant to division (A)(6) of this section and division (A) 372
of section 1901.11 of the Revised Code or division (A) of section 373
1907.16 of the Revised Code, increased by five per cent.374

       (c) After 2001Each calendar year from 2019 through 2023, the 375
amount determined under division (E)(4) of this section, reduced 376
by an amount equal to the annual compensation paid to that judge 377
pursuant to division (A) of section 1901.11 of the Revised Code or 378
pursuant to division (A) of section 1907.16 of the Revised Code.379

       (B) Except as provided in sections 1901.122 and 1901.123 of 380
the Revised Code, except as otherwise provided in this division, 381
and except for the compensation to which the judges described in 382
division (A)(5) of this section are entitled pursuant to divisions 383
(B)(1)(a) and (2) of section 1901.11 of the Revised Code, the 384
annual salary of the chief justice of the supreme court and of 385
each justice or judge listed in division (A) of this section shall 386
be paid in equal monthly installments from the state treasury. If 387
the chief justice of the supreme court or any justice or judge 388
listed in division (A)(2), (3), or (4) of this section delivers a 389
written request to be paid biweekly to the administrative director 390
of the supreme court prior to the first day of January of any 391
year, the annual salary of the chief justice or the justice or 392
judge that is listed in division (A)(2), (3), or (4) of this 393
section shall be paid, during the year immediately following the 394
year in which the request is delivered to the administrative 395
director of the supreme court, biweekly from the state treasury.396

       (C) Upon the death of the chief justice or a justice of the 397
supreme court during that person's term of office, an amount shall 398
be paid in accordance with section 2113.04 of the Revised Code, or 399
to that person's estate. The amount shall equal the amount of the 400
salary that the chief justice or justice would have received 401
during the remainder of the unexpired term or an amount equal to 402
the salary of office for two years, whichever is less.403

       (D) Neither the chief justice of the supreme court nor any 404
justice or judge of the supreme court, the court of appeals, the 405
court of common pleas, or the probate court shall hold any other 406
office of trust or profit under the authority of this state or the 407
United States.408

       (E)(1) Each calendar year from 2002 through 20082019 through 409
2023, the annual salaries of the chief justice of the supreme 410
court and of the justices and judges named in divisions (A)(2) and 411
(3) of this section shall be increased by an amount equal to the 412
adjustment percentage for that year multiplied by the compensation 413
paid the preceding year pursuant to division (A)(1), (2), or (3) 414
of this section.415

       (2) Each calendar year from 2002 through 20082019 through 416
2023, the aggregate annual salary payable under division (A)(4) of 417
this section to the judges named in that division shall be 418
increased by an amount equal to the adjustment percentage for that 419
year multiplied by the aggregate compensation paid the preceding 420
year pursuant to division (A)(4) of this section and section 421
141.05 of the Revised Code.422

       (3) Each calendar year from 2002 through 20082019 through 423
2023, the salary payable from the state treasury under division 424
(A)(5) of this section to the judges named in that division shall 425
be increased by an amount equal to the adjustment percentage for 426
that year multiplied by the aggregate compensation paid the 427
preceding year pursuant to division (A)(5) of this section and 428
division (B)(1)(a) of section 1901.11 of the Revised Code.429

       (4) Each calendar year from 2002 through 20082019 through 430
2023, the salary payable from the state treasury under division 431
(A)(6) of this section to the judges named in that division shall 432
be increased by an amount equal to the adjustment percentage for 433
that year multiplied by the aggregate compensation paid the 434
preceding year pursuant to division (A)(6) of this section and 435
division (A) of section 1901.11 of the Revised Code from municipal 436
corporations and counties or division (A) of section 1907.16 of 437
the Revised Code from counties.438

       (F) In addition to the salaries payable pursuant to this 439
section, the chief justice of the supreme court and the justices 440
of the supreme court shall be entitled to a vehicle allowance of 441
five hundred dollars per month, payable from the state treasury. 442
The allowance shall be increased on the first day of January of 443
each odd-numbered year by an amount equal to the percentage 444
increase, if any, in the consumer price index for the immediately 445
preceding twenty-four month period for which information is 446
available.447

       (G) On or before the first day of December of each year, the 448
Ohio supreme court, through its chief administrator, shall notify 449
the administrative judge of the Montgomery county municipal court, 450
the board of county commissioners of Montgomery county, and the 451
treasurer of the state of the yearly salary cost of five part-time 452
county court judges as of that date. If the total yearly salary 453
costs of all of the judges of the Montgomery county municipal 454
court as of the first day of December of that same year exceeds 455
that amount, the administrative judge of the Montgomery county 456
municipal court shall cause payment of the excess between those 457
two amounts less any reduced amount paid for the health care costs 458
of the Montgomery county municipal court judges in comparison to 459
the health care costs of five part-time county court judges from 460
the general special projects fund or the fund for a specific 461
special project created pursuant to section 1901.26 of the Revised 462
Code to the treasurer of Montgomery county and to the treasurer of 463
the state in amounts proportional to the percentage of the 464
salaries of the municipal court judges paid by the county and by 465
the state.466

       (H) As used in this section:467

       (1) The "adjustment percentage" for a year is the lesser of 468
the following:469

       (a) Three per cent;470

       (b) The percentage increase, if any, in the consumer price 471
index over the twelve-month period that ends on the thirtieth day 472
of September of the immediately preceding year, rounded to the 473
nearest one-tenth of one per cent.474

       (2) "Consumer price index" has the same meaning as in section 475
101.27 of the Revised Code.476

       (3) "Salary" does not include any portion of the cost, 477
premium, or charge for health, medical, hospital, dental, or 478
surgical benefits, or any combination of those benefits, covering 479
the chief justice of the supreme court or a justice or judge named 480
in this section and paid on the chief justice's or the justice's 481
or judge's behalf by a governmental entity.482

       Sec. 195.01. (A) There is hereby created the Ohio public 483
officials compensation advisory commission to recommend the 484
salaries of all state and local elected officials. 485

       (B) The commission shall consist of the following members:486

       (1) Two members appointed by the governor, one from each 487
major political party;488

       (2) Two members appointed by the president of the senate;489

       (3) One member appointed by the minority leader of the 490
senate;491

       (4) Two members appointed by the speaker of the house of 492
representatives;493

       (5) One member appointed by the minority leader of the house 494
of representatives;495

       (6) One member appointed by the chief justice of the supreme 496
court.497

       (C) All members appointed to the commission shall possess 498
expertise, knowledge, or skills consistent with the purpose of the 499
commission, including personnel management, fiscal management, 500
economic analysis, and statistics.501

       (D) The following individuals are ineligible to serve on the 502
commission:503

       (1) An individual who has served in public office by 504
appointment or election within a year prior to the proposed 505
appointment to the commission;506

       (2) An incumbent by appointment or election to an office in 507
which the commission may make a salary recommendation;508

       (3) An individual employed as a legislative agent, retirement 509
system lobbyist, or executive agency lobbyist or an employer of a 510
legislative agent, retirement system lobbyist, or executive agency 511
lobbyist.512

       (E) Each member shall be appointed for a term of two years 513
and may be reappointed. Vacancies shall be filled in the manner 514
provided for the original appointment. Members may be removed or 515
replaced by the member's appointing authority.516

       (F) Each member shall serve without compensation but shall be 517
reimbursed for actual and necessary expenses incurred in the 518
performance of official duties. 519

       (G) The commission may employ staff and contract with 520
consultants with expertise in the field of compensation. The 521
commission shall be appropriated funds necessary to carry out 522
these tasks. 523

       (H) The legislative service commission shall provide 524
facilities and staff support for the commission. 525

       (I) Except as provided in section 195.05 of the Revised Code, 526
the commission shall convene every other year starting in 2022.527

       Sec. 195.02. The Ohio public officials compensation advisory 528
commission shall recommend the salaries of elected officials in 529
the form of pay schedules. The commission shall consider any 530
matter related to proper compensation of elected officials and 531
shall recommend any compensation package or structure the 532
commission finds to be appropriate. In determining the salaries to 533
be recommended in the pay schedules and additional compensation 534
amounts, the commission shall do all of the following:535

       (A) Review the statutes that establish the current salaries 536
of elected officials and their additional compensation amounts;537

       (B) Consider the length of time since the last salary or 538
additional compensation amount of an elected official was last 539
adjusted;540

       (C) Take into consideration both of the following changes 541
that have occurred since the salary or additional compensation 542
amount of an elected official was last adjusted:543

       (1) Any changes in the consumer price index prepared by the 544
United States bureau of labor statistics for urban wage earners 545
and clerical workers;546

       (2) Any changes in tax laws applicable to an elected 547
official.548

       (D) Consider the salaries paid to elected officials in other 549
states that are comparable to this state in terms of the 550
following:551

       (1) Population;552

       (2) Revenue and expenses per capita;553

       (3) Urban and rural diversity; 554

       (4) Federal salaries for similar positions;555

       (5) In the case of general assembly salaries, frequency of 556
legislative sessions.557

       (E) Review the laws of this state governing reimbursement of 558
expenses incurred by elected officials and take into consideration 559
the expenses incident to the office held, for which the elected 560
official is not reimbursed;561

       (F) Consider any other relevant factors that the commission 562
considers necessary to make its determination.563

       Sec. 195.03. (A) The Ohio public officials compensation 564
advisory commission shall make the recommendations for elected 565
officials pay schedules and additional compensation amounts in the 566
form of a resolution adopted by a simple majority of the 567
commission's members. The resolution shall include a listing of 568
elected officials' current salaries and additional compensation 569
amounts and the statutes reviewed by the commission.570

       (B) The commission shall prepare and adopt its initial 571
resolution not later than January 31, 2023, and subsequent 572
resolutions by January 31 of every other year thereafter. 573

       (C) The pay schedules and additional compensation amounts in 574
the commission's initial resolution shall be recommended to take 575
effect January 1, 2025, for state elected officials and January 1, 576
2024, for county elected officials.577

       Sec. 195.04.  The Ohio public officials compensation advisory 578
commission shall provide a copy of the resolution adopted under 579
section 195.03 of the Revised Code to the governor, president and 580
minority leader of the senate, speaker and minority leader of the 581
house of representatives, and chief justice of the supreme court. 582

       Sec. 195.05. (A) The Ohio public officials compensation 583
advisory commission shall reconvene to adopt a new resolution 584
recommending elected officials pay schedules and additional 585
compensation amounts if the general assembly:586

       (1) Does not adopt a resolution approving the resolution 587
adopted by the commission under section 195.04 of the Revised Code 588
by July 1 of the submission year; or589

       (2) Notifies the commission that changes to the schedules and 590
compensation amounts under the commission's resolution need to be 591
made in accordance with the general assembly's direction.592

       (B) The commission shall reconvene at one of the following 593
times:594

       (1) After July 1 of the submission year in the case the 595
general assembly does not act before that date to adopt a 596
resolution approving the commission's resolution;597

       (2) Within sixty days of receiving notice under division 598
(A)(1) of this section.599

       (C) The commission shall continue to reconvene to adopt a 600
resolution in accordance with sections 195.02 to 195.04 of the 601
Revised Code and divisions (A) and (B) of this section until the 602
general assembly adopts a resolution approving a resolution of the 603
commission.604

       (D) Elected official salaries shall not be altered in the 605
absence of a resolution adopted by the commission under section 606
195.04 of the Revised Code proposing the alterations that have 607
been approved by resolution of the general assembly.608

       Sec. 195.06. The governor shall consider a resolution adopted 609
by the general assembly approving a resolution adopted by the Ohio 610
public officials compensation advisory commission under section 611
195.04 of the Revised Code, and any statutory changes necessary to 612
implement the commission's resolution, when the governor proposes 613
the state budget under section 107.03 of the Revised Code.614

       Sec. 325.03.  Each county auditor shall be classified, for 615
salary purposes, according to the population of the county. All 616
county auditors shall receive annual compensation in accordance 617
with the following schedules and in accordance with section 325.18 618
of the Revised Code:619

       (B) In addition to the annual compensation that a sheriff 775
receives under this section for performing the duties of sheriff 776
prescribed by law, each sheriff shall receive in consideration of 777
the impact of Amended Substitute Senate Bill No. 2 of the 121st 778
general assembly on the workload of the sheriff, an additional 779
amount equal to one-eighth of the annual compensation that the 780
sheriff receives under division (A) of this section and section 781
325.18 of the Revised Code. This additional compensation shall be 782
paid biweekly from the county treasury if adequate funds have been 783
appropriated by the general assembly. If adequate funds have been 784
appropriated by the general assembly for the purposes of this 785
section, not later than the fifteenth day of March and September 786
of each year, the attorney general shall reimburse the fiscal 787
officer of the county the amount of additional compensation paid 788
under this division, the related amount of employer contributions 789
made under Chapter 145. of the Revised Code as required by the 790
public employees retirement board, and the related amount of the 791
payments to the social security administration for employer 792
contributions for Medicare part A. The fiscal officer shall 793
deposit the revenue in the county treasury.794

       Sec. 325.08.  Each clerk of the court of common pleas shall 795
be classified, for salary purposes, according to the population of 796
the county. All clerks of the court of common pleas shall receive 797
annual compensation in accordance with the following schedules and 798
in accordance with section 325.18 of the Revised Code:799

       (B) A prosecuting attorney in a county with a population of 1006
one million one or more who does not engage in the private 1007
practice of law shall receive in calendar year 2017 and in each 1008
calendar year thereafter annual compensation in an amount equal to 1009
the total compensation paid to a judge of the court of common 1010
pleas of that county pursuant to sections 141.04 and 141.05 of the 1011
Revised Code for the same calendar year, reduced by one hundred 1012
dollars.1013

       (C) A prosecuting attorney shall not engage in the private 1014
practice of law unless before taking office the prosecuting 1015
attorney notifies the board of county commissioners of the 1016
intention to engage in the private practice of law.1017

       A prosecuting attorney may elect to engage or not to engage 1018
in the private practice of law before the commencement of each new 1019
term of office, and a prosecuting attorney who engages in the 1020
private practice of law who intends not to engage in the private 1021
practice of law during the prosecuting attorney's next term of 1022
office shall so notify the board of county commissioners. A 1023
prosecuting attorney who elects not to engage in the private 1024
practice of law may, for a period of six months after taking 1025
office, engage in the private practice of law for the purpose of 1026
concluding the affairs of private practice of law without any 1027
diminution of salary as provided for in division (A) of this 1028
section and in section 325.18 of the Revised Code.1029

       (C)(D) As used in this section, "salary" does not include any 1030
portion of the cost, premium, or charge for health, medical, 1031
hospital, dental, or surgical benefits, or any combination of 1032
those benefits, covering the prosecuting attorney and paid on that 1033
person's behalf by a governmental entity.1034

       Sec. 325.14.  (A) Each county engineer shall be classified, 1035
for salary purposes, according to the population of the county. 1036
All county engineers shall receive annual compensation in 1037
accordance with the following schedules and in accordance with 1038
section 325.18 of the Revised Code:1039

       Such salary may be paid monthly out of the general county 1121
fund or out of the county's share of the fund derived from the 1122
receipts from motor vehicle licenses, as distributed by section 1123
4501.04 of the Revised Code, and the county's share of the fund 1124
derived from the motor vehicle fuel tax, as distributed by section 1125
5735.27 of the Revised Code, as the board of county commissioners 1126
directs, upon the warrant of the county auditor and shall be in 1127
lieu of all fees, costs, per diem or other allowances, and other 1128
perquisites, of whatever kind, which any engineer collects and 1129
receives. The engineer shall be the county tax map draftperson, 1130
but shall receive no additional compensation for performing the 1131
duties of that position. When the engineer performs service in 1132
connection with ditches or drainage works, the engineer shall 1133
charge and collect the per diem allowances or other fees provided 1134
by law and shall pay all of those allowances and fees, monthly, 1135
into the county treasury to the credit of the general county fund. 1136
The engineer shall pay into the county treasury all allowances and 1137
fees collected when the engineer performs services under sections 1138
315.28 to 315.34 of the Revised Code.1139

       (B) A county engineer may elect to engage or not to engage in 1140
the private practice of engineering or surveying before the 1141
commencement of each new term of office, and a county engineer who 1142
elects not to engage in the private practice of engineering or 1143
surveying may, for a period of six months after taking office, 1144
engage in the private practice of engineering or surveying for the 1145
purpose of concluding the affairs of private practice without any 1146
diminution of salary as provided in division (A) of this section 1147
and in section 325.18 of the Revised Code.1148

       Sec. 325.15.  (A) Each coroner shall be classified, for 1149
salary purposes, according to the population of the county. All 1150
coroners shall receive annual compensation in accordance with the 1151
following schedules and in accordance with section 325.18 of the 1152
Revised Code:1153

       (B) A coroner in a county with a population of one hundred 1219

engages in the private practice of medicine but who intends not to 1228
engage in the private practice of medicine during the coroner's 1229
next term of office shall so notify the board of county 1230
commissioners as specified in this division. For a period of six 1231
months after taking office, a coroner who elects not to engage in 1232
the private practice of medicine may engage in the private 1233
practice of medicine, without any reduction of the salary as 1234
provided in division (A) of this section and in section 325.18 of 1235
the Revised Code, for the purpose of concluding the affairs of the 1236
coroner's private practice of medicine.1237

       Sec. 325.18.  (A) As used in this section, "consumer price 1238
index" means the consumer price index prepared by the United 1239
States bureau of labor statistics (U.S. city average for urban 1240
wage earners and clerical workers: all items, 1982-1984=100) or, 1241
if that index is no longer published, a generally available 1242
comparable index.1243

       (B)(1) In calendar year 2003, the annual compensation amounts 1244
for county auditors under division (D) of section 325.03 of the 1245
Revised Code shall be increased by first increasing the amounts by 1246
the percentage under division (B)(1)(a) of this section then 1247
further increasing them by the percentage under division (B)(1)(b) 1248
of this section. Such percentages are:1249

       (a) The lesser of three per cent or the percentage increase, 1250
if any, in the consumer price index from October 1, 2000, to 1251
September 30, 2001, rounded to the nearest one-tenth of one per 1252
cent;1253

       (b) The lesser of three per cent or the percentage increase, 1254
if any, in the consumer price index from October 1, 2001, to 1255
September 30, 2002, rounded to the nearest one-tenth of one per 1256
cent.1257

       (2) Each calendar year from 2004 through 2008, the annual 1258
compensation of each county auditor shall be increased by the 1259
lesser of the following:1260

       (a) Three per cent;1261

       (b) The percentage increase, if any, in the consumer price 1262
index over the twelve-month period that ends on the thirtieth day 1263
of September of the immediately preceding calendar year, rounded 1264
to the nearest one-tenth of one per cent.1265

       (C) EachIn calendar year from 2002 through 20082017 and in 1266
each calendar year thereafter, the annual compensation in the 1267
immediately preceding calendar year of each county auditor, county 1268
treasurer, sheriff, clerk of the court of common pleas, county 1269
recorder, county commissioner, prosecuting attorney, other than a 1270
prosecuting attorney described in division (B) of section 325.11 1271
of the Revised Code, county engineer, and coroner shall be 1272
increased by the lesser of the following:1273

       (1) Three per cent;1274

       (2) The percentage increase, if any, in the consumer price 1275
index over the twelve-month period that ends on the thirtieth day 1276
of September of the immediately preceding calendar year, rounded 1277
to the nearest one-tenth of one per cent.1278

       (D)(C) Notwithstanding this section and sections 325.06, 1279
325.11, 325.14, and 325.15 of the Revised Code, when computing a 1280
salary for any elected county officer under any of those sections, 1281
if the population range for the class under which the officer is 1282
to be compensated is not the same as the population range for that 1283
class for any other such elected county office, the class at which 1284
the officer's salary is determined shall be the highest class at 1285
which any officer from that same county is compensated under the 1286
population range applicable to that officer.1287

       Sec. 505.24. Each(A) In calendar year 2015, each township 1288
trustee is entitled to compensation as follows:1289

       (A) Except as otherwise provided in division (B) of this 1290
section,in an amount for each day of service in the business of 1291
the township, to be paid from the township treasury as follows:1292

       (1) In townships having a budget of two hundred fifty 1293
thousand dollars or less, twentythirty-seven dollars and 1294
sixty-one cents per day for not more than two hundred days;1295

       (2) In townships having a budget of more than two hundred1296
fifty thousand but not more than onefive hundred thousand 1297
dollars, twenty-fourforty-three dollars and fifty-five cents per 1298
day for not more than two hundred days;1299

       (3) In townships having a budget of more than onefive1300
hundred thousand but not more than twoseven hundred fifty 1301
thousand dollars, twenty-eightforty-six dollars and fifty1302
nineteen cents per day for not more than two hundred days;1303

       (4) In townships having a budget of more than twoseven1304
hundred fifty thousand but not more than one million five hundred 1305
thousand dollars, thirty-threefifty-two dollars and 1306
seventy-eight cents per day for not more than two hundred days;1307

       (5) In townships having a budget of more than one million1308
five hundred thousand but not more than seventhree million five1309
hundred fifty thousand dollars, thirty-fivefifty-eight dollars 1310
and six cents per day for not more than two hundred days;1311

       (6) In townships having a budget of more than seventhree 1312
million five hundred fifty thousand but not more than onesix1313
million five hundred thousand dollars, fortysixty-three dollars 1314
and thirty-three cents per day for not more than two hundred days;1315

       (7) In townships having a budget of more than onesix million 1316
five hundred thousand but not more than threeten million five 1317
hundred thousand dollars, forty-foureighty-two dollars and seven 1318
cents per day for not more than two hundred days;1319

       (8) In townships having a budget of more than threeten1320
million five hundred thousand dollars but not more than six 1321
million dollars, forty-eightone hundred five dollars and 1322
fifty-one cents per day for not more than two hundred days;1323

       (9) In townships having a budget of more than six million 1324
dollars, fifty-two dollars per day for not more than two hundred 1325
days.1326

       (B) Beginning inIn calendar year 19992016 and in each 1327
calendar year thereafter, the amounts paid as specified in 1328
division (A) of this section shall be replaced by the following 1329
amounts:1330

       (1) In calendar year 1999, the amounts specified in division 1331
(A) of this section increased by three per cent;1332

       (2) In calendar year 2000, the amounts determined under 1333
division (B)(1) of this section increased by three per cent;1334

       (3) In calendar year 2001, the amounts determined under 1335
division (B)(2) of this section increased by three per cent;1336

       (4) In calendar year 2002, except in townships having a 1337
budget of more than six million dollars, the amounts determined 1338
under division (B)(3) of this section increased by three per cent; 1339
in townships having a budget of more than six million but not more 1340
than ten million dollars, seventy dollars per day for not more 1341
than two hundred days; and in townships having a budget of more 1342
than ten million dollars, ninety dollars per day for not more than 1343
two hundred days;1344

       (5) In calendar years 2003 through 2008, the amounts 1345
determined under division (B) of this section forin the 1346
immediately preceding calendar year shall be increased by the 1347
lesser of the following:1348

       (a)(1) Three per cent;1349

       (b)(2) The percentage increase, if any, in the consumer price 1350
index over the twelve-month period that ends on the thirtieth day 1351
of September of the immediately preceding calendar year, rounded 1352
to the nearest one-tenth of one per cent;1353

       (6) In calendar year 2009 and thereafter, the amount 1354
determined under division (B) of this section for calendar year 1355
2008.1356

       As used in division (B) of this section, "consumer price 1357
index" has the same meaning as in section 325.18 of the Revised 1358
Code.1359

       (C) Whenever members of a board of township trustees are 1360
compensated per diem and not by annual salary, the board shall 1361
establish, by resolution, a method by which each member of the 1362
board shall periodically notify the township fiscal officer of the 1363
number of days spent in the service of the township and the kinds 1364
of services rendered on those days. The per diem compensation 1365
shall be paid from the township general fund or from other 1366
township funds in such proportions as the kinds of services 1367
performed may require. The notice shall be filed with the township 1368
fiscal officer and preserved for inspection by any persons 1369
interested.1370

       By unanimous vote, a board of township trustees may adopt a 1371
method of compensation consisting of an annual salary to be paid 1372
in equal monthly payments. If the office of trustee is held by 1373
more than one person during any calendar year, each person holding 1374
the office shall receive payments for only those months, and any 1375
fractions of those months, during which the person holds the 1376
office. The amount of the annual salary approved by the board 1377
shall be no more than the maximum amount that could be received 1378
annually by a trustee if the trustee were paid on a per diem basis 1379
as specified in this division, and shall be paid from the township 1380
general fund or from other township funds in such proportions as 1381
the board may specify by resolution. Each trustee shall certify 1382
the percentage of time spent working on matters to be paid from 1383
the township general fund and from other township funds in such 1384
proportions as the kinds of services performed. A board of 1385
township trustees that has adopted a salary method of compensation 1386
may return to a method of compensation on a per diem basis as 1387
specified in this division by a majority vote. Any change in the 1388
method of compensation shall be effective on the first day of 1389
January of the year following the year during which the board has 1390
voted to change the method of compensation.1391

       Sec. 507.09.  (A) Except as otherwise provided in division 1392
(D) of this sectionIn calendar year 2015, the township fiscal 1393
officer shall be entitled to compensation as follows:1394

       (1) In townships having a budget of two hundred fifty 1395
thousand dollars or less, threeten thousand fiveone hundred 1396
sixty-one dollars;1397

       (2) In townships having a budget of more than two hundred1398
fifty thousand but not more than onefive hundred thousand 1399
dollars, fivethirteen thousand five hundredsixty-four dollars;1400

       (3) In townships having a budget of more than onefive1401
hundred thousand but not more than twoseven hundred fifty 1402
thousand dollars, sevenfourteen thousand sevenfive hundred 1403
fifteen dollars;1404

       (4) In townships having a budget of more than twoseven1405
hundred fifty thousand but not more than one million five hundred 1406
thousand dollars, nineseventeen thousand ninefour hundred 1407
nineteen dollars;1408

       (5) In townships having a budget of more than one million1409
five hundred thousand but not more than seventhree million five1410
hundred fifty thousand dollars, eleventwenty thousand three 1411
hundred twenty-one dollars;1412

       (6) In townships having a budget of more than seventhree 1413
million five hundred fifty thousand but not more than onesix1414
million five hundred thousand dollars, thirteentwenty-one1415
thousand twoseven hundred seventy-three dollars;1416

       (7) In townships having a budget of more than onesix million 1417
five hundred thousand but not more than threeten million five 1418
hundred thousand dollars, fifteentwenty-four thousand fournine1419
hundred eighty-eight dollars;1420

       (8) In townships having a budget of more than threeten1421
million five hundred thousand dollars but not more than six 1422
million dollars, sixteentwenty-eight thousand fivenine hundred 1423
nine dollars;1424

       (9) In townships having a budget of more than six million 1425
dollars, seventeen thousand six hundred dollars.1426

       (B) In calendar year 2016 and in each calendar year 1427
thereafter, the compensation paid in the immediately preceding 1428
calendar year shall be increased by the lesser of the following:1429

       (1) Three per cent;1430

       (2) The percentage increase, if any, in the consumer price 1431
index over the twelve-month period that ends on the thirtieth day 1432
of September of the immediately preceding calendar year, rounded 1433
to the nearest one-tenth of one per cent.1434

       As used in division (B) of this section, "consumer price 1435
index" has the same meaning as in section 325.18 of the Revised 1436
Code.1437

       (C) Any township fiscal officer may elect to receive less 1438
than the compensation the fiscal officer is entitled to under 1439
division (A) or (B) of this section. Any township fiscal officer 1440
electing to do this shall so notify the board of township trustees 1441
in writing, and the board shall include this notice in the minutes 1442
of its next board meeting.1443

       (C)(D) The compensation of the township fiscal officer shall 1444
be paid in equal monthly payments. If the office of township 1445
fiscal officer is held by more than one person during any calendar 1446
year, each person holding the office shall receive payments for 1447
only those months, and any fractions of those months, during which 1448
the person holds the office.1449

       A township fiscal officer may be compensated from the 1450
township general fund or from other township funds based on the 1451
proportion of time the township fiscal officer spends providing 1452
services related to each fund. A township fiscal officer must 1453
document the amount of time the township fiscal officer spends 1454
providing services related to each fund by certification 1455
specifying the percentage of time spent working on matters to be 1456
paid from the township general fund or from other township funds 1457
in such proportions as the kinds of services performed.1458

       (D) Beginning in calendar year 1999, the township fiscal 1459
officer shall be entitled to compensation as follows:1460

       (1) In calendar year 1999, the compensation specified in 1461
division (A) of this section increased by three per cent;1462

       (2) In calendar year 2000, the compensation determined under 1463
division (D)(1) of this section increased by three per cent;1464

       (3) In calendar year 2001, the compensation determined under 1465
division (D)(2) of this section increased by three per cent;1466

       (4) In calendar year 2002, except in townships having a 1467
budget of more than six million dollars, the compensation 1468
determined under division (D)(3) of this section increased by 1469
three per cent; in townships having a budget of more than six 1470
million but not more than ten million dollars, nineteen thousand 1471
eight hundred ten dollars; and in townships having a budget of 1472
more than ten million dollars, twenty thousand nine hundred 1473
dollars;1474

       (5) In calendar year 2003, the compensation determined under 1475
division (D)(4) of this section increased by three per cent or the 1476
percentage increase in the consumer price index as described in 1477
division (D)(7)(b) of this section, whichever percentage is lower;1478

       (6) In calendar year 2004, except in townships having a 1479
budget of more than six million dollars, the compensation 1480
determined under division (D)(5) of this section for the calendar 1481
year 2003 increased by three per cent or the percentage increase 1482
in the consumer price index as described in division (D)(7)(b) of 1483
this section, whichever percentage is lower; in townships having a 1484
budget of more than six million but not more than ten million 1485
dollars, twenty-two thousand eighty-seven dollars; and in 1486
townships having a budget of more than ten million dollars, 1487
twenty-five thousand five hundred fifty-three dollars;1488

       (7) In calendar years 2005 through 2008, the compensation 1489
determined under division (D) of this section for the immediately 1490
preceding calendar year increased by the lesser of the following:1491

       (a) Three per cent;1492

       (b) The percentage increase, if any, in the consumer price 1493
index over the twelve-month period that ends on the thirtieth day 1494
of September of the immediately preceding calendar year, rounded 1495
to the nearest one-tenth of one per cent;1496

       (8) In calendar year 2009 and thereafter, the amount 1497
determined under division (D) of this section for calendar year 1498
2008.1499

       As used in this division, "consumer price index" has the same 1500
meaning as in section 325.18 of the Revised Code.1501

       Sec. 3501.12. (A) The annual compensation of members of the 1502
board of elections shall be determined on the basis of the 1503
population of the county according to the next preceding federal 1504
census, and shall be paid monthly out of the appropriations made 1505
to the board and upon vouchers or payrolls certified by the 1506
chairperson, or a member of the board designated by it, and 1507
countersigned by the director or in the director's absence by the 1508
deputy director. Upon presentation of any such voucher or payroll, 1509
the county auditor shall issue a warrant upon the county treasurer 1510
for the amount thereof as in the case of vouchers or payrolls for 1511
county offices and the treasurer shall pay such warrant.1512

       (A) Except as provided in divisions (B) and (C) of this 1513
section(B) In calendar year 2014, the amount of annual 1514
compensation of memberseach member of the board of elections1515
shall be as follows:1516

       (1) Eighty-fiveNinety-two dollars and eighty-nine cents for 1517
each full one thousand of the first one hundred thousand 1518
population;1519

       (2) FortyForty-four dollars and fiftytwenty-six cents for 1520
each full one thousand of the second one hundred thousand 1521
population;1522

       (3) Twenty-twoTwenty-four dollars and four cents for each 1523
full one thousand of the third one hundred thousand population;1524

       (4) SixSeven dollars and seventy-fivethirty-seven cents for 1525
each full one thousand above three hundred thousand population.1526

       (B) Except as provided in division (C) of this section(C) In 1527
calendar year 2014, the compensation of a member of the board 1528
shall not be less than three thousand threesix hundred 1529
seventy-fiveeighty-seven dollars and shall not exceed twenty1530
twenty-one thousand eight hundred fifty-five dollars annually.1531

       (C) In calendar year 2001, the annual compensation of each 1532
member of the board shall be computed after increasing the dollar 1533
amounts specified in divisions (A) and (B) of this section by 1534
three per cent.1535

       (D) In calendar year 2002, the annual compensation of each 1536
member of the board shall be computed after increasing by three 1537
per cent the dollar amounts used to compute the compensation of a 1538
member under division (C) of this section.1539

       (E) In calendar year 2003 and thereafter, the annual 1540
compensation of each member of the board shall be computed after 1541
increasing by three per cent the dollar amounts used to compute 1542
the compensation of a member under division (D) of this section1543

       (D) In calendar year 2015, the annual compensation of each 1544
member of the board shall be computed after increasing the dollar 1545
amounts specified in divisions (B) and (C) of this section by five 1546
per cent. Such compensation shall not be less than four thousand 1547
eight hundred thirty dollars.1548

       (E) In calendar year 2016, the annual compensation of each 1549
member of the board shall be computed after increasing the dollar 1550
amounts specified in division (D) of this section by five per 1551
cent. Such compensation shall not be less than six thousand 1552
dollars.1553

       (F) In calendar year 2017 and in each calendar year 1554
thereafter, the annual compensation in the immediately preceding 1555
calendar year of each member of the board shall be increased by 1556
the lesser of the following:1557

       (1) Three per cent;1558

       (2) The percentage increase, if any, in the consumer price 1559
index over the twelve-month period that ends on the thirtieth day 1560
of September of the immediately preceding calendar year, rounded 1561
to the nearest one-tenth of one per cent.1562

       As used in this section, "consumer price index" has the same 1563
meaning as in section 325.18 of the Revised Code.1564

       For the purposes of this section, members of boards of 1565
elections shall be deemed to be appointed and not elected, and 1566
therefore not subject to Section 20 of Article II of the Ohio 1567
Constitution.1568

       Section 2.  That existing sections 101.27, 141.011, 141.04, 1569
325.03, 325.04, 325.06, 325.08, 325.09, 325.10, 325.11, 325.14, 1570
325.15, 325.18, 505.24, 507.09, and 3501.12 of the Revised Code 1571
are hereby repealed.1572

       Section 3.  That Section 307.10 of Am. Sub. H.B. 59 of the 1573
130th General Assembly be amended to read as follows:1574

       OPERATING EXPENSES - JUDICIARY/SUPREME COURT1595

       Of the foregoing appropriation item 005321, Operating 1596
Expenses - Judiciary/Supreme Court, up to $206,770 in each fiscal 1597
year may be used to support the functions of the State Criminal 1598
Sentencing Council.1599

       LAW-RELATED EDUCATION1600

       The foregoing appropriation item 005406, Law-Related 1601
Education, shall be distributed directly to the Ohio Center for 1602
Law-Related Education for the purposes of providing continuing 1603
citizenship education activities to primary and secondary 1604
students, expanding delinquency prevention programs, increasing 1605
activities for at-risk youth, and accessing additional public and 1606
private money for new programs.1607

       OHIO COURTS TECHNOLOGY INITIATIVE1608

       The foregoing appropriation item 005409, Ohio Courts 1609
Technology Initiative, shall be used to fund an initiative by the 1610
Supreme Court to facilitate the exchange of information and 1611
warehousing of data by and between Ohio courts and other justice 1612
system partners through the creation of an Ohio Courts Network, 1613
the delivery of technology services to courts throughout the 1614
state, including the provision of hardware, software, and the 1615
development and implementation of educational and training 1616
programs for judges and court personnel, and operation of the 1617
Commission on Technology and the Courts by the Supreme Court for 1618
the promulgation of statewide rules, policies, and uniform 1619
standards, and to aid in the orderly adoption and comprehensive 1620
use of technology in Ohio courts.1621

       CONTINUING JUDICIAL EDUCATION1622

       The Continuing Judicial Education Fund (Fund 6720) shall 1623
consist of fees paid by judges and court personnel for attending 1624
continuing education courses and other gifts and grants received 1625
for the purpose of continuing judicial education. The foregoing 1626
appropriation item 005601, Continuing Judicial Education, shall be 1627
used to pay expenses for continuing education courses for judges 1628
and court personnel. If it is determined by the Administrative 1629
Director of the Supreme Court that additional appropriations are 1630
necessary, the amounts are hereby appropriated.1631

       No money in Fund 6720 shall be transferred to any other fund 1632
by the Director of Budget and Management or the Controlling Board. 1633
Interest earned on money in Fund 6720 shall be credited to the 1634
fund.1635

       FEDERAL GRANTS1636

       The Federal Grants Fund (Fund 3J00) shall consist of grants 1637
and other moneys awarded to the Supreme Court (The Judiciary) by 1638
the United States Government or other entities that receive the 1639
moneys directly from the United States Government and distribute 1640
those moneys to the Supreme Court (The Judiciary). The foregoing 1641
appropriation item 005603, Federal Grants, shall be used in a 1642
manner consistent with the purpose of the grant or award. If it is 1643
determined by the Administrative Director of the Supreme Court 1644
that additional appropriations are necessary, the amounts are 1645
hereby appropriated.1646

       No money in Fund 3J00 shall be transferred to any other fund 1647
by the Director of Budget and Management or the Controlling Board. 1648
However, interest earned on money in Fund 3J00 shall be credited 1649
or transferred to the General Revenue Fund.1650

       ATTORNEY SERVICES1651

       The Attorney Services Fund (Fund 4C80), formerly known as the 1652
Attorney Registration Fund, shall consist of money received by the 1653
Supreme Court (The Judiciary) pursuant to the Rules for the 1654
Government of the Bar of Ohio. In addition to funding other 1655
activities considered appropriate by the Supreme Court, the 1656
foregoing appropriation item 005605, Attorney Services, may be 1657
used to compensate employees and to fund appropriate activities of 1658
the following offices established by the Supreme Court: the Office 1659
of Disciplinary Counsel, the Board of Commissioners on Grievances 1660
and Discipline, the Clients' Security Fund, and the Attorney 1661
Services Division. If it is determined by the Administrative 1662
Director of the Supreme Court that additional appropriations are 1663
necessary, the amounts are hereby appropriated.1664

       No money in Fund 4C80 shall be transferred to any other fund 1665
by the Director of Budget and Management or the Controlling Board. 1666
Interest earned on money in Fund 4C80 shall be credited to the 1667
fund.1668

       COURT INTERPRETER CERTIFICATION1669

       The Court Interpreter Certification Fund (Fund 5HT0) shall 1670
consist of money received by the Supreme Court (The Judiciary) 1671
pursuant to Rules 80 through 87 of the Rules of Superintendence 1672
for the Courts of Ohio. The foregoing appropriation item 005617, 1673
Court Interpreter Certification, shall be used to provide 1674
training, to provide the written examination, and to pay language 1675
experts to rate, or grade, the oral examinations of those applying 1676
to become certified court interpreters. If it is determined by the 1677
Administrative Director that additional appropriations are 1678
necessary, the amounts are hereby appropriated.1679

       No money in Fund 5HT0 shall be transferred to any other fund 1680
by the Director of Budget and Management or the Controlling Board. 1681
Interest earned on money in Fund 5HT0 shall be credited to the 1682
fund.1683

       COUNTY LAW LIBRARY RESOURCES BOARD1684

       The Statewide Consortium of County Law Library Resources 1685
Boards Fund (Fund 5JY0) shall consist of moneys deposited pursuant 1686
to section 307.515 of the Revised Code into a county's law library 1687
resources fund and forwarded by that county's treasurer for 1688
deposit in the state treasury pursuant to division (E)(1) of 1689
section 3375.481 of the Revised Code. The foregoing appropriation 1690
item 005620, County Law Library Resources Board, shall be used for 1691
the operation of the Statewide Consortium of County Law Library 1692
Resources Boards. If it is determined by the Administrative 1693
Director of the Supreme Court that additional appropriations are 1694
necessary, the amounts are hereby appropriated.1695

        No money in Fund 5JY0 shall be transferred to any other fund 1696
by the Director of Budget and Management or the Controlling Board. 1697
Interest earned on money in Fund 5JY0 shall be credited to the 1698
fund.1699

       GRANTS AND AWARDS1700

       The Grants and Awards Fund (Fund 5T80) shall consist of 1701
grants and other money awarded to the Supreme Court (The 1702
Judiciary) by the State Justice Institute, the Division of 1703
Criminal Justice Services, or other entities. The foregoing 1704
appropriation item 005609, Grants and Awards, shall be used in a 1705
manner consistent with the purpose of the grant or award. If it is 1706
determined by the Administrative Director of the Supreme Court 1707
that additional appropriations are necessary, the amounts are 1708
hereby appropriated.1709

       No money in Fund 5T80 shall be transferred to any other fund 1710
by the Director of Budget and Management or the Controlling Board. 1711
However, interest earned on money in Fund 5T80 shall be credited 1712
or transferred to the General Revenue Fund.1713

       SUPREME COURT ADMISSIONS1714

       The foregoing appropriation item 005606, Supreme Court 1715
Admissions, shall be used to compensate Supreme Court employees 1716
who are primarily responsible for administering the attorney 1717
admissions program under the Rules for the Government of the Bar 1718
of Ohio, and to fund any other activities considered appropriate 1719
by the court. Moneys shall be deposited into the Supreme Court 1720
Admissions Fund (Fund 6A80) under the Supreme Court Rules for the 1721
Government of the Bar of Ohio. If it is determined by the 1722
Administrative Director of the Supreme Court that additional 1723
appropriations are necessary, the amounts are hereby appropriated.1724

       No money in Fund 6A80 shall be transferred to any other fund 1725
by the Director of Budget and Management or the Controlling Board. 1726
Interest earned on money in Fund 6A80 shall be credited to the 1727
fund.1728

       Section 4.  That existing Section 307.10 of Am. Sub. H.B. 59 1729
of the 130th General Assembly is hereby repealed.1730

       Section 5.  This act is an emergency measure necessary for 1731
the immediate preservation of the public peace, health, and 1732
safety. The reason for such necessity is to adjust the salaries of 1733
elected county officials and township trustees and fiscal officers 1734
elected for terms beginning 2015 and thereafter and the salaries 1735
of General Assembly members and statewide elected executive 1736
officers for terms beginning 2017 and thereafter. Therefore, this 1737
act goes into immediate effect.1738
